COLORADO 80203 Tel: 303-866-3299 Fax: 303-866-2530 - CHARTER SCHOOL INSTITUTE MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into as of 2 20 43?, by and between the State Charter School Institute and Adams 14 District ("District"). CSI and the District agree as follows: 1. Nothing in this Memorandum should be construed to affect the District? 5 exclusive chartering authority; the District in accordance with statute retains exclusive chartering authority within its geographic boundaries. 2. Within 30 days of full execution of this Memorandum, the Adams 14 Board of Education shall, without prejudice or waiver of any rights, rescind Adams 14 Board of Education Resolutions 14? 021 and 14-023. 3. As needed and determined jointly, CSI staff will provide the following services for the District. Any necessary direct cost fees to be determined separately as needed: a. Development and implementation of new charter school procedures and materials based on CSl's system (including but not limited to: a Call for Applications, new school application, rubric, reviewer orientation, community meeting protocols, applicant interview methods, recommendation reporting, resolution drafting, contract negotiation, milestone development, new school onboa rding, year 0 readiness evaluation, year 1 accreditation, etc.) b. Development and implementation of charter school development materials and procedures for the District based on CSl's system (including renewal, expansion, replication). c. Development and implementation of charter school annual review and evaluation materials and procedures for the District based on CSI's system. 4. CSI, consistent with model authorizer practices, will rigorously monitor and investigate as deemed appropriate by CSI, the CSI authorized charter schools (currently authorized within the District?s boundaries) operations and will implement a comprehensive accountability system that addresses the uniqueness of charter schools, including evaluation and monitoring of student performance, operations, governance and ?nances. In the event that a charter school authorized by CSI in the District requests any material revision1 of the terms of the charter contract that would have an impact on the District, including closure or renewal CSI will: 3. Provide the School?s written application to the Adams 14 board and staff, with at least 45 days? advance notice; b. Consider written and verbal input from the District and community members concerning the prOposal as a part of the CSI comprehensive review procedures and before acting on the proposal; c. Participate in a community meeting at a District venue during which the School (School staff and at least one member of the School?s board) will present to and take questions from the community (CSI staff and at least one representative of the CSI board will participate); 6. CSI will work collaboratively with the District to address any student-level issues including but not limited to student records, student transfers, discipline, and special education transition for students attending a charter school authorized by CSI in the District. 7. Charter schools authorized by in the District will be allocated the appropriate amounts of per pupil funding based on the Colorado Department of Education funding formula for CSI schools located within District boundaries in accordance with law. The charter school will be responsible to provide state or federally mandated services, including special education services, Section 504 accommodations for students and members of the public, food and transportation services as appropriate and as required by law. 8. Charter schools authorized by CSI in the District may contract on a fee basis with the District, subject to approval by, and at the sole discretion of, the District, for the provision of services, including but not limited to special education services, transportation, food services, facilities, and technology. 9. Academic scores and other mandated reporting data for charter schools authorized by CSI in the District will be reported as part of the lnstitute?s aggregate and summary performance scores and other reports, in accordance with state rules and law. District agrees to transfer any and all student records and other academic and ?nancial data to the Institute in a timely manner on an as needed basis.
