CONSUMER ALLIANCE TI-IE WI-CE Butzlaff, Nathan B (GOV) From: Sent: To: Subject: Natalie Joubert Monday, October 14, 2013 12:02 PM Butzlaff, Nathan B (GOV) RE: Industry Briefing Read-Aheads for Tomorrow Hi Nathan,    I actually looked through this this past weekend, and I believe I was inaccurate in stating that some of the Gulf States did  not agree with the House version of the GOM Transboundary bill. You may recall that Louisiana and some of the other  Gulf States were, however, unhappy with the House Energy & Jobs Act that was passed at the same time. They  disagreed with HR 2231 due to the way revenue‐sharing for new participating states would be structured. Essentially,  Virginia, North Carolina, etc. would have access to revenue‐sharing from first leases and first production, unlike the Gulf  who didn’t have revenue‐sharing until 2007.     However, on the Senate and House versions of the Transboundary issue, I do know that there is some disagreement  generally about the House’s inclusion of exemptions for reporting requirements as amended in Dodd‐Frank (language  below):     From House bill:    ‘(d) Exemption From Resources Extraction Reporting Requirement- Actions taken by a public company in accordance with any transboundary hydrocarbon agreement shall not constitute the commercial development of oil, natural gas, or minerals for purposes of section 13(q) of the Securities Exchange Act of 1934 (157 U.S.C. 78m(q)). Nick Tew (ntew@gsa.state.al.us); Mike.Morrissey@governor.state.tx.us; Chip Kline (Chip.Kline@GOV.STATE.LA.US) Cc: Natalie Joubert; David Holt CEA; bgreenfield@consumerenergyalliance.org Subject: Update - Federal Legislation re: Offshore Oil & Gas All,     I wanted to make you aware of some late breaking federal legislative news related to offshore oil and gas that could  come up in Biloxi, particularly with the press.  Specifically, there are two items:     1) On Saturday, the U.S. Senate passed legislation implementing the Transboundary Hydrocarbon Agreement that  the United States and Mexico signed in 2012.  This opens about 1.5 million acres of the Gulf of Mexico OCS  currently under a drilling moratorium that expires next January.  The U.S. House passed a similar – but not  identical – bill this past summer.  I have copied an article below with further detail.  Kip – I think that this is the  item you mentioned to me.  2) Louisiana Republican U.S. House Members Bill Cassidy and John Fleming introduced a bill on Friday that allows  the federal government to continue to provide services and activities during a federal shutdown that are funded  by user fee revenue.  In this context, their primary focus is on oil and gas permitting on new lease sales from  BOEM at the Interior Department.  Their press release is attached.     CQ NEWS  Oct. 12, 2013 – 4:44 p.m.  Senate Backs U.S.‐Mexico Drilling Agreement  By Sarah Chacko, CQ Roll Call     The Senate passed a bill Saturday that would implement a 2012 U.S.‐Mexico agreement on drilling in the Gulf of Mexico.    The bill (S 812), which senators backed by unanimous consent, would establish a framework for the cooperative  exploration and development of oil and gas reservoirs in the gulf.     The United States and Mexico signed the Transboundary Hydrocarbon Agreement in February 2012, and the Mexican  Senate approved it two months later. The accord would open about 1.5 million acres of the Outer Continental Shelf  currently under a drilling moratorium that expires January 2014.     Senate Energy and Natural Resources Committee Chairman Ron Wyden, D‐Ore., said at a hearing earlier this month  there could be an “open season” among oil producers when the moratorium is lifted.  35 “It is good for energy, good for jobs and good for the environment to have rules guide development in the Gulf of  Mexico,” Wyden spokesman Keith Chu said in an email.     The Bureau of Ocean Energy Management, which manages the development of the Nation’s offshore energy and  mineral resources, estimates that the transboundary area holds as much as 172 million barrels of oil and 304 billion  cubic feet of natural gas.     The Obama administration and the oil industry say the agreement would make development of other transboundary  areas more attractive to operators by providing legal certainty around the area.  An Interior Department official also confirmed at the Oct. 1 hearing that leases covered under the agreement would be  subject to a royalty‐sharing scheduled to begin in 2016 under a 2006 law (PL 109‐432) and signaled interest in discussing  legislative options for changing the regime.     Sen. Mary L. Landrieu, D‐La., indicated earlier this year that she would seek to amend the measure if administration  lawyers said the transboundary areas would not otherwise fall under the law’s scope. She and Senate Energy ranking  Republican Lisa Murkowski of Alaska have co‐authored a bill (S 630) to overhaul how money generated from offshore  energy activities is shared among coastal states.     The House passed a similar measure (HR 1613) on June 27 with a provision that would exempt oil, gas and mining  companies from a requirement under the 2010 Dodd‐Frank financial regulatory overhaul law (PL 111‐203) to disclose  some payments made to foreign countries.     A federal court vacated the rule in July and the Securities and Exchange Commission decided to rework the rule, making  the controversy over the House provision moot.      36 Butzlaff, Nathan B (GOV) From: Sent: To: Cc: Subject: Attachments: Natalie Joubert Monday, October 14, 2013 11:38 AM Jill Boxer (AL);
