Senator Decker Representative: Rho ades MISCELLANEOUS PROVISIONS Motion: Move the following: 1. Florence Wiid Rivers Interpretive Center. Provide $25,000 GPR in 2007-08 and require DNR to provide a grant to the Florence Wild Rivers Interpretive Center to support operational costs, park and recreation uses, forestry education, and tourist information. 2. Grant to Racine Young Women?s Christian Association (YWCA). Provide $25,000 GPR in 2007-08 to the Department of Workforce Development to hand a one-time grant to th Racine YWCA for start-up costs for a job skills training program. - - 3. Department of Administration--Miscellaneous Appropriations. Create an annual GPR aids to individuals and organizations appropriation under miscellaneous appropriations administered by the Department of Administration to fund one-time grants for the following programs, Sunset the appropriation on. June 30, 2009. a. Resch Aquatic Center. Provide $15,000 GPR on a onetime basis in 2007?08 to the Resch Aquatic Center in Green Bay to assist with the costs associated with furnishings including, but not limited to, locker's for the center's lifeguards and/or construction of a concrete apron for spectators; b. Town of Pensaukee. Provide $10,000 GPR on a one-time basis in 2007-08 to the Town of Pensaukee to purchase furnishings, including historical photographs and frames, conference ?irniture, desks, and chairs, for the town hall; 0. - City of Sun Prairie. Provide $25,000 GPR on a one?time basis in 2007-08 to the City of Sun Prairie to be used for the design and construction of a handicapped-accessible playground in Firemen's Park; d. Sonthside Organizing Committee. Provide $12,500 GPR. on a one-time basis in 2007-08 to the Southside Organizing Committee in the City of Milwaukee for the purchase of a lap top computer and projector, a portable sound system with four wireless microphones, and translating equipment for 15 individuals; e. Violence Reduction and Child Safety. Provide $10,000 GPR in one-time funding in 2007-08 to the TAG program at Greater New Birth, Inc. in the City of Milwaukee to address child safety and violence reduction programming. Motion #999 Page 1 4. "Fighting Bob" LaFoliette Day. Specify that annually, June 14 be considered "Fighting Bob" LaFollette Day in Wisconsin. - 5. Hunting Mentorship Program and Weapons Casing. Create a-hunting mentorship program and authorize a person who is 12 years of age, or such lower age as DNR speci?es by administrative rule, to hunt without obtaining a certi?cate of accomplishment and to possess or control a ?rearm while hunting if the person has a valid hunting approval and is hunting with a quali?ed mentor. A mentor must be 18 years of age or older and be the parent or guardian of the person for whom he or she is serving as a mentor, or be authorized by the parent or guardian to serve as the mentor. Further, require that, at all times when serving as a mentor, the mentor must be within arm's reach of the person for whom he or she is serving as a mentor, must have a current valid hunting license, and must have obtained a hunter safety certi?cate of accomplishment or be exempt from the requirement to obtain a certi?cate. In addition, for those persons issued a hunting license and authorized to hunt with a mentor who are not required to obtain a hunter safety certi?cate, DNR would be required to issue a pamphlet containing hunter safety information. Also, specify that a person may only mentor one person at a time. Further, specify that an unloaded ?rearm need not be in a case, and a bow or crossbow need not be unstrung or in a case while being transported if the ?rearm, bow, or crossbow are placed in a location in the vehicle that is not within arms reach of the driver and any passengers of the vehicle when the vehicle is moving. 6. Arts Board -- One-Time?iGrants. Create an appropriation to fund one-time grants for the following programs. Sunset the appropriation on June 30, 2009. a. Lake Superior Big op' Chautauqua. Provide $25,000 GPR in 2007-08 to the Lake Superior Big Top Chautauqua performing arts center. b. K0 271i Dance Company. Provide $10,000 GPR in 2007-08 to the children?s department of the K0 Thi Dance Company. 0. African American Children's Theater. Provide $5,000 GPR in 2007-08 for the African American Children's Theater. - 7. Public Instruction - Various Grants. Create an appropriation to fund one-time grants for the programs under and Sunset the appropriation on June 30, 2009. a. Big Brothers/Big Sisters of Dane County. Provide $25,000 GPR in 2007-08 to Big Brothers/Big Sisters of Dane County for mentoring in collaboration with the Madison Metropolitan School District. b. Latino Community Center. Provide $12,500 GPR in 2007-08 to the Latino Community Center for a school safety improvement project at South Division High School. c. Badger State Science and Engineering Fair. Provide $12,5 00 GPR annually to the Motion #999 . Page 2 Badger State Science and Engineering Fair. d. Elks and Easter Seals Respite Center. I Provide $12,500 GPR annually above base funding for the Elks and Easter Seals center for respite and recreation. Specify that this funding would be one-time. Base level funding is $75,000 GPR. . 8. 1-94 Highway Signs. Require the Department of Transportation to install and maintain highway signs on 1?94 in Milwaukee County that highlight lakefront attractions in the City of Milwaukee. Specify that the signs shall include information about-the Milwaukee Art Museum, Discovery world, the Betty Brinn Children?s Museum, Surrnnerfest, and the Milwaukee County War Memorial. Specify that signs shall be placed at the following locations: on the northbound side of 1-94 between Rawson Avenue and College Avenue; and on the east-bound side of ?94 in the proximity of the Waukesha County/Milwaukee County line. Require DOT to also install temporary signs providing driving directions to these attractions during the Marquette Interchange reconstruction proj ect. .. 9. Routing 'of State Highways in the City of Ripon. Require the Department of Transportation to conduct a study of a propdsal to reroute state highways through the City of Ripon as follows: for STH 23, on Berlin Road, Oshkosh Street and Douglas Street; for STH-44, on CTH and Douglas Street; and for STH 49, on CTH KK, Douglas Street, Oshkosh Street, and Berlin Road. Require the Department to prepare a report summarizing the results of the study and present that report to the Joint Committee on Finance by June 30, 2008. 10. Grant to Racine County Worlg?orce Development Board (WDB). Provide $25,000 GPR in 2007-08 to. the Department of Workforce Development to fund a one-time grant to the Racine County WDB to develop a Comprehensive community?wide workforce development plan that addresses speci?c challenges in Racine County, including the preparation of a highly skilled and educated workforce to meet employer needs, to enhance the economic viability of Racine County, ll. Designate Donald J. Schneider Highway. Require DOT to designate and mark the route of USH 8 between USH 53 and the City of Turtle Lake in Barron County as the "Donald J. Schneider Highway" in recognition of former Wisconsin Senate Chief Clerk Donald J. Schneider for his many years of service to the Wisconsin Senate and the people of. Wisconsin. . l2. Driver?s Licenses Used Identi?cation Purposes Following Cancellation. Specify that in cases in which a driver?s license is cancelled prior to the date it would otherwise expire due to a determination that the license holder?s eyesight does not meet the Department of Transportation's standards for the safe operation of a vehicle, the driver?s license card may be used as a valid identi?cationcard until the expiration date on the license, without requiring the holder to pay an identi?cation card issuance fee. Require the Departrnent, in these circumstances, to update its records to re?ect this change and to make a distinctive mark on the license to indicate that it is not valid as a driver's license, but is valid for purposes of identi?cation. Require the holder of a driver's license that is cancelled under these circumstances to surrender the license to the Department for the purposes of making this modi?cation. - Motion #999 Page 3 13. Village of Rochester Consolidation. Authorize the Village of Rochester in Racine County to consolidate with the Town of Rochester in Racine County if the boards of the Village and Town each pass an ordinance by two-thirds vote ?xing the termsof consolidation and this ordinance is rati?ed by the electors at a referendum held in each municipality. Specify that the Village and Town would not have to enter into a boundary agreement in order to consolidate and the Village and Town may determine their respective boundaries without a boundary agreement with any bordering town, village or city. 14. Report on Overcrowding in the Prairie du Chien Correctional Institution?s Segregation Unit. Direct the Department Of Corrections to evaluate the current capacity and usage of its segregation unit at the Prairie du Chien Correctional Institution, and submit a report to the Joint Committee on Finance by July 1, 2008 on the Department's ?ndings. Require that the report speci?cally address the issue of inmate overcrowding at the Segregation unit. 15. Marina Condominiums. Move to specify that except for marinacondominiums existing prior to June 2007, no owner of riparian land that abuts a navigable water may grant an easement or similar conveyance of any riparian right in the land to another person, except for the right to cross the land in order to have access to the navigable Water (which does not include the rightto place any structure or material, including a boat docking facility, in the navigable water). De?ne a "marina condominium" as a condominium in which the common elements, limited common elements, or condominium units consist of or include boat docking facilities and in which one or more of the boat docking facilities is not appurtenant to a dwelling unit in the condominium, or in which there are no dwelling units. I In addition, specify that any marina condominium created prior to June 1, 2007, be effective regardless of any subsequent amendment, modi?cation or restatement of declaration by a court or administrative order or by all of the owners of the condominium units, or any determination by court or administrative order that the declaration is void or voidable or that the condominium units in the marina condominium are not intended for any type of independent use. However, Specify that any such marina condominiums may not increase the size of the facility or number of boat slips I in the boat docking facility. Further, specify that a marina condominium in existence prior to June 1, 2007, that contains more than 300 boat slips must have. at least 40% of the total number of boat slips in the marina condominium available for rent or transient use by the public. Require the marina condominium declarant to include this information in the sales or transfer document should the declarant sell or transfer interest in a" condominium unit affected by this restriction. In addition, in the instance of a'marina condominium that was previously a marina, specify that a permit issued to place, maintain, or use a boat docking facility prior to the formation of the marina condominium remain in effect and may not be rescinded or modi?ed by DNR, a municipality, or a court or administrative order, or if any modi?cations are made that affect the condominium declaration, if the grounds for the rescission or modi?cation are based on the Motion #999 I Page 4 facility's status as a marina condominium, provided the permit was issued prior to the conversion of the marina into a marina condominium. In the instance of a marina condominium that was not previously a marina, specify that a permit issued to place, maintain, or use a boat docking facility prior to the formation of the marina condominium may not be modi?ed by DNR, a municipality, court "or administrative order, or if any modi?cations are made that affect the condominium declaration. Specify that the Departmentof Natural Resources retain the authority to enforce the terms and conditions of a permit or other authorization except as they relate to the form of ownership of a boat docking facility. Further, specify that no owner of riparian land mayor-sate a marina condominium on riparian land on or after June 1, 2007. Specify that any marina condominium created after June 1, 2007, be invalid and ownership of the riparian land would become a tenancy in common held by the owners of the marina condominium units. 16. Contracted Actuarial Study. Provide $15,000 GPR in 2007-08 (instead of $15,000 SEG in a separate appropriation) for the Legislative Council Staff to contract for an actuarial opinion on SB 19 and its amendments or 2007 Assembly Bill 43 and its amendments (instead of SB 19 only) related to creditable military service under the Wisconsin Retirement System. Request (rather than direct) the Joint Survey Committee on Retirement Systems to contract for an actuarial opinion on SB 19 orAB 43. I 17. Low-Income Residential Housing Property ax Exemption. Modify the property tax exemption for educational, religious, and benevolent institutions by specifying that the exemption, as it pertains to benevolent associations, includes organizations that own low-income residential housing as provided under sections 3.01 and 3.02 of Internal Revenue Service Revenue Procedure 96-32. Extend the 30-acre limitation under the eXemption, as opposed to the lO-acre limitation, to property owned by benevolent organizations and specify that property operated as low-income residential housing is a qualifying use under the 30?acre limitation. Modify the current law provision that allows exempt property to be leased if the leasehold income from the property is used for maintenance and construction debt retirement to also allow leased property to be operated as low?income residential housing as provided under sections 3.01 and 3.02 of the Internal Revenue Service Revenue Procedure 96-32. Exclude lessors who lease property meeting the requirements under sections 3.01 and 3.02 of Internal Revenue Service Revenue Procedure 96-32 ??om the current law provision requiring owners of exempt property that is leased to provide records relating to the lessor?s use of income from leased property. Extend these provisions to apply retroactively to property assessed as oflanuary 1, 2003. 18. Incorporation of Certain Towns. Modify the previous Committee actiOn by- authorizing the Town of Ledgeview in Brown County to become a village notwithstanding statutory guidelines for becoming a village. Specify that Ledgeview would not have to gain approval from the Incorporation Review Board to hold a referendum. Specify that Ledgeview and the City of De Pere must enter a boundary agreement, but specify that this agreement need not be completed before a referendum is held to determine whether the Town would become a village. i Motion #999 Page 5 19. False Claims. Modify the bill's provisions and the Committee's previous action related to penalties for submitting false claims and civil cases against those that make false claims so that they only apply to contracts, services, and commodity purchases related to the medical assistance program. 20. Department of Regulation and Licensing. Delete the previous actions of the Committee in regards to Issue Paper #680 [Initial and Renewal Fee Structure], and, instead, do the following: delete the Governor's recommendation; require the Department of Regulation and Licensing to lapse $3,833,000 PR in 2007-08,and $1,917,200 PR in 2008-09 from the agency's general program operations appropriation and $355,900 PR in 2007-08 from the examinations operations appropriation; Specify that all of the Department's initial and renewal credentials be assessed an additional $5 between July 1, 2007, through June 30, 2009; speci?i that the assessment would be one-time and deposited into the general fund; and direct the Department to utilize the four most recent complete years of time-keeping data'to develop initial and renewal credential fees for the 2009?11 biennium and all subsequent biennia. This modi?cation would result in a GPR?revenue increase to the Committee's previous action of $4,188,900 in 2007-08 and $1,917,200 in 2008-09. 21. Health Care Quality Fund. Reduce the amount of cigarette tax revenue deposited in the Health Care Quality Fund by $20,000,000 annually. 22. Intergovernmental Transfer Funding. Increase MA bene?ts funding by $20,000,000 FED annually to re?ect the intergovernmental transfer funding for services provided by UW physicians to MA recipients. This funding would be used to support supplemental rate increases to UW physicians for rendering services to MA recipients.
