SHORT TITLE. 5 This title may he cited as the "Second Amendment 6 Enforeement Art of 2014". 7 SEC. 302. CONGRESSIONAL FINDINGS. 8 finds the following: 9 The Second Amendment to the llnited 10 States (?onstitntion provides that the right of the ll people to keep and bear arms shall not be infringed. 2 (2) As the (?ongress and the Supreme (?ourt of the llnited States have reeognized, the Seeond Amendment to the llnited States (?onstitution pro- tweets the rights of individuals, ineluding those who are not members of a militia or engaged in military serxiee or training, to keep and bear arms. (3) The law?abiding eitizens of the District of (lolumbia are deprived by loeal laws of handguns, ri? fles, and shotguns that are eommonlv kept by law? abiding persons throughout the llnited States for sporting use and for lawful defense of their persons, homes, businesses, and families. The Distriet. of (lolumbia has the highest per ('apita murder rate in the Nation, whieh may be. attributed in part to local laws prohibiting posses? sion of firearms by law?abiding persons who would othenvise be able to defend themselves and their loved ones in their own homes and businesses. (5) The Federal Gun (?ontrol Aet of 1968, as amended b_v the Firearms ()wners? Proteetion Aet of 1986. and the '31?adv Handgun Violenee. Prevention Aet of 1991}, provide eomprehensive Federal regula- tions applieable in the Distriet of (?olumbia as else? where. In addition, existing Distriet of (?olumbia eriminal laws punish possession and illegal use of ALI-H4326 firearms by violent criminals and felons. 2 sequently, there is no need for local laws which only 3 affect and disarm law?abiding citizens. 4 (ti) Officials of the District of Columbia have 5 indicated their intention to continue to unduly re? 6 strict lawful firearm possession and use by citizens 7 of the District. 8 (7) Legislation is required to correct the Dis? 9 trict of (?olumbia?s law in order to restore the funda- 10 mental rights of its citizens under the Second 11 Amendment to the llnited States (?onstitution and 12 thereby enhance public safety. 13 SEC. 303. REFORM D.C. AUTHORITY TO RE- 14 STRICT FIREARMS. 15 Section 4 of the Act entitled ?An Act to prohibit the 16 killing of wild birds and wild animals in the District of 17 Columbia". approved June 30, 1906 (13?1 Stat. 809; sec. 18 ()fficial (?ode) is amended by adding at 19 the end the following: ?Nothing in this section or any 20 other provision of law shall authorize, or shall be con? 21 strued to permit. the Council, the Mayor, or any govern- 22 mental or regulatory authority of the District of (?olumbia 23 to prohibit. constructively prohibit. or unduly burden the 24 ability of persons not prohibited from possessing firearms 25 under Federal law from acquiring, possessing in their 1 4336 ,4 homes or businesses, or using for sporting, self?proteetioii or other lawful purposes, any firearm neither prohibited by Federal law nor subjeet to the National Firearms Aet. rl?he Distriet of Columbia shall not. have authority to enaet laws or regulations that diseourage or eliminate the pri- vate ownership or use of firearms. Nothing in the pi'eyious two sentenees shall be eonstrued to prohibit the Distriet of (?olumbia from regulating or prohibiting the earrying of firearms by a person, either eoneealed or openly, other than at the person?s dwelling plaee, plaee of business, or on other land possessed by the person?. SEC. 304. REPEAL D.C. SEMIAUTOMATIC BAN. IN 101(10) of the Firearms (.?ontrol Regulations Aet of 1975 (see. ()ffieial Code) is amended to read as follows: ?Maehine gun' means any firearm whieh shoots, is designed to shoot, or may be readily re? stored to shoot aut<)matieally, more than 1 shot without. manual reloading by a single funetion of the. trigger, and ineludes the frame or of any sueh weapon, any part designed and intended solely and exclusively, or eombination of parts designed and intended, for use in eonyerting a weapon into a maehine gun, and any eombination of parts from whieh a maehine gun ean be. assembled if sueh parts OGOOQONM-DUJNH TING PENALTIES. are in the possession or under the control of a per? song?.
