ROARING FORK SCHOOL DISTRICT RE-1 GARFIELD COUNTY, COLORADO ASSISTANT SUPERINTENDENT AND CHIEF ACADEMIC OFFICER CONTRACT Roaring Fork School District RE-1 (the “School District”) hereby employs Dr. Robert Stein (the “Employee”) as an Assistant Superintendent and Chief Academic Officer and Employee hereby accepts such employment upon the terms and conditions set forth below. 1. The term of this Contract shall be from July 1, 2015 through June 30, 2017. 2. The Employee shall perform such duties and services as may be assigned from time to time by the School District Board of Education and, subject to the policies and directives of the Board, by the Superintendent of Schools. Such duties include those in the Chart of Responsibilities and Job Description attached hereto and incorporated herein as may be amended from time to time by the Parties.. The Employee shall fulfill his employment responsibilities in compliance with applicable laws, policies, rules and regulations, as they may be amended from time to time. 3. This Contract is intended by the parties to be a full-time contract and Employee shall be responsible for 252 duty days to be scheduled in accordance with the District calendar and the needs of the District. Employee shall receive 20 days of vacation annually, exclusive of regular school holidays and Saturdays and Sundays, 3 personal leave days annually and 9 sick leave days pursuant to School District policy. 4. The School District shall pay the Employee a salary in the gross amount of $130,000.00 per annum, to be paid in twelve (12) equal installments on the 28th day of each month. Unless otherwise amended by the parties Employee’s salary shall be subject to the same cost of living adjustment as may be approved from time to time by the Board for all School District employees. Such salary shall be subject to withholding of payroll taxes and such other amounts as may be required by law or generally applicable Board policy. 5. The School District shall provide Employee a total allowance of Two Thousand Two Hundred Dollars ($2,200) per month for mileage and cell phone expenses necessarily incurred by Employee in carrying out his duties hereunder and for Employee to purchase his own dental, health or vision insurance 6. Other than benefits for mileage and cell phone expenses and dental, health, or vision insurance, which benefits are addressed herein, Employee shall be entitled during the term of this Contract to receive other such employment benefits as are generally available under School District policy to other School District twelve-month administrative employees. 7. Employee shall hold a Colorado certificate or license with an endorsement appropriate for an Assistant Superintendent. Except as set forth herein, if at any time Employee fails to meet these requirements, this Contract, without further action by either of the Parties, shall thereupon be automatically terminated for cause as set forth herein. 8. During the term of the Contract, the School District and Employee may mutually agree, in writing, to terminate this Contract. 9. The School District may terminate this Contract for cause upon the grounds set forth in section 22-63-301, C.R.S., but shall provide Employee with such due process as is required by law before doing so. Upon termination for cause, the School District shall have no further financial obligation to Employee except as is provided by law. 10. The School District may unilaterally terminate this Contract without cause upon payment of three months’ salary as defined herein. Salary paid under this paragraph shall be only that amount set forth in section 4 above and shall not include any other benefit provided Employee as a consequence of this Contract. 11. Employee may unilaterally terminate this Contract in the manner permitted for chief administrative officers in section 22-63-202(2), C.R.S. The parties agree that section 22-63-202(2), C.R.S. shall be a part of this Contract. 12. Notwithstanding and not as modification of any other specification or reference herein, this Contract is subject to and includes all applicable laws of the federal and state governments and all duly adopted policies, rules and regulations of the School District as are in effect or become in effect during the term of this Contract; and the School District specifically reserves the right to change such policies, rules and regulations at any time without prior notice. 13. This Contract shall be binding on the parties upon approval by the School District’s Board of Education and execution of the Contract by the Board President, the Board Secretary, and the Employee. Any amendment or modification to this Contact must be in writing, approved by the School District’s Board of Education and duly executed by the parties hereto.
