BILL NO. 1454 ORDINANCE NO. 1444 AN ORDINANCE OF THE CITY OF EDMUNDSON, CALLING AN ELECTION TO BE HELD ON NOVEMBER 3, 2015, IN ORDER TO SUBMIT A PROPOSITION TO THE QUALIFIED VOTERS REGARDING THE REAL ESTATE TAX RATE WHEREAS, the City’s ad valorem tax on commercial property is currently set at $.500; and WHEREAS, the commercial businesses within the City require a greater level of service than the residential areas; and WHEREAS, the City does not currently levy a real estate tax on residential property and the Board believes that the residents should not be unfairly burdened with the cost of City services provided to the commercial areas; and WHEREAS, Missouri law only requires uniformity of taxation within a subclass and not among the subclasses of property and, therefore, the rate of commercial taxation to be authorized and eventually levied will not have any effect on residential rates. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF EDMUNDSON, MISSOURI, AS FOLLOWS: Section 1 An election is hereby called and ordered to be held on the 3 rd day of November, 2015, within the City of Edmundson for the purpose of submitting to the qualified voters of the City a proposition which shall be submitted in substantially the following form: PROPOSITION C Shall the City of Edmundson be authorized to levy an ad valorem property tax on real property in an amount not to exceed One Dollar per one hundred dollars of assessed valuation which will result in an increase on commercial property (the City does not currently levy a real estate tax on residential property)? Section 2 The City Clerk shall prepare and cause to be forwarded to the Board of Election Commissioners of St. Louis County, Missouri, a Notice of Election in compliance with this ordinance and take such other steps as may be required so that an election may be lawfully conducted. Section 3 The Board of Election Commissioners of St. Louis County shall conduct such election according to the law and certify the results thereof. Said Board of Election Commissioners shall designate such polling places as shall be required for said election and shall appoint such necessary election officials as may be required for the conduct thereof. Said Board of Election Commissioners shall also publish such notice of said election as shall be required by law and shall do and perform such other necessary acts as may be required to conduct such election in accord with the statutes of the State of Missouri and the ordinances of the City of Edmundson, Missouri. Section 4 This Ordinance shall be in full force and effect from and after the date of its passage and approval.
