INTENDED SCOPE OF ACTIVITIES Fueling and Lubricating Full-service delivery of aviation fuels (both Jet Fuel and Avgas) will be provided by Landmark?s professionally?trained and certified Line Service Technicians (LSTs), utilizing Safety First program. LSTs will provide clear and bright aviation fuels, which have passed strict quality control checks and inspections, to customer aircraft. Landmark ensures the delivery of contaminant-free Jet Fuel and Avgas by conducting and documenting all required checks and inspections in full compliance with applicable regulatory measures, consistent with Landmark?s proprietary quality control measures and in accordance with the strictest Airline Transport Association 103, National Fire Protection Association 407, American Society for Testing and Materials D1655 and American Petroleum Institute 1540 standards. Landmark?s quality control measures include daily, quarterly, semi~annual and annual inspections of the fuel storage facility, refueling vehicles and the handling procedures used for receiving and unloading fuel. Audits are regularly conducted throughout the Landmark network by highly trained personnel who review the quality control procedures and documentation. This process ensures the highest fuel quality standards are being met, and as such, all aviation fuels are guaranteed to be on-specification. Aircraft Line Services Ground Traffic Direction and Control, Parking. and Tiedown LSTs will provide ground traffic direction and control, parking, and tiedown services for all arriving and departing aircraft. As such, LSTs are tasked with monitoring all aircraft, vehicle and equipment movements on the ramp to ensure safety and security at all times. Loading, Unloading, and Towing As the crew and passengers disembark, the LST will enthusiastically greet them and welcome them to the Airport and the Aspen area. INTENDED SCOPE OF ACTIVITIES . A i A At the appropriate time, the LST will provide assistance with baggage, ground transportation, guidance to the Aspen FBO terminal buiiding, or any other services that may be required. As passengers arrive for boarding, an LST will assist the crew with loading baggage aboard the aircraft. All aircraft towing will be accomplished by professionally-trained and certified LSTs with extensive aircraft towing experience. Any tug operator performing a towing operation will perform a complete aircraft walk-around inspection prior to any aircraft being moved. Additionally, every LST will receive specific training on aircraft towing procedures, aircraft clearance tolerances, guidance techniques and proper signaling prior to being assigned safety monitor duties. Ground/Auxiliary Power Unit (GPUs) Landmark will maintain GPUs to provide DC and AC power. GPUs will be available for engine starts when crews do not want to utilize the aircraft?s battery system. In addition, GPUs will be available for longer durations upon request. Oxygen, Pre-heat and De-icing Landmark will provide oxygen along with pre-heating and de-icing services for all general aviation aircraft frequenting the airport and utilizing the Landmark Aspen FBO. Hangar Space Rental Landmark will provide aircraft storage (including a heated hangar) for all general aviation aircraft frequenting the Airport and utilizing the Landmark Aspen FBO. Battery and Electrical Service Landmark will provide battery and electrical service for all general aviation aircraft frequenting the Airport and utilizing the Landmark Aspen FBO. Tire and Landing Gear Inflation and Service Landmark will provide tire inflation services (compressed air and nitrogen) and landing gear inflation services (utilizing nitrogen) to all general aviation aircraft frequenting the Airport and utilizing the Landmark Aspen FBO 515$, Application Full-Service Fixed Base Operator (FBO) Page 5 -. INTENDED SCOPE OF ACTIVITIES Aircraft Cleaning, Interior, and Exterior Washing and Detailing Upon request, Landmark will provide professional?quality aircraft washing, waxing and detailing services. These services will be available and priced according to the condition of the aircraft, the extent of the service desired and the timeframe required for completion of the work. During high profile events and upon request, Landmark will utilize internationally known aircraft detailing companies to support Landmark personnel with aircraft washing and detailing. Aircraft Waste Disposal Aircraft lavatory servicing will be accomplished through the use of lavatory service vehicles and carts. All LSTs will be trained in proper sanitation practices for the servicing of aircraft lavatories. Disposal of lavatory waste will occur in accordance with Airport policies and in a location designated specifically by the Airport. Potable Water Servicing Potable water will be available for all aircraft utilizing a dedicated potable water supply. Landmark will ensure the potable water provided to aircraft is filtered, clean and safe for crew and passenger consumption. Aircraft Maintenance Landmark provides airframe and powerplant maintenance and repair at 11 MRO facilities. The company provides factory authorized services for many of- the most popular aircraft in use today including Hawker Beechcraft, Lear, Cessna and Piaggio. Additionally, nine MRO facilities are FAA Part 145 Certified Repair Stations and have airframe-specific capabilities to serve the needs of aircraft owners/operators in the respective geographic region. Landmark consistently services a wide range of aircraft from single-engine reciprocating aircraft to turbine aircraft. Landmark has the full of maintaining appropriate levels of aircraft parts and accessories, providing minor aircraft airframe and engine maintenance services, preventive maintenance, re- building and alterations and incidental parts and accessories. INTENDED SCOPE OF ACTIVITIES General Aviation Customer Services Landmark CSRs make ground transportation (Landmark courtesy van, hotel shuttle, rental car, limousine and courtesy Landmark crew car), hotel, catering, dining and entertainment reservations and other arrangements for crews and passengers. Food/beverage vending; baggage porter services and incidental sale of flight?related accessories will also be provided. Flight Services Landmark is particularly excited at the prospect of creating a thriving aircraft charter and management operation at the Landmark Aspen FBO. Landmark is an FAA Part 135 certified charter operator with a fleet of over 60 charter and managed aircraft. As such, Landmark has a wide variety of aircraft and resources available. Centrally dispatched from the company?s Winston-Salem, North Carolina location, Landmark?s charter divisions hold ARGUS's highest ratings. As Landmark is able to identify, develop and secure aircraft charter and management opportunities in the Aspen area, Landmark will base aircraft and crews at the Airport. These activities will generate additional revenue for the Airport through increased fuel flowage fees and increase the number of Landmark employees at the Airport. In conjunction with a local teaming partner, flight and ground school training (FAA Part 61) along with aircraft rental will be offered as well. Service to Local Aviation Community Landmark'is pleased to support the'local aviation community (including mountain/air rescue, Civil Air Patrol (CAP) and local aeronautical clubs such as Experimental Aircraft Association and the Ninety-Nines) through the provision of high-quality aviation products, services, and facilities. INTENDED SCOPE OF ACTIVITIES Landmark?s development team understands the costs associated with constructing the FBO facility, has arranged and received committed financing and has retained a local team of companies and individuals capable of executing on the company?s vision. The following operational components of the proposed FBO facility reflect Landmark?s experience operating FBOs in resort destination markets and best practices learned from working with dozens of airports on major multi-million dollar investment projects to construct, remodel and overhaul FBO terminals, ramps and hangars across the company?s FBO network. When designing the new Landmark Aspen FBO facility, Landmark will focus on capturing the character of the Aspen area and the Airport while incorporating unique elements that will resonate with customers. The proposed FBO facility will combine aesthetic appeal with a highly efficient design to maximize both the attractiveness and productiveness of available space. Since the proposed FBO facility will be adjacent to the Airport?s ARFF facility, the?FBO facility will be designed in a way that complements the existing structures and landscaping, and will be relatively unobtrusive when viewed from Old Creek Road. The FBO facility will be sited in a way to minimize its impact on the land andviews from adjacent properties and roads. Leased Premises Consistent with the Airport's Master Plan, Landmark intends on developing the 18 acres designated for the Airport?s second FBO on the West side of the Airport. All improvements on the leased premises will be in compliance with all setback and height restrictions applicable to the Airport including the Building Restriction Line (500 feet from the centerline of the runway), the Object Free Area (400 feet from the edge of the runway), and the Airport height limitation of 35 feet. INTENDED SCOPE OF ACTIVITIES Landmark Aspen FBO Facilities General Aviation Terminal Landmark?s General Aviation Terminal (Terminal) will introduce Aspen?s local culture while adhering to the common ?Landmark feel?. The new 9,943 square feet facility will contain numerous luxurious amenities that will serve the needs of crews and passengers that travel to Aspen. These features include passenger waiting areas, restrooms, customer service and concierge counters, car rental counter, line service and administrative offices, crew lounge, flight planning room, catering facilities, tenant offices and an executive conference room. The Terminal will feature a covered passenger pick?upldrop-off area and will have approximately 96 vehicle parking spaces. The Terminal will seek to incorporate principles of ?green design? by using recycled and re?clairned natural materials, non-toxic paints and finishes, and solar hot water heating systems. Aircraft Hangars Landmark will develop two separate hangar facilities. The 20,000 square foot hangar immediately adjacent to the Terminal will be the aircraft maintenance hangar and will accommodate storage of based and transient aircraft. The 40,000 square foot hangar adjacent to the main ramp will be utilized for the storage of based and transient aircraft. Ground Support Equipment Shop Landmark will develop a 6,000 square foot ground support equipment shop in order to maintain Landmark?s ground support equipment, vehicles, and refueling vehicles to the highest industry standards. Ramp The 9.0 acre ramp is designed to accommodate the parking and staging requirements of all corporate and general aviation aircraft utilizing the Airport, including Tie Downs for light piston aircraft. Additionally, dedicated space for [ong~term aircraft storage has been included to minimize the need to move parked aircraft to accommodate operations into and out ofthe hangars. INTENDED SCOPE OF ACTIVITIES Financing Landmark has three methods of financing that the company uses to pursue FBO development. First, the company will reinvest cash flows generated from its operations. Second, the company has access to a revolving credit facility. Third, the company?s equity ownership group, led by The Carlyle Group, has provided an equity commitment to fund growth investments such as the one contemplated here. Consistent with past development projects, Landmark will fund the development of the company?s world- class FBO facilities at the Airport with a combination of cash flow from operations and either a draw on its revolving credit facility or equity capital from its owners. Such a decision will be transparent to the County. In either instance, the company will have available committed capital to fund all FBO development and operating costs. Since the development of the Landmark Aspen FBO facility and commencement of activities are approximately two to three years out, an estimate of the number and type of aircraft that will be based at the new FBO facility would not be accurate. However, Landmark has provided in subsection 5 of this section a detailed description of the facilities that Landmark intends to develop. It is anticipated that many different types of aircraft (both based and transient) will continue to frequent ASE and that Landmark's customer base will consist of all types of recreational, business, and corporate aircraft. Special attention will be given to assuring that all based aircraft customers meet or exceed local area guidelines for noise abatement operations. It is the intent of Landmark to be a good steward of the environment, a model tenant on the Airport and respectful of the wishes of the surrounding communities. The equipment that Landmark will deploy at the Landmark Aspen FBO facility is identified on the following page. INTENDED SCOPE OF ACTIVITIES Employment One of Landmark?s competitive through which customers, airport sponsors and communities benefit is the company?s ability to maximize job creation through: an increased focus on customer service and (ii) the ability to provide a full suite of aviation services FBO, MRO and aircraft charter and management). In each of the company?s recent BO wins (ATL, TPA and MIA), Landmark increased employment for FBO services alone by 15% to 25%. Landmark estimates that the Landmark Aspen FBO will employ approximately 36 local area individuals. Since the commencement date is approximately two to three years out, Landmark is unable to provide names and qualifications of each person. Employment Policies Landmark differentiates itself from many of its industry peers by employing a significant majority of line service and customer service personnel on a full?time, rather than part? time, basis. For example, when Landmark transitioned the MIA and TPA FBO operations it hired most of the predecessor local employees and reclassified over 90% of them from part-time to full?time status. From an employee?s perspective, full- time employment provides job security, better compensation and access to employee benefits. For the Aspen area, this means stable employment and higher levels of economic activity. n? ?a Recognizing that the airport opens for departures at 0700 and closes at 2230 for departures and 2300 for arrivals, Landmark Aspen FBO will maintain operating hours from 0600 to 2400, 7 days per week with staffing concentrated in the peak activity periods of aircraft operations. INTENDED SCOPE OF ACTIVITIES Local Pitkin County Code is the dominant local legislation that will govern the development and operation of the proposed Landmark Aspen FBO. Landmark has invested more capital into FBO acquisition and development over the last five years than any industry participant (well over $200 million). In fact, since Landmark opened the facility in March 2009, it has received a 100% satisfaction rating from airnavcom users. Landmark is not aware of another FBO facility in the world that has the same flawless feedback with a similar volume of reviews (44). The FBO development project was financed under a construction loan with Amegy Bank of Texas. San Antonio International Airport Following the FBO development project at Asheville Regional Airport, Landmark made investments in the company?s FBO at San Antonio International Airport. This investment took place in the midst of a long and distinguished operating history at the airport. In 2008, Landmark pursued an opportunity to lease additional space to develop a solution for an underserved customer base. Specifically, the existing FBO facilities at the airport (including those of the three FBO competitors) lacked the proper security and ramp to accommodate VIP and special charter aircraft and passengers. To address this issue, Landmark undertook a major upgrade to the ramp and constructed additional FBO facilities to meet the operating requirements for the unique aircraft and passengers to be served. Today, this facility handles virtually 100% of all VIP and special charter traffic at the airport and has eliminated a previously common critique of the airport?s FBO capabilities. The new Landmark SAN FBO facility will consist of a ?flagship? terminal, a hangar complex consisting of five hangars with associated office and shop space and over 250,000 square feet of apron area. Capitalizing on southern California?s abundant sunshine, an open two-story atrium will provide customers with a constant connection to natural daylight and the outside environment. The Landmark terminal floor plan is designed for practical functionality. As such, the design provides separate passenger and crew nodes for quiet relaxation, TV viewing and Wi?Fi access. Customers have easy access to spacious restrooms featuring spa amenities and a dedicated service counter for fulfilling ground transportation requests. The crew areas, which are strategically located, include quiet rooms with attached restrooms and showers and a flight planning/weather briefing room. This effort resulted in identification of specific programming needs for each flight department including the configuration, dimensions and square footage of the hangars, office and shop space; lighting and power requirements for the hangars; and width and height of the hangar doors. As such, Landmark is committed to working closely with the County and the planning, and engineering consultants that have been engaged by the County to achieve this objective. Further, Landmark?s FBO development team is intimately familiar with the federal, state and local requirements that affect FBO design, construction and operation. Federal requirements include the Airport Sponsor Assurances, Advisory Circulars, 14 CFR (including, but not limited to, Part 77 and 139), and the requirements set forth by the Environmental Protection Agency, Occupational Health and Safety Administration, Department of Agriculture, Bureau of Mines and the Army Corps of Engineers. As evidenced by past FBO development projects and future projects currently in the planning stages, Landmark is committed to: (1) working closely with each federal, state and local government agency to ensure full compliance with all applicable regulatory measures, (2) using imaginative and innovative design and construction approaches and techniques to maintain variety and interest, (3) adhering to high standards for design (architectural and engineering) and construction of the new FBO facility and (4) investing in environmentally friendly enhancements designed to improve energy efficiency and reduce the environmental footprint. In addition, Landmark understands an amenable relationship between the Airport, the development project and the community needs to be maintained. Environmental Concerns The Airport is located in an attainment area for all air pollution standards per US. Environmental Protection Agency classification. Attainment areas are those regions where air pollution levels have not exceeded the National Ambient Air Quality Standards (NAAQS). The Colorado Department of Public Health and Environment, Water Quality Control Division has stated for the Airport?s Master Plan that a construction dewatering permit is required if dewatering is to occur. COMPLIANCE required for construction activity and should be applied for at least 10 days prior to breaking ground. Updating the Storm Water Management Plan (SWMP) is required when changes to the facility occur that affect storm water quality. The Colorado Division of Wildlife (CDOW) also indicated for the Airport?s Master Plan that the west side of the Airport is in close proximity to, and adjacent to, important big game winter range. Placements of aviation facilities within existing fields and improvement to existing 8? tall wildlife fences at the north end of the Airport were recommended. CDOW also stated that no impacts to any threatened or endangered species are likely to occur since future developments will occur within the existing airport property line and fenced area (such as the proposed F80). The Pitkin County Land Use Code provides for consideration of neighborhood impacts relative to expansions or improvements that would promote aviation operations. Section 7-90, Areas Around Defined Key Facilities, includes criteria for analyzing the compatibility of proposed projects in the vicinity of the Airport. These criteria can be applied to evaluate the compatibility of potential improvements at the Airport with the existing uses in the surrounding area, as follows: Sensitivity to aircraft Wise Whether the use results in more people being exposed to danger, should there be an aircraft accident on approach or takeoff Potential for generating electricai interference with navigational signals or radio communication Potential for creating ground lighting, making it difficult for pilots to distinguish the airport. runway lighting Potential for creating glare in the eyes of pilots Potentiai for otherwise impairing visibility in the vicinity of the airport Potentiai for creating a hazard or endangering aircraft landing or takeoff operations Avigation Easements Section 7?90 requires that Avigation Easements are granted and recorded in areas within DNL Contour Fifty-five (55) prior to construction of any new or expanded land use. The easements must ?grant the right to flight over the land, together with the right to cause noise, vibrations, smoke, fumes, flare, dust, fuel particles, and all other effects of aircraft operations.? - Application Full-Service Fixed Base Operator (FBO) Page 40 . A I A I .0 Among others, the Burlingame Seasonal Housing site and the Maroon Creek Club represent two nearby properties that have granted Avigation Easements. These easements address impacts generated at the airport including noise, fumes, and vibrations that may be created by any aircraft using the airport facility, including any future aircraft that may subsequently be permitted to be used on the airport. Per Ordinance No. 99-43, the Pitkin County Board of County Commissioners (8000) approved the Avigation Easement for Burlingame Seasonal Housing site in August 1999. The Avigation Easement Agreement includes a provision that precludes the City of Aspen and the Music Associates of Aspen, Inc. from opposing any future improvements or expansion at the airport based on the adverse effect wherefrom on the development and operation of the Burlingame Seasonal Housing Project. The Avigation Easement for the Maroon Creek Club property was executed in 1993. It includes a provision that precludes the Pearce Equities Group ll, LLC, the entity that owned and developed the Maroon Creek Club project, from bringing any suit against the County related to any matters covered by the Avigation Easement including noise, fumes, vibrations, discomfort, inconvenience, etc. Airport Operations Landmark works extensively with airport operators and proprietors at each of its 51 FBO locations to ensure that the company and its customers operate in compliance with airport rules and regulations. Landmark's FBO location managers are all active participants on relevant airport committees and the company?s senior management participates in national compliance and regulation forums. Through these forums, the company is often able to preemptiver identify and implement operational procedures before they are required by airport operators and proprietors. While numerous examples of compliance exist across the company?s FBO network, several examples of Landmark?s success working with other airports are included below. Airport Emergency Plans Landmark has Memorandum of Agreements with Airport Authorities whereby the Company's leased premises can be used in response to emergency situations to ensure the welfare of all air carrier and general aviation customers. COMPLIANCE Disaster Exercise Events in addition to preparing Landmark emergency plans and procedures and having cooperative agreements with each airport operator and proprietor to assist with airport specific emergency plans and procedures, Landmark regularly participates in table top and live airport emergency drills and disaster exercises to enhance the effectiveness of I the cooperation and the operational readiness of the airport. Some examples of Landmark?s contributions include training emergency responders on entry (breach) procedures for general aviation aircraft in order to avoid fire or explosion related to penetration of oxygen, hydraulic or fuel lines. Disabled Aircraft Recovery Landmark has a comprehensive disabled aircraft recovery plan in place at San Diego International Airport. As an example, on October 19, 2010, Landmark assisted with the recovery of a Federal Express Cessna Caravan from the Airport's runway. George Condon, the Authority?s Director of Aviation Operations and Public Safety, noted that Landmark's actions in this instance ?significantly aided in the prompt reopening of the runway, thereby reducing the overall operational impact to the FAA as well as to the passenger and cargo carriers serving San Diego International Airport." Noise Abatement Landmark?s ASE FBO customer service representatives will be trained to educate all corporate and general aviation pilots on the Airport?s Fly Green/Fly Clean program and the company will feature signs prominently displayed around the terminal educating pilots on the program. Fueling Standards Fueling standards for the aviation industry are enacted, recommended or required by a multitude of governmental agencies, associations, aircraft operators (customers) and airports. Landmark utilizes the National Air Transportation Association?s Safety 1? Professional Line Service Training program and Airline Transportation Association?s Specification 103 as the foundation for maintaining compliance. In addition, each Landmark FBO location and associated equipment and trainingiinspection records are regularly reviewed by the airport operator or proprietor, fuel supplier, insurance company and numerous customers to ensure compliance.
