Count 6: POSSESSION OF DRUG PARAPHERNALIA The above?named defendant on or about Friday, July 19, 2013, in the City of Tomah, Monroe County, Wisconsin, did knowingly use or possess with the primary intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled substance, to wit: two syringes, two pen bodies, and a spoon,, contrary to sec. 961.573(1) Wis. Stats, a Misdemeanor, and upon conviction may be fined not more than Five Hundred Dollars or imprisoned for not more than thirty (30) days, or both. And the Court may suspend the defendant's operating privileges for not less than six (6) months nor more than five (5) years. If the defendant's driving privileges are already suspended, any suspension imposed must be served consecutively. PROBABLE CAUSE: Complainant relates that he has reviewed the incident report prepared by Officer Jarrod Furlano of the Tomah Police Department, a law enforcement officer believed to be truthful and reliable, which is modified in part and quoted herein: On information and belief the above incident occurred in Monroe F- i i - 2 2 2013 07/212120 satires ?austy Wisconai-i INITIAL INFORMATION STATE OF WISCONSIN VS - Timothy A. Benton was on patrol on 7/192?13 when dispatch advised that the VA Police were in contact with two subjects and one of the two was in possession of drug items. Sloan and I responded. CONTACT WITH TIMOTHY BENTON I arrived and saw several VA Police Officers standing near a vehicle and they appeared to be in custody with a male subject. I recognized the male as Timothy Benton from prior Police contacts. It should be noted that Timothy in a known drug abuser. Chief Obong of the VA Police indicated that they had contact with Timothy regarding him mentioning drugs to another patient. Chief Obong stated that while in contact with Timothy-they were granted consent to search a vehicle by the owner of the vehicle, a male that Timothy was with. Chief Obong stated that during the search of the vehicle several paraphernalia items were located in a bag in Timothy's property. See additional reports for search details. The items were in a small black zip up bag. The bag contained two syringes, two pen bodies that appeared to have been used to snort something, a spoon with a white residue on it and a small plastic case containing bits of what appeared to be cotton balls. The entire bag appeared to be a kit used for the snorting or injecting of drugs. Dispatch ran Timothy's information and advised that he was on five sets of bond conditions; four felony and one misdemeanor. DISPOSITION I took custody of Timothy. I placed him in a set of my handcuffs and seated him in the backseat of my squad. I took possession of the drug kit that the VA Police had located. Prior to transporting Timothy to jail, he requested that his handcuffs be loosened. I looked at the cuffs and saw that he was trying to twist his hands so that his palms would be facing each other, which is not proper handcuffing technique. 1 advised him of this and then transported him to jail. Once we arrived Timothy was turned over to jail staff for booking. EVIDENCE The drug injection lsnorting kit was packaged and entered into evidence. END OF REPORT Complainant relates that he has also reviewed statements prepared by VA Police Officer Nicholas Johns. Officer Johns reports that on July 19, 2013, at approximately 1250 hours, he was notified by VA Police Dispatcher George Barnes that he received a call from building 404 Registered Nurse, Erin Mosely. She called to reports that a residence came to her to report two males approached him near the elevator and asked him to "get high" with them. Officer Johns reports that he asked Dispatcher Barnes to review the camera footage from the entrance areas of building 404 to see if he could locate two. males on camera matching the description. Barnes was able to view the footage a'En?Ii @E?served two males, matching the description, exit the front entrance of building to a vehicle parked in the parking lot directly north of the building. glofi'rsnjepons that a? - 07r22/2013 3 marker circuitCourt Monroe County Wisronsm STATE OF WISCONSIN - VS - Timothy A. Benton Barnes observed two subjects enter a black, extended cab pick-up truck and exit the parking lot. Barnes was unable to determine the direction of travel at this point and could not locate the truck from a different camera view. Dispatcher Barnes that he viewed the camera footage from the building and noted the clothing worn by the two males subjects. Officer Johns reports he then conducted a search of the exterior property and parking lot at the VA Medical Center and was unable to locate the vehicle in the video. Officer Johns reports that at approximately 1340 hours, he was notified by Dispatcher Barnes that he had just received a call from a nursing staff member, Kathleen Holmes, that she observed the male subject sitting outside an office in building 400. She said she observed the male subject cutting his toenails with a large knife. She was concerned for the safety of other patients and was aware that knives are prohibited on VA property. Officer Johns reports that he responded in the direction of the front entrance?of building 400 to attempt to locate and make contact with the male subject. As he approached, he observed Nurse Holmes exit the front entrance and point to two males walking directly in front of her. Officer Johns reports that he recognized the two males as the same males he saw on the camera footage earlier. Officer Johns reports that he observed the two males walk to a black Ford Ranger pick-up truck parked in the parking lot, and one male placed an item inside the truck and moved a large black Pit Bull dog. Officer Johns reports that he recognized one male wearing the same clothing he noted as the males he observed earlier. He recognized this person from previous contacts as Timothy A. Benton. He did not recognized the second subject. Officer Johns identified himself as a police officer and asked them to step away from the truck and speak to him. Benton immediately yelled, ?i put the knife away already.? Officer Johns asked Benton where the knife was and he stated he placed it inside the truck. Officer Johns at that point radioed to Dispatcher Barnes requesting assistance. Officer Johns identified the second male subject by an identification card as Jason R. Brown. Officer Johns reports at that point VA Chief Police Obong arrived at his location to assist. Benton continued to be argumentative and stated, ?i already put the knife away. I don?t see why you need to even stop me." Officer Johns reports he explained to Benton that he was observed carrying the knife by a staff member and since Benton had been receiving care here at the Tomah VA Medical Center for several years he was certain he was aware of the violation against carrying weapons, including knives, on VA property. Benton responded, ?it's the staff here, they are all against me.? . Officer Johns advised he told Benton there was a second complaint made by another patient alleging that Benton had asked the patient to "get high" with him. Benton responded, was just joking. This is bullshit!" Chief Obong asked Benton to step over to the sidewalk area to speak with him while Officer Johns spoke to Brown. Brown told Officer Johns that he had only known Benton a few weeks. Benton attempting to solicit drugs. Brown also stated that he thought Benton?s comment was inappropriate since Veterans are here for treatment. Officer Johns reports at that time Dispatcher Barnes informed him that Brown?s driving privileges were suspended. Officer Johns then informed Brown of his license status. Officer asked Brown if there were any other weapons or drugs in the vehicle. Brown stated, don?t think so.? Officer Johns asked Brown if he could consent to a search of his vehicle, and he stated, ?Go ahead, your not going to find anything that?s mine." Chief Obong then asked Benton to remove his dog in the truck, only the dog from the truck. Benton appeared to get upset and stated, ?you just told me to put the dog back in there, and now you want me to take him back out. Make up your mind." At that point, Officer Johns reported that observed Benton remove a backpack from the passenger side of the truck and put it on. Benton stated, "Can I go inside now to get me medications?? Chief Obong asked Benton if there were any weapons or drugs present in the backpack and asked him to take it off. Benton stated ?No, all have is extra clothes.? Chief Obong asked him if hew as sure, and Benton stated, ?Yes am sure. You have no reason to look in it anyway." Officer Johns reports that Benton then began digging through the backpack, and he did not stop even when instructed to do so. Officer Johns reported that as Benton continued digging, he saw what appeared to be a hypodermic needle fall out of the backpack and on to the pavement. Chief Obong asked Benton to step away from the backpack, and Benton complied. Chief Obong retrieved the backpack and began to search it. Chief Obong?s search of Benton's backpack revealed two tubes, which appeared to be ballpoint pens, which were disassembled. Inside the pen tubes, there appeared to be a substance or residue. The search also produced a small round container with several small pieces of cotton. Officer Johns reported that through his training and experience, Chief Obong and he concluded the items were likely paraphernalia items used for drug use. Chief Obong also took possession of the pocket knife, which had been stored in the backpack. Officer Johns reports that the additional items were recovered from the backpack, and those are located in Chief Obong's report. Officer Johns reported that at approximately 1425 hours, Tomah Police Of?cer Sloan, Furlano and Marshall arrived on scene. Benton was turned over to the Tomah Police. Complainant relates that he has also reviewed an incident report prepared by Chief Roberto Obong of the VA Police Department. Chief Obong reported that during his contact with Benton he asked him if he was still using methamphetamines and heroin. Benton replied that he had not used in a while, but he really could not say for sure because he does use sometimes. Chief Obong asked him which one he used recently, herein or methamphetamine.
