Ndii?tiad Tit/i3 Case Number: 14-16644 ff .. 3.. .1 Offensei Shooting Submitting Officer: DetRodney Curd. - Today?s Date: 08/11/14 On 08/05/14 at 21 10 hours I was off duty and at my residence. 1 received a call from Beaveroreek Dispatch about an of?cer involved shooting at Walmart, 3340 Pentagon. was aware that other detectives were responding to Walmart as well. I arrived on scene at 2134 hours and made contact with Detective Lindsey. He told me Of?cer Sean Williams had shot a man who had arrived at the store with his girlfriend a few minutes before. While in the store the man had what was believed to be a ri?e. Detective Lindsey told me the girlfriend, who brought the man with the gun to Walmart, was begin transported to the Beavercreek Police Department. He asked me if I could go in and interview her. A short time later I arrived at the Beavercreek Police Department. I asked Of?cer Brownlee to bring the girlfriend, now known to me as Tasha L. Thomas, to the investigations interview room. At 2141 hours I started the interview. This interview was being recorded on the interview room recording system. I told Tasha Thomas that I needed to know what had occurred at Walmart that evening. I told her she was free to stop talking with me at any time. She said she understood and wanted to cooperate with police. I ?rst asked her some information about herself. I learned that she lives on Burrows in Fairborn. She gave me a phone number of 937~260~5687. Ms. Thomas said that she works at Access Home Health Care as a Home Health Aide. She told me. she has three children; Roger, age six, La?Corteon, age seven, and lair-Anthony, age three. She said that her mother Diana also lives with her and her three children. I learned that she had taken her boyfriend, John H. Crawford of Cincinnati, to Walmart. She said she arrived between 2115 and 2130 hours. Ms. Thomas said she was driving her 1999 gold Chevy Suburban, Ohio registration GER7271. I started discussing how she knew John Crawford. Ms. Thomas said she met him about four months ago at Cricket Bar in Huber Heights. She said he just recently lost his restaurant job and lived in Cincinnati. Ms. Thomas said that she recently went to Georgia with him where they spent a few days. Prior to going to Walmart, she met John Crawford and his mom at the Cincinnati Premium Outlets at approximately 1800 hours. She said when she picked him up at the Premium Outlets white plastic grocery type bag with him. She said she did not know what was in the bag, but he did leave it in her car. John was going to spend the night with her in Fairborn. They wanted to stop to get some items to make s?rnores before going to Fairborn. She said they came from Cincinnati, arriving at Walrnart from 1?675. During the ride from Cincinnati, Ms. Thomas said that his baby?s mamma, LeeCee. calledhirn several times giving him a hard time about visitation for their two boys that he has with her. She said he ignored some of the calls but she continued to ring his cell phone. Tasha Thomas said they were inside Walmart. She started shopping for items such as uniform tops for her home health care work and food to make s?rnores. While in women?s clothing she said that LeeCee called John yet one more time. She told him to go someplace and take care of this and talk to her. John said ok and walked away from her towards the rear part of the store. She said she "did not see where he went, but he did walk away from the front doors. She said a short time later someone with. Walmart told her that she had to leave the store right away because something had happened. Ms. Thomas said she did not hear any shots being fired or anything else. The next thing she knew someone was telling her to get out? of the store. A Show time later when John did not come out, she went in and was checking on where he might be. A police of?cer told her to stay with him and put her in his car. I asked Tasha Thomas if she had seen John Crawford take a ?rearm of any type into Walmart. She said he had not. She did not believe he ever carried a gun. She had never known him to have a ?rearm. The initial information I had was that he may have brought a gun into the store with him. So I was very direct in my questions that I was having problems believing she would have not seen him bring a gun into the store. She became emotional during the interview and started crying saying that she is not lying, she will take a lie detector test and do whatever she needs to do. She did not see him bring a gun into the store, she did not know anything about him having a gun, and did not know anything about anybody shooting. During the interview i was contacted by Captain Grile who asked about the ownership of the 1999 Chevy Suburban. Ms. Thomas said she owns the vehicle. She hadjust signed a lease with a used cars sales, but the plates on the car are to another car. She told me she has not had the chance to transfer the plates but she is the actual owner of the vehicle. She agreed to Sign consent to search for the vehicle which I accomplished with her. Of?cer Brownlee had taken her Kyocera Cell Phone. I told her we would also like to check through the cell phone. I asked her if she would agree to sign consent to search for the phone. She agreed to sign the consent to search which was also accomplished. During the interview, I asked her if she had used any drugs or alcohol that evening and she said she had not. I also asked her if John Crawford had used any drugs or alcohol that evening prior to the incident. She said she did not see him drinking or did not smell any alcoholic beverage on him. She said he did smell like weed. She knew he smoked pot sometimes. He also told her in the past he used to deal drugs. I asked Ms. Thomas if She would complete a written statement about her contact with John Crawford that evening. She agreed to accomplish a statement. Amanda Opicka, Greene County Prosecutor?s Of?ce arrived to assist as a Victim?s Advocate. I introduced Mrs. Opiclca to Ms. Thomas. During the same time frame I learned that Diana Thomas, Tasha?s mother, had arrived at the station. I learned at the same time that John Crawford had been pronounced dead at the hospital. With Mrs. Opicka in the room I noti?ed Tasha Thomas that her boyfriend was deceased. A short time later, after Tasha Thomas calmed down, she left with her mother. I gave her my business card and told her we would stay in contact with her about her suburban and her cell phone. I went back to Walmart and made contact with units on scene. I learned that First Assistant Prosecutor Suzanne Schmidt had arrived on scene. It was decided that we would tow the suburban to the Beavercreek Police Department, and complete a search warrant the next day. While on scene, Tasha Thomas came by the scene with her mother Diana. I noti?ed her that we would not be searching her vehicle on scene as originally thought. The vehicle was going to be towed to the Beavercreek Police Department and a Search warrant would be completed. We would notify her when the vehicle could be released to her. While on scene I was asked to assist with the search of the interior of Walmart. One wallet was found in the isle area apparently by someone leaving quickly because of the incident. There was concern that other people may be missing a purse or a wallet that we would need to take charge of. I walked about the isles with other units and did not locate any other items of interest. White in Walrnart, I went by the, women?s clothing section and found what I believed to be Tasha Thomas? grocery cart. Inside the grocery cart was some tops normally worn by medical personnel, Hershey chocolate and marshmallows. The discovery of this cart would agree with the statement she made earlier. I also learned while on scene that the ri?e involved was a pellet gun that was taken from a box While he was inside the store. This would also agree with the statement that she made that he did not take any type of firearm out of her car into the store with him. Grile around 2050 hrs. in reference to responding out to a scene of an of?cer involved shooting. The incident took place at Walmart located in Beavercreek Ohio. I was advised by Capt. Chile that of?cers responded to Walmart in reference to a Weapons complaint. Dispatch advised that callers stated that a black male subj cat was Walking around the store holding a ri?e and waving it at people. Capt. Grile advised that officers arrived on scene and confronted the subject and had to ?re their weapon at him due to the fact that he failed to put the weapon down when requested by of?cers. Capt. Grile advised that the suspect was identi?ed as John Crawford out of Cincinnati. Capt. Grile requested that I respond to MVH because the Medics took him there ER due to his injuries. When I arrived at MVH, I was met by Ofc. Stall who advised that the ER team is currently working on John. Ofe. Stall advised that he responded to the scene shortly after Of?cers called out and entered the store. Ofc. Stull advised that he heard Ofc. Williams say over the radio that he had one down and that he was going to be administering ?rst aid. Ofc. Stull advised that when he arrived he observsd John lying on the ground'in the rear of the store in the dog food aisle. Ofc. Stall advised that he assisted Ofc. Williams and Sgt. Darlcow with administering first aid by placing tourniquets on John?s. arms to control the bleeding. Ofc. Stall advised that Medics arrived shortly and rendered additional ?rst aid to John and transported him to MVH. Ofe. Stall advised that he observed a black colored long barrel assault ri?e lying on the ?oor next to John when he arrived on scene. While speaking with Ofc. Stall, the medical staff came out and advised that John has died as a result of his injuries. I instructed Ofc. Stall to assist me in taking photographs of John prior to the coroner?s of?ce arrival. I went into the ER room and the medical team was stitching John?s chest area back up. I had Ofc. Stall take several piennes of John and his injuries. 1 also used a ruler to show the size of the wounds that John sustained as a result of being shot. John was pronounced dead at .2123 hrs. by Doctor Hendershot. Dr. Hendershot advised that John died as a result of multiple gunshot wounds and lose of blood. John had wounds on his right forearm and right side of his torso. John also had injuries to his left arm/elbow and upper right side of the torso. I didn?t observe any other injuries or womds to John?s body and neither did the medical staff. Staff advised that the Montgomery County Coroner?s Office was on their way to remove John. A short time later I was advised by a mass that John?s family showed up (2200 hrs.) and that they wanted to speak with me and see John. Staff advised that they were unable to see John because the coroner had already Page I 1 removed him. John?s family was waiting in the grieving room. When I entered the room, ohn?s mother was sitting down and his father was standing up. I introduced myself to both of them and advised them that I was sorry for their loss. It didn?t seem to me that they were very receptive to my apology. ohn?s father was identi?ed as John Crawford Jr. and his mother was identi?ed as Tressa Sherrod. They both confirmed that John resides in Cincinnati Ohio and that according to them he was up in the Fairborn area for a BBQ but neither one of them knew where Fairborn is located. John Jr. advised that John went to Walmart to purchase items for the BBQ. John Jr. advised that his son would have never done anything like this and that his son does not even own a weapon. I advised him that I was unable to con?rm where the weapon came from because I have not been out to the scene. John Jr. advised that he has been in law enforcement previously but would advise me as to what he use to do. John Jr. then asked me if we have the ?two tap? rule in the state of Ohio. I advised him that he needed to explain that question and asked if we are taught to shot two rounds at a time and I advised him that we are instructed to shot to stop the threat. I then focused my attention and questioning on John and why he was up in this arear. Tressa advised that she drove John to the Premitnn Outlets located in Monroe Ohio and that ohn?s friend, Tasha was to pick him up there and drive him to Fairborn. Tressa advised that she dropped John off and then left him there to wait for Tosha. Tressa advised that she called Tosha to verify if she picked up John and she advised that she did and that they were on their way up to the Fairborn area. I asked Tressa if Tosha was John?s girlfriend and both John Jr. and Tress advised no, she was just a friend. John?s girlfriend, LeeCee Johnson and that she lives in Cincinnati and they have two children together. I asked why John would come up to Fairborn with a female friend instead of being with his girlfriend and children and both parents failed to answer me. Tressa told me that LeeCee was on the phone with John at the time of the incident and that LeeCee told her that she heard John say that it wasn?t real. i attempted to obtain information that would help set a timeiine as to ohn?s activities that day and Tressa got agitated with me and stated that she doesn?t think that any of this is relevant. I was unable to fmish my interview because John Jr. advised that they were just going to get an attorney and that they weren?t going to answer any more questions. I did explain to them what my understanding was as to what happened but I cautioned them because I have not been on scene yet so I was unable" to con?rm anything and John r. acknowledged that. {then provided them both with my business card and advised them if they needed anything to not to hesitate to call me. I also provided John Jr. with the phone number to the Montgomery County Coroner?s Office. I then went back to the ER and retrieved my evidence kit along with a bag of clothes that John came in with which was timed over to me by MVH police. I then exited the ER and called Capt. Chile to advise him as to the conversation that I had with ohn?s parents. Capt. Grile advised me to respond to the scene to assist and that he was speaking with the Chief in reference to having come out and process the scene. I arrived on scene and met with Capt. Fiorita and Sgt. Molnar at the command post. They instructed me to get with the Chief, Capt. Grile and Suzanne Schmidt. The scene was completely tapped off and secured. Ofc. Stall was posted out front of the main entrance and was keeping track of who entered and exited the store and their times. It was relayed to me that the weapon that John had in his possession at the time of the incident was a BB gun that was black in color and it resembled an assault rifle. The gun did not have an orange tip on it and looks genuine. I spoke with Suzanne Schmidt, Fred Meadows, Capt. Grile and the Chief. Capt. Grile advised that Page i 2 they have contacted and they were on their way out to the scene to process it. The Chief explained that he has decided to let BCE handle the evidence work and investigation in an effort to keep the transparenCy of the investigation along with taking out any con?ict of interest. Prior to leaving the scene I entered Walrnart with and other Detectives to walk through Walrnart to make sure that there were not any personal items left lying around as a result of people running out of the store. After exiting Walmart the scene was of?cially turned over to BCI and their evidence collection team. I then transported the clothing from the hospital back to the PD and secured them in the sally port cage to dry. On 8/06/14 Iprinted off all the photographs that we took of John while at the hospital. I also transcribed Ofc. Stull?s leger as to who entered the scene and the times in which they entered and exited. I also took photographs of the command post boards to show what was documented while at the incident. John does have a CCH and I noticed that on 8/20/13 ohnwas charged with Robbery, concealed weapon and receiving stolen property from an incident that took place in North College Hill Ohio. ohn?s CCH shows that he was never indicted on those charges. I also provided Mike Fox from the Montgomery County Coroner?s Of?ce with ohn?s parents? names and contact info. On 8/07/14 I called North College Hill PD and spoke with them and asked if they could provide me with a copy of the Police Report involving John from 8/20/13. I received the report via faxed around 1100 hrs. The report indicates that John was with three other subjects in a vehicle when they rolled up on some peeple and displayed a gun and robbed them. Of?cers later located the vehicle and stopped it and the occupants hailed from the vehicle. John was located hiding in an abandoned house. John denied having any involvement along with denying that he knew anybody in the vehicle however the other three subjects stated that they have known John for all their life. Grile who noti?ed me that a disturbance/shooting occurred at Walmatt (3360 Pentagon Blvd.) andrequested my response to assist with the investigation. Capt. Grile instructed me to respond first to the Beavercreek Police Department and retrieve all necessary eqoipment to process the scene. @2125lns. I arrived to the Beavercreek Police-Department and gathered all pertinent evidence equipment and responded to Walmart. @2148hrs. I arrived on~scene at Walmart and initially made contact with Capt. Grile who was at the command post (in front of Of?ce Depot). ?Capt. Grile directed me to assist Sgt. with extendingthe crime scene past the 1999 Chevy Suburban that the suspect (John H. Crawford arrived in to Walmart. I then proceeded to use yellow police tape to enhance the crime scene past the Chevy that was parked in the center of the Walmart parking lot refer to attached photographs for details of the vehicle?s exact location. @2215hrs. Upon completing the tape, I re-contacted Capt. Grile who was now speaking with Det. Lindsey. Capt. Grile, Det. Lindsey and I then proceeded to the general merchandise entrance/exit of Wahnart Where I made contact with Walmart?s LPG (Shannon Berry). I requested Berry to start reviewing video footage of this incident While Capt. Grile, Det. Lindsey and I walked the shooting scene (southwest corner of the main building pet supply section). I noticed two ri?e shell casings near the garden center doors along with a green/white cell phone lying face down near the area Where Crawford was being worked on by BTF medics. I then looked at the ri?e Crawford was holding and discussed with Capt. Grile/Det. Lindsey that maybe Walmart sells this particular weapon. I did not touch, move or disturb anything while examining the scene and Capt. Grile/Det. Lindsey and I proceeded back to the sporting good section to search their inventory. Upon arrival to sporting goods, I located a box sitting on a shelfjust right of the cash register that had a picture identical to the rifle that Crawford possessed. Using the antenna of my radio, i lifted the lid of the box (was partially open) and could determine the ri?e was missing. Det. Lindsey and I then responded to Walmart?s LP of?ce where I made contact with Berry reference the video. Det. Lindsey and I reviewed thexvideo footage of Crawford entering the building with his friend (Tasha Thomas); found where he did pickup the ri?e in sporting goods and the altercation involving Ofc. Williams/Sgt. Darkow. @2339111'3. [exited the store and met with Sgt. Molnar at the command post. Sgt. Molnar requested that I obtain Sgt. Darkow?s patrol ri?e that was being held by Ofc. Diaz. 1 then responded to Ofc. Diaz and took possession of Sgt. Darkow?s Sig Sauer M400 ri?e (serialtt 21GOO6212) along with the magazine that was removed prior to my arrival. I checked the title?s bolt and determined that it was looked back in the upper receiver rendering it unloaded/safe. Ofc. Diaz indicated that when he took possession of Sgt. Darkew?s ri?e; he removed the magazine, cleared the chambered round and placed the discharged round back into the magazine. I then transported the rifle to my vehicle where I secured it and the full magazine in my trunk. @0058hrs. Iresponded back into Walmart where I walked the store with agents (Durst White). 1 showed the agents the empty ri?e box that i found in sporting goods and this concludes my involvement with the interior scene. After speaking with the agents, Det. Curd, Piasecki, Lindsey and I searched the entire store for any property that might have been left by the ?eeing customers. I collected a wallet belonging to Ricky Wheeler next to the check-out counter in the paint department. Itdok possession of Wheeler?s wallet and we didn?t locate any other left items in the store. @0129hrs. exited Walmart and met back up with Agent White who was photographing the exterior scene. I noti?ed Agent White that I had custody of Sgt. Darkow?s ri?e and he responded to my vehicle to photograph the ri?e, magazine and ammunition. Agent White indicated that I could log the ri?e into our property room and they will obtain it at a later date if necessary. I left the Walmart parking lot and responded to the Beavercreek Police Department where I logged Sgt. Darkow?s ri?e into the property room. After securing all our evidence equipment, I made contact with Ricky Wheeler and noti?ed him that I had his wallet. Wheeler advised that he would be up and requested that I return it now. @0245hrs. ireSponded to Wheeler?s home (2321 Faircreek Ridge Dr. - Fairborn) and tinned his wallet back into his custody. Wheeler examined the contents of his wallet and indicated that nothing was missing. Wheeler signed a BPD property card for his wallet and I left his home without incident. I made contact with the Montgomery County Coroner?s Of?ce and they adViSed that John Crawford Ill autopsy will begin at O900hrs. @085 Ohrs. I responded to the Montgomery County Coroner?s Office where I made contact with Greene County Coroner? 3 Chief Investigator (William Harden). Investigator Harden and I then attended Crawford?s autopsy conducted by Dr. Robert Shott. Upon completion of Crawford?s autopsy, Dr. Shott advised that Crawford was shot twice (once in the left elbow and once in the abdomen) and believes he died from internal bleeding. Dr. Shott showed me where one of the two rounds entered Crawford?s left abdomen, penetrated his liver/diaphragm/right kidney and exited his body out the right into Crawford?s right forearm. Dr. Shott attempted to extract the round from Crawford?s right forearm but informed that it was broken up into multiple very small pieces. Dr. Shott advised that he will provide his official cause of death in the Coroner?s report which should be completed in 36 weeks after the toxicology is finished. 8-08-14 @1 lOShrs. He informed me the suspect was transported to Miami Valley Hospital and no of?cer was injured during the incident. Upon my arrival at Walmart at approx. 2130 hrs, 1 made contact with Capt. Grile, Sgt. Molnar, and Sgt. Hummel. They briefed me on the incident by informing me Ofc. Sean Williams shot a subject, later identi?ed as John Crawford, in Walmart who was holding a gun and reportedly waving it at customers. I was informed the store had been evacuated and Ofc. Bondy was currently stationed at the inner perimeter of the scene inside the store. Capt. Grile informed me Det. Krall was responding to the police department to gather equipment needed to process the scene for evidence, Det. Piasecki was enroute to Miami Valley Hospital where the subject was transported, and Det. Curd was enroute to Walmart. Greene Co. Sheriff?s Deputies turned over- four written statements to me they had collected from four potential witnesses, Nicole Ebright, Jacob Steffen, Amy Lee Dixon, and Natasha Belford. The witnesses were no longer on scene. Ebright was a customer and Steffan, Dixon, and Belford worked in the pharmacy. In reviewing the statements, none of these witnesses saw the incident. They only heard the gunshots, causing Ebright to run to her car with her daughter, and Steffan, Dixon, and Belford closed the gate to the pharmacy and locked themselves in the pharmacy restroom. I observed a group of people standing in the parking lot behind the crime scene tape. 1 made contact with them to determine if there were any Witnesses to the incident. There were no witnesses, but one of the females was Dianna Thomas (937?3 97-253 3/ 1884 Burrows Blvd. Fairborn, said she was the mother of Tasha Thomas, a friend of John Crawford. She said Tasha called her after the incident and told her to come to Walmart. Dianna said Tasha said she did not see what happened. I asked why Tasha and Crawford were at Walmart. She said Tasha picked up Crawford at an outlet store in Cincinnati and they went to Walmart to pick up supplies to make S?mores at a cookout they were having at her house in. Fairborn. I informed her Tasha was being transported to BPD to be interviewed by Det. Curd about the incident. There was also a group of Walrnart employees standing outside the store. None of the employees witnessed the incident. One of the employees was Shannon Berry, the Loss Prevention Manager, who said they would be able to provide a roster Of all the employees working at the time of the incident. lwent inside Walmart and made contact with Ofc. Bondy who was standing at the scene. I observed the scene from outside the police tape and he pointed out where two shell casings were located. One was next to the law and garden door on the inside of the building and one was a few feet away, inside the lawn and garden department. I also observed a black rifle laying on the ?oor at the end of the aisle in the pet department. There was also blood on the ?oor in the same vicinity as the gun. In the adjacent aisle, there was medical supplies that Ofc. Bondy said was used by the of?cers on scene. A?er observing the area, I went back outside and met with Det. Krall and Captain Grile. At 2222 hrs, we went into Walrnart and met with Ofc. Bondy at the scene. We walked into the inner perimeter and upon observing the black ri?e up close, we determined it Was a pellet/lab gun. We did not touch anything at the scene. We then walked to the sporting goods department and located the shelf where the pellet guns were on diSplay. There was an empty box on. the shelf of the exact same model gun that was lying in the aisle. Det. Krall and I then went to the LP of?ce where we met with Shannon Berry and other employees. Berry queued up the surveillance video and Det. Krall and I watched the video of the incident. The employees left the of?ce and I then showed the video to Chief Evers, Capt. Grile, Capt. Fiorita, Greene Co. Assistant Prosecutor Suzanne Schmidt, and the investigator for the Prosecutor?s Office, Fred Meadows. After we viewed the video, Berry located footage of Crawford entering the store at 2009 hrs, entering the aisle with the pellet gun and grabbing the gun at 2018 hrs, and walking to the pet department where he arrived 2021 hrs. 1 exited Walrnart at 2330 hrs. A short time later, Myself, Det. Curd, Det. Krall, and Det. Piasecki were noti?ed by Chief Evers that BCI would be conducting the investigation and processing the scene. We stayed on scene to provide assistance if needed. As we were entering the store, another officer called on the radio that shots had been ?red. assisted in clearing the store of cuStomers and learned that one of the customers had fallen. and was unresponslve, near the bicycles at the back of the store. i responded to that area with an AED, which was applied and started by Sgt. Molnar. The patient was shocked and the A50 advised to start CPR. Molnar and i took turns providing chest compressions. The AED shocked the patient: a second time and then we continued chest compressions until medics arrived on scene and removed the patient. Nicley and I ali responded north on N. Fair?eid Rd together code 3 (lights and sirens). While en route, Ofc. Sean Williams caiied on scene at Walmart. Sgt. Darkow arrived on scene shortly alter. When Ofo. Chris Williams and i pulled into the parking lot of Waimart, Ofo. Chris Williams asked Otc. Sean Williams what corner of the store the male was in. Sean Wiiliams standing over the suspect. couid see blood splatter ail over the floor and a black assauit rifle lying on the ground. I made sure Ofc. Sean Williams was alright and he advised he was. Bondy and lthen began yeliing for the remaining customers to exit the store immediately. After clearing the area, returned to where Clio. Sean Williams was standing. observed the male suspect laying face first on the ground with a pool of blood protruding from around him. Ofc. Sean Williams already had the suspect handcuffed. The male was breathing heavily but not responsive. The male had obvious gunshot wounds to the arms and chest. 1 radioed to the units outside that i needed them to prepare a first responders kit because i was coming out to retrieve it. lthen ran outside and got a first aid kit from Ofc. Nicley. NOTE: While standing over the weapon on scene, it appeared to be a real gun. i did not see an orange tip at the end of the barrel like most toy guns and replicas normally have. i noticed a magazine was loaded inside the weapon and it appeared to be ready to ?re. i assumed the Weapon was a fuily functional assault rifle. When i made it back to the suspect, began placing a tourniquet on his left arm. i placed the tourniquet as high up on the suspects arm because he was bleeding from below the eibow. While applying the first tourniquet, Ofc. Bondy ran out to his police cruiser to get a second tourniquet. When he returned, i placed the second tourniquet on the suspect?s right arm. The suspect had gun shot wounds on both arms. Shortlyatter appiyingthe second tourniquet, Medics arrived and scene and began care. i assisted medics until the point they loaded the suspect into the Ambulance. From there, i followed the Ambulance to Miami Valley Hospital (main campus). Upon arrival at MVH, the suspect was rushed to the operating room. While at the hospital, i learned the suspect?s name was John Crawford. Hospital'statf attempted lifesaving proceduresbut Crawford was listed deceased at 2:123 hours by Doctor Hendershot. i notified Sgt. Stull #113 Beavercreek Police Department Supplement Narrative Date: 8/ 5/ 4 Incident 141 6644 Of?cer: Bondy #96 Your Honor, On 8/5/14 at approximately 2023, I responded to Walmart (3360 Pentagon Blvd.) on a Code 3 response ref. a Weapons complaint. BPD Dispatch advised that a male was inside the store carrying a ri?e and pointing it at people. I reSponded from the area of Colonel Glenn Hwy near the IR 675 overpass. While on route, Dispatch updated responding units that the male was seen loading a ri?e and pointing it at customers, including children, inside the store. The mate's description was relayed by Dispatch as a black male wearing a blue shirt and pants, with an afro style haircut. Dispatch relayed the suspect?s last known location in the store as being in the ?back corner" in the pet supplies department. I arrived on scene at 2025 and drove to the ?Market? entrance, which is the eastern most entrance of Walmart. 1 entered Walmart through the Market entrance. Officer S. Williams and Sgt. Darlcow were already on scene and inside of Walmart. Shortly afterl entered Walmart, I heard two gunshots which sounded as if they were coming from the far west end of the store. Sgt. Darlcow direbted me to remove any customers and employees away from the scene. At this point during the incident, customers and employees were already rapidly exiting the store. I was alerted by an employee that a female near the back of the store was having a medical emergency and was on the ground. 1 responded to the female and observed her lying face down on the floor. Two Walrnart employees were with the female. I radioed the situation to BPD Dispatch and requested a medic respond for the female patient. I was then contacted on the radio by Off. S. He did not have any further information but was calling me to have me send investigators to the scene. I then received a call from Detective Piasecki who said he received a call as the FOP president to have an attorney respond to the PD for an officer involved shooting. Whiie in route to Wal Mart, I called Detectives Piasecki, Curd, Krall, and Lindsey for them to respond to Wal Mart to begin a criminal investigation and process the scene. Upon my arrival, I made Contact with Sergeant Molnar who had a command post set up in front of the strip mall, to the east of Wal Mart. I then instructed Krail to respond to the PD ?rst and gather the crime scene processing equipment including the total station, cameras and video recorders. i learned a subject had been inside the store pointing a ri?e at customers, and was later shot by officers after confronting him. All parties had been tranSporied hour the scene, with the subject transported to MVH. Yellow crime scene tape was securing the store front. I learned that Deputies and Of?cers from Fairborn Police were inside clearing the store for victims and suspects. I called Det. Piasecki and had him respond directly to MVH, as it was in his route of travel. Of?cer Brownlee flagged me down as he was standing by the back open door of a patrol car. Sitting inside the back seat with her legs out, smoking a cigarette was Tasha. After Brownlee told me who she was, I advised her we would like to take her to the PD for an interview. She stated. she drove her boyfriend, Crawford, to the Wal Mart, was separated from him so that he could take a call, and then she did not know what happened. I asked her if we could take her to the PD. She agreed, as long as I got a pair of jeans from her Suburban since she was in shorts and was .cold. She directed me on how to unlock the car and where the jeans were located in the vehicle. I retrieved the jeans, secured the car and told her I was holding the key. She then was transported to BPD by Brownlee. I called Det. Curd and told him I had very limited informatidn (as described above) and that I wanted him to go to the PD, interview Tasha, and report back to me . what he learned. I then got a call from Det Piasecki who said Crawford had died from the wounds and that he and the Coroner were going to speak to the family who was in the lobby. Learning what vehicle Crawford arrived in, I expanded the yellow tape perimeter to include the Suburban. Eventually, the building was confirmed to be unoccupied. I posted Officer Matt Stull at the store entrance to begin a crime scene log. Prosecutor Susanne Schmidt arrived on scene as well as Chief Evers. I was then told that BCI would process the scene, and in the morning the Chief would decide if we, or BCI, would handle the investigation. Once the scene was secured, I facilitated Wal Mart LP employees to enter their of?ce (just inside the front doors) to begin finding security footage of the incident. I then Went into the store where I found Of?cer Bondy standing security over the crime scene, which was marked by yellow tape. I made a quick scan of the crime scene, specifiCally the weapon Crawford had. I examined it at length, looking at the barrel trying to determine the caliber of weapon. It was onlyupon close examination that I could see that the manufacturer was Crosman. ?(At no time did I handle the weapon, my examination was visual). it was at that time I learned that the weapon was a .177 pellet ri?e, that was made to resemble an assault ri?e ?rearm. I went back outside to await BCI. At that time, Sgt. Molnar moved car 135 over to the command post to get the white board. When he opened rear driveris door he pointed the butt of a ri?e out to me and said it was Officer Williams? ri?e. I took custody of the rife, dropped the double mag, ejected a round from the chamber and visually cleared the weapon. I then secured the weapon in the trunk of my staff car. I then went to the PD to get a statement from the two of?cers invoived Sgt. Darkow and Officer Williams. Once I was at the PD, I secured the ri?e, loose round, and double magazine in a property lockerassumed BCI would want to take custody of the ri?e, but i wanted the gun in a more secure place than the trunk of my car. I retained the key to the locker in my right front pocket. I then made contact with Williams and Darkow, who had their attorney Mr. Poff with them. I then obtained a verbal statement from Officer Williams and Sgt. Darkow, individually, with their attorney present. I captured these statements on digital audio recorder. Both were then released to go home, after ensuring they had safe means to get home. Since this case has been transferred to BCI, I have supplied BCI with copies of the interviews and will not summarize it in my statement. I then returned to the scene to await BCI. Upon their arrival, I gave them a quick tour of the store and crime scene. Once releasing the scene to them, I advised Of?cer Bondy he could leave his post. We had knowledge of at least one customer who left a wallet in the store so 1 confirmed that we were ok to locate customer purses and wallets in the store and collect them to return them to their owners. They said anything that was not related to any person involved and not in the immediatecrime scene could be collected and returned. I got the assistance of the four detectives to look around the store. One wallet was found at the paint counter and was collected and given to Det. Krall to return to the owner. No other items were found or removed. It was decided that a search warrant would be obtained for the suburban since the plates did not match the VIN. I called for the tow and then followed the vehicle to the PD where I secured it in the sally port. Once back at the PD, I removed the rifle, round and magazine from the property locker, secured it in my car, and drove it back up to Wal Mart. I turned it over to Bet. White of BCI per his request. I ?rst went to the police department to pick up some equipment and enSure the patrol operations for the street were being covered by incoming personnel. arrived at the command post at 2110 hours and was briefed by Sgt. We discussed inner perimeter and outer perimeter scene security and the status of the ongoing secondary sweep of the interior of the store. Ofc- Bondy was securing the inner crime scene evidence where the subject was shot. Other patrol units were securing the exterior of the building to prevent anyone from entering. Once the secondary search was completed, Ofc. Stull was posted at the west front entrance and started a timeline of anyone entering and exiting the scene. An of?cer was also posted at the vehicle (tan colored Chevy Suburban) allegedly used to transport the suspect to the scene. After the scene was secured, Chief Evers, Capt. S. Molnar #76 Disposition: Pending On August 5th; 2014 at approximately 2020 hrs, I responded to 3360 Pentagon Blvd. on the report of a man carrying a rifle inside the store and pointing it at innocent bystanders. At the time, I had just gotten off duty when I heard the dispatch come out over my portable radio. Due to the potential seriousness of the event, I proceeded to Wal?Mart in my personal vehicle. While en?route, I heard Dispatch state that a customer inside the store said it appeared as if the individual appeared to be attempting to load the weapon. Just prior to my arrival at Wal?Mart, I heard gt. Darkow state over the radio that shots had been ?red and he needed a medic to respond. Just a few seconds later, I heard Off. S. Williams state that the suspect was down. I telephoned Capt. I. Fiorita at approximately 2027 while err-route and noti?ed him of the incident. I heard another unit ask for a ?rst aid kit over the radio and upon my arrival, I procured a medical kit and some caution tape from a cruiser that was on scene. During this time, I also heard Off. C. Williams state that another person was down due to a medical emergency. When I entered the store, I was not Wearing a full uniform but had my badge hanging around my neck. I immediately responded to the rear of the store near the bicycle rack and located a female, later identi?ed as Angela Williamsg that was tying on the ?oor and unresponsive. She was lying on her stomach with her head to the east. i checked for a pulse and rolled her over onto her back. I could feel a faint pulse and her respirations were sporadic. Off. A. Nicley arrived just moments later with an AED. Off. Nicley and I deployed the AED and began administering CPR to Ms. Williams. The AED delivered two ?shocks? to Ms. Williams a few minutes apart and we continued to administer CPR in the interim. Medic crews arrived on the scene and took over patient care. I left that location at that time and went outside to establish a Command Post for the incident. I set up a Command Post at approximately 2043 hrs. in front of the store on the east end between Wal-Mart and Of?ce Depot. I contacted BPD Dispatch and asked for mutual aid assistance from Fairborn PD and Greene County SO. I also established a command radio channel (LE TAC 5) for all responding units. 7 Off. Minehart from airborn PD teSponded and Depuites Funk, Balonier, Tavner and Thomas responded from Greene County SO. I was advised over the radio at approximately 2049 hrs. that the immediate crime scene where the shooting had taken place was secure, At apprordmately 2053 I sent Off. Minehart and Dep. Thomas into the store in order to begin clearing the store. At approximately 2105 hrs. Deputies Tavner and Balonier entered the store and joined Off. Minehart and Dep. Thomas to ?nish clearing the store. While the officers were still clearing the store, i was noti?ed via telephone by Off. M. Stull that the suSpect had expired and the time of death was 2123 hrs. The primary search was completed at approximately 2134 hrs. and I was also advised at that time that the remainder of the outside of the building was secure. At some point, I was made aware that Off. S. Williams had tired his weapon at the suspect and I advised Lt. Rob Young, BFD, that he needed to be transported to the hespital. Sgt. Darkow accompanied him. Sgt. Hummel had arrived on scene and moved Sgt. Darkow?s patrol vehicle (135) to the command post. I noticed that Off. Williams? ri?e was in the back seat of car 135. I recognized the ri?e as his personal weapon that he was authorized to carry on duty and turned it over to Capt. Grile. At 2144 hrs. the search team re-entered the store along with Dep. Funk and his K- 9 in order to perform a secondary search. The secondary search was completed at approximately 2211 hrs. and the store was deemed empty and clear of bystanders and/or witnesses. At approximately 2227 hrs, B01851 was notified and requested to respond to the scene. The scene was secure and at 2237 I released BFD Fire/Emergency crews from the scene. At 2300 hrs, a Wright State PD unit was released who had been controlling traf?c at the intersection of N. Fair?eld and Pentagon Blvd. At 2323 hrs, 1 released Deputies Tavner and Funk from the scene. Also at that time. COPPs 656 and 653 were released from the scene. At 2338 hrs, 1 released Deputies Tavner and Balonier ?om the scene. Off. Minehart had been monitoring the rear of the store and was released at 0014 hrs. on August 6th, 2014. arrived on scene at 0018 hrs. and took control of the crime scene. Off. Upon my arrival the store was evacuated and the Medics were removing an individual. i positioned the police cruiser on the West side of the parking lot outer perimeter; I blocked a parking aisle and kept people away from the store. I asked each of them if they needed anything and assisted them switching their radios to the channel LE TAC 5. Darkow said he had dif?culty hearing the radio clue to being close when the shots were fired.
