DISCLOSURE OF ENFORCEMENT ACTIONS. 2 (a) DISCLOSURE OF PROGRAM REVIEWS AND OPEN 3 INVESTIGATIONS.—The Department of Education Organi4 zation Act is amended— 5 (1) in section 203(b) (20 U.S.C. 3413(b)), by 6 adding at the end the following new paragraphs: 7 ‘‘(3) The Assistant Secretary for Civil Rights shall 8 make publicly available on the Department’s website a list 9 of institutions under investigation, the sanctions (if any) 10 or findings issued pursuant to such investigations, and a 11 copy of program reviews and resolution agreements en12 tered into with the Secretary or Attorney General under 13 title IX of the Education Amendments of 1972 (20 U.S.C. 14 1681 et seq.) or title IV of the Civil Rights Act of 1964 15 (42 U.S.C. 2000c et seq.). 16 ‘‘(4) Not later than 30 days after the termination of 17 the resolution agreements described in paragraph (3), the 18 Assistant Secretary for Civil Rights shall transmit to the 19 Secretary, the President, and the Congress, and make 20 publicly available on the Department’s website, the letter 21 terminating the Department of Education’s monitoring of 22 such agreements.’’; and 23 (2) in section 205 (20 U.S.C. 3415), by adding 24 at the end the following new subsection: 25 ‘‘(c) The Assistant Secretary for Postsecondary Edu- 26 cation shall make publicly available on the Department’s f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 3 1 website a list of institutions under investigation, the sanc2 tions (if any) or findings issued pursuant to such inves3 tigations, and a copy of program reviews and resolution 4 agreements entered into with the Secretary or Attorney 5 General under subsection 485(f) of the Higher Education 6 Act of 1965 (20 U.S.C. 1092(f)).’’. 7 (b) INSPECTOR GENERAL.—Not later than January 8 1, 2016, the Inspector General of the Department of Edu9 cation shall submit to Congress and make publicly avail10 able a report reviewing compliance with paragraphs (3) 11 and (4) of section 203(b) of the Department of Education 12 Organization Act (20 U.S.C. 3413(b)) and section 205(c) 13 of such Act (20 U.S.C. 3415), as added by subsection (a). 14 SEC. 3. CLIMATE SURVEYS. 6 Paragraph (1) of section 485(f) of the Higher Edu- 7 cation Act of 1965 (20 U.S.C. 1092(f)) is amended by 8 adding at the end the following new subparagraph: 9 ‘‘(K) Beginning October 1, 2017, statistics 10 based upon a sexual violence climate survey con- 11 ducted not later than April 1, 2016, and every 2 12 years thereafter— 13 ‘‘(i) which is developed and approved by 14 the Secretary, in consultation with the Director 15 of the Centers for Disease Control of the De- 16 partment of Health and Human Services and 17 the Attorney General, except that the National 18 Intimate Partner and Sexual Violence Survey 19 developed by the National Center for Injury 20 Prevention and Control of the Centers for Dis- 21 ease Control and Prevention may be used for 22 purposes of this subparagraph until the sexual 23 violence climate survey has been developed; and 24 ‘‘(ii) which assesses the occurrence on cam- 25 pus or in a noncampus building or property f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 5 1 during the preceding calendar year for which 2 data is available of— 3 ‘‘(I) instances of domestic violence, 4 dating violence, sexual assault, and stalk- 5 ing; 6 ‘‘(II) indicators of discrimination, and 7 positive and negative trends for intimate 8 relationships regardless of gender or sexual 9 orientation; 10 ‘‘(III) the effectiveness of campus 11 policies designed to improve relationships 12 between students regardless of gender or 13 sexual orientation; 14 ‘‘(IV) the effectiveness of current 15 processes for complaints on and investiga- 16 tions into sex-based, race-based, national 17 origin-based, sexual-orientation based, gen- 18 der-identity based, and disability based 19 harassment, assault, discrimination, do- 20 mestic violence, dating violence, and stalk- 21 ing; 22 ‘‘(V) perpetration of domestic vio- 23 lence, dating violence, sexual assault, and 24 stalking; and f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 6 1 ‘‘(VI) any other issues relating to sex- 2 based, race-based, national origin-based, 3 sexual-orientation based, gender-identity 4 based, and disability-based discrimination, 5 harassment, assault, domestic violence, 6 dating violence, and assault, as appro- 7 priate.’’. 8 SEC. 5. CREATION OF A PRIVATE RIGHT OF ACTION. 9 Section 485(f)(14) of the Higher Education Act of 10 1965 (20 U.S.C. 1092(f)(14)) is amended to read as fol11 lows: 12 ‘‘(14)(A) Subject to subparagraph (C), an aggrieved 13 individual may allege a violation of this subsection in a 14 judicial proceeding. A court may award an aggrieved indi15 vidual all appropriate relief, including equitable relief, 16 compensatory damages, cost of the action, and remedial 17 action. 18 ‘‘(B) This paragraph shall not be construed to pre- 19 clude an aggrieved individual from obtaining other rem20 edies under any other provision of law or to require such 21 individual to exhaust any administrative complaint process 22 or notice-of-claim requirement before seeking redress 23 under this paragraph. 24 ‘‘(C) For actions brought pursuant to this paragraph, 25 the statute of limitations period shall be determined in ac- f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 7 1 cordance with section 1658(a) of title 28, United States 2 Code. The tolling of any such limitations period shall be 3 determined in accordance with section 1979 of the Revised 4 Statutes of the United States (42 U.S.C. 1983) in the 5 forum State.’’. 6 SEC. 6. INCREASE OF CLERY ACT PENALTIES. 7 Section 485(f)(13) of the Higher Education Act of 8 1965 (20 U.S.C. 1092(f)(13)) is amended— 9 (1) by striking ‘‘in the same amount and’’; and 10 (2) by inserting before the period at the end the 11 following: ‘‘, expect that such section shall be applied 12 by substituting ‘$100,000’ for ‘$25,000’ ’’. 13 SEC. 7. NOTIFICATION OF POLICIES AIMED AT PREVEN- 14 15 TION OF SEXUAL VIOLENCE. (a) IN GENERAL.—Paragraph (8) of section 485(f) 16 of the Higher Education Act of 1965 (20 U.S.C. 1092(f)) 17 is amended by adding at the end the following new sub18 paragraphs: 19 ‘‘(D) The statement of policy described in subpara- 20 graph (A) shall be— 21 22 ‘‘(i) written using simple and understandable language and clear formatting; and 23 ‘‘(ii) made available and posted on the institu- 24 tion’s public website, and in conspicuous places, in- 25 cluding places in and around student housing, resi- f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 8 1 dence halls, student health centers, student recre- 2 ation centers, the main student center on campus, 3 and academic buildings where students congregate 4 and are likely to see it. 5 ‘‘(E) The statement of policy described in subpara- 6 graph (A) shall be provided, on an annual basis, to each 7 student group, student team, or student organization 8 which is part of such institution, is recognized by the insti9 tution, or permitted by the institution to use its name or 10 facilities or is known by the institution to act as an unaf11 filiated student group, student team, or student organiza12 tion, and each institution of higher education described in 13 subparagraph (A) shall ensure that each such group, 14 team, or organization distributes a copy of such policy to 15 each of its members as well as each of its applicants for 16 membership, including plebes, pledges, or similar appli17 cants. 18 ‘‘(F) An institution’s compliance with subparagraph 19 (E) with respect to an unaffiliated student group, student 20 team, or student organization shall not constitute evidence 21 of the institution’s recognition or endorsement of such un22 affiliated group, team, or organization.’’. 23 (b) COMPTROLLER GENERAL REVIEW.—Not later 24 than August 1, 2017, the Comptroller General shall report 25 to the Committee on Education and the Workforce of the f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 9 1 House of Representatives and the Committee on Health, 2 Education, and Labor of the Senate on— 3 (1) the implementation of section 485(f)(8) of 4 the Higher Education Act of 1965 (20 U.S.C. 5 1092(f)(8)), as amended by subsection (a), includ- 6 ing— 7 (A) the extent to which institutions of 8 higher education have developed the statement 9 of policy required under subparagraph (A) of 10 such section; 11 (B) how institutions of higher education 12 are— 13 (i) distributing such statement of pol- 14 icy; and 15 (ii) determining whether the policy is 16 received and understood by students; and 17 (C) the Secretary of Education’s oversight 18 of the compliance of institutions of higher edu- 19 cation with respect to the statement of policy 20 requirements under such section, including ef- 21 forts, in consultation with the Attorney General, 22 to provide technical assistance to institutions of 23 higher education in complying with such re- 24 quirements; and f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 10 1 (2) any changes in the numbers of dating vio- 2 lence, domestic violence, sexual assault, or stalking 3 incidents reported to campus security authorities or 4 local police agencies as indicated by the annual secu- 5 rity reports distributed under of section 485(f)(1) of 6 the Higher Education Act of 1965 (20 U.S.C. 7 1092(f)(1)). 8 SEC. 8. CAMPUS SEXUAL VIOLENCE TASK FORCE. 9 (a) CAMPUS SEXUAL VIOLENCE TASK FORCE.—Not 10 later than 180 days after the date of enactment of this 11 Act, the Secretary of Education and the Attorney General 12 shall create a joint interagency task force to be known as 13 the ‘‘Campus Sexual Violence Task Force’’ that shall— 14 (1) provide pertinent information to the Sec- 15 retary of Education, Attorney General, Congress, 16 and the public with respect to campus sexual vio- 17 lence prevention, investigations, and responses, in- 18 cluding the creation of a consistent, public complaint 19 processes for violations of title IX of the Education 20 Amendments of 1972 (20 U.S.C. 1681 et seq.) and 21 section 485(f) of the Higher Education Act of 1965 22 (20 U.S.C. 1092(f)); 23 (2) provide recommendations to institutions of 24 higher education for establishing sexual assault pre- 25 vention and response teams; f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 11 1 (3) develop recommendations for institutions of 2 higher education on providing survivor resources, in- 3 cluding healthcare, rape kits, sexual assault nurse 4 examiners, and access to confidential advocacy and 5 support services; 6 (4) develop recommendations for best practices 7 for responses and prevention with respect to sexual 8 violence for educational institutions, taking into con- 9 sideration an institution’s size and resources; 10 (5) solicit input from survivors, advocates from 11 national, State, and local anti-sexual violence advo- 12 cacy organizations, institutions of higher education, 13 and other public stakeholders; 14 (6) assess the Department of Education’s abil- 15 ity under section 902 of the Education Amendments 16 of 1972 (20 U.S.C. 1682) to levy intermediate fines 17 for noncompliance with title IX of the Education 18 Amendments of 1972 (20 U.S.C. 1681 et seq.) and 19 the advisability of additional remedies for such non- 20 compliance, in addition to the remedies already 21 available under Federal law; and 22 23 (7) create a plan described in subsection (c). (c) ADDITIONAL PLAN.—Not later than 270 days 16 after the date of enactment of this Act, the Campus Sex17 ual Violence Task Force shall submit to Congress a plan 18 for recruiting, retaining, and training a highly-qualified 19 workforce employed by the Department of Education to 20 carry out investigation of complaints alleging a violation 21 of title IX of the Education Amendments of 1972 (20 22 U.S.C. 1681 et seq.) or section 485(f) of the Higher Edu23 cation Act of 1965 (20 U.S.C. 1092(f)), and enforcement 24 of such title IX (20 U.S.C. 1681 et seq.) or such section f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 13 1 485(f) (20 U.S.C. 1092(f)), with respect to campus sexual 2 violence. Such plan shall include— 3 (1) an assessment of the capabilities of the cur- 4 rent workforce carrying out such investigation and 5 enforcement; 6 (2) an examination of issues of recruiting, re- 7 tention, and the professional development of such 8 workforce, including the possibility of providing re- 9 tention bonuses or other forms of compensation for 10 the purpose of ensuring the Department of Edu- 11 cation has the capacity, in both personnel and skills, 12 needed to properly perform its mission and provide 13 adequate oversight of educational institutions; 14 (3) an assessment of the benefits of outreach 15 and training with both law enforcement agencies and 16 institutions of higher education with respect to such 17 workforce; 18 (4) developing best practices for interviewing 19 and investigating sexual violence, including guidance 20 on evidentiary standards for administrative re- 21 sponses; 22 (5) an examination of best practices for making 23 institutions of higher education aware of the most 24 effective campus sexual violence prevention, inves- f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00013 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 14 1 tigation, and response practices and identifying 2 areas where more research should be conducted; and 3 (6) strategies for addressing such other matters 4 as the Secretary of Education considers necessary to 5 campus sexual violence prevention, investigation, and 6 responses. 7 (d) ANNUAL REPORT.—The Campus Sexual Violence 8 Task Force shall report to Congress on an annual basis, 9 and make publicly available, a report of its activities and 10 any update of the plan required under subsection (c), in11 cluding the number of complaints received regarding sex12 ual violence (including violence on the basis of sexual ori13 entation and gender identity), the number of open inves14 tigations, the average time to complete an investigation, 15 the number of investigations initiated based on com16 plaints, and the number of investigations initiated by the 17 Department of Education. 18 (e) AUTHORIZATION OF APPROPRIATIONS.— 19 (1) TITLE 20 MENTS OF 1972.—There 21 priated for training, hiring, and retaining a work- 22 force exclusively dedicated to investigation and en- 23 forcement of title IX of the Education Amendments 24 of 1972 (20 U.S.C. 1681 et seq.) provisions with re- 25 spect to sexual violence, for fiscal year 2016 and f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 IX OF THE EDUCATION AMEND- 15:32 May 19, 2015 Jkt 000000 are authorized to be appro- (597283 6) PO 00000 Frm 00014 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 15 1 each of the 4 succeeding fiscal years, an amount 2 that is equal to the sum of the amounts appro- 3 priated for such purpose for fiscal year 2015 plus 4 $5,000,000. 5 (2) SECTION OF THE HIGHER EDU- 6 CATION ACT OF 1965.—There 7 appropriated for training, hiring, and retaining a 8 workforce exclusively dedicated to investigation and 9 enforcement of section 485(f) of the Higher Edu- 10 cation Act of 1965 (20 U.S.C. 1092(f)), for fiscal 11 year 2016 and each of the 4 succeeding fiscal years, 12 an amount that is equal to the sum of the amounts 13 appropriated for such purpose for fiscal year 2015 14 plus $5,000,000. 15 (f) DEFINITIONS.—In this section: are authorized to be 16 (1) The term ‘‘educational institution’’ includes 17 an institution of higher education, an elementary 18 school, or a secondary school. 19 (2) The terms ‘‘elementary school’’ and ‘‘sec- 20 ondary school’’ have the meanings given the terms 21 in section 9101 of the Elementary and Secondary 22 Education Act of 1965 (20 U.S.C. 7801). 23 (3) The term ‘‘institution of higher education’’ 24 has the meaning given the term in section 102 of the 25 Higher Education Act of 1965 (20 U.S.C. 1002). f:\VHLC\051915\051915.344.xml May 19, 2015 (3:32 p.m.) VerDate Nov 24 2008 485(F) 15:32 May 19, 2015 Jkt 000000 (597283 6) PO 00000 Frm 00015 Fmt 6652 Sfmt 6201 C:\USERS\NLWOFSY\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\SPEIER~1.X F:\M14\SPEIER\SPEIER_049.XML 16 1 (4) The term ‘‘sexual assault’’ has the meaning 2 of an offense that meets the definition of rape, fond- 3 ling, incest, or statutory rape under— 4 (A) the Uniform Crime Report of the Fed- 5 eral Bureau of Investigation; and 6 (B) the final regulations published by the 7 Department of Education in the Federal Reg- 8 ister on October 20, 2014 for Appendix A of 9 subpart D of part 668, Code of Federal Regula- 10 11 tions (79 Fed. Reg. 62752). SEC. 9.
