Crosby into custody on a felony warrant for Aggravated Stalking. Upon arrival at the house, I observed Kyle inside through an open window. I knocked on the front door and rang the doorbell, as well as gave loud verbal commands for about twenty minutes. I yelled that I had a warrant for Kyle's arrest and to come to the door. Kyle?s father, Anthony, saw me and got on the floor next to his bed in an attempt to hide. We then spent about forty ?ve minutes to an hour trying to call the suspect out of the house on the PA system. During that time, Sgt. Richter announced to the suspect that a K-9 was on scene and may be utilized if he resisted. After we exhausted all efforts to make contact, the decision to force entry into the house was made. Pfc. Mills breached the front door and contact was made with the suspect?s parents who stepped outside. Of?cer Bush then began yelling verbal commands for Kyle to exit his bedroom, which he was in behind a closed door. After numerous commands, Kyle refused to come out. I kicked the bedroom door open and Ofc. Bartolotta and I covered Kyle with our ?rearms. He was ordered to get on the ground but refused. Ofc. Bartolotta attempted to go hands on with Kyle when he ended up on his stomach on the bed. His arms and hands were concealed underneath him and he refused numerous commands to reveal his hands and be placed under arrest. was in fear at that point that Kyle may have been trying to get to some type of weapon as he had ample time to stage or hide a weapon before we made contact with him. After he still refused to give us his hands, Pfc. Bush gave K-9 Tomy the command to bite. During this, Ofc. Mckinney was attempting to handcuff Kyle. Kyle did free his left arm from underneath him and began aggressively swinging it in my direction and the direction of Ofc. Mckinney. He was not allowing us to handcuff him as he was swinging at us. At that time I struck Kyle with a closed ?st in the lower back and rib area several times in an attempt to distract and gain compliance in order to arrest him. Ofc. Mckinney was able to get a handcuff on Kyle?s right arm, however his left was still free as he was continuing to swing it in my direction. I was now worried that Kyle would get his right arm free and have a weapon (handcuff) to attack us with. I delivered two more strikes to Kyle?s lower back. This was ineffective and we were still unable to control him as he continued to resist and swing his arms. I then delivered two strikes with my expandable baton to Kyle?s right upper thigh. This was effective in allowing us to ?nally handcuff Kyle. The North Port Fire Department responded and took Kyle to SMH-North Port for medical treatment. Once he was cleared, transported him to the North Sarasota County Jail. Photos of Kyle and his injuries were taken and entered into evidence. He turned to his right, not complying with orders, and I then pushed him onto the bed. Narrative Summary - brie?y describe the incident (continue on page 3 if needed): On the aforementioned date and time, I responded to the address in question in reference to serving a felony arrest warrant for aggravated stalking. The offender listed on the warrant was Kyle T. Crosby. Prior to my arrival, Kyle was seen inside the home by other of?cers. Of?cers attempted to make contact with Kyle using several different means. It was determined that forced entry into the home was necessary to effect the warrant arrest. I positioned myself as a part of the entry team. Once entry was made, I began clearing the residence with my agency issued Sig Sauer P226R at the low ready position. in a bedroom on the East side of the home, I came into contact with a female subject, later identi?ed as Elizabeth Crosby, Kyle's mother; she was attempting to conceal herself under bed sheets while laying in a bed, clearly awake. I observed that her hands were empty, but she still refused to exit the bed. Because the location of Klye was unknown and Elizabeth refused to exit the' bed, I attempted to handcuff her. She again pulled the sheet over her body and concealed her hands under the sheet. I removed the sheet once again and grabbed her left arm. I was able to place her hands in double locked handcuffs behind her back. I then escorted her out of the residence to continue safely clearing the residence in search of Kyle. Of?cers came to a closed and locked interior door on the West side of the residence; loud verbal commands were given for the occupants to exit the room. No response was received. The door was subsequently breached by Pfc. Donohew. I observed Kyle standing just inside the bed room near the doorway. Verbal commands were given to him to get on the ground and he failed to comply. I was now standing in the hallway leading to the bedroom. I was bordered on both sides by interior walls. Of?cers in front of me began moving into the room and I followed. At this time Kyle was laying on the bed, face down. He had his arms out of my view; they were pulled into his midsection. I placed both of my knees on the bed in an attempt to reach and eventually gain control of Kyle's hands. Verbal commands were continually being given to Kyle to stop resisting and place his hands behind his back. Kyle continued to refuse. I placed my right knee into the the lower portion of Kyle's back to restrict his range of motion and prevent him from possibly using a weapon against me or other of?cers. Kyle was i 'then bit on his left calf by Ofc. Bush's K-9 Tomy. Kyle then removed his left arm from underneath his body and began ?ailing it in a backwards motion. I observed that Kyle's arm was coming very close to striking me and it was evident that he was not attempting to put his hand behind his back. I then delivered two closed ?sted strikes targeted to Kyle's upper right shoulder in an attempt to gain physical control of his hands and stop him from aggressively resisting my lawful duties. After my ?rst strike to his shoulder, Kyle began moving. He lowered his head and shoulder which caused my second strike to make contact with the right side of his face. Kyle then released his right arm from underneath his body. I was able take control of both of arms and place his hands behind his back. I placed him in a set of double locked 'handcuffs. Crosby (subject). Upon arrival Of?cer Donohewit166 identi?ed the subject in the back rear bedroom on the Westside of the residence. Several attempts were made by Of?cer Donohew and Officer Mills#260 to make contact at the front door and at the open bedroom window of the subject?s room. Dispatch also called the residence via telephone and received no answer. After failed attempts Sgt. Richter#263 began giving multiple announcements over the PA system for the subject to exit the residence. He again refused. Forced entry was then made into the front door of the residence. I made several K-Q announcements for anyone inside to exit the residence or a K-Q would be released. Shortly after a male occupant exited from a front bedroom. At that time I again began giving K-9 Announcements to the subject that he needed to come out of the residence or a K-S would be released. He again failed to comply. Of?cer Bartolotta?271, Of?cer Donohew, myself and Of?cer Mckinney?279 moved further into the residence toward the rear bedroom where the subject was last seen. Upon reaching the rear bedroom the door was closed and locked. Of?cer Donohew forced entry into the bedroom and the subject was standing in the doorway. Verbal commands were immediately given to the subject to get onto the ground. He failed to comply and was subsequently forced onto the bed in the bedroom by Officer Bartolotta. The subject began to resist by pulling his hands under his body not allowing officers to gain control of his hands. More verbal commands were given for him to show his hands and to stop resisting. He continued to refuse at which time I gave K-9 Tomy the command to bite. K-9 Tomy bit the subject in the left calf. He still continued to resist by attempting to hit of?cers with his left arm. Once officers gained control of both arms of the subject, I gave K-Q Tomy the command to release which he did. He was subsequently handcuffed by other officers.
