Derek McGovern was arrested for OMVWI 2nd and was cited for Fail/Yield for a Yield Sign. McGovern was released to a responsible party. Assignment Dispatch advised that a two car accident was reported at East Saratoga Street and Woodard Avenue. Sgt. Weaverr Officer Jones, FTO Officer Kenworthy and Ir Officer Staf ford. responded . Contact with Derek J. McGovern FTO Officer Kenworthy and I arrived on scene. I observed a silver Chevy Cavalier in the front yard of 620 Woodard Avenue. There was a male lying on the ground in the boulevard in front of 620 Woodard Avenue. I observed another dark in color Dodge Intrepid in the middle of the 600 block of Woodard Avenue. I made contact with the male lying in the boulevard, Identified verbally as Derek J. McGovern. McGovern had blood above his right eye. I asked McGovern if he was alright and if he needed an ambulance. He said he was fine and did not need an ambulance. I asked McGovern what happened. McGovern said he was traveling north bound on Woodard Avenue when he came to the intersection of Woodard Avenue and Saratoga Street. He said he tapped his brakes and proceeded into the intersection. McGovern said he did not see the vehicle coming from the east on Saratoga Street. He said he was struck and his vehicle ended up in the yard at 620 Woodard Avenue. - McGovern said he was traveling at a speed of approximately 30 MPH hour and that he was wearing his seat belt. The speed limit on Woodard Avenue is 25 MPH. I ended my contact with McGovern. Contact with J. Johnson I made contact with a witness, identified verbally as J. JohnSon. I asked if she saw what happened. She said that the Cavalier was traveling north bound on Woodard Avenue and the Intrepid was traveling East bound on East Saratoga Street. said she looked away for a second and heard a bang. I shut off my emergency lights. I explained to McGovern that I was going have him ?administer a field sobriety_test. Horizontal Gaze Nystagmus (HGN) Test I turned McGovern around so he was facing my squad oar.' I put McGovern in the instructional position of the HGN test. I explained the test to McGovern and he stated he understood. I did not observe any clues. I told McGovern to stand by the sidewalk while I speak with Sgt. Weaver. I discussed my findings with Sgt. Weaver and he told me that it is possible for McGovern not to show any Nystagmus because he had taken a narcotic {Oxycodone) earlier. Sgt. Weaver told McGovern to walk over to our location. McGovern complied. Sgt. Weaver looked at McGovern's eyes then at Officer Kenworthy's eyes. Sgt. Weaver told McGovern to sit down on the bumper of my squad car. McGovern complied. Sgt. Weaver explained that he was looking at McGovern's pupils to see if they were big or if they were constricted. I walked over to McGovern and shined my light just under his eyes. I observed his pupils to be constricted and his lids were half closed. McGovern looked very drowsy. I looked at Officer Kenworthy's eyes for comparison. Note: McGovern was unable to perform the Walk and Turn test and the One Leg Stand test due to him having surgery on his right knee. Arrest Based on the facts that McGovern admitted to consuming alcohol, taking Oxycodone prior to consuming alcohol and constricted pupils I made the decision to place McGovern under arrest. I placed hand cuffs on McGovern, checked them for fit and double locked them. I placed McGovern in the back of my squad car. I was unable to place a_safety belt on McGovern due to the fact that he had to sit across the backseat because of his right knee. After I placed McGovern under arrest he decided that he wanted to go to the hospital and get checked out. I transported McGovern to vTomah Memorial Hospital (TMHJ. OMVWI Processing We arrived at THE. I assisted McGovern getting out of the backseat of my squad car and into TMH. While at TMH I issued McGovern a citation for OMVWI 2nd. I then read McGovern the Informing the Accused.
