On Saturday, July 201 2013, at about 8:59am. lwas advised of a driving complaint via dispatch. The suspect vehicle was a maroon Ford F?i50 that was north bound in the 300 block of N. Superior AVenue. I was completely out of position at the time of the call. - At about 9:08am, was advised via dispatch-that the VA Police were outwith the-suspect vehicle near building 404. Due to our concurrentju-risdiction on VA property responded to their location to assist them at their request. arrived on scene and met with VA Police who briefed me on what they had. i made contact with the driver who was identified by his Wl driver?s license as Damien Ehlert. CLOSED DRUG Damien he admitted to having driven the maroon Ford to this location. Damien stated he had driven from Sparta to the VA where the VA Police made contact with him. I spoke with Damien and made the decision that was not going to arrest him for During our conVersation I learned Damien was prescribed and had taken his medications for the day. I learned that one of these medications was Oxycodone. i also learned that Damien was roommates with Derik McGovern. i knew Derik had a history of being involved in drUQ activity. i asked Damien if there was anything illegal in the truck and he stated there was not. i asked Damien for consent to search the truck and he granted consent. assisted the VA Police with the search of the vehicle and started on the passenger side. Damien's backpack was on the front passenger seat and located multiple prescription pill bottles inside the backpack. i noted they were all filled on July 18 and July 19 of 2013. I also noted that they all seemed empty or nearly empty. One of the empty bottles was Oxycodone 5 MG and was filled on July 19, 2013 with 16 pills. I then noticed the other bottles were only filled with 2 ?4 pills each, i held onto the Oxycodone pill bottle and asked Damien about it. Damien stated he had taken 4 pills the previous night. I asked Damien if he had given Derik pills and Damien confirmed he had. Damien stated they had come out to the truck in the parking lot the night before at about 7:00pm or 7:30pm. Damien stated he gave Derik 10 Oxycodone pills and then took the remaining 2 pills this morning. I asked Damien if Derik had paid him'for the pills and he stated Derik was going to pay him $100.00 when Derik got paid. 'l confirmed with Damien that this was not the first time this has happened. Damien estimated that he had delivered approximately 50 pills to Derik since they met in April. i asked Damien how many different occasions there. has been where he delivered pills to Derik. Damien estimated it has happened around 12 othertimes in the past. Damien stated Derik has not made any sort of payment to him for the pills and is alWays "going to pay him". i confirmed that at the time of the deliVery that Damien knew it was illegal to deliver his pills to another person. Damien stated he knew it was illegal that there could be ramifications for having done this multiple times. I will be referring Damien to the Monroe County District Attorney for Delivery of a Sched. ll Narcotic. i packaged and placed the pill bottleintoevidence.
