STATE OF TEXAS THE COMMISSIONERS COURT OF COUNTY OF BREWSTER BREWSTER COUNTY, TEXAS RESOLUTION REGARDING PROPOSED GAS PIPELINE THROUGH BREWSTER COUNTY WHEREAS, Energy Transfer Partners proposes to build a 42-inch gas pipeline from the WAHA Hub in Pecos County, Texas, for the transmission of natural gas to Mexico; and WHEREAS, Energy Transfer Partners has identi?ed the proposed pipeline as an intrastate pipeline not subject to Federal Energy Regulatory Commission jurisdiction; and WHEREAS, the purpose of the proposed pipeline is for the international transmission of natural gas; and WHEREAS, the Railroad Commission of the State of Texas denies responsibility for regulating the siting and construction of the proposed pipeline and has indicated no state agency has that authority; and WHEREAS, the proposed pipeline passes through 33 miles of Brewster County and in close proximity to Alpine, Texas; and WHEREAS, the Brewster County Commissioners Court has concerns regarding lack of oversight for the proposed pipeline by the State of Texas; NOW, THEREFORE, LET IT BE RESOLVED, that Brewster County Commissioners Court petitions the Federal Energy Regulatory Commission to intervene and assumejurisdiction for the proposed pipeline through Brewster County to ensure said pipeline is subject to federal statutes, rules, regulations, and procedures.
