I am therefore concerned about the potential impact that the apparent federal investigation involving you and your associated entities may have on the proper functioning of the of?ce. I have encouraged you to be open and transparent with the public about the ongoing investigation and once again urge you to improve public con?dence in this important of?ce. Article 3, Section 5 of the Washington State Constitution, and supporting case law, give me the authority to require of?cers of the state to reSpond in writing to any inquiries I may have relating to the duties of their respective of?ces. The same constitutional provision grants me the power to see that the laws are faith?Jlly executed. Therefore, I am respectfully directing you to answer the following inquires in writing: 1. What speci?c changes have you made in the operation of the Auditor?s Of?ce since you became aware of the federal investigation to ensure: a) that you are not involved in any aspect of responding to law enforcement?s requests served on the of?ce; b) that the federal investigation is not disrupting the work of the of?ce; and c) that the public has con?dence in the vital responsibilities of the of?ce? 2. Is the federal investigation impacting any of the open or pending audits or investigations being conducted by the Auditor?s Of?ce? 3. Are you aware of any con?icts of interest that you or your staff may have that may affect the operation of the Auditor?s Of?ce? PO.
