The age and diversity present within these forested communities provides excellent habitat. They range from large grazed pastures with, open water ponds to systems which are currently signi?cantly impacted by human activities or grazing so that their habitat potential is diminished. Category IV: these wetlands are either small dredged open-water pondswith little or no San Juan Island San Juan is the second largest island and the most populated. Friday Harbor is the only incorporated town in the county and is located on the east side of the island. Most of has rolling topography with a mix of forest lands, open pasture, intermittent streams, lakes and numerous ponds used for livestock watering. Many of the ponds and wet pasture areas have .had continued impacts due to overgrazing._ Category I: wetlands were not identified .in large numbers on San Juan Island. The majority of Category I wetlands on San Juan are palustrine forested systems. These wetlandsare typically dominated .by red alder, western red cedar, blackcottonwood, and lodgepole pine in the canopy. Common snowberry albus), salmonberry, willow, western crabapple (Evrus (=Malus) fusca), and Douglas? hawthorn @rataegus douglasii) comprise the shrub layer. This statement will also include information on all correspondence between SJC employees/public/owners regarding this permit. The Hughes building permit application, Buildg-?l4-0229 was routed to me on July 19, 2014 for a cursory land use/critical area reVIew. My cursory land use/cr review of the land use designation maps, plat maps, critical area maps, and aerial and topography maps. Critical area maps depicted a pond/wetland area located on the property directly west of the Hughes property. in addition to the wetland critical maps showed an ?un? typed stream"/drainage area running from the pond/wetland to the south east. In my initial in office review, measured the Hughes house site to be roughly 150 plus feet from what estimated to ?be the approximate pond/wetland boundary. The house site is located came to the conclusmn that the pond/wetland would most likely be rated as a Category or IV wetland and that the house site would be beyond the required water quality/habitat buffers. At this point in time no letter was sent to the applicant requesting additional wetland information. Between August 25th and August 27'th (I cannot remember the exact clay) I visited the Hughes parcel with my co?worker Nadine Cook. On my site visit I observed a substantial amount of wetland vegetation around the pond and surrounding areas. Due to the heavy amount of vegetation, both wetland and non-wetland species I could not clearly identify the wetland Buildg-14-0229 Hughes Page 1 . boundary. As could not clearly identify the wetland boundary I believed a wetland assessment should be completed by a qualified wetland specialist in order to determine the boundary and category of wetland to determine appropriate buffers from the house site. A letter was sent to Travis Stanton, agent for the Hughes on August 27, 2014 requesting a wetland assessment prior to land use/ critical area approval of the building permit. The letter included information about a county wetland assistance program in place in 2014 which provided a free wetland assessment from a wetland consultant contracted with the county. On September 4, 2014 I received an email from Mr. Stanton which said he had faxed the application for the free wetland assistance program. I do not believe this application made it our department as it was not documented or entered into our permit tracking system or the application was discarded following later correspondence with other staff. Some point after receiving my letter believe the property owner called a council member or Mike Thomas in protest of the requirement of a wetland assessment. On September 7, 2014 I received an email from SJC DCD Director, Sam Gibboney which said Mike Thomas, County Manager and a ?local wetland expert? someone with the initials visited the site and determined that there were no wetlands present so need for a wetland assessment. No information was included in the email in regards to how Mike and the ?local wetland expert" came to the conclusion that no wetlands were present, I thought this odd because saw something very different on site. sent Sam an email on September 11, 2014 asking if we received any written determination from the ?local wetland expert?, following an email request from Sheryl Albritton. did not receive any response from Sam. I approved this permit on September 12, 2014 following several frustrated inquiries from the applicant's agent asking why this permit wasn?t issued yet. later verbally reminded Sam for a written response for the file and she said she would look into it and get back to me. never received any additional written documentation other than the email from Sam dated September 7, 2014. Since did not receive any response from Sam I spoke to Linda Kuller, Planning Manager regarding this issue. I emailed her on December 12, 2014 with Sam's email attached. To this date, no written documentation was ever provided from the ?local wetland expert?. Box 947 Friday Harbor, WA 98250 (3 60) 378-2354 (360) 373-2116 Fax (360) 378-3922 PCIINQ-15-0003 FINAL REPORT May 7, 2015 TO: Sam Gibboney, Director of the Department of Community Development RE: and 654194 On January 201?, 2015 I received an Environmental Tracking Report System (ERTS) noti?cation from the Department of Ecology regarding concern over possible violation of the County?s Critical Area Ordinance (CAO) as it applies to wetland protection standards. My review of County records and site evaluation by the Department of Ecology?s Wetland Specialist Doug Gresham determined that three Category IV wetlands exist on this property but that no infractions were identi?ed. On January 23, 2015, I contacted DOE Wetland Specialist Doug Gresham, PWS and requested his assistance in determining whether or not wetlands were present. On January 26, 2015, Doug Gresham and I visited the parcel in question. Mr. Gresham ?rst Walked the site and determined that there were three areas in close proximity that had indications of wetland habitat that required further investigation and offered to rate and delineate those areas (Exhibit B). Mr. Gresham proceeded to rate and delineate the upper pond area (Wetland Exhibit B) on parcel 353450053 and the wetland area below the pond that extends from parcel 353450053 into the applicant?s parcel 35345009 (Wetland Exhibit B) and a smaller area east of the driveway and near Treeline Drive (Wetland Exhibit B). Mr. Gresham dug soil pits at each location and veri?ed the presence of hydric soils at all locations and then proceeded to delineate each wetland area (See Ecology Wetland Findings for the Hughes Property Exhibit A). After the delineations were complete and an initial determination that the upper pond and the lower area below (Wetlands and Exhibit B) were Category wetlands of suf?cient size to be regulated 10005t) we measured the distance from the wetland edges to the Hughes? project and found that it was properly placed outside what would be the Water Quality buffer of 60? and the Habitat Buffer of 110? pursuant to SJCC 1330.150 Tables 3.3; and 3.4 respectively. From the edge of Wetland we measured 89' to some ground disturbance associated with the project which is within the habitat buffer but allowed pursuant to SJ CC 18.30.150 Table Wetland was measured to be approximately 4003f and therefore not regulated pursuant to SJCC Considering the on-site ?ndings of Mr. Gresham, further review of County Code and on-site measurements, Code Enforcement finds the Hughes? project to be in compliance with wetland protection standards and ?nds no violation of those standards. There are some minor violations of the permit in that the approved Storm Water Management Plan's (SWMP) Best Management Practices (BMPS) have not been fully implemented. Regarding the ERTS Complainant?s allegations concerning the driveway being expanded into a channel: The Portland Fair Estates plat was recorded in 197] and the face of the plat illustrates a conveyance through the subject property that appears relatively intact; additionally the drive in question was established before 2003 and before the current CAO regulations. The conveyance appears on the County?s GIS overlay as an unclassi?ed stream however, it is clear that the entire platted area has undergone decades of substantial alteration and the ?stream? currently exists as a ditch with culverts along Treeline Drive along the southern property line of the Hughes and at this time no infraction appears to have occurred. The drive appears to have been modi?ed to act as a construction access as required by the Storm Water Management Manual Element 2, BMP C105, as speci?ed in the approved SWMP and will become the only drive once the project is complete. Code Enforcement will work with the property owners and their contractor to bring their project into compliance with the SWMP but otherwise finds no need for formal enforcement action and considers the enforcement inquiry closed. February 5, 2015 I received Wetland Specialist Doug Gresham report (Exhibit A) on the Hughes? wetland in which Mr. Gresham rates the wetlands in question as Category IV.
