Mr. Desmaret is charged under Counts 9 (Mail Fraud) and 10 (Hobbs Act Extortion) of the indictment. At the time Mr. Desmaret was charged; he was the Deputy Mayor of the Village of Spring Valley in Rockland County, New York. He ivas also employed by the Town of Ramapo as an Assessing Data Analyst. Prior to the indictment being handed up by the jury, Mr. Desmaret entered into a Proffer Agreement with the government and proceeded to meet with members of the United States Attorney?s Office for several months in an effort to cooperate with them. Despite his best efforts, which were numerous and sincere, Mr. Desmaret was not able to aid the government in any meaningful way. On January 29, 2014, Mr. Desmaret entered a guilty plea to Counts 9 and 10 of the indictment, before Your Honor in accordance with the plea agreement the parties entered into on January 23, 2014. Sentencing has been scheduled for June 18, 2015. This letter is respectfully submitted in support of our request that Honor impose a non? custodial sentence of home confinement and community service; when Mr. Desmaret appears before you for sentencing on that date. The Presentence Report dated May 15, 2015, prepared by US. Probation Of?cer Katrina Minus-Shepard, correctly sets forth the Guideline offense level at 29, with due regard to the terms of the plea agreement and Mr. Desmaret?s accepiance of responsibility for his actions. Although the guidelines provide that Your Honor mayiimpose a prison sentence of from 87 to 108 months, this Court is respectfully urged to sentencie Mr. Desmaret outside the guidelines range to a non-custodial sentence. Karas Re: Joseph Desmaret sentence for Mr. Desmaret is a ?reasonable? and appropriate sentence as is de?ned in 18 U.S.C. 3553(a). 5 The Nature and Circumstances of the Offense As the Presentence Report details, and as corroborated by Mr. Desmaret plea allocution, in the capacity of Deputy Mayor of the Village of Spring Valley, he accepted bribes in the amount of $10,600.00 from a government witness in exchange for his support of a ?ctitious project to build a catering hall and community center on vacant property in the Village of Spring Valley. Mr. Desmaret had no knowledge that his co~deifendant, Spring Valley Mayor Noramie Jasmin, had also met with the government witness and? had planned to surreptitiously gain a ?nancial interest in the project. i The Characteristics of the Defendant Joseph Desmaret is a 57 year old man who was born in Haiti on August 18, 1957. and emigrated to the United States in 1983. After securing various professional certi?cations in information management, he received a BS. Degree Business Administration in Accounting with Specialization in Computers from Mercy Collegeiin 1999. He began working as a Financial Analyst for MCI (now Verizon) in Rye Brook, NY, around the same time he received his undergraduate degree, and he kept that position for approximate1y seven (7) years. After leaving MCI, he started his own business in his Spring Valley community as a trainer and instructor of basic computer programs. Thereafter, he was employed by the Town of Rarnapo as an Assessing Data Analyst. He remained in that position until the current charges were lodged against him and he was required to resign. 5 He was elected as a Trustee to the Village of Valley Board and served in that capacity ?'om 2003 to 2007. In 2009, he was elected and served as Spring Valley?s Deputy Mayor from 2009 to 2013. His tenure ended shortly after his arrest. Although signi?cantly marred by his unethical iconduct that resulted in his conviction for bribe taking, Mr. Desmaret?s dedication to community? service, bothin Spring Valley, New York and in his native Haiti, never lagged since he emigrated to this country. He has been involved in a myriad of community service incentives including foiod and clothing drives, securing books for school children, earthquake relief activities, and mentoring local children on their use of technology. Photographs depicting some of his charitable endeavors are attached to this Sentencing Memorandum for the Court?s consideration. Joel Michel (Sr. Pastor of Elgise Baptiste iD?espression Francaise in Spring Valley, New York describes Mr. Desmaret?s charitable work as follows: He often lent his support to youth reliated program at the church. As a former Lucent Technician, he used to come to our youth group meeting and speak passionately to them on the new development and trend in the ?eld and encouraged them to excel in math and science in order to be prepared for the future job market. I Later on, he opened a computer center and began to offer basic computer classes to adults in the community and as well as providing access to young people from the community who did not have computer at home after school to complete their homework. He also opened a GED program for the ELS students who wanted to obtain High School Diploma. He was an initiator and visionary. Through these initiatives he had added value to many others as he attempted to help them more become marketable and equipped to find or maintain their Job. Mrs. Gabrielle Pierre, a nurse at Summit Park HOSpital in Spring Valley, wrote in a letter dated February 25, 2014 that Joseph Desmaret created H.A.D.O the Haitain American Diaspora Foundation. ?The organization was created in order to help Haitian artist from Haiti present and sale their artworkiin the United States. Mr. Desmaret made it possible for several artist to obtain their visas to the US, found them room and board and help several shows in Rockland County, N.J., NY. and Long Island. These events lasted several weeks to months and were very successful and pro?table for the artist. They formed business connections that provided them with continues revenue.? 5 Rev. Michel?s and Mrs. Pierre?s sentiments arei echoed in many of the letters that have been written to this Court in support of Joseph Desmaret, all of which have been attached to this sentence memorandum. In fact, petitions were circulated in the community shortly after the charges against Mr. Desmaret were made public, and 3288 people signed those petitions which stated, ?As our Deputy Mayor Mr. Desmaret dedicated? his life to helping the needful: He traveled back and forth to Haiti every year to bring relief to thousands of school children and needy families, especially those living in tent cities after the anuary 12, 2010 earthquake that devastated Haiti. He has been a caring, generous, thoughtful and involved community member.? (Copies of the signed petitions are attached to this Memorandum). Mr. Desmaret is truly remorseful and embarrassed by his unlawful conduct. He was determined and relentless in his efforts to assist, but because he was such a peripheral ?player? in the larger scheme, he really knew nothing of any importance. 3 The Imposition of a Non-Custodial Sentence It is respectfully submitted that a non-custodial sentence would be most reasonable in this case. It would serve to show that although the crime committed was a very serious breach of the public trust, all the good deeds Joseph Desmaret performed for his community, both in Spring Valley and in Haiti, more accurately depict his true nature and character. It would also recognize that he played a rather minor role in what the tabloids have dubbed the ?corridor of corruption? scandal. Joseph Desmaret is a broken man. He has found himself without a home, Virtually penniless and unemployed as a result of his wrongdoing. He has accepted full responsibility for his conduct and is truly remorseful. In his own words in the letter he has submitted to Your Honor, he stated, admit that I was wrong and I accept full responsibility. 1 can promise the court that I will never do this again. It saddens me to write this letter because I have only known of the good things Mr. Desmaret has done over the years. I was ?rst introduced to Mr. Desmaret during the summer of 2011. I was trying to obtain an internship through the legal department in Spring Valley. After meeting me, he walked me over to the legal department and assured them that they would have a hard working girl on their hands. I remember it so clearly; Mr.Desmaret was moved by ambition to be better and to do better. During this internship I did an innumerable amount of ?ling, but I also got to go to court and see the criminal justice system from a different perspective. I was usually taught in a classroom setting, but this opening gave me an opportunity to experience legal system ?rst hand. Also, we have crossed path on many other occasions. I saw MLDesmairet during church services, and I have also made contributions to assist him in helping several Haitians that currently live in tent cities, due to the devastating earthquake that nearly destroyed Haiti.
