(Kappa Alpha), regarding a field. Dep. TAYLOR arrived on scene at approximately 0105 hours and broadcasted over Palo Alto Communications Channel 1 that he had located the unconscious female, later identified as (V01), behind a dumpster, breathing but completely unresponsive. I arrived on scene at approximately 0106 hours and began to assist Dep. TAYLOR. The area in which we found (V01) is a student residential area, specifically fraternity houses with walkways that have ambient lighting and high foot traffic near a basketball court. I walked down a service access driveway on the west side of Kappa Alpha behind a dumpster between the Kappa Alpha and Jerry Houses. Dep. TAYLOR found (V01) lying on the left side of her body on the approximately 0101 hours Dep. ADAMS, Dep. TAYLOR and report of a female who was unconscious but breathing in a groud behind the dumpster. The front of her body was facing the Kappa Alpha House. Her head was closest to the dumpster, and her feet were furthest from the dumpster. The back of her black dress was covered in 7 pine needles. The back of her neck was visible and her long hair was 8 disheveled. knotted and completely covered in pine needles. She was 9 wearing brown boots that were still laced, with the laces tied in a 10 bow. There were zippers on the heels of her shoes that were in the 11 fully zipped up position. She was lying in a position with her feet 12 and legs bent in a 45?90 degree angle (fetal position) and her arms 13 were in front of her chest with her hands on the ground near her 14 face. She had a light grey sweatshirt that was removed from her right 15 arm, but was still on her left arm between the ground and her left 3 16 arm. The extra sweater material was bunched up in front of her on the 1? ground. Her dress was pulled on the front of her body as well, I 18 abover her waist and her lowe abdomen and pubic area was visible. She 19 was wearing a bra, however it appeared very disheveled, with part of 20 it exposed outside of her dress. The top of her dress was stretched 21 down over both of her shoulders. She was wearing a necklace that had 22 feathers as a pendant. The necklace was wrapped around all the way 23 around her neck so that the pendant portion was now centered on her 24 back. 25 26 I saw what appeared to be a pair of womengs white thong underwear 27 that was wadded up approximately 6 inches from her stomach. TAYLOR stayed with the unconscious I 12 female. I ran approximately 25 yards and found two male subjects i 13 physically restraining another male subject, later identified as 14 on the ground. One of the males, later identified as 15 was straddling on the ground and holding 1 16 both of his arms down. The other subject later identified as 1 17 was sitting on top of legs. Two other male I 18 subjects later identified as and were I I 19 nearby offering assistance to 20 21 I asked what was going on and (WOIJJONSSON said awe found him on top 1 22 of the girl; and pointed back towards the direction of (V01). 23 remained silent. I told to get off of 24 so that I could place handcuffs on to detain 25 him while I figured out what was going on. 26 27 had a strong odor of an alcoholic beverage emanating from 28 his person. I noticed that his pants seemed disheveled around his 29 crotch area and he had what appeared to be a buldge 3O consistent with an erect penis underneath his pants. He complied and I subsequently placed in 9 handcuffs and escorted him back to my patrol vehicle. 10 stumbled when walking but seemed coherent enough to 11 comprehend what I was saying and complied with my requests. I i 12 conducted a pat search of with negative results. I 13 ensured the handcuffs were double locked and checked for a proper 14 fit. I placed him in the back of my patrol vehicle and again advised 15 him he was not under arrest at this point, but being detained. I told 16 and to wait in 17 an area adjacent to my patrol vehicle so they could be identified and 18 talked to. i 19 20 In total, I took 42 photographs of where (V01) was found, the i 21 immediate scene surrounding her and later of I 22 downloaded these digital photos onto a CD and booked it into SUDPS 23 Evidence Locker 10. Palo Alto Fire Department Engine 66 and Medic 62 24 arrived on scene and began treating the unconscious female. 25 26 Dep. PAFD Medical personnel advised that the unconscious female was severely intoxicated and they were going to transport her to Valley Medical Center. Dep. TAYLOR accompanied the female onboard Medic 62 to Valley Medical Center. She was still completely unresponsive and unable to answer any questions. I contacted who was waiting near my patrol vehicle as I had requested. I interviewed him separately from the other witnesses and asked that he not discuss the incident with anyone else until after I had spoken with each witness individually. was identified by his Identification card should be noted that several times throughout giving his statement, It became very upset, to the point where he began crying while recounting the incident. He had to stop and take several deep breaths before being able to resume giving me his statement. He said it was a very disturbing event for him to witness and be involved in, but he just reacted to the situation at hand without really thinking. However, said as he kept riding by, he 7 noticed that the female laying on the ground was not moving and 8 asomething seemed weird; about the situation. When asked to elaborate 9 about what seemed weird, he just said that he got a weird feeling 10 about it because it looked like the female was asleep or 11 unconscious. I 12 He started riding slower and began looking intently at the male and I 13 female. He could tell that the female appeared to not be moving at 14 all and he was sure something was wrong. told 15 they needed to check and make sure everything was ok. 16 17 and got off their bikes approximately 10 yards 18 away from and (V01).
