was nominated as a Director for the First NBCBank Mr Carrouche is compensated as a director for the bank3On or about May 19 2006 the Pension fund purchased stock in First NBC Bank ThePension fund also established a loan and line of credit with First NBC Bank through LakewoodRestoration Partners LTD for Lakewood Golf and Lakewood Development entities owned byBoardCurrently First NBC leases space for a bank branch at LakewoodDevelopment through Lakewood Restoration Partners LTDthe Pension4At meetings on July 16 2010 September 15 2010 and December 12 2012 WilliamCarrouche as a member of the Pension Board abstained from votes pertaining to First NBCBank However the meeting minutes do not explain why he abstained and he did not file adisclosure report with the Board of Ethics5On July 7 2010 December 17 2010 and January 12 2011 votes regarding business withFirst NBC Bankweretaken by the Pension Board William Carrouchewaspresentatthemeeting There is no indication in the meeting minutes that William Carrouchc rccused himselffrom participation in the meeting There were no disclosure reports filed with the Board of Ethics6On June 30 2010 William Carrouchc signed a purchase questionnaire on behalf of thePension Fund relative to its purchase of 260869 shares of First NBC Bank There was nodisclosure filed with the Board of Ethics7La RS 42d of the Code prohibits a public servant from providing compensated2111Cservices to a person that has or is seeking a contractual or other business or financial relationshipwith his agency8La RS 391 provides an exception to R1233S 421111C 2 d and allows a member orchief executive officer of a local depositing authority to be a compensated or uncompensatedofficer director or employee of a bank provided he rccuses himself from voting in favor of thebank and discloses those transactions to the Board of Ethics within fifteen 15 days of the recusal9William Carrouche as a member of the Pension Board violated La RS 421111C 2dby being employed with First NBC Bulk at a time when First NBC Bank had a businessrelationship with the Pension Board and where William Carrouchc failed to file the requireddisclosure reports with the Board of EthicsLa RS 421153 provides with respect to penaltiesBUpon finding that any public employee or other person has violated anyprovision of any law within the jurisdiction of the board the board by a majority vote of the1LSARS 391211 defines local depositing authority as all parishes municipalities boards commissions sheriffsand tax collectors judges clerks of court and any other public bodies or officers of any parish municipality ortownshipmembership may remove suspend or order a reduction in pay or demotion of the publicemployee or other person or impose a fine of not more than ten thousand dollars or bothLa RS 421155 provides with respect to penaltiesAIf an investigation pursuant to RS 421141 reveals that any public servantor other person has violated any law within the jurisdiction of the board to his economic advantagethe board may order the payment of penalties Recovery may include in addition to an amountequal to such economic advantage penalties not to exceed
