The victim as working near a large diesel generator when an unknown event caused him to necome caught in the generator fan. 'The large six blade fan struck the victim in the back torso causing massive trauma to the torso. The fan held the victim in place until the victims clothing released him to the floor of the trailer and then but onto the ground. Evidence of the victims clothing was wound into the fan and drive belts. One fan blade showed significant cover was pp; inIuse at the time gj'the incident. The generator contiued to operate until shut down by the owner upon discovery of the victim . The victim was transported to Copley Hospital by Northern EMS. .However the victim was pronounced while enroute. This incident was witnessed by a second employee of Castle Rock Carnival. All statements given by employees at the scene are consistent with the scene itself and the injuries to the body of the victim. Lamoille SA Joel Page was notified and AME Tammy Lurvey responded to the scene. Mark Faith of White?Fiess Funeral home in Morrisville transported the victim the the ME's Office in Burlington. VOSHA Safety Compliance Officer Sally Cole was also reaponded to the scene. The scene was released?after the completion of Sally Cole's investigation. Baxter INFORMATION: COMPLAINANT: Arthur Gillette DESCRIPTION OF SCENE: The scene was located at the Lamoille County Field Days on Wilson Rd in Johnson VT. The crew of Castle Rock Amusement was there to set up? the carnival rides for the annual Field Days event. The victim?was a member of the Castle Rock_Amusement crew. The victim was located near the back of the semi?trailer that contained a diesel generator. The diesel generator is centered inside the semi?trailer with the two rear trailer doors being opened, exposing he radiator (front of the generator). The generators radiator is nearly -parallel with the back open end of the trailer with approximately 24" on both sides between the wall and the generator itself. The diesel generator provides power for the rides during set up and event operation. The victim.was in the area of generator when an unknown event caused the victim to be drawn into the pulley system and struck by the generators fan blades. The victim sustained massive trauma to his torso as a result. The victim came to rest outside of the semi-trailer on the grbund. The victim was subsequently located in this position. DISCOVERED Arthur Gillette ?1 LIST OF containing digital photographs of the scene and Telles NARRATIVE: On July 19, 2011, at approximately I was contacted by LT Brian Miller and asked to assist the Lamoille County Sheriff?s Department with a possible accidental death located at the Lamoille County Field Days event in . Johnson VT: I was informed that.one of the carnival crew may have been electrocuted by a generator and appears he will succumb to the injuries sustained. I arrived on scene at approximately 1549hrs. I met with LCSD Sgt. Ronald Audet and Chief Deputy Ebin Merrill. Sgt. Audet had secured the scene with crime scene tape, Sgt. Audet advised the victim, a male crew member had been transported to the Copley Hospital by NEMS with massive trauma to his torso. The trauma to the victim?s torso was substantial enough to cause his internal tissues to be partially removed from his body. Sgt. Audet stated EMS personnel felt the victim_had been electrocuted due to the location of his body near a diesel generator and the damage sustained to the victimfs body. LCSD Detective Jesse Sawyer responded to Copley to stand by with the victim. Sgt. Audet advised me he spoke with the owner of Castle Rock Amusement Arthur-Gillette prior to my arrival and took a brief written statement from him. Sgt. Audet stated_Gillette informed him he heard a person who seemed to be in pain near the generator trailer. Gillette went to the trailer and observed Leonardo Telles lying on the floor with obvious injuries to his torso. Gillette turned the generator off-and ran for help. ?The trailer is a Trail?mobile semitrailer with Florida registration C6520V, registered to Arthur Gillette. I spoke with Gillette briefly prior to processing the scene and asked to help secure the workers that were in the area when the incident took place. Gillette agreed. - . While beginning to process the scene we were informed that the victim had been pronounced dead on the way to the hospital. Sgt. Audet prior to my arrival had left a message with Joel Page of the Lamoille SA's Office and the Office. SA Page contacted us at approximately 1622hrs stating it was fine to remove the body to the Office. AME Tammy Lurvey agreed to respond to the scene. We also had dispatch contact VOSHA. VOSHA Investigator Sally Cole later responded to the seene. - Sgt. Audet and Chief Deputy Ebin Merrill had taken initial photographs of the scene prior to my arrival. Sgt. Audet and Chief Deputy Merrill assisted me in taking several more?photographs and video of the scene. While processing the scene I quickly noted the incident did_not appear to be an electrocution. There appeared to be no evidence suggesting-an electrocution at first look. I noted a large pool of blood and black cloth material on the ground in back of the generator trailer. I noticed a large pool of blood on the floor of the generator trailer trailing to the large pool of blood on the ground outside. I also noted large amounts of blood and biological 'htter splattered in the generator fan area to include the entire floor and "walls on both sides of the generator. The blood and biological matter pattern suggested a high velocity.rotational transfer caused only by the rotating fan blades of the generator. I also observed several pieces of black cloth material scattered around and mixed in with the blood and biological matter located at the scene. I observed large pieces of the same black colored cloth material wrapped up into the drive portion of the fan located directly on the back of the fan. The same cloth material was also wrapped up into the drive pulley system located at the base of the'fan. Both the fan and drive pulley's had black cloth material wrapped into and intertwined within them. I also noted a broken drive belt on the pulley system. The generator fan consisted of six solid metal fan blades. One of the generator fan blades was badly damaged. The damaged fan blade was sustained damage in the form of bending in two separate directions. The evidence at the scene suggested that the fan blade had come into contact with the victim. After processing the scene I spoke with the owner Arthur Gillette. Gillette stated that he and his crew arrived last night for the week long Field Days event. Gillette stated his crew began the process of setting up the rides and grounds today. Gillette indicated.the employees are broken down into groups ?and each group is self?sufficient in the set up process. Gillette stated when. the accident happened today he was just pulling into the ride area when he heard someone in distress. Gillette stated he heard someone in distress near the generator trailer. Gillette stated that the generator was running at the time. When he got to the trailer he entered from the front and observed Telles on the floor next to the generator with obvious injuries. Gillette stated he shut the ogenerator off and ran to get help. Gillette jumped out of the back of the generator trailer where he unknowingly at the time, twisted his knee.? Gillette stated he ran to the office area and told Deanna Judkins to all 911. Gillette also informed members of his crew Robert Leonard DOB ?when? a* and Valente Romero Gabriel er :nn?g to_run over to the NEMS (Ambulance Bay)'next door and get help. 'Gillette stated the ambulance crew was there within minutes. Gillette stated when he originally went to the scene Telles was the only person around. Gillette also indicated that he didn't understand why he would have been in the generator trailer.? Gillette stated Valente, Rob and himself are the_only employees that have the authorization to be in the trailer and the only three ;that know how to start the generator. Gillette stated he did net know who had started the generator today. I informed Gillette was it possible that Telles would have been in the trailer to retrieve wire for the rides. Gillette stated he needed it he could have pulled it out from the back of the trailer on the ground. . :ierwv Judkins stated she did not witness the accident nor did she see any of it after. Judkins stated she was I Spoke with Deanna Judkins DOB working in the office when she heard someone yelling to call 911. Judkins went outside and met with Art (Gillette) who was running toward her and yelling "call 911". Judkins returned to the office and called Sll. spoke with Robert Leonard DOE :a mug Leonard stated he did not see.the accident and was not near the accident scene when it happened. Leonard stated he did arrive while Gillette was trying to get help for Telles. Leonard Stated he went over to the ambulance bay next door to get help. I asked Leonard if he knew how the generator got turned on and why Telles would have been in there. Leonard echoed Gillette's response in that he didn't know why Telles would have been in there and that there are only three'people who have the authorization to be in the generator trailer. Leonard stated Valente, Gillette and himself are the only three that know how to operate the generator. I spoke with Valente Romero Gabriel WE Valente stated that he did not witness the accident with Telles and only arrived after. Valente stated saw Telles on the ground behind the generator trailer. Valente ran to get help from the ambulance crew NEMS next door. Valente stated he turned the generator on about a half hour prior to the accident. Valente stated he turned it on to assist in the set?up of the rides. . Prior to leaving the scene.I spoke with Sgt. Audet who had previously agreed to interview all_of the work crew that was in the area at the time of the accident. Sgt. Audet informed me the two crew members working with Telles 'stated that he had gone over to the generator trailer get an electrical adapter. They did not see the accident occur but did see Telles after on the ground. Refer to Sgt. Audets report for the full interview. Chief Deputy Ebin Merrill and Sgt. Audet agreed to stay on scene while traveled to Copley Hospital in Morristown: I arrived at Copley Hospital and met with Detective Jesse Sawyer and AME Tammy Lurvi. Detective Saw er advised me he had spoken briefly with Anacleto Garcia?Andrade DOB about the accident. Anacleto rode with Telles to. the Hospital in the ambulance. I spoke with Anacleto. Anacleto informed me he was working on the Rapid Turn when the accident happened. The Rapid Turn was directly to the rear of the generator trailer approximately 20yards. Anacleto stated his attention was drawn to the generator by an "explosion" sound and the noise of the generators motor getting interrupted and/or powering down. .- . Anacleto said the noise prompted him to climb to the top of the Rapid Turn so he could look down into the back of the neighboring generator trailer. Anacleto immediately observed Telles standing over top of the generator with a large hole in his side. Anacleto described the large hole in Telles's side as a large gaping wound. Anaoleto.stated from his vantage point Telles was standing on the right side of the generator. Anacleto also stated the generator continued to operate while Telles stood over it. Anacleto informed me Telles stood over the generator before falling to the ground with his left side facing the generator. Anacleto explained that Telles's left arm fell into the generator as he fell and lay on the trailer floor. Anacleto recalls Art (Gillette) running into-the generator trailer while the event with Telles was taking place. Anacleto stated Art turned the generator off. Anacleto stated he observed Telles pull himself out of the rear of the generator trailer and onto the ground outside. Anacleto felt the accident with Telles took place over a few seconds to minutes. . Anacleto did was not able to help or reach Telles due to his location up on the Rapid-Turn. Anacleto did not observe any other people around at the actual time of the accident. Several people came around while trying to get help for Telles. I asked Anacleto how well he knew Telles. Anacleto stated that he knew Telles well from working at Castle Rock Amusement. Anacleto stated that Telles es not take any medication, does not smoke and was in good spirits earlier in the day. . After speaking with Anacleto, AME Lurvi, Detective Sawyer and I examined the body of Leonardo Espinabarro Telles. Prior to examining the body I was provided with the Mexican Passport of Leonardo Espinabarro Telles. The victim and the photograph provided in the passport appear to be one and the same. The body was that of an adult Latino male. The body was dressed in black shorts, green belt, black underwear, collared black shirt, blank tank top (under collared shirt), white half socks and brown boots. The shorts, underwear, belt, black collared shirt and black tank top were all ripped open. The ripped outerwear caused most of the left side of the victim?s body to be exposed. The shorts, collared shirt and tank top were_still attached to the victim's right leg,-right shoulder and right arm_area as normally worn. .The ambulance crew stated they did not cut any clothing away while transporting. The body had three AED lead patches applied to the front torso by the ambulance _crew. The body appeared to be in slight rigor with no notable lividity. The eyes and mouth had nothing remarkable. The front:torso of the body appeared to be ?Ermal. I noted a small previous abrasion to the front right shin area. I a ted several new areas of trauma on the body. The victims left forearm sustained a large contatt abrasion that covered most of the.forearm. Within the frame work of the large abrasion on the left forearm there was portion that -carried through the skin and muscle into the skeletal structure of his arm. The victims left thigh had a new abrasion that only broke the skin. There were four 'lines of contusions on the left side of the victim's buttocks. The four linear contusions were parallel with each other. The back of the victim's torso was .eviscerated from the lower middle portion of the buttocks to the left shoulder. The gaping wound transected most of'the victims back side exposing the inner cavity. A significant portion of the victims bowels were outside of the cavity area. The victimts hands were bagged by AME Lurvi. The victims's body was placed in a body bag a secure with a Hospital Red Tag #369314. I filled out the red tag and secured it with the body along with Telles passport and paperwork. Mark Faith of White-Fiess.Funeral home in Morristown_VT transported the body to the Office in Burlington. . Preliminary Report of Autopsy: Steven Shaprio reported the diagnosis and cause of death was a traumatic avulsion/evisceration due to being caught in an industrial fan. The manner of death is Accidental. Summary: The investigation revealed that on July 19, 2011 the victim Leonardo Espinabarro Telles,r a Mexican National here on a work visa was working with the Castle Rock Carnival of Pittsfield Mass setting up for the annual Lamoille Field Days event in Johnson VT. The victim was working near a large diesel generator when an unknown event caused him to become caught in the generator fan.- The large six blade fan struck the victim in the back torso causing massive trauma to the torso.
