PROBABLE CAUSE COMMITTEE RECOMMENDATION TO COUNCIL CASE no. 002-296-01 :10- 1. Said Individual is Mufti-Certified (Jailer 09f08/08; Basic 04128109). 2. Said of?cer was employed with the most recent law enforcement unit on or about 07l05i07. 3. Said officer is not currently employed by a law enforcement unit. 4-. Said officer was fifteen (15) hours short in training for 2010. . - 5. Said officer submitted a response to this investigation. (See Attachment CASE SUMMARY The law enforcement unit indicated that on or about 08/03/09, said officer violated Personnel Regulations and/or the law enforcement unit?s Procedures when heishe admitted working a secondary job without submitting a secondary employment request form. Said officer further admitted hitting the side of a civilian vehicle with his/her Asp Baton causing 'an estimated damage of six hundred fifty dollars The damage occurred while said of?cer was working ,on a secondary job. During said officer?s oral interyiew, heishe alleged that he/she was instructed by someone in the command staff that as long as he/she filled outia secondary employment form, he/she would be ok to work a secondary job. Said officer further added that the command staff he/she spoke to was fullyaware that hefshe had not successfully completed his/her probationary period. According to the law enforcement unit, said officer would not identify the person or persons who allegedly gave himfher those instructions, stating that hefshe didn't want to get anyone in trouble; then changing the statement to don?t remember who I talked to, "where they work or if they were male or female." However, the statements received from command staff contradicts said officer?s allegation. Internal affairs concluded that said'officer intentionally and deliberately concealed facts in this case by misleading the internal affairs investigator during the course of the investigation. . . .The law enforcement unit indicated that on or about said officer was provided a letter by the CEO indicating that he was considering terminating him/her for violating Personnel Regulations (PR) andlor the Law Enforcement Unit Policies; Art.7A: Fraud, Falsehood, Perjury and Malfeasance; PR 1800-2 Art. 21: Secondary Employment Approval; Art.21: Work Rule 1.03 (Conduct); and PR-1800-2 Art. 21: Conformance to Directives. - I On or about 10108109, said of?cer-was allowed by the law enforcement unit to resign in lieu of being terminated. On or about 11l22f10, at- 0630 hours, said officer was arrested by officers from another law enfordement unit for the Weapon on Schc?ml Safety Zone; and Obstruction/Hindering Law Enforcement Officer. The report indicated that said officer went on campus to use the computerlab but found out that it was closed. He/she was leaving when confronted by a campus police officer. At the time hefshe Was stopped, said officer carrying a biack bag' with two guns. The officer wanted to know why helshe was on campus and asked for hisiher identification but was told that he/she didn?t have one. When asked what was in the bag, the officer indicated that said officer turned around and started walking away. The officer indicated that he kept asking said cfficerto stop but he/she failed to compiy and continued walking until helshe got to his/her E?f?a?wm?: CASE NO. 002?296-01 ~10 vehicle. once at the vehicle, said officer placed the begin the vehicle. The officer suspected that the bag possibly Contained contraband due to the circumstances and the fact that said officer had no identification. However, once said officer got to the vehicle, he/she retrieved a wallet and provided the officer his/her identification. it was at that time the officer discovered forthe bag contained two loaded weapons. S'aid officer was subsequently arrested Weapon on School Safety Zone; and Obstruction/Hindering Law Enforcement Officer. . . . During an interview, the arresting officer determine that said officer had a permit to carry a concealed weapon but could not produce any information as to the authority to carry them on campus. Said officer informed the officer that he/she was a graduate of that college and he/she felt that 'he/she needed the weapons for self protection. Said officer was subsequently transported to the County Detention Center. On or about 11/23/10, said officer appeared. in court for the charges of Weapon on School Safety Zone; and Obstruction/Hindering Law Enforcement Of?cer. Said officer was ordered to complete forty (40) hours of community service. . On or about ,01/1 3/1 1, all charges against said officer were dismissed by the court. Said officer reported the arrest to POST per requirement of POST Rules. Said officer - .indicated that while attempting to prevent from being robbed while .on. campus to access a 24 hour computer lab,' he/she possessed two concealed firearms in a book bag at about 0600- hours. Said officer claim that the bag was illegally searched without valid consent or a search warrant. He/she reported that he/she was jailed for possessing weapons in a school safety zone and for Obstruction of a Law enforcement Of?cer for refusing to allow the officer to search his/her bag.
