FACTS CONSTITUTING REASONABLE CAUSE: On Monday, February 27, 2012, at approximately 8:39 the Monticello Police Department received. a 911 call from Victoria Pedraza. She said that her two-year old girl was not breathing and she needed an ambulance. Two ambulance crews responded to the Pedraza home and found the two-year old child lying in a bed. She did not have a pulse, she was not breathing, and her eyes were ?xed dilated. They transported the child to the Emergency Room, where she was pronounced dead. Doctors and nurses examined the body and saw numerous bruises on the chest, abdomen, arm, leg, and face of the child. They suspected abuse, so they called law enforcement. The mother of "the child is Victoria Pedraza. The step?father of the child is Daniel Pedraza. They are married and live together in a trailer home in Drew County. There are no other adults or children living in the household. Both parents claim that the child fell from a dock and landed on some large rocks the previous day, Sunday, February 26, 2012. They both stated that the child must have sustained some injuries at that point, because nothing else has happened to her and she has appeared fine. They both stated that they were the sole caretakers of the child during this time. The parents claimed that the fall occurred on Sunday, February 26. 2012 at about 7:30~8:00 21.111. They picked "the child up, checked her over, and saw no bruises, scrapes, or cats. They said there was a small cut on the child?s lip, and a small amount of blood came out. But, she wiped it away and it stopped. They claimed that the child laughed, said she was okay, and that the child ran down the dock and continued to the next 4 hours. They claimed that the child appeared normal and did not complain of any injuries. The parents said they went home, and at around 5:00 or 6:00 pm. that evening, the child began to vomit. She was ill all evening, and continued to vomit. The parents said the child went to sleep, and they observed her until 4:00 a.n1. The parents woke up the next morning, February 27, 2012, at about 8:00 a.m. and claim the child was having trouble breathing and that her eyes were rolling back in her head. At one point, she stopped breathing. so they started CPR and called 911. Both parents were interviewed separately, and they gave similar stories, but there were also several signi?cant inconsistencies. Both parents are in the National Guard and they told me about how they diScipline their is only two years old. They claimed that she is rambunctious, and they make her stand at attention when she speaks to them. They also make her do push?ups and squat with her back against a wall as punishment. Victoria admitted to holding the child down several times in the past in an attempt to calm her down. Daniel admitted to spanking the child several days ago with a belt. He said the marks are probably still on the girl's lower back. Upon examination of the body, I saw three small marks on the child?s lower back, consistent with Daniel's story. I obtained consent to search the home from both parents on February 27, 2012. I found a long piece of cord hanging from the master bedroom closet rod that did not appear to have any legitimate use. The cord was hanging over a closet rod and ran out into the bedroom floor. There was also a pillow on the floor of the closet. There were no clothes hanging in that though it was the only closet in the bedroom. During interviews, Victoria and Daniel gave different accounts of when the cord was placed on the rod and the purpose of the cord. During the search of the home, Daniel 8.: Victoria told of?cers that they tried to heal the child naturally. They recited prayers, sprinkled her with holy water, and used an egg and a purple onion to try and heal her. During a later interview, both Daniel ?1 Victoria admitted that they wished they had sought medical attention for the child sooner. However, after she fell from the dock, they were scared to call for help because there were previous allegations of abuse, which were being investigated by They said they are both going to have to live with that regret for the rest of their lives. They both said that relatives have claimed child abuse before. and they were scared to call for help because it would look like they abused her. An autopsy was performed on the child's body1 and I spoke with the medical examiner who performed the autopsy1 Dr. EricMon, on February 28. 2012. I also told him of the parent's account on how the child sustained the iniuries. Dr. Erickson told me that the parents' story was not consistent with the iniuries he saw on the child. He said the child had a cut on her lip that would have bled. He said it wouldn?t have stopped after a few minutes either. He said there were also numerous bruises on the child's and new. He said the small bowel was ripped apart, and it would've been very painful for the child when that inqu occurred. He said any reasonable person would?ve seen that the child needed medical care. Dr. Erickson suspected that a hard punch or similar concentrated blow to the abdomen caused the small bowel to tear apart. He said that after sustaining the iniurv. the child would have been seriouslv ill and it would have been noticeable. Taking into account all the bruises and iniuries, be characterized the child as being chronicallv abused. He listed the death as a homicide with multiple blunt force injuries. The cord was hanging over a closet rod and ran out into the bedroom floor. There was also a pillow on the ?oor of the closet. There were no clothes hanging in that though it was the only closet in the bedroom. During interviews, Victoria and Daniel gave different accounts of when the cord was placed on the rod and the purpose of the cord. During the search of the home, Daniel Victoria told of?cers that they tried to heal the child naturally. They recited prayers, sprinkled her with holy water, and used an egg and a purple onion to try and heal her. During a later interview, both Daniel Victoria admitted that they wished they had sought medical attention for the child sooner. However, after she fell from the dock, they were scared to call for help because there were previous allegations of abuse, which were being investigated by DHS. They said they are both going to have to live with that regret for the rest of their lives. They both said that relatives have claimed child abuse before, and they were scared to call for help because it would look like they abused her. An autopsv was performed on the child?s body. and I spoke with the medical examiner who performed the autopsy. Dr. Erickson. on February 28., 2012. I also told him of the parent's account on how the child sustained the injuries. Dr. Erickson told me that the parents? story? was not consistent with the iniuries he saw on the child. He said the child had a cut on her lip that would have bled. He said it wouldn?t have stepped after a few minutes either. He said there were also numerous bruises on the child's and new. He said the small bowel was ripped apart. and it would?ve been very painful for the child when that injury occurred. He said any reasonable person would?ve seen that the child needed medical care. Dr. Erickson suspected that a hard punch or similar concentrated blow to the abdomen caused the small bowel to tear apart. He said that after sustaining the iniurv. the child would have been seriously ill and it would have been noticeable. Taking into account all the bruises and ininries. he characterized the child as being chronicallv abused. He listed the death as a homicide with multiple blunt force injuries. She needed an ambulance. An ambulance crew with Monticello Ambulance Service responded to the call and arrived on scene within minutes. The EMTs were directed inside the house by DANIEL. They went to a bedroom and found VICTORIA doing CPR on her two year old daughter, AUBRIANA (BRIE) COKE. The EMTs noted that the child did not have a heartbeat, her eyes were dilated, and she was cold to the touch. They continued CPR and carried her to an ambulance. On the way out the door, one of the paramedics, SCOTT CARSON, asked VICTORIA how long the child had not been breathing. He remembered her saying 3040 minutes. They rushed the child to the hospital, where she was pronounced dead. The doctor and nurses examined the body and found numerous suspicious bruises on the child?s stomach, arms, and knees, so they called law enforcement. About an hour into the investigation, I received a call from Drew County Sheriff MARK GOBER. He asked that I assist in the investigation. I went to the hospital and examined the body for myself. I noticed numerous bruises on the front of the child. There were also a few small bruises on the child?slower back. I noticed a large, square, white patch on the child?s upper back. The discoloration was in a de?nite pattern. It was square with four round holes going down both sides. At that point, I didn?t know what to make of the design, but later, I suspected that the design was made by some type of vest or restraint system that was placed on the child prior to and during her death. The white patch indicated that the child was lying on something with that square shape when she died. As her blood settled and pooled to her back, the protruding square object that the child was lying on, didn?t allow the blood to settle there. Therefore, it made the skin appear white and discolored. Several interviews were conducted with both DANIEL and VICTORIA. They both claimed that the child fell. from a wooden dock the day before, while they were at Lake Monticello ?shing. They were walking down the dock, when they looked behind them and saw BRIE lying on some large rocks near the water. She had apparently fallen. VICTORIA picked her up, brushed her off, and checked her over, but did not ?nd any obvious injuries. They played 85 ?shed from the dock for the next 4 hours. BRIE did not appear sick or fact she ran around and played like normal. They went home, ate pizza, and sometime in the evening, BRIE began acting sick, and she threw up. They bathed her and noticed some bruising on her stomach. She continued to act sick weak all night, and she threw up several more times. They both thought about calling for help, but were hesitant to, because of previous DHS child abuse investigations. They claimed that Monday morning, February 27, 2012, they woke up and BRIE was still weak. DANIEL called his mother for advice. DANIEL said prayers over BRIE and blessed her. He also rubbed an egg on her to try and cleanse her 83 heal her. At one point, she stopped breathing and they performed CPR. They ?nally called 9 1 1 at 8:39 am. Both parents admit that they were the only ones watching BRIE in the days leading up to her death. There were no babysitters or anybody else in the home. During interviews, the PEDRAZAS described how they disciplined BRIE. They made her stand at attention when she addressed them. They made her respond to them with a verbal yes or no. As a form of punishment, BRIE was made to stand in a timeout corner for extended periods of time, she was made to do push?ups, and squat with her back against a wall in the position of a chair, with her arms outstretched. Of?cers conducted a consent search of the house on Monday, February 27, 2012, and they collected several items of evidence. Both DANIEL and VICTORIA were present the entire time. A long length of parachute?type cord was found draped over the master bedroom closet rod. There was a 100p on one end of the cord and the other end stretched out into the master bedroom ?oor. Both DANIEL and VICTORIA gave different accounts for the purpose of the cord. An autopsy was performed on body on February 28, 2012. The medical examiner told me that injuries were not consistent with falling off a dock, like the parents .. claimed. He classi?ed BRIE as seriously 82; chronically abused. She said she saw DANIEL punch BRIE in the stomach with his fist, and then BRIE started vomiting and showing signs of injury. We loaded everything up in the truck and put BRIE in Lhere at abuut 7:30 a.m. We Went to the back side of the lake on Old Highway J3. We've been Lhere befnre, and we like it because it has a playground for BRIE to play on. We (VICTORIA and went down on the dock. Every time we've gone Lhere, BRIE Lrics to grab (mm the railing and swing. We "heard a splash" and we tumed around and "saw BRIE in the water." VICTORIA "jumped in there and grabbed her." it Wasn't even far awaymit was when: the rocks were. "We panicked" and asked her if she hurt something, but she was fine. She said no and was laughing, The water was cold and it of took her breath away. We did n't think it was that serious, because she's always told us when someLhing was wrong with her. We watched some TV, and around 8:00 or 9:00 VICTORIA gave BRIE a bath and she started throwing up. While she was giving her a bath, she noticed that her stomach started getting red. I saw her stomach too, and it was just little didn?t look serious. We took her out of the bath and took her to the living was just sitting there. Then, she started throwing up the pizza, and we cleaned it up. We cleaned her up too. It was around 10:00 p.111. We kept monitoring her. We knew the stomach virus was going around, and that?s what we thought it was, so we really didn?t think it was anything. She kept throwing up, just a little bit, and then a little of gagging and stuff. At about 3:00 she stepped throwing up completelysleep. We sat up and watched her for about an hour ?to see if she was breathing right.? She was not having trouble breathing beforehand. ..she was breathing perfectly. But, we still had it on our mind that she fell on her stomach. We went to sleep and then I woke up at 8: 15 am. I know I called my mom around 8:25 am. I went into room and checked on her, then I woke VICTORIA up and we went to check on BRIE. BRIE was barely moving when we woke her up. She seemed weak and everything. We propped her up, and I went to get some water. We asked BRIE if she wanted some water and she said she was barely able to say it. We gave her the water, and we couldn?t tell if she was choking on it. So, we laid her on her side so she could Spit it out. That?s when her eyes started rolling back, and she lost her strength to move her arms. ?We panicked,? and we started doing CPR. VICTORIA called 91 1 and requested an ambulance. We kept doing CPR and ?uids came out of nose and mouth. We thought she was choking on it, so we laid her on her side. ?Because that?s what we were lay a casualty on its so that liquids could come out and keep the respiratory track Open. We did that, and then cleaned up her ?uids, and then started CPR again. She was breathing when she was on her was barely breathing. But, likethree minutes later, the ambulance got there, and she wasn?t really moving. We had been doing CPR for about 5?10 minutes. When I called my mom earlier, I told her that BRIE was weak, and I asked her what to do. I told her it looked like BRIE was having problems stomach too. She told me to put some alcohol on a cloth so that BRIE could smell it and awaken more. We did that, and it worked. She woke up reacted to it. She started breathing that?s when we called the ambulance, because we were so scared ?that she was getting to that point.? When the ambulance crew got there, BRIE was barely moving. I didn?t stay in there to see what was going was too painful to see her in bed not moving. We had been doing CPR in her where she slept. She was my motivation to get better and everything. I keep thinking, what if I had just gone ahead and taken her to the doctor after she fell be better now. Nobody else was with us yesterday when we went ?shing-..just me, VICTORIA, and BRIE. BRIE was wearing a pair of jeans and a t?shirt yesterday. . .I don?t remember what color it was. She didn?t throw up on those threw up on her pajamas. They were pretty big rocks that she fell on yesterday. I didn?t see her fall. I just saw her afterwards. When I looked, she was kind of on her hands and knees, with her hands down too. There was a big rock under her why we asked her if she was hurt or anything, but she just said ?no momma.? She was laughing and she was happy. She didn?t seem to be in any pain. We lifted up her shirt and everything. We looked for cuts, scrapes, and bruising, but there was nothing there. It wasn?t even red. The marks on her stomach started showing up around 10:00 p.rn., when VICTORIA gave her a bath. Little red spots started showing up on her. When we put her diaper on her, she didn?t pee or nothing. And, when she threw up, there wasn?t any blood or anything in it, just food and some greenish liquid. ?We monitored her throughout the night, just in case something really was serious.? When she started throwing up, we thought it was the stomach virus. When BRIE fell from the dock, she must?ve hit her mouth, because she had some cuts in her lips. We didn?t notice the bruising on her knee until this morning. When I went in to see her this morning, her body was going her ?ngernails were turning dark, like they were losing their color. About a week or two weeks ago, BRIE fell down and got a bruise on her right leg. She fell on the back deck patio. She was playing with her balls on the deck, and I guess she fell and hit her leg. After awhile, it got red. We put ice on it and put Neosporin on the out. Last night, at around. 10:00 we noticed that BRIE had some carpet burn marks on her spine. VICTORIA jumped in to get her right after it happened. She fell in a rocky area. Recently, we?ve had problems with family. We were living with them for a little while, and they were trying to run her life for her. grandmother was causing problems for us. BRIE started to act out and disrespect VICTORIA whenever she?d change her diaper, so we made BRIE sleep with us in our bed. After awhile, behavior improved. Around Desember 1'7 or 18, 2011, her grandmother wrote a letter telling me to leave her house, so I did. I moved my things out the next day and went to stay with my parents. VICTORIA stayed behind at the house with her family. A few days later, VICTORIA called me and wanted me to come get her. In January, social services get ahold of us and started an investigation. We think that somebody from side of the family contacted social services, and then my family got involved too. My mother used to be bad towards us, but now she wants to act like mother of the year. She used to think that we weren?t feeding BRIE, but we were. When we got into an argument one day, she told me that if I didn?t like her rules, then we could just leave. I told my mother to shut up and not to treat VICTORIA like that in front of me. My sister was living there at the time too, and I guess she thought I was about to hit my mom, so she called the police. The police showed up, and I talked with them. That all happened in January, 20 1 1, right before DHS got involved. After that, DHS checked on BRIE and she was healthy and didn?t have any bruises or anything. There were times when BRIE would just watch TV and not do anything wrong, but there were other times when she would. get into ?brat mode.? We would put her into timeout as punishment. There were times when BRIE would yell, scream, and tell her mom no, no, no, and that?s when she would get a spanking. It was only two or three spankings, because that?s the law. The last time I spanked BRIE was two or three days ago, because she was yelling. I Spanked her on her bottom, but I?m not sure if I left any-marks. Both VICTORIA and BRIE bruise easily. I don?t know if I bruised her or not. Sometimes we would threaten BRIE with the belt, and she would respond to that. She would stop what she was doing and then she would apologize to her mother. I hit BRIE recently with a belt, because she threw her plate of food on the ?oor. It was a week and a half ago. I used the belt and I tried to spank her on the bottom, because that?s where her diaper is. But, she moved and I missed and hit her lower back near her spine. I saw that I left some marks on her too. After that, I told her she needed to start obeying. She started crying after that and just stood there. Now, we?re in the military, so we have this thing that we do. We make BRIE stand with her hands behind her back when she talks to us. We?ve told BRIE that it?s a sign of respect to stand at attention, with her hands behind her back, when we?re speaking to her. So, it was like automatic for her. Whenever we would call her over to us, she?d put her hands behind her back. It worked up to a point, but family would just give her whatever she wanted. It was just impossible sometimes to break her brat mode, and it gave me and VICTORIA a headache sometimes. BRIE would make us mad, but never to the point that we wanted to beat her more than what the law allowed. I think the law allows two or three hits or swats. When I Spanked her a week and a half ago, I Spanked her with a belt. It?s still at the house. When I bathed her last night, the mark was still there. (I told DANIEL that I wanted to talk with him for a few minutes longer, and I asked him if that was okay. He said that was ?ne. He said whatever I needed was ?ne, and it was okay with him.) That mark that I?m talking about, it was kind of a scar. I put it there with a belt. She also had those carpet burn marks on her spine. As I approached the trailer house, I noticed a wooden deck attached to the front. There were about 3 or 4 steps leading up to the deck and wooden rails on both sides. I entered the home and stepped into the living room. There was a large, ?at screen TV on a wooden stand against one wall, and a couch on either wall. There was also a recliner and a glass coffee table in the living room. There were no clothes, toys, or other debris on the floor. I turned south and walked down a narrow hallway. I passed a bathroom on my left and continued towards bedroom. I stepped into the bedroom and saw a TV on a. The rest of the room was ?lled. with a wooden rocking chair, a wooden chest of drawers, a plastic toy bin, and a small, wooden rocking chair. The small chair had name painted on it. The room appeared neat and well were no toys or clothes strewn about on the ?oor. I examined the ?oor and saw a stain on the carpet, near the bed. VICTORIA told me that was where BRIE had thrown up earlier. She said she cleaned up the vomit with clothing, and she placed the clothes in a plastic sack near the bedroom door. I noticed the sack of clothes on the ?oor, near the bedroom entrance. There was a small, black ?eece jacket laid on the large wooden rocking chair and a pair of child?s tennis shoes were on the ?oor near the closet. I examined the bed and noticed that the brown towel was wet to the touch, and it to rubbing alcohol. There was also a small stain on the gray sheet. I looked at the blue ?eece blanket on the bed, and it looked like it had vomit stains on it. The pillow on the bed did not seem like a normal child?s pillow. It looked like a couch pillow. I turned my attention to the wooden dresser, and I noticed that it was missing the top drawer. VICTORIA told me that it was left in the trailer by the previous tenants, and she kept the piece of furniture because it was useful. I noticed a dark purple stain on top of the dresser, but it did not appear to be closer inspection, it looked like a soft drink spill or candy spill. I looked in the closet and did not see anything signi?cant. It contained miscellaneous clothing items and a plastic storage tote, ?lled with child?s clothing. I left the bedroom and examined the nearest bathroom. I noticed that a small wooden stool was pushed up to the sink counter. I also looked at the trash can and noticed some vomit on the trash bag. There was some tissue paper and a red, plastic up in the trash can. I left the bathroom, walked North down the hallway, and entered a Spare bedroom. The bedroom was empty, except for miscellaneous clothing and other items against the wall. There was a National Guard backpack, bags of clothing, and boxes of stuff lining the walls. There was also a closet ?lled with bags of clothing. I left the room, walked into the living room, and entered the kitchen. There were some dishes in the sink, but everything appeared to be in its place. There was also a wooden table in the kitchen. The utility room was off of the kitchen. There was a door leading to the outside. There was no washer or dryer in the utility room. I stepped into the master bedroom and noticed a large bed against the east wall and a chest of drawers against the west wall. There were two water bottles on the bed. VICTORIA said that one bottle of water was used to give BRIE something to it was just a normal bottle of water. There was also a small wooden near the bed on the south wall. The drawers were all closed on the but I noticed several unusual items prayer candle, a bottle of rubbing alcohol, an empty water bottle, an Ace bandage, an egg, and a box of cotton~tipped swabs, among other things. I noticed some National Guard uniform clothes on the ?oor of the bedroom and some shoes 85 underwear in a corner. There was also a cell phone charger plugged into an outlet, in a corner near the clothes. I also saw a plastic medicine dropper in the middle of the ?oor. VICTORIA said she used the medicine drapper to suck out mucus and stuff from mouth 85 that she could breathe. There was also a stain/ discoloration in the carpet near the medicine drOpper. I looked towards the foot of the bedantibiotic 8r. pain relief cream on the ?oor. It was near the end of a long piece of cord that led into the closet. The closet door was open, so I looked inside. I followed the cord, and it led into the was draped over the closet rod. There was a loop tied in the end of the cord. There did not appear to be any legitimate use for the cord, and it looked suspicious. VICTORIA came into the bedroom at that moment, and I asked her why the cord was there. She told me she used the cord to do exercises. She grabbed the cord and demonstrated how she pulled back 82; forth on it to exercise her arms 82; back. She said the cord had been there for a week or two. I asked VICTORIA if DNA would be on the cord, and she replied ?yes.? She said that BRIE played with the cord from time to like she played 85 handled everything else. VICTORIA left the room, and DANIEL came in there. I asked him about the cord too. He told me that he used the cord to make that the cord had only been there for three days. There were two plastic baskets ?lled with clothes sitting on the ?oor of the closet. There was also a pillow on the ?oor. I found it odd that no clothes were hanging in the closet. I left the closet and examined the bathroom. There were normal toiletry items on the counter and nothing seemed out of place. I looked in the trash can, and I saw several pieces of tissue paper that were colored with a green the bile from the vomit. Conducting the search was: Sergeant SCOTT WOODWARD, Arkansas State Police?CID The search was conducted around the dock at Lake Monticello on what is commonly known as the ?Plantersville Access? side of the lake. This area is described as a large dirt and grassy area on the east side of Lake Monticello. The purpose of this search was to document the area in which DANIEL and VICTORIA PEDRAZA told us two year old AUBRIANA COKE fell from the dock onto the rocks, I found a step up from the ground onto the clock which measured 19 As I began to visually inspect the area, I found the rocks to be in close proximity to the ?oor of the dock. I found the opening between the dock ?oor and the top rail to be 28?. I then measured the distance from the dock ?oor to. the rocks. Those distances are as follows. a On the north side, the distance from the dock ?oor to the rocks ranged from 30? to 38 a On the south side, the distance from the dock ?oor to the rocks ranged from 25? to 40? As I continued inspecting the area, I noticed that the rocks beneath the water line were covered with moss. I carefully observed that none of the moss was disturbed on the rocks. I then rubbed my hand over one of the rocks and saw that the moss was easily disturbed, which lead me to believe that if AUBRIANA had fell from the dock on the rocks in the water, the moss would so indicate that. So, I put the chicken up and ?nished putting lotion on her. Now, she?s a hot, hot, natured we put BRIE to bed around 4:00 am. in her bed. She just lay around. the rest of the evening. When I gave her the bath, I noticed that her stomach was pushing out that girl?s got a gut on I really didn?t notice that I pushed on her stomach because I knew that if she was hurting, she would tell me. I pushed on her stomach all the way down, starting from the bottom of her ribcage. I asked her if that hurt, and she said ?no mommy.? I started seeing the bruises at that point. That?s when I rubbed the frozen chicken on her. I did CPR on BRIE probably from about 8:30 am. until the I was my phone was DANIEL went to get his his phone was he charged my phone enough, and I called 91 1 from my phone. It took about 5 minutes for my phone to charge up. We did CPR the entire time. We didn?t stop it once we started it. Yesterday, when we were at the lake, DANIEL and I had already gotten up onto the dock, and he and I were talking, or whatever. BRIE was behind us, running. She climbed her way up onto me dock. I thought that maybe she tried to catch herself with her knees. I put her clothes in a plastic bag last night, after she got sick the last time. I took her shirt off of her and she kept throwing up, so I just held her shirt out in front of her and let her throw up in it. We don?t have a washer dryer yet, so I bagged them up until I could wash them later today. So, BRIE fell from the dock around 8:00 am. and we went home around noon. She ate some pizza when we got home. She ate the pizza around 1:00 or 1:30 not sure. After that, she went about her business in the house. I could tell she didn?t feel well, but she kept talking to us, and said she wanted to watch a movie. She threw up later, and I just thought it was probably the stomach bug. I just didn?t put two and two together. As far as discipline, we usually do tiri1e~out, but here lately we?ve been doing ?corrective training.? That includes push?ups and doing the chair on a wall (VICTORIA demonstrated the chairwon?the?wall technique. You squat with your back against the wall, as if you?re sitting in a chair.) You just squat against a wall, and your legs get muscle hated that more than that would call her attention quick.? That girl could do some push?ups too. You know, most peOple, they do push-ups with their back arched, well BRIE would do them straight. I always thought she was one of the strongest kindergarteners. Now, she would watch us do push?ups, sit?ups, and what have you. She just wanted to be like us. Now, one time BRIE just threw her plate down on the ?oor, or something like that. And, she just went into ?brat mode,? and she doesn?t ever do that. DANIEL got the belt out and swatted her one time on the butt. He?s the disciplinarian wouldn?t do that. I was more the one that would make her do push~ups and sit against the wall. We probably had to do that several times a three times a week. DANIEL Spanked her with a belt awhile back, but he told me about it. He said he was trying to hit her diaper, but she moved and he hit her leg or back. I know there?s a mark on her right side, but I think that?s going to be from falling down the back deck of the house. She?s bad about not paying attention when she?s walking too. As far as natural healing, family has their own way of dealing with things. His family has a thing about using an egg to cleanse the body. You put holy water on the egg and rub it over the body. When we ?rst woke up this morning, I brought BRIE into our bedroom. DANIEL blessed her and prayed over her. It was real quick. She was Opening her eyes at this time. But, after DANIEL blessed her. ..she took that deep breath and didn?t let it back out. That?s when I called her Brie. . .and her eyes started rolling back in her head. After he blessed her, I gave her a drink of water, and she drank it. Then I laid her back down. We were on the ?oor in our bedroom. She was real weak at that time. After she took that last breath and didn?t let it when I started I use that cord in the closet to do pull?ups. I wrap the cord around my forearms and use my body weight as resistance. I don?t do it as often as I should. I don?t have time to go to the gym, so I make do with whatever I hate. I saw that DANIEL had a long piece of that cord, and I asked him to tie it up in the closet for me. You can tell that I?ve already broke it on the side, from pulling on it so hard. I told him that we?d have to do something else. DANIEL put the cord up in the closet last after we moved there. I?m a pillow person. I like a bunch of pillows on my bed, and DANIEL doesn?t. I like to sleep with three pillows on the bed,-a-nd- he sleeps with one. So I toss the otherpillows in the closet. . BRIE loved to look for deer and ride the four?wheeler. She also loved to ?sh. When we went ?shing yesterday, she used her little ?shing pole and was just reeling away. She only had a fake lure on it though. (VICTORIA started to I should have known that something was hurting her. Maybe I didn?t do the CPR right baby. Ignever tied her up with that cord in the closet. Whenever we?d discipline her, we?d make her stand in her corner, by her closet. I would never harm or abuse her, and I would never put her in harm?s way. And, I wouldn?t put her in front of somebody that was going to harm why I?m not with her father now. Both of us usually discipline BRIE. Yes, I?ve got bruises on both of my forearms. I was moving boxes a few days ago at drill, and I wasn?t ready for them and they fell on my arms. The bruises on are from me spanking her with my hand. had to spank her with a belt sometimes too. Last night, BRIE was sleeping in her roompillows in her room with her. She had that pillow that you found in my closet. She threw up on that pillow, so I put it in the ?oor of my wash later. That?s why, like you saw on her bed, she was using one of the pillows from the couch. When I was doing CPR on BRIE, I was doing it on my bedroom the dresser and the bed. Before that, I picked BRIE up out of her bed and carried her to our bedroom. She was still responsive at that point. DANIEL uses that 550 cord to make bracelets. The day before were eating outside, on the back deck and BRIE got ?nished eating and she started playing. She jumped down the steps, from step to step to step. She got to the bottom third step and tried to jump all the way to the ground. Well, she didn?t land on her feet, and she fell down onto the ground. She got right back up and ran right back up the steps. DANIEL and I have our altercations, but never hitting each other. I?m the one that?s to hit, and he?s holding me back. I went to bed at about 4:00 am. Nothing happened between 4:00 am. and 8:00 am. I was worn out, so I just went on to bed, and I know she was worn out too. I actually put her to bed a little before 4:00 am. and I kept on checking on her. I walked in there and checked on her a couple times, and when I saw that she wasn?t going to throw up anymoreshe slept. Yes, I really did go to Wad?mart last night. I bought WIC items. I had to get some stuff to ?nish cooking dinner. I cooked pork chops and mashed potatoes. I tried to feed some to asked her if she was hungry and she said no. I asked her if she was told her that she needed to eat she just shook her head. The ?rst time she threw up was around dinner 5:00 or 6:00 pm. I wasn?t actually cooking dinner just the time that I call dinner time. I didn?t cook until later on. When she threw up, it was green. I don?t know why it was she was sick. Her vomit had chunks of pizza in it and it was gross. She ?nished throwing up in the toilet, and I wiped her mouth for her. She threw up a few more times before and after I went to Wad?mart. When I got back from Wal?mart, it was about ?7 :20 or 7:30 and I ?nished cooking dinner. Well-,-I checked on her when I ?rst got back from the I ?nished I went back to her bedroom to check on her again. I could tell she wasn?t feeling well. That?s when she said she had to throw up again. So she threw up in the bathroom, and she walked back to her bedroom. She threw up in her bedroom and it got all over her clothes, so I just took them off of her and gave her a was around 8:00 pm. Sheriff GOBER and TIM NICHOLS were present as well. I received a phone call from Sheriff GOBER stating Lhat VICTORIA Wanted to talk with us, so I told him to her over to my ofiice. I asked VICTORIA if she still undersuood her rigth that I read aloud to her the night before, and she said she did. (Crying) He punched her that was already dark out. He just snaps. I have no temper. BRIE had used the bathroom on the ?oor. I don?t know if I told ya?ll that. She had done it on her her timeout corner by her closet. That?s where we would send her when she was in timeout. So, she was in timeout, and I guess she used the bathroom on the was wet on the ?oor. DANIEL is the one that found it. DANIEL was in the bedroom with was trying to discipline her and make her stand against the wall, in the chair position. I went in there and saw him talking to her. I think he was trying out whether or not she used the bathroom on the floor. I was standing near the doorway, and he had his back to me. He punched her in the stomach with his list. It wasn?t a soft punch, but he wasn?t just pounding on her. I didn?t know it was that hard. (Crying) BRIE made a took her breath away. He made her go get in the bathtub. She had washed herself and it was bruising up Me and him both were in the bathroom while BRIE was taking a bath. The bath lasted maybe 10 minutes the bath, and I could see that her stomach was bruising was red. He told me to go put BRIE in the kitchen. I think DANIEL was scared that he might have done don?t know. Then, DANIEL cut up some have their own way of doing softened the tomatoes by putting them in the microwave and putting them in a paper towel. He put them on don?t know, for the heat or something. He told me to lay there with her. She never never cried. She was just laying there, letting me put that on her. And I just sat there in the kitchen ?oor withher. Her eyes were wasn?t was just laying there and she was breathing hard. Then she sat up. She had her blue blanket with her. DANIEL and I were arguing or whatever. So I put a movie in. That?s when she started getting sick and throwing up. She would go to the toilet and throw up in there. She threw up in both bathrooms. She threw up in her bathroom then our bathroom later in the night. She also threw up on the ?oor in her bedroom and in my bedroom. I was just God, I hope and pray that it?s not from nothing that he done. I asked are you she didn?t was just breathing hard. I wrapped her up in her blanket, and I put her in bed with us. She slept in bed with us, closest to the wall. I was up with her all night throwing up and everything. She didn?t throw up in my bed. She would tell me when she needed to go, and we?d get up and go to the bathroom. Finally, was breathing, you wasn?t as bad as it was earlier into the we went to sleep. BRIE up and she was just weak. DANIEL got her some water, and I tried to give it to her. That?s when her breathing was getting more shallow, and he was trying to bless her and everything. That?s when she took that deep breath that she didn?t let out. I started CPR on my bed, and then I moved her to my I knew my bed wasn?t a ?at enough surface. I did CPR, and that?s when that gurgling stuff started to happen. (Crying) I thought maybe she?s just choking on the water I just gave her, so I turned her over on her side. She acted like she wanted to cough. That?s when I told DANIEL to just stay right there, and I went and got that medicine dropper. I tried to get that stuff out of her even stuck my ?nger down her throat to make sure her airway was clear. I turned her back over and that?s when she had snot coming out of her nose. I still did CPR on her and more CPR on her. I told DANIEL to come do it on her while I call 91 l. I said, we?ve got to call an got to call an ambulance. So, we moved her into her bedroom so the ambulance people wouldn?t have to get through everything in the living room and kitchen. We put her on her bed, and I continued CPR on her. When the ambulance people got there, I moved out of the way. (I asked VICTORIA what was untrue about her previous statements, and she said almost all of it.) I BRIE has fallen off the dock before, but she didn?t fall off the dock Sunday morning. She didn?t fall off of anything Sunday morning. I know that the bruises on butt were from a belt. I have bruises on my butt from a DANIEL. (Crying) When the ambulance came, DANIEL was are we going to say? I said, I don?t know. It was my idea to come up with the story, because we had been out there to the dock. several days before. . . (crying) Everything happened Sunday afternoon/ evening. I was cooking mashed potatoes, and I needed some stuff, that?s why I decided to go to Wal?mart. I think he hit her right before I went to Wal?rnart. I think it was only one hit. BRIE was in her corner. At one point, he had her doing the chair position against the wall. I think he used his right hand to punch her, because he?s right?handed. I saw him hit her, and he told me he hit her in her diaphragm. We had talked about getting help with his anger The story about my cell phone going dead was correct. It went dead, and I had DANIEL go put it on the charger. I only had 5% battery life when I called. This was like a mother?s worst nightmare. I was trying to save her on my own. We had started CPR a. little after I called 911 at 8:39 am. I didn?t call anybody else that morning, and DANIEL only called his mom. That was before BRIE got to the super shallow breathing. When I got back, BRIE was still in timeout. She had been in timeout since before I had left. When I got back, I went in her room to check on her. She was still standing up, facing the corner, with her hands behind her back. DANIEL was in the living room. We were talking about getting jobs, or something like that. I got the groceries and unloaded them. I checked on BRIE again and that?s when I could tell she was starting to get sick. She threw up on the ?oor, and I cleaned it up. BRIE had already been hit at this point. After DANIEL punched her, I walked out of the room. He always says that I BRIE picks up on me when I?m he says that?s why she acts up and disrespects me. That?s why I just walked I?ve stepped in before and gotten whooped with a belt. 80 I went into the kitchen and kept cooking. DANIEL came out of her bedroom, and I went to Wal?mart to get some milk. I got back, and I guess DANIEL put her back in timeout, instead of doing the chair. I put all the groceries up. DANIEL was in the living room, and I was in the kitchen. I think that?s when DANIEL went back in there and laid her down on the ?oor. He went and got some ice, and rubbed it on her. He came out of the bedroom and told me to go in there and check on her. When I go in, she was throwing up, and I cleaned it up. I cleaned it up, because I didn?t want DANIEL getting mad. That was the whole name of the piss DANIEL off. I was rubbing stomach and rubbing her hair. DANIEL came back in and saw that she had thrown up, so he told me to put her in the bathtub. I could see that her stomach was turning red and - bruising. We cleaned her up and got her out of the bath. I put a pull?up on her and took her into the kitchen. That?s where DANIEL did the tomato thing. . .when he rubbed them on her stomach. BRIE was not was just breathing shallow. I should have known it was probably hurting her to breath. She was just lying there, and DANIEL was letting the tomatoes just sit on her stomach. I was sitting beside her. DANIEL and I were told me to go sit in the living room, because I was a piece of shit mom. At one point, BRIE sat up, so I went back in there with her. I was drinking some water, and I asked her if she wanted any and she said yes. Some time don?t know how long. BRIE and I were still in the kitchen ?oor, and DANIEL was in the living room doing PT. He was doing push?ups and sit-ups. After awhile, we decided to go to bed. BRIE got up and walked by herself to our bedroom. She got sick, so she went into our bathroom and threw up in the toilet. She ?nished throwing up, and I wiped her mouth. She stepped into our bedroom and threw up time on the ?oor. I cleaned that up. I don?t even know what time it was. It was past 9:00 or maybe 10:bed. BRIE was lying against the wall, then me and DANIEL. was up all night with BRIE whenever she threw up. DANIEL just stayed in bed. That?s where the throw up on the pillow came from. I just FILE NUMBER: 1?12 CRIME: DEATH INVESTIGATION INTERVIEW OF SUSPECT #4 CONTINUED VICTORIA PEDRAZA PAGE 5 OF 8 threw the pillow on the closet ?oor, with the rest of the dirty clothes. We just laid in bed, and I had my hand on her stomach, to make sure that her breathing was fine. We woke up at about 8:00 am. and I shook BRIE to wake her up. She opened her eyes and looked at me. I got her some water, and she took a sip of water. I was sitting up in the bed. I had BRIE wrapped up in her blanket, and I was just holding her. That?s when DANIEL was blessing was using holy water. He was also praying over her. He used the egg to cleanse her also. He used the eg the night before she was lying in the kitchen ?oor. He rubbed the egg on her and cleansed her then too. After he used the egg on her in the bedroomwater and let it don?t really know what that was about. I was just holding she was weak. I thought it was because she had thrown up so much. That?s when DANIEL called his mom and told her that BRIE wasn?t breathing all that good. She said to put alcohol on a rag and pass it under her nose. I got a towel and a bottle of rubbing alcohol, while DANIEL held her. We tried it, but it didn?t do any good. Right after that, she took that deep breath, and stopped breathing. I started CPR on her in my bed, but I heard that gurgling, and I thought she was choking on the water she drank. We moved her onto the ?oor, and I continued CPR on I kept hearing the gurgling sound- I ran to the kitchen and got the medicine dropper and tried to suck it out. I kept doing breathing and chest compressions, and I checked her pulse. I did that for a little bit, and then I called CPR. DANIEL took over because he could see that I was getting tired. Then, I told him to take her to her bedroom to make it easier to get her on the stretcher. DANIEL carried her back there, and I continued CPR on her bed until the EMTs got there. Those marks on lower back, those were probably done by the belt. I think it happened a few days don?t know exactly when. He?s hit her with the belt been hit with the belt too. - No, we didn?t clean up the house after we called 911 or anything. We didn?t throw anything away either. When I was doing CPR, DANIEL got some Q?tips and swabbed the inside of nose, to make sure her airway was clear. I think he may have thrown those Q?tips away. Now, the night before, I had cleaned up the house and taken the trash out, because I knew that the trash truck came early Monday morning. This was way before BRIE got in trouble. The clothes in that plastic bag that have vomit on them, she wasn?t wearing those clothes when she got punched. They were just close by when she threw up, and I used them to scoop up the vomit. I had taken those clothes off of her earlier, it was a green shirt, blue jeans, and socks. She wasn?t wearing anything when she got a p?ullnup (diaper). I stood against the wall, as if I was BRIE, and she demonstrated what she saw DANIEL do to her.) BRIE was doing the chair against the wall, and her anns were out in front of her. She wasn?t smiling, laughing, or wasn?t doing anything. She was could just look at her and she would stop whatever she was doing. DANIEL was on his knees in front of was at eyewlevel with her. I was standing in the doorway. He was talking to her that she knew better than to do that. I saw his arm move back, and then go forward looked like a punch. She lurched forward and sank lower against the wall. I went back into the kitchen, and then DANIEL came out into the living room. I think that?s when he got some ice and the frozen chicken from the freezer. He went back in there for a little while, and then came out. He told me to go in there and check on herthe bruise on her leg, and she was holding the chicken on her stomach. She was lying down, and that?s when she threw up. I just didn?t know how to get out of that situation with DANIEL. I didn?t have any family to help me, and I didn?t have a car. Friday night, after he beat me with the belt, I thought about calling somebody to come get me. He even told me not to call anybody or use my phone unless he called or texted me. Saturday, he had Drill all day, and I thought about leaving, but I didn?t. I?m telling you the truth about the cord in the closet. I?ve never seen, with my two eyes, BRIE tied up or anything like that. I?ve never heard about DANIEL doing that either. No, it?s not usual for that cord to be commg out of the closet like that. He must?ve hung that cord in the closet earlier on into the week. He didn?t explain to me what he was doing with it. I?m home all the time. No, I?venever seen DANIEL make those bracelets in our closet before. In fact, he hasn?t made any bracelets recently at our house that I?m aware of. He?s made some before at his mom?s house though. (I left the room brie?y and let Sheriff GOBER and TIM NICHOLS speak with her alone. She told them that she?s only seen DANIEL hit BRIE with his hand and a belt before, but nothing else. She said most of the discipline took place in bedroom, and that she didn?t interfere. She didn?t want to interfere and upset DANIEL. DANIEL has hit her and BRIE before with his knuckle.) I haven?t told anybody else about DANIEL punching BRIE in the stomach. That day when you cancelled the polygraph test, I ?gured you all were out at the dock, so I told DANIEL that I wanted to go out there too. I just had a feeling that ya?ll were out there. Since all of this happened, DANIEL has said that he went too he pushed her too far. He just wanted BRIE to be the best at everything. He said that is how he was raised. He told me he was just trying to correct get her on the right path. I knew it would get to this point and that everything would come out. I just wanted to get my baby buried and in the then I would deal with all of it. I don?t know how lip got busted. I think DANIEL may have popped her in the rnouth-..that Sunday. I heard a slap, but I thought he was just spanking her. I was in the kitchen, and DANIEL was in the bedroom with BRIE. DANIEL was back there with her for about 5 minutes, and then he came back into the living room. No, neither of us were on drugs or alcohol on all this happened. DANIEL was back and forth between the living room and room all day Sunday. . .but I was back and forth in there too. I remember that we watched the ?Heroes? TV series Sunday and BRIE watched it with us. When it was over, DANIEL called her over to him and asked her a question. She didn?t answer out loud with a yes or no, so I think that is when he ?rst put her in timeout. She was in timeout in her room, and I went in there a few times and checked on her. I checked on her to make sure she was doing DANIEL wouldn?t have a reason to come in there and correct her. She was just standing there in timeout. At one point, something made DANIEL really he didn?t do anything to BRIE, but he came out of the bedroom and just took a nap on the living room couch. I was looking on the internet on my for jobs. A few times I went to the bedroom and checked on that?s all I did was check on her. I didn?t want DANIEL to think I was interfering or trying to get her out of timeout while he was asleep. I also didn?t want him to think I was contradicting what he was doing. A couple of hours passed, I think, and DANIEL went in the bedroom. BRIE must?ve sat down and peed through her pull?up (diaper), because the ?oor was wet. I went on in the room, and BRIE was already standing against the wall and. DANIEL was in front of her. That?s when the punch happened. BRIE was in timeout most of the afternoon. She was in there for about 2 hours. She was supposed to be standing while she was in there. That?s not normal punishment for her. Normal timeout was usually 15 minutes. The whole time, I was just thinking why, why, is taking too long. But, I didn?t want to interfere and push buttons. DANIEL was asleep for a couple of BRIE was in timeout the entire time. I heard him say, you know better than that! I know the pitch /tone of his voice, and I could tell it getting loud, so that?s when I went back there to the bedroom. He said some things to her, and then punched her in the stomach. I don?t remember DANIEL ever hitting her with anything that day. But one time, I think he took the belt back there with him. It was a black one you guys collected. All you had to do was just let BRIE see the belt, and she?d straighten up. When I called 91 1, feet were cold to the they were-a bluish color. I just thought that was from a lack of oxygen. She was good and alive when we woke up at around 8:00 a.m. Sunday night, I noticed that her top lip was puffed out a little bit. It made me think that DANIEL had hit her in the mouth, but I didn?t ask. The past two days, nobody elsewatched BRIE. It was just me and DANIEL. Saturday, DANIEL went to Drill, and I just held BRIE in my arms. He was away all day. I was hurting and just he whooped me with the belt. BRIE and I just spent time together that day, and it was good. (Crying) It was mommy and daughter we never get that together. She helped me clean the house, and then we went outside and played. I was determined to call somebody that day, to come and get me and take us away. I thought about it all that day, but then I knew that DANIEL would get pretty mad and pop his (I showed VICTORIA the camo?auge Army vest and asked her if she had a similar one.) I don?t have my gear at the house. All of mine is at the storage unit in Warren. I don?t know if DANIEL has his vest or not. I don?t think I?ve seen it, but it is probably either in storage or at his mother?s house. They allowed me to inspect several pieces of equipment, including a vest. Captain PHILLIPS allowed me to take possession of one of the vests, so that I could compare it to my evidence. One of his men prepared a National Guard receipt for the vest, and I signed it. The receipt will be included with the file. I accepted the vest took it into my possession on that date. Conducting the search was: A CLAYTON MOSS, Arkansas State Police?CID I drove to the Armory after one of friends and fellow Guardsmen, EBONY WINSTON, told me that the mark I found on back looked similar to an old load?bearing vest, issued by the National Guard. I arrived at the Armory and spoke with an of?cer out there. He found an older~model vest with a web belt, and I examined it. The patterns and dimensions looked similar to the mark on upper back. The commander of the Guard unit, Captain PHILLIPS, allowed me to take the vest and use it in the case. I signed a receipt for the vest, and I concluded the search. The following item was collected as evidence during the search: CM-E18 One green Army?National Guard issued load-bearing vest, with web belt. I collected this item from the National Guard Armory in Monticello. I placed it in a paper sack and labeled it as I will retain possession of this item for future reference. End of evidence items.
