Union Paci?c built the fences to deter unauthorized anddangerous trespassing. The city and the Coastal Commission both responded byinsisting that the railroad could not keep the fences in place without having aCoastal Development Permit (CDP). Union Paci?c responded by claiming that apermit is not required. Among other reasons, the California Public UtilitiesCommission (CPUC) has the sole jurisdiction over where and under whatcircumstances the public may cross railroad tracks. It has not exercised itsjurisdiction to authorize public crossings at any of these locations. This meansthat the city cannot place conditions on whether Union Pacific can deny publicaccess to the right of way because the city does not have legal authority to allowpublic access. The city disagreed with Union Paci?c?s analysis and issued citations. Later,the Coastal Commission also issued citations. The city?s citations began accruing?nes. Union Paci?c made multiple efforts to schedule a meeting of all parties totry ?nding a path forward, but the city refused to meet unless the railroad first?led an application for a CDP. After the Coastal Commission became directlyinvolved, representatives from Union Paci?c, the city, the CPUC, and the CoastalCommission ?nally were able to sit down together on December 9, 2013.Although we did not identify a clear resolution, the meeting provided a valuabledialogue and confirmed immediate options.'yANc?grc BUILDING Scott Kolwitz, Principal PlannerCity of VenturaMarch 18, 2014Page 2At the December 9th meeting, city staff offered to stop accrual of further?nes if Union Paci?c would ?le an application for a CDP. Staff noted that thepermit process would provide a forum for public input, which would be animportant element in any negotiated outcome. Shortly thereafter, Union Paci?cagreed to ?le an application for a permit with an express reservation of all legalrights.On February 6, 2014, Wayne Whitlock and I met with you and Dave Wardfor an initial review of the railroad?s application materials. We met with you againby conference call on February 26th to review the application. The railroad?s localManager of Track Maintenance, Javier Sanchez, attended in person in your office.Our application became of?cially submitted when our check for the application feearrived at the city on March 3th. During our meetings in February, we clearedApril 10th as a tentative date for the ?rst public workshop about the application.Over the course of all of these events, the fences have been vandalized,leaving holes in some places. In addition, at Hurst Street, trespassers have beencircumventing the fence by crossing neighboring residential property and climbingover shorter adjacent fences to get onto the right of way. Wayne and I describedthese problems during our February meetings and told you and Mr. Ward that therailroad intended to repair the vandalism and extend the fence at Hurst. You toldus that any changes in the features of the fence would need to be depicted inupdated drawings in support of the application.On March 13, 2014, I sent you and Mr. Ward an email to notify you that therailroad planned to perform the fence repairs and extension the following week.As stated in my email, I was sending the note as a courtesy so that the city wouldbe aware of the work in advance in case it received any inquiries. You respondedwith a request for a conference call.Wayne and I spoke with you and other city staff on March 14th. Staffinformed us that it would not allow us to perform repairs or lengthen the fence.Staff asserted that the fences are unauthorized, so repairs are also unauthorized,and extending the fences would be a new unauthorized project. Taking either stepwould subject the railroad to new citations and new ?nes. Staff said that oncenew citations were issued, there will be no way for the railroad to stop ?nes fromaccruing until it either removes the fences or complies with the conditions for apermit at the end of the application process. How long the permit process maytake is uncertain, but it could exceed a year. Staff also noted that the CoastalCommission could issue ?nes under its separate authority. The city?s ?nes for theprior citations exceeded $20,000.Scott Kolvvitz, Principal PlannerCity of VenturaMarch 18, 2014Page 3Wayne and I described the safety and liability risks this situation presentsfor the railroad. If there was any doubt about the trespassing problem before, thevandalism has confirmed it. Union Paci?c has taken steps to discourage thatillegal and unsafe behavior and very reasonably wishes to increase theeffectiveness of the fences. Doing so would not be a departure from our currentpath Union Pacific remains committed to the permit process and engagementwith all interested parties. Doing so should also not come as a surprise. Wayneand I have been very open about the company?s intentions in prior conversations.The city?s threat of additional enforcement under these circumstances shows aclear and remarkable preference for process over public safety. The city isessentially condoning both trespassing and vandalism of private property. In theprocess, it is effectively allowing the public to cross the tracks wherever the publicwishes without permission from the CPUC and without any safety measuressuch as improved walking surfaces, warning lights, gates, or signs in place.The path that the city should take and which I hope it still takes is toexercise its discretion to forebear enforcement for the sake of safety. The partiesdisagree about the law on point. Union Pacific has reserved its legal arguments tosee if a solution can be found through the permit process. The city and CoastalCommission should likewise reserve their legal arguments for the future to avoidescalating the dispute and exposing local residents to danger.In the meantime, under threat of enforcement, Union Paci?c has cancelledthe work it had scheduled. The railroad continues to reserve its right and itsability to proceed with its work at any time, despite citations, without furthercommunication with the city. For now, though, this letter will con?rm that theonly reason that members of the public are able to illegally enter the railroad rightof way at these locations is that the city has placed Union Pacific under duress notto take steps to prevent it.I look forward to your response and continuing with next steps in the permitapplication process.Very truly yours,DAVID M.
