COMMENT SECTION: On June 17, 2014 North Port Police Department responded to 8455 Chesebro Avenue in reference to a hit and run crash. Upon arriving at the scene, the van suspected of being involved in the accident was located abandoned, two blocks south at 8504 Culebra Avenue. Three officers and K9 Tomy conducted a track to locate the subjects. While conducting the track, several witnesses told police two females had run from the area. The witnesses stated the two females appeared intoxicated. While approaching Anador Street, the officers saw the defendant, a white female, running and immediately shouted verbal commands ordering the defendant to stop. The defendant did not comply with the orders and concealed herself behind a large bush. The three officers surrounded the bush and continued to order the defendant to show her hands and come out. While attempting to flee, from a crouched position, the defendant ran out of the bush face first into K9 Tomy. K9 Tomy was leashed and the K9 officer immediately pulled back upon seeing the defendant. K9 Tomy bit the defendant on the head as she collided with the dog. The defendant was transported to North Port Emergency Room for further care. The defendant sustained a large laceration to the left side of her scalp requiring 3O sutures to treat the wound. The defendant was not subsequently arrested. Law enforcement was unable to determine the actual driver involved in the hit and run crash. The State's investigation revealed North Port police responded appropriately and conducted a lawful investigation. Based on the inability to determine the driver involved in the hit and run crash, the defendant's minimal resistance in complying with law enforcement's commands, and the significant injuries the defendant sustained, the State elects to decline prosecution.
