These work rules apply to all employees of the agency and speci?cally prohibit: #2 Failure to comply with written policies or procedures including but not limited to Executive Directives and Administrative Directives. - #4 Negligence in the performance of assigned duties or failure to exercise good judgment in dealing with employees, juveniles, offenders or the public. 0 #12 Verbally threatening, intimidating, demeaning, interfering with another employee, an inmate, juvenile, offender, the public or an investigation; or using profane or abusive language with another employee, an inmate, juvenile, offender or the public. 0 #13 Harassment, including but not limited to harassment based on protected status (race, gender, religion, etc.), towards employees, the public, inmates, juveniles or offenders. #14 Horseplay, practical jokes, or other disruptive or unsafe behavior. This action is based on previous discipline and the following facts: On March 7, 2014, you sent an email to Sgt- I. at Fox Lake Correctional Institution (F LCI) regarding two inmates at LCI, identi?ed here as AK and The email was sexual in nature and inappropriate. As a result, an investigation ensued and it was discovered that during your employment at LCI you had engaged in demeaning and harassing behavior'toward FLCI inmates, specifically inmates AK and IM. Your behavior constituted sexual harassment and violated the Department?s zero-tolerance standard regarding sexual contact, sexual assault and sexual harassment of offenders. Additionally, you had engaged in horseplay with these inmates and used profanity while speaking to them. The speci?c behaviors are described below: 0 On March 7, 2014, while on duty at DCI, you sent an email using your DOC state email account to Sgt. at FLCI. In the email you state, "Tell (AK) he is still a vertical set of lips and M) likes the sausage." Sgt. reported he believed the email was sexual in nature and that you were re erring to AK as part of the fema anatomy and IM as a homosexual. Inmate AK alleged when you were working at FLCI, you would frequently refer to him as booty? or as having a booty?. You admitted to this behavior and other staff and inmates witnessed this as well. Inmate AK alleged that during an incident when he was in the shower you threw a plunger and scrub brush at him, hitting him in his penis, causing pain. You admitted throwing these items at penis area. a - Inmate AK alleged an incident in which you entered his cell while his back was turned and he was bent over. While he was in this position you started ?humping? him from the back. He alleged he was able to feel your erect penis physically touching his buttocks. Inmate AK alleged you humped him approximately 4 or 5 times while he was in this position. You admitted to going into inmate AK's cell with him being present and said you tried to get around AK by placing your hands by his hips. You stated you probably pushed fonlvard and inmate AK pushed back, and others observing this would think you were humping inmate AK. 4/13/15 - 133 Mr. Thomas Lukas August 12, 2014 Page 2 Inmate'M reported an incident in which the two of you were walking up a ?ight of stairs, with you behind when you pulled his shorts partially down. You admitted to pulling inmate'M's shorts or pants partially down, exposing the top of his underwear. 0 You admitted to cutting out and leaving in AK's cell a newspaper article in reference to a gay marriage bill being passed or proposed in Wisconsin, on which you wrote and'M?s names. You also admitted to writing something across the top of the article intending to express that AK and could now get married. 0 . Inmate AK alleged you poked him in the genital area with a stick while he was in your of?ce. You denied ever touching him, but admitted you have poked at him in the belly area. 0 You admitted to referring to and calling several inmates at "bitches." You admitted to telling inmates at "fuck you", ?fuck oft?, and ?get the fuck away from me." You admitted making sexual comments to inmates, telling them to ?move (their) ass? and telling one inmate to ?work it?, stating this meant for him to ?shake his ass? as he walked. 0 You admitted to looking up inmate numbers and locations for other inmates, to giving your personalnewspapers to inmates and to going inside of inmate AK's cell to move stuff around'and mess up his desk. It bears noting that at all times during these events, inmate AK suffered from a physical disability which required the use of a wheelchair for movement around the housing unit and institution. The allegations made by the inmates interviewed during this investigation were consistent regarding your abusive and harassing behavior. Many of these allegations were supported by staff who also witnessed your behavior. You were generally evasive and denied these allegations throughout the investigation until you were presented with the evidence. At the pre-disciplinary meeting on July 3, 2014, you admitted you had not always acted in the professional manner that is expected of a Correctional Sergeant. You didn?t provide any other mitigating information that would preclude me from taking disciplinary action. it is clear that you abused your authority by sexually harassing inmates, using inappropriate language toward inmates, and exhibiting demeaning behaviors toward inmates. Your behavior demonstrates your complete disregard for the care and welfare of the inmates in your custody. This creates a volatile situation and seriously jeopardizes the safety and security of the institution. - Your behavior demonstrates your inability to be an effective positive influence on the inmates you interact with daily. Many of your remarks to inmates were of a sexual nature and violate the tenets of the Federal Prison Rape Elimination Act. You have violated the trust of the Department and the public, and have destroyed your integrity as a responsible correctional staff member. Your conduct is so contrary to the mission of the institution and the Department as a whole, and these violations are so serious that termination of your employment is warranted. You have previously been disciplined for work rule violations as follows: 5/20/2013 Written reprimand Work rule negligence failure to properly conduct inmate count You are required to return all items issued to you that are property of DCI (uniform, equipment, DOC ID, etc.) These items should be returned to DCI and handed to a security supervisor as soon as possible but no later than August 19. 2014.
