I was informed that the SWAT Team was conducting a methodical yard search in the area around 1759 Seminary. 1759 Seminary is a two story, stucco, apartment building situated on the West side of Seminary. I was advised that information was being received that one if not all the suspects were hiding in apartments inside 1759 Seminary. Elements from the SWAT Team were positioned around 1759 Seminary to contain any suspects while other elements conducted the yard search. 2045 I directed Sergeant Basa to prepare a photo line up containing a photo ofJoseph Pennymon and show it Karsseboom who was still being treated at the hospital. Milina notified me a short time later that Karsseboom was unable to identify Pennymon as one of the suspects. I should be noted that Officer Karsseboom was in a great deal of pain and partially sedated at the time that he viewed the photo lineup. Pennymon was on parole, and was transported to CID. I directed Sgt. Gantt to obtain a reference DNA sample from Pennymon upon his arrival to CID. I was advised that . I contacted Officer Andersen who was at CID an asked him to begin preparing a search warrant for the search of Ellis' apartment and any other apartment related to the suspects. Officer Andersen was able to obtain information to establish probable cause for the search of apartments #212, 110, and 108. Additional information was developed that Purvis Ellis resided in apartment #212. While at the command post, I was advised that information had been received that Damien McDaniels, Deante Kincaid and Joseph Pennymon were involved in the assault of Officer Karsseboom. 2145 Three individuals were detained after exiting apartment #110. The subjects were identified as three were interviewed, and one of the subjects, , advised that '!!!1!!!!'~!!~!!~~!!'!!~!'!~!!!~1111111111111111111111~!!!!!ยท Thehe was the brother of Joseph Pennymon. #110. 22 Jan 13 0445 also advised that Pennymon stayed in apartment Officer Anderson obtained a search warrant for apartments #212, 110, and 108. As the SWAT Team began preparing to make entry into the apartments listed on the search warrant, a .MB (later identified as Damien McDaniels) walked from 1733 Seminary north into the gate of 1759 Seminary and then began to walk into the building where he was detained by SWAT Team member Officer A. Leal. McDaniels was wearing only jeans and tennis shoes. Given the fact that it was very cold (36 degrees according to the weather almanac) it was odd that McDaniels was not fully clothed. Officer Manguy took custody of McDaniels and transported him to the command post. McDaniels initially lied about his name but was eventually identified, arrested for an outstanding warrant and transported to CID. Officer Manguy noted on his supplemental report that he had observed what appeared to be blood on McDaniel's pants. 0500 The Swat Team began to secure the apartments listed on the search warrant. 0521 Sgt. Reilly advised that the three apartments were clear of suspects and secure to search. 0538 I directed a search team of Officers S. Bang and R. Trevino to search apartment #108. Bang and Trevino located ammunition, a cut GPS ankle monitor and two cellular phones. Prior to the service of the search warrants, I was advised by Captain Joyner that Deante Kinkaid had removed his GPS ankle monitor and was currently listed as a Parolee at Large. It is apparent from the ankle was monitor that Kinkaid was utilizing apartment #108. AFB named was transported to CID. detained in relation to apartment #108. I directed a search team of Officers K.
