Thomas Street as, wausau, wt 54401 go; NARRATIVE Did Victim(s) Give Permission for Crimes to be Committed NIA On 10f12f06 at 0335 hours, Of?cer Pekarske (061) and I were dispatched to the above address in reference to a possible overdose. Arrival on Scenea?Initial Interview of Matthew S. Schuster I entered the apartment complex and observed several Wausau Fire Personnel inside the room. As I entered I observed a male, later identified as Matthew S. Schuster (DOB 06f11f83), standing in the center of the room. I also observed a female lying on the twin size bed who appeared to be unresponsive. The female was later identi?ed as Angela M. Colby (DOB UQIUWSB). The bed was against the north wall of the room, and Angela was lying on her back against the wall. Angela?s head was pointed towards the east, and her body was parallel to the wall. The apartment was approximately 12' 12' and only contained one room. Their was a refrigerator and a small dresser against the west side wall. There was a rod fastened to the east wall, which was holding several Clothing items that were on hangers. I observed several food items and dishes on top of the refrigerator and also several clothing items on the ?oor around the room. In the center of the floor, I observed a small stand with a TV that was currently turned on. I heard ask Matthew several times they could treat Angela. Matthew was crying and kept saying ?no don?t tell me.? After being asked several more times to leave the room, I had to physically direct Matthew out the door and into the hallway. Of?cer Pekarske entered at this point, and I requested he take Matthew outside away from the room. Due to the small size of the rooms, EMT Mitch M. King removed Angela from the bed and into the hallway on their cot to continue medical treatment. I later asked Mitch to provide a written statement about his observations when entering the room, and provided him with a written statement form. Mitch advised he would ?ll out the form on his next shift, and drop it off at the police department when complete. continued to work on Angela for approximately 20-25 minutes. While this going on, I requested Lt. Juedes (862) respond to the scene. Despite their best efforts, they were unable to resuscitate Angela. Wausau Fire personnel requested dispatch to contact the coroner and have them respond to the scene. Due to the cold weather, Officer Pekarskc escorted Matthew upstairs to keep warm. I went upstairs and noti?ed Matthew that Angela had passed away. Matthew immediately began to ask if I was joking, and began to cry. I advised Matthew again that the were unable to resuscitate Angela. Matthew asked that I contact his mother and ask her to come to his residence. I contacted his mother and advised her of what had happened. She stated she would come, but did not know where Matthew lived. She advised she knew where the police department was, and I told her to meet us there. While I was on the phone with Matthew?s mother, I heard Officer Pekarske request me to come back upstairs right away. Once upstairs, we had to physical restrain Matthew to keep him from coming downstairs. Matthew said he wanted to see her, but calmed down after being told his mother was on the way. Matthew provided of?cers with a statement about what had happened. I was informed by Of?cer Pekarske that a probation hold was placed on Matthew and he would be transported to jail (see Of?cer Pekarske?s narrative for details). Interview with Julie A. Schuster-I?Ieinrtz After I called, Julie responded to the Wausau Police Department to meet with Matthew. Once at the department, Of?cer Porath spoke with Julie (see Officer Porath?s narrative for details). Processing of SeenefInvestigation Wausau Fire personnel requested dispatch contact the coroner to respond to our location. At 0437 (Tirburon time) hours, Deputy Medical Examiner Jean Finelyarrived on scene. I advised Jean of the information currently available surrounding the incident. After examining the body, Jean advised Angela?s body would be transported to Madison for an autopsy. Jean advised the time of death would be noted at 0435 hours (according to her watch). At 0513 hours, Detective Hansen arrived on scene. Detective Hansen began to process the scene and collect evidence (see Detective Hansen?s narrative for details). Witness Interviews The following interviews are from the other tenants of the apartment building. Detectives Weckworth (812) and Knapp (803) are currently interviewing the remaining residents (see their narratives for details). Interview ofPeggy A. Bronson I spoke with Peggy A. Bronson (DOB 09(15i?47?) who advised she lived in apartment 1. Peggy stated she had a cold and could not hear anything over her own coughing. Peggy said she did not hear or see anything unusual throughout the evening. Peggy said she did not know Matthew and that he had just moved in. After Speaking with Peggy, I knocked on the door of apartment 5. Peggy saw me knocking and advised Arnold was not there. Peggy did not know any other information about him, except his name was Arnold. She advised Arnold stays with his sister for several days at a time and was not there last night. Peggy said you would knowif Arnold was home because he tends to pace the halls. [Merriam-v ofJumes K. Hanson I spoke with James J. Hanson (DOB 05128;!62) who advised he lives in apartment 3. James said he did not see or hear anything strange or unusual, and that he had not woken up throughout the night. James said he met Matthew once and only said James advised he never saw anyone with Matthew at the apartment building. Interview of Scott L. Evnason I spoke with Scott L. Evenson (DOB 07130i?69) who advised he is the apartment manager and lives in apartment 10. Scott said he had been home for the last 24 hours, and did not hear or see anything strange or unusual. Scott said Matthew moved in only a couple days ago and that he lives alone in the apartment. He last saw Matthew at 11: 00 a.m. (10f11f06) with Angela, as they were returning with several Walmart bags. Scott advised he only woke up once throughout the night, and that was to the noise of the fire and police departments. Interview ofJoeI M. Duske 1 spoke with Joel M. Duske (DOB 082053) who advised he lives in apartment Joel?s apartment is next door to Matthew?s apartment. Joel advised he went to sleep at 10:00 p.111. and heard nothing at all throughout the night. Joel said he only woke up (around 6:00 am.) because he had to go to the bathroom. Joel advised he never met the neighbor, because hejust moved in. Joel advised he saw Matthew and Angela on 10ft U06 at approximately 4:30 pm. Joel also stated that Angela was the only person he ever saw at the apartment with Matthew. Crime Scene Log On my arrival, several personnel from Wausau Fire Department were already on scene. All of the ?re personnel except for Tom, advised they had entered the room while rendering medical aid to Angela. I identi?ed the personnel as the following: Mitch M. King Brad M. Ludwig Jennifer J. Sharp Tom J. Gipp On my arrival, Angela was removed from the room and into the hallway. After she was removed from the room, I took custody of the room to make sure no one entered or exited. Olson #053 When I left the scene at 0948 hours, I was relieved by Of?cer Timken I turned over a crime scene log to Of?cer Timken when he took custody of the scene. Noti?cation of Kelly J. Ketchm Lt. Bliven (001) advised he was able to locate Angela?s mother who was identi?ed as Kelly J. Ketchm (DOB 08! 18f66). Due to Kelly living in Wisconsin Rapids, Lt. Bliven contacted the local police department who noti?ed Kelly of Angela?s passing. Lt. Bliven also advised Angela?s father was also contacted (see his narrative for details). Information from Stevens Point Police Department I spoke with Of?cer Porath who advised Julie (Matthew?s mother) made mention of a possible incident between Matthew and Angela that happened in Steven?s Point where police may have been contacted. Of?cer Porath further advised that Matthew?s probation agent would know about the incident. I contacted Steven?s Point Police Department and spoke with a dispatcher. was advised there was only one contact in their records involving both Matthew and Angela. The contact was entered as a traf?c accident, where Angela was listed as ?other? and Matthew was listed as ?arrested.? The dispatcher was unable to provide any other details about the incident, but provided me with a case number of (106?08235. I requested Marathon County Diapatch to send a TTY to Steven?s Point Police Department to request a copy of (306-08235 be faxed to the police department. I was advised the request was sent, with instructions to have the report forwarded to Detective Hansen. Additional Information I took pictures of the interior of the room prior to Detective Hansen?s arrival= which were entered into evidence (see attached photo log). . I contacted the Wood County Sheriff?s Department. I was told they were able to identify Angela?s mother as Kelly J. Ketchm. I asked them to make the death noti?cation to Kelly. At approximately 0645 hours, I received a phone call from the Wood County Dispatch that the noti?cation was made to Kelly by two Wood County Deputies. At approximately 0700 hours, i received a phone call from Kelly Ketchm. Following is the information gave to Kelly: Angela?s boyfriend called 91] between three and four AM advising Angela had overdosed. Of?cers and Fire Department personnel responded to the apartment and were unable to resuscitate Angela. I told Kelly that the investigation was still continuing as to the cause of death. Deputy Medical Examiner Jean Finley requested the information to call Kelly. 1 provided the information to Ms. Finley and I contacted Kelly on Ms. Finley?s behalf. Kelly told me she would notify Angela?s father, David V. Stoner, of Angela?s death. Thomas St. for a report of an overdose. Matthew S. Sehuster 06-11-83 reported that his girlfriend Angela Colby 09-04-83 had overdosed. During the course of the investigation I had contact with Schuster?s mother, Julia A. Schuster?Heinritz 0841-53. I interviewed her to gather information on Schuster?s relationship with Colby. Schuster?Heinritz said that Schuster and Colby had been dating for approximately a year. She said that they had previously lived together in Stevens Point. She said Schuster had told her that Colby was on medications for asthma and depression. She said she thought the depression medication was Paxil. Schuster-Heinritz said Schuster had told her he really loved Colby and he had even talked . about marriage. She said she was surprised that Colby had stayed with Schuster for so long, given all of the trouble Schuster had been in. She said she would be surprised if Colby overdosed on medications. She stated that Colby would get upset with Schuster when he ?misused? his medications. Schuster-Heinrita said that Schuster suffers from Post Traumatic Stress Disorder (PTSD). She said that the PTSD was a result of his service in the US Army. Schuster?Heinritz said that Schuster served in the 101st Airborne in Afghanistan. She said that he has always been very emotional, even more so after leaving the Army. She added that she has never known him to be violent, especially towards Colby. Schuster?Heinritz said that Schuster did tell her though that Colby had accused him of striking her. She did not know the particulars about the incident, but said Schuster?s probation agent knew about the incident. Olson and I arrived on scene shortly after the Wattsau Fire Dept. EMS crews had arrived. As I entered the front door of the location, Ofc. Olson began to direct a male party towards me and asked me if I could escort this individual outside. The male appeared to be visibly upset and crying as he stepped outside with me. This male party was later identi?ed as Matthew S. Schuster (DOB 06:? 1133). I began speaking with Schuster outside in an attempt to gather information as to what had occurred this evening. Due to Schuster?s lack of appropriate clothing for the cold weather conditions, I escorted him to the second ?oor of the building where he took a seat on a chair in the hallway. 1 then continued our conversation in an attempt to gather information. Interview with Matthew S. Schuster (On Scene) As Ofc. Olson and the EMS crew remained downstairs with the patient; I stayed with Schuster upstairs in the hallway and began speaking with him to determine the events that had taken place this evening. Throughout my entire contact with Schuster, he remained visibly upset and was crying and shaking; at times to the point where he could no longer carry on a conversation with me. Schuster also had slurred speech and appeared tired and at times I had to repeat my questions numerous times in order to obtain a response. Schuster verbally identi?ed himself to me and also stated that he was the person who had called 9?1-1. Schuster said that he called 9-1? 1 because he had woken up in the middle of the night and had found that his girlfriend?s body was cold and that she did not have a pulse. Schuster then identi?ed his girlfriend as Angela M. Colby (09K04r?83) and stated that she was the female patient that the EMS crew was attending to. During our initial conversation Schuster asked me repeatedly, ?is she dead, is she dead?. I was unable to answer him at that time as I was unaware of what events were taking place downstairs. After I was able to identify Schuster and Colby I then asked Schuster what had happened this evening. Schuster told me that Colby must have overdosed on pills while he was sleeping. I then asked Schuster what type of pills he thought she had taken and Schuster said Oxycodone. Schuster said he was prescribed Oxycodone as a pain medication for a back injury. I asked Schuster if he knew how many pills Colby had taken and he said maybe one or two. But he then stated that she was not the type of person who could handle pills and that one or two may be too many for her. I asked Schuster how he knew the number of pills that Colby had taken and he stated that it appeared there were maybe one or two pills missing from his bottle of Oxycodone. I also asked Schuster how did he know that Colby had taken an overdose of pills and was unable to answer my question and stated, don?t know, what else could it be?. During my initial questioning Schuster was very vague and fragmented with his answers and he also appeared to be very upset and would often break his thoughts mid-sentence in order Colby was OK. Schuster stated that they had met about one year ago and had been dating ever since. He stated that Colby lives in Stevens Point. During this conversation Schuster often broke from my questions and began explaining to me that he has post traumatic stress disorder that occurred from the time he spent over in Afghanistan in the service. He also stated that he takes a variety of different medications for anxiety and depression. Schuster said that he had taken his medications tonight as directed. Schuster then returned to my original questions and stated that him and Colby got along very well and did not fight. He stated that they have a lot in common as they have both experienced issues in the past. Sehuster stated that Colby appeared normal today and had never made any mention of being depressed or that she had wanted to kill herself. Schuster told me that everything had been between him and Colby and that they were talking about possibly getting married this spring. I then asked Schuster to explain the events to me from today and what had led up to us arriving at his residence. Sehuster stated that he and Colby had been hanging out together all day and that she had spent the night last night as well. Schuster said that they did not really do anything on Wednesday theyjust ?chilled out? and watched TV most of the day. Schuster stated that he had taken his ?seraquil? (he was unsure how to spell this) pills and that this medication often times makes him tired. Schuster stated that he and Colby were lying together in bed watching TV and that he began getting tired and than he eventually feel asleep about 10 or 1 1 RM. Sehuster said that as far as he knows, Colby was awake and OK when he fell asleep. Schuster then told me that he woke up about 3 AM. and saw that Colby was sleeping. Schuster said that he was hungry so he got up and get some cereal. Schuster then left the room to get some food and then returned to the bedroom to eat. Schuster stated that after he finished eating he tried to wake Colby up and she would not get up. Schustet? said he then grabbed his cell phone and called 9?1?1. Schuster stated that he talked to the 9-l-l dispatcher for what he though was about 10 minutes before we arrived on scene. Schuster then said, ?that?s it? and ended his account of the events. At this time ch. Olson came upstairs and spoke with Schuster and advised him that the EMS crew was unable to revive Colby and that she had died. Schuster became even more upset and began crying loudly and stated that this could not be happening. Ofc. Schuster Upon arrival at the PD, Schuster was escorted to Interview Room #3 and I explained to him the process for the statement. 1 then opened up the WPD statement form on the computer and entered the appropriate information into the header section. Prior to having Schuster give his statement, I turned on my Dictaphone and placed it on the table in front of us and advised Schuster that I would be recording our conversation and Schuster stated that was ?ne with him. The media card from the Dictaphone was submitted as media evidence. I then asked Schuster to provide me with his account of the eventsjust like he had told me while we were on scene. Schuster?s speech was slurred and he was talking very fast. Additional he was often times dif?cult to understand as he kept putting his head down and placing his hands in front of his month. Also Schuster?s mood changed often and at times Schuster would be crying, then his attitude would change and he appeared to act and speak out of anger. Even though Schuster?s mood changed often he continued to be cooperative with me and attempted to answer my questions. Schuster then provided me with a brief account of the events which I typed onto the statement form. I had to have Schuster repeat himself often as he was talking very fast. The oral statement that Schuster provided is the ?rst paragraph on page one of the typed statement form. I then advised Schuster that I would be asking him a series of questions and that I would he typing his responses. Schuster stated that this was ?ne with him and agreed to answer my questions. I then typed my questions and labeled them on'the statement form with a I then read the questions to Schuster and typed his responses, which were labeled with an As Schuster was replying to my questions he again was dif?cult to understand and I had to have him repeat his answers numerous times in order to document what he was saying. Numerous times during questioning we had to break in order to obtain consent to search permission from Schuster in order for of?cers on scene to gather additional information and evidence. Schuster signed the consent forms freely and voluntarily. Also during the question and answer portion of the statement, I was advised by Ofc. Porath that Probation and Parole in Madison had authorized a probation hold on Schuster. At this time Ofc. Porath then read Schuster his Miranda rights, which Schuster stated that he understood. Hansen would like me to ask Schuster if he would give us consent to draw his blood for testing of substances that cause impairment. I then filled out a permission to search form, specific to obtaining a sample of Schuster?s blood for substances that cause impairment. I explained the consent to search form to Schuster and he stated that he understood this and that he would have no problem with us obtaining a sample of his blood. Prior to placing Schuster in the patrol car, Ofc. Porath'secured Schuster in wrist restraints as he was in our custody and would be going to the Marathon County Jail on a probation hold. Thomas St, apartment We were asked to attempt to make contact with the occupants of the other apartments in the same building to see if they, the peopletperson residing there, may have any information that would pertain to this investigation. On our arrival at 242 E. Thomas St. we spoke with Of?cer Brent Olson, who had been assigned to watch the apartment entry. Of?cer Olson told us he had already spoken to the persons living in apartment numberstold us he had been told by the person living in apt. #1 that the person living in apartment #5 (Arnold) was not around at all last evening or this morning. This person told Olson that had Arnold been around, you would know it because all he does is pace up and down in the hallway. There are 14 one room apartments at 242 E. Hansen with a death investigation by attending an autopsy at the Madison VA Hospital. The autopsy was on Angela M. Colby (DOB: 09-04-83). I traveled to Madison with CDME Jean Finley and Colby. The forensic autopsy began at about 10:40 am. and ended at about 12:00 pm. Through the autopsy, there was no anatomic reason found for Colby?s death. Colby?s stomach contents contained numerous small coarse granular items which were light in color. The items would be consistent with the ingestion of crushed-up pills. Mrs. Ketchum likes Matthew Schuster and felt that Matthew and Angela made a good couple. Angela loved Matthew and was looking forward to a future with him. Angela and Matthew are a good match for each other because they both suffered from depression and understood the difficulties associated with it. Matthew would help Angela and Angela would help Matthew. Mrs. Ketchum stated, if Angela took Matthew?s pills, Matthew did not know about it. I informed Mrs. Ketchum Matthew admitted to allowing Angela to take his medication. Even with this information, Mrs. Ketchum said it was an accident, and did not appear to have any animosity toward Matthew. I asked Mrs. Ketchum if she was aware of Angela?s use of prescription medication for pain. I was informed that Angela called her mother last Monday and complained of severe neck pain. Mrs. Ketchum met with Angela and provided over the counter medications and a neck massage. Angela was also diagnosed with endometriosis as a young teenager. The result of the endometriosis was extreme pain and cramping during Angela?s menstrual cycle. Angela would be in bed for days during her period. Mrs. Ketchum stated, it would not surprise her that Angela took pain pills during her period. I was also told Angela was raped several years ago and spent one day in the mental health unit of St. Michaels Hospital in Stevens Point. The caller, Matthew S. Schuster mr'w 06-11-83 told dispatchers that he was unable to wake his girlfriend, Angela M. Colby 09414-33, and she may have taken some pain pills. EMS crews attempted resuscitation without success. Matthew Schuster admitted in an interviews that Angela Colby took some of his prescription medications. INITIAL POLICE RESPONSE 1 Officers, Olson, Pekarskc, Folder, and Porath responded to 242 E. Thomas St. Wausau WI after being dispatched for an unresponsive female. The of?cers arrived shortly after the EMS crew was on scene. Angela Colby was found on a single bed in the one room apartment. Matthew Schuster told the ?rst paramedic on scene that he believed his girlfriend; Angela Colby, had overdosed on medication. Thomas St. #6 and met with Of?cer Olson, paramedics, and Chief Deputy Medical Examiner (CDME) Finley. Angela Colby had been pronounced dead at 04:35 am. CDME Finley briefed me on the circumstances of the death. According to CDME Finley, she found evidence of possible petechia in Angela Colby?s lower eyelids. Petechia is a minute red or purple spot found on the surface of the skin as the result of tiny hemorrhages of blood vessels in the skin. When petechia is found on the eyelids, it can be the result of suffocation or While at apartment Finley and I saw empty prescription bottles in the garbage next to the refrigerator. Matt Schuster had told of?cers that he was prescribed numerous drugs for Post Traumatic Stress Disorder, anxiety, and depression. Matthew Schuster is a disabled war veteran. Several prescription bottles with Matthew Schuster?s name containing pills were found in the dresser. I spoke with of?cers again regarding the interview with Mr. Schuster. The body was then transported and released to the Taylor Funeral Home, Wisconsin Rapids. SEARCH WARRANT FOR 242 E. THOMAS ST. #6 There was concern as to Mr. Schuster?s ability to make decisions. It appeared Mr. Schuster could be impaired from the prescription medications he took. After speaking with of?cers that interviewed him, Mr. Schuster agreed to submit to a blood test to determine if he was under the in?uence of any intoxicants or drugs. A search warrant to search 242 E. Thomas St. #6 was obtained from Circuit Court Judge Branch 11, Greg Huber and signed at 09:56 am. A copy of the complaint for search warrant, the search warrant, and return of of?cer is attached to this report. WARRANT EXECUTED Detective Barnes and I executed the search warrant at 242 E. Thomas St. #6 Wausau at 10:35 am. Items seized included prescription drugs, empty prescription drug bottles, towels, a broken light fixture cover, partial pieces of pen tubes, and writings from Matthew Schuster and Angela Colby. The execution of the warrant was ?nished at 12:22 pm. The items were taken and packaged at the Wausau Police Dept. as evidence. INTERVIEW OF MATT SCHUSTER AT POLICE DEPARTMENT Detective Barnes and I interviewed Matthew Schuster at the Wausau Police Department in interview room The interview was audio recorded with a Dictaphone. Detective Barnes was the primary interviewer and assisted with notes. Matthew Schuster voluntarily signed a waiver and agreed to answer questions. Mr. Schuster was all ready in custody on a probation hold. Matthew conveyed the following information during the interview. Some of the information was disclosed after being asked speci?c questions. Some of the information was disclosed without being solicited by questions. Matthew Schuster was extremely emotional during the interview and had a great deal of difficulty answering questions at some points. Angela was staying at his apartment beginning Monday, October 09, 2006. Angela took some of his prescription medications including Paxil while he was sleeping. Matthew looked at the pills in his Oxycodone bottle and thought some of the pills were missing. Matthew thought that Angela had physical signs of overdose. Matthew stated that he knew this because he had overdoscd in the past and knew the signs. From the time Angela stayed with Matthew on Monday she took Oxycodone. It is unclear about how many of the pills Angel took. Matthew began saying that she took one pill a few days prior to that day. Later, Matthew admitted that he knew Angela ?took a whole bunch?. Matthew stated that Angela had also taken Xanax, and Valium, medications that were prescribed to him. The medications had been consumed in the days immediately prior to her death. Matthew could not remember if he took too many pills on October 1 l, 2006 or if' he just took the amount prescribed. He could recall taking whatever pills he was supposed to take and then he passed out. Matthew stated after he takes his medication at night to go to bed he passes out. Matthew could not recall all of the events of the evening of October 11, 2006 including what he and Angela ate for dinner or what they watched on television. Angela was awake when Matthew took his medication before bed time. Angela asked Matthew for some medications to take home with her. Matthew told her that he did not want her to get caught with them. Angela told Matthew that she wanted to sell some of the medications. Matthew refused to give them to her. Angela became angry and began to pout. Angela went to one corner of the bed and watched television. Matthew went to sleep. Matthew stated that she had asked for medications in the past and he refused her. Matthew described Angela?s use of medications as ?addicted to having a good time?. Matthew said it was not a problem with taking the pills. Matthew has discussed Angela's pill taking with her mother in the past. Matthew stated that Angela was slurring her words after taking medications and he acknowledged that she was impaired. Matthew told Angela that the medications were dangerous and he discouraged her from taking them. Matthew and Angela went to sleep after saying good night to each other and went to sleep cuddling. Matthew was on the window side of the bed and Angela was on the television side of the bed. Matthew described how he checked Angela for vital signs and shook her. Matthew called into Angela?s ear to try to wake her. Matthew called emergency services when he knew there was a problem. Matthew talked about Angela taking Oxycodone for any kind of pain, notjust physical. Matthew has gone through drug rehab for taking pills for the wrong reason. Matthew stated that Angela had been prescribed Paxil but did not have a health plan and she took some of his Paxil. Angela was out of her prescription Paxil. Angela also took his prescription Xanax and Valium. Matthew did not know how many of each pills Angela took. Matthew changed the number of pills he thought Angela took from one pill per night in the last few days to 10 pills over the previous 4 days. Matthew stated Angela took 4 Valium before bed that day. There was no alcohol involved with taking the pills. Angela did not bring any medications with her to Matthew?s apartment. Matthew stated that Angela would take one pain pill and when she started to feel that it was wearing off she would take another. Angela would continue to take more pills when she felt like the last pill wore off. Matthew told Angela that the pills were still working. Matthew stated the he received $2500 per month for his disability. Angela did not work and he gave her money. Matthew did not know how long Angela had been taking his Oxycodone. When Matthew left the room to use the bathroom, Angela would be sitting next to his dresser drawer where he stored his medication. Matthew gave her 10 pills to use at a later date for when she had had pain from her menstrual cycle. Angela wanted to take the pills ?to party?. Matthew gave Angela the pills to pacify her because she would become angry if he did not give them to her. Matthew told Angela that the pills were bad for her but he would give in to her demands after some time. Matthew broke down crying during the interview and he expressed extreme sorrow for her death. At one point Matthew said that he didn?t want herto die and he would have died for her. He wished that he would have died. Matthew thought that Angela took pills while he was sleeping. Matthew stated that he gave her some pills but not enough to hurt her. Matthew stated he takes his pain medication because he was shot in the back while he was in Iraq which required major spinal surgery. Matthew stated that he knew Angela was snif?ng the pills. It should be noted that pieces of cut up pen tubes werefaand in the apartment. The pens were asedfor snorting the medications. Matthew saw Angela cutting up a pen and he told her not to do that. Matthew told her not to use the medications in that manner and they should be taken orally because it was dangerous to snort the medications. Matthew saw her snorting the oxycodone ?a couple? times in the previous days. Matthew asked to be transported to the unit at VA hospital in Tomah WI. He stated he was experiencing ?ashbacks and talked about losing his best friends in Iraq. Matthew stated he was unable to handle what was happening. Matthew told dispatch that his 23 year old girlfriend was not breathing and was not responsive. Wausau emergency medical units responded and found Angela M. Colby ?w 09-04-83 inside apartment #6 at 242 E. Thomas St. Wausau WI. Angela was lying on a single size mattress in the one room apartment. Medical responders attempted resuscitation and the efforts were not successful. Wausau Police Of?cers responded to the scene. Matthew Schuster was extremely distraught and acting out uncontrollably. The medical workers orderedSchuster to stay away while performing their duties. Of?cers had to restrain Schuster to prevent him from interfering with the med crew because he was not following orders. Chief Deputy Medical Examiner Jean Finley pronounced Angela Colby deceased at 04:35 am. The following information was conveyed by Finley. Finley found possible evidence of petichae in the lower eyelids which could indicate possible suffocation or The oral airway was ?lled with mucus when the endotracheal tube was placed by the EMS personal. There are no physical signs of trauma such as ligature or strangulation marks. There was no visible bruising at this point so strangulation cannot be ruled out. The face had fresh blood on it from the intubation. The pillow and sheet on the bed she was ?sleeping? in was wet and has stainsthat are suspected to be gastric contents and possibly blood. The face was congested and the skin tone was somewhat dark. Matthew Schuster voluntarily came to the Wausau Police Dept. to give a statement. Matthew gave consent to of?cers to search the apartment. Matthew is a war veteran and suffers from post traumatic stress As a result of the medical problems, Matthew is under the care of a physician and takes numerous prescription drugs. Matthew displayed a vast array of emotions during an interview from uncontrollable distress to a display of no emotion. At that time he was not considered a reliable witness and his ability to render decisions was questionable. According to of?cers that interviewed Matthew Schuster, he had scratch marks on his face. It was not irmnediately certain what the cause of the scratches were to the face. Schuster told of?cers that Angela Colby could have died from an overdose of drugs. Schuster claims that he was with Colby the entire night prior to her death and did not see her ingest any drugs. While of?cers were asking Schuster questions, he deviated from one subject and began talking about he checked Angela Colby?s pulse and placed his hand over Angela?s face for 30 seconds. Schuster demonstrated by placing his own hand over his own face. Schuster then returned to the previous question. The sudden rendition of that event could not be explained. Of?cers asked Schuster to elaborate on his actions when he placed his hand on Angela and Schuster changed the subject. . There were no robvious signs of a struggle in the apartruent. After a cursory search of the garbage can, a broken light ?xture cover was found in the garbage can next to the refrigerator. The overhead light ?xture cover was missing indicating the broken ?xture cover in the garbage can was likely from the over head light. Several empty prescription pill bottles were found in the garbage can. A search warrant is being requested to further investigate the facts surrounding Angela Colby's death. Some items were recovered from the room at the time the body was removed.
