When the officers arrived at the location, the Victim, Subject 1, was seen holding a knife to his throat. The officers ordered Subject 1 to put the knife down, but he did not comply. Officer B attempted to subdue Subject 1 by deploying his taser, but the taser had no effect on Subject 1. Subject 1 removed the prongs from his person, grabbed his common-law wife, Witness 1, from behind and placed a knife to her throat. The officers ordered Subject 1 to release Witness 1. Subject 1 hesitated, pushed Witness 1 to the side and lunged forward at the officers. Officer A discharged his weapon. Subject 1 sustained gunshot wounds to his upper torso. The officers radioed for an ambulance and once the ambulance arrived, Subject 1 was transported to Cook County’s Stroger Hospital. Subject 1 was pronounced dead at 2138 hours on 24 December 2009. INVESTIGATION: Officer B related to the Round Table Panel an account that was consistent with the above summary. Officer B told the panel that on 24 December 2009, once he arrived at 20XX West 51st Street, he saw Subject 1 and his young son (later identified as Witness 2) enter the residence. Officer B, Officer A and Officer C followed Subject 1 into the residence. Upon entering the residence, Officer B saw that a Christmas tree had been turned over. Officer B heard Subject 1 yell, “My tree I don’t care!” Subject 1 took a long knife, with a wooden handle, and placed it against his throat. Officer B ordered Subject 1 to drop the knife, but he did not comply. Officer B looked in another room and saw other knives protruding from a chest of drawers. Officer B ordered Subject 1 to drop the knife again, but he failed to comply. Officer B deployed his taser, but it had no effect on Subject 1 Officer B saw Subject 1 pull out the taser prongs. Officer B reloaded the taser and deployed it a second time, but Subject 1 removed the prongs again and they seemed to have no effect on him. By this time Subject 1 was holding the knife to Witness 1’s throat. Officer C drew his weapon and positioned himself behind Subject 1 while Officer B and Officer A continued to order Subject 1 to release Witness 1. Subject 1 suddenly pushed Witness 1 to his left and lunged toward Officer B and Officer A with the knife still in his hand. Officer A discharged his weapon, striking Subject 1 in his upper torso area. Subject 1 collapsed to the floor. Officer C related to the Round Table Panel an account of the incident that was consistent with the above summary. Officer C related to the panel that on 24 December 2009, once he responded to Subject 1’s residence, he saw Subject 1 exit his residence and then re-enter. Officer B entered the residence, followed by Officer C and Officer A. Officer C saw Subject 1 with his arms folded against his chest. Officer B spoke to Witness 1, who stated that she wanted Subject 1 to leave the residence. Subject 1 yelled, “I’m not going anywhere” and then he placed a knife to his (Subject 1’s) neck. Officer B deployed his taser, but the taser had no effect on Subject 1 Subject 1 removed the prongs from his person and grabbed Witness 1 from behind and placed the knife to her neck. Officer B ordered Subject 1 again to put the knife down, but he refused. Officer B deployed his taser again, but Subject 1 removed the prongs again and the taser had no effect on him. Once Officer C re-positioned himself behind Subject 1, Subject 1 pushed Witness 1 in Officer C’s direction. Officer C heard several gunshots coming from the direction of the entry way into the kitchen, near where Officer B and Officer A were standing. Subject 1 collapsed to the floor. Officer A related to the Round Table Panel an account of the incident that was consistent with the above summary. Officer A added that once he approached the residence, he saw Subject 1 enter the residence followed by Officer B and Officer C. Officer A removed his weapon from its holster and held it downward as he entered the residence. Officer A saw Subject 1 standing near a sofa and his hands were folded across his chest. Officer B spoke to Witness 1. Officer A saw that the family Christmas tree had been turned over. Then Officer A heard Subject 1 yell, “Fuck that tree.” Subject 1 suddenly placed a knife against his throat. Officer A and Officer B ordered Subject 1 to drop the knife, but he refused. Officer B removed his taser and deployed his taser at Subject 1 but the taser had no effect on him. Subject 1 removed the prongs from his person. Officer A removed his ASP and swung at Subject 1 in order to subdue him, but he missed. Subject 1 grabbed Witness 1 from behind and placed the knife to her throat. Officer A and Officer B remained in the hallway, between the kitchen and the living room. Officer C entered the kitchen and maneuvered himself behind Subject 1 The officers ordered Subject 1 to drop the knife. Subject 1 pushed Witness 1 to the left and lunged forward, toward Officer B and Officer A. Officer B re-positioned himself behind Officer A and to his right. Officer A fired his weapon four times, striking Subject 1 in his upper torso and he collapsed to the floor. CPD Detective 1, told the Round Table Panel that she spoke to the Witness 1. Witness 1 provided CPD Detective 1 with an account of the incident that was consistent with the above summary of incident. Witness 1 told CPD Detective 1 that on 24 December 2009, she, Subject 1, and their nine year old son, Witness 2, were doing Christmas shopping. Once they returned to their residence, Subject 1 and Witness 1 engaged in a verbal altercation. Witness 1 added that Subject 1 punched Witness 1 on the left side of her face and pushed her. Witness 1 called “911.” Subject 1 knocked their Christmas tree to the floor, and placed several knives in a chest of drawers with their handles exposed. Minutes later some officers responded. Subject 1 placed a butter knife to his throat. The officers tased Subject 1 with no effect. Subject 1 grabbed Witness 1 and placed the knife to her neck. Witness 1 related that she tried to calm Subject 1 down. The officers shot Subject 1 and he collapsed to the floor. Then the police escorted Witness 1 out of her residence. Page 3 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 CPD Detective 1, told the Round Table Panel that she spoke to the witness, Witness 2. Witness 2 provided CPD Detective 1 with an account of the incident that was consistent with the above summary of incident. Witness 2 told CPD Detective 1 that on 24 December 2009, his mother, Witness 1, called 911. Subject 1 (his father) held a knife to Witness 1’s throat. Witness 2 told CPD Detective 1 that when Subject 1 drinks he gets “crazy” (Att. # 4). In an interview to IPRA on 15 January 2010, the Witness 2, (a minor) provided the following account of the incident which was consistent with the summary of incident above. Witness 2 stated that on 24 December 2009, he had gone Christmas shopping with his parents, Subject 1 and Witness 1. By the time they returned home, Subject 1 was intoxicated. Subject 1 slapped and pushed Witness 1. Subject 1 knocked down the Christmas tree and then instructed Witness 2 to open his presents. Witness 2 refused and told Subject 1 that he would open only one present at midnight. Subject 1 became upset. Witness 1 called “911.” Once the police arrived they had their weapons out, Subject 1 took a butter knife and placed it against his (Subject 1) neck. Subject 1 grabbed Witness 1 and placed the knife to her person. The officers tasered Subject 1 and shot him. Witness 2 stated that he was in the living room while Subject 1 and Witness 1 were in the kitchen when the shooting occurred. Witness 2 stated that he did not have a clear view of the incident (Att. # 17). In audio interview to IPRA on 21 January 2010, the Witness 1, provided the following account of the incident which was consistent with the summary of incident above. Witness 1 stated that on 24 December 2009, she had gone Christmas shopping with her common-law husband, Subject 1, and their son, Witness 2 They stopped at a home to deliver a gift. Subject 1 got angry because delivering this gift took a long time. Subject 1 began to yell out the car window and to rev up the car motor to get Witness 1 to hurry. While on their way home it was slippery outside so Witness 1 asked Subject 1 to slow down. Once they reached their residence and unloaded the gifts, Witness 1 saw that Subject 1 was upset. She stated that he had consumed three shots of Gin an hour prior, but she did not believe he was intoxicated. Witness 1 and Subject 1 engaged in a verbal and physical altercation in the living room. Subject 1 pushed Witness 1 and she fell on their couch. As they approached the entrance of their bedroom, Subject 1 slapped her. She told Subject 1 that she did not want to fight in front of their son and she asked him to wrap the gifts with her. Subject 1 picked up the Christmas tree and threw it, causing it to fall near Witness 2’s bedroom and the refrigerator. Witness 1 called “911” and told the dispatcher that she and Subject 1 were fighting again and he had pushed her and slapped her. While she waited for the officers to arrive, she saw Subject 1 get some knives from the kitchen and take them to the bedroom and place them in a drawer. Then he left the drawer open where the knives were exposed. Page 4 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 The police arrived shortly thereafter and Witness 1 opened the door for them. The officers asked where Subject 1 was. Subject 1 exited the bedroom and spoke to the officers in the living room. Witness 1 stood near the bedroom, closer to the kitchen. Suddenly while Subject 1 was talking to the officers, he produced a large steak knife, possibly from the jacket he was wearing, and placed the knife to his throat. Witness 1 pleaded with Subject 1 to stop his actions, but he responded that he knew the officers were planning to tase him. Subject 1 argued with the officers. Suddenly, one of the officers tasered Subject 1 but Subject 1 removed the wires from his clothes. Then Subject 1 grabbed Witness 1 and placed the knife to her throat. Witness 1 pleaded for her life. At some point she heard two gunshots (Att. # 54). The Case Report (HR704806) did not provide a narrative account of the incident. The report reads, “See Detective Supplementary…” (Att. #5). The Detective Supplementary Case Reports (HR 711004 and HR 704806) indicate that Subject 1 was a black male, approximately 44 years old, with black hair, a short hair style, with brown eyes and a medium brown complexion. The reports include an account of the incident that is consistent with the summary of incident and the interviews summarized above. The reports added that Officer A and Officer C were assigned to Beat 0924 and working in uniform. Officer B was working Beat 910 and dressed in uniform. Officer B and Officer A and Officer C responded to a domestic disturbance at 20XX West 51st Street. Once they arrived they encountered Subject 1 and followed him inside his apartment. The officers spoke to Witness 1, who had engaged in a domestic altercation with Subject 1 earlier. Witness 1 told the officers that she wanted Subject 1 to leave. Subject 1 produced a large hunting knife, placed it to his own throat and told the officers that he was not leaving. The officers gave Subject 1 verbal commands to drop the knife, but he refused to comply. Officer B deployed his taser, but it had no effect on Subject 1. Once Subject 1 removed the taser probes, he grabbed Witness 1 from behind and placed the knife to her throat. Subject 1 backed out of the living room and into the kitchen, while still holding Witness 1 from behind with the knife at her throat. The officers followed Subject 1 and gave him verbal commands to cease his actions, which he ignored. Officer B deployed his taser a second time. Subject 1 charged at Officer B and Officer A. Officer A feared for his life and Officer B’s life so he fired four shots at Subject 1 who collapsed in the hallway between the kitchen and the living room. The Detective Supplementary Case Report prepared by CPD Detective 2, dated 3 January 2010, added that Subject 1 was pronounced dead by Doctor A on 24 December 2009 at 2138 hours. The cause of death was gunshot wound. The Detective Supplementary Case Report, prepared by CPD Detective 2 on 21 October 2010, added that when CPD Detective 2 arrived at 20XX W. 51st Street, he spoke to Witness 2 Witness 2 told CPD Detective 2 that on 24 December 2009; his parents (Witness 1 and Subject 1) picked him up from his babysitter’s home. Subject 1 remained inside their car and he began honking his horn. Witness 1 started walking toward their car when she fell. Subject 1 appeared angry and acted “crazy as hell.” Page 5 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 Subject 1 drove onto the sidewalk and told Witness 1 to get in the car, but she initially refused. Once Subject 1, Witness 1 and Witness 2 arrived at home, Subject 1 flipped over their Christmas tree and pushed Witness 1. Then Subject 1 told Witness 2 to open his presents because he (Subject 1) believed that he would be going to jail. Once the officers arrived, they ordered Subject 1 to put down his knife, but he refused. Then Witness 2 saw Subject 1 take his knife and place it to Witness 1’s neck and grab her by her throat. Witness 2 stated that he believed that Subject 1 was going to kill Witness 1. Subject 1, also took the knife and placed it to his own throat. Witness 2 saw the officers tase Subject 1 and then the police shot Subject 1 twice. Witness 2 told CPD Detective 2 that Subject 1 hits Witness 1 “all the time” and that when Subject 1 drinks he acts “crazy.” As a precaution he (Witness 2) keeps a baseball bat in the front hallway for protection. CPD Detective 2 added that Chicago Police Department records reveal that the police had been summoned to 20XX West 51st Street numerous times in the months preceding the incident because of on-going domestic-related issues between Witness 1 and Subject 1 CPD Detective 2 added that following the Round Table no C.R. Number was obtained and the officers’ actions were deemed to be within the Chicago Police Department’s Use of Force Guidelines (Att. #s 29, 47 and 48). Officer A’s Tactical Response Report (TRR) and Officer’s Battery Report indicated that he encountered Subject 1 on 24 December 2009, at 2055 hours, at 20XX West 51st Street. The report indicated that Subject 1 was involved in a domestic disturbance and that he failed to follow the officers’ verbal directions. The report stated that Subject 1 posed an imminent threat when he attacked the officers with a knife. The report indicated that Subject 1 was tasered, but he was unaffected by the taser deployment. Officer A reported that when Subject 1 attacked the officers with a knife, he feared for his life and fired his weapon at Subject 1, striking him (Att. #s 6, 7). Officer B’s TRR and Officer’s Battery Report indicated that he encountered Subject 1 on 24 December 2009 at 2055 hours at 20XX W. 51st Street, inside the first floor apartment. The report indicated that Subject 1 did not follow verbal direction and posed an imminent threat of battery when he attacked Officer B with a knife, so Officer B deployed his taser (Att #s 45, 46). The Office of Emergency Management and Communications (OEMC) Event Query provided information that is consistent with the accounts of the incident. The event query further indicates that Witness 1 called the police on 24 December 2009 at 2058 hours and told the dispatcher that her husband (Subject 1) was drunk and ungrateful. She stated that he (Subject 1) turned over their Christmas tree, slammed her into a wall and threw various items around their home (Att. # 14, 18). The Chicago Fire Department’s ambulance report stated that on 24 December 2009 at 2055, the paramedics received a call that Subject 1 was the victim of a shooting. Subject 1 was found unresponsive, lying in a pool of blood. Subject 1 had a faint pulse. The paramedics saw two gunshot wounds to his chest and one to his hip and one to his leg (Att. # 51). Page 6 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 Subject 1’s medical records document that he was admitted to Cook County’s Stroger Hospital on 24 December 2009 in traumatic arrest. The report indicated that Subject 1 sustained a gunshot wound to his right “parasternal region,” near his third rib, a second to his “inferior right nipple,” a third to his right upper thigh, a fourth in his pelvis and the hospital staff observed a taser barb over his “epigastrum.” The report indicated that Subject 1 had a girlfriend named Witness 1, but no wife. Subject 1’s mother was notified of Subject 1’s condition and whereabouts. According to the report, Subject 1 suffered traumatic cardiac arrest and was pronounced dead (Att. # 53). An Illinois State Police Division of Forensic Services (ISP) report dated 31 August 2010 indicates that one of the fired bullets found at the scene could not be identified or eliminated as having been fired from Officer A’s firearm. Three of the cartridge cases found at the scene were matched with Officer A’s Smith and Wesson Glock, model 22 semiautomatic pistol. Officer A’s weapon was examined and found to be in good firing condition. An ISP report dated 20 July 2011 indicates that a hunting knife was inventoried but the knife did not reveal any latent impressions suitable for comparison. The bullets recovered from Subject 1 were not tested for comparison with Officer A’s firearm (Att. # 34). The Evidence Technician photographs depict the exterior of the residence at 20XX West 51st Street. The photos show the apartment’s living room. A gray couch was on one wall, a large floor- model television on another wall and a computer desk and book shelf on a third wall. There were CDs, packages and debris on the floor. The photos depict a bedroom with gray cabinets inside. One of cabinet’s drawers had a knife protruding out of it. The kitchen contained a round table with packages on top. There appeared to be a bullet hole in one of the walls (Att. # 15). The Medical Examiner’s photographs depict that Subject 1’s clothes consisted of beige gym shoes, dark-colored boxers, and white socks. The photos depict what appears to be a gunshot wound underneath his left arm, near his elbow, a gunshot wound underneath his right armpit, a taser prong near the center of his chest, a gunshot wound near his left groin area and another gunshot wound at the top of his front left thigh, near his groin. Photos of the bullets removed from Subject 1’s body depict what appeared to be a star-shaped pattern (Att. # 19). The Medical Examiner’s Report indicated that Subject 1 was examined on 26 December 2009 at 1125 hours by Doctor B. 1 According to the report, Subject 1 had an entrance gunshot wound to his right upper chest, another entrance wound to the right side of his chest, a third entrance wound to his right lateral thigh and a fourth gunshot wound to his left medial forearm. Subject 1 also sustained some electrical injuries from the taser prongs. The cause of death was multiple gunshot wounds and the manner of death was homicide (Att. # 52). In a statement to IPRA on 30 April 2012, Officer B provided an account of the incident which was consistent with the accounts provided to the Round Table Panel and with Chicago Police Department reports. Officer B stated on 24 December 2009, he and Officer C and Officer A responded to a domestic disturbance at 20XX W. 51st Street. Once they arrived he saw Subject 1 standing outside the doorway of his residence and the officers watched as Subject 1 went inside. Once they reached the door, Witness 1 allowed them to enter and she told them that she and Subject 1 had an argument and that he was going crazy. Witness 1 told the officers that Subject 1 was knocking things over and that he had physically mistreated her so she wanted him to leave the residence. Officer B saw Subject 1 in the residence and he described him as a large male. When the officers told Subject 1 that Witness 1 wanted him to leave the residence, Subject 1 removed a large knife that he had concealed in his arms and placed the knife to his (Subject 1’s) neck. Officer B and Officer C and Officer A stepped back and drew their weapons for their safety. The officers ordered Subject 1 to drop the knife, but he refused. Officer B deployed his taser, but it had no effect on Subject 1 Subject 1 pulled out the taser probes, grabbed Witness 1 and placed his knife to her neck. While Subject 1 used Witness 1 as a shield, the officers order him to drop the knife, but Subject 1 responded that he was going to kill Witness 1. Witness 1 began to scream and she pleaded with Subject 1 to leave her alone and not to kill her. While still holding Witness 1 and the knife, Subject 1 left the living room and walked down the hallway toward the kitchen. The officers continued to order Subject 1 to drop the knife, but he refused. The officers tried to position themselves in order to diffuse the situation. Officer B was in front of Subject 1 while Officer A was to Officer B’s left and Officer C was to Officer B’s right. The officers tried to communicate to each other to develop a strategy where nobody would get hurt. Officer B holstered his weapon and deployed his taser a second time. Subject 1 pushed Witness 1 to the side, in the direction of Officer C, and began to charge in Officer A and Officer B’s direction, with his hand up in the air and the knife in his hand. Officer B tried to get his weapon out and he saw the knife coming down in his direction. Suddenly, he heard four shots and Subject 1 collapsed to the floor (Att. # 55). In a statement, at IPRA on 25 April 2012, Officer A provided the following account of the incident. The statement is consistent with the summary above, Officer A’s account given before the Round Table Panel and with Chicago Police Department reports. Officer A stated that on 24 December 2009, he responded to Subject 1’s home at 20XX West 51st Street, along with Officer B and Officer C. Officer A saw Subject 1 standing outside his apartment when they first arrived, but when Subject 1 saw the police Page 8 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 he entered his residence. Once Officer A, Officer C and Officer B followed Subject 1 inside his residence, Officer A saw Subject 1 in the living room with his arms folded. Officer B began to question Witness 1 about what happened. Witness 1 told Officer B that Subject 1 had thrown food at her, pushed her and uprooted their Christmas tree. Witness 1 told the officers that she wanted Subject 1 to leave the residence. Officer B told Subject 1 that he should leave, but he refused. Suddenly, Subject 1 produced a large hunting knife and held it to his neck. Officer A ordered Subject 1 to drop the knife, but he did not comply. Officer A warned Subject 1 telling him that he did not want Witness 2 to remember this scene. Officer A heard a taser popping sound. Officer A holstered his weapon, took out his baton and attempted to knock the knife out of Subject 1’s hand. The taser had no effect of Subject 1 Officer A saw Subject 1 run toward Witness 1. Officer A took his ASP and swung at Subject 1’s knees, but missed. Once Subject 1 grabbed Witness 1, Officer C tried to grab and wrestle Witness 1 away from Subject 1 By this time Subject 1 and Witness 1 were inside the kitchen. Subject 1 threw Officer C inside the kitchen, so Officer C positioned himself behind Subject 1 and Witness 1. Subject 1 was grabbing Witness 1 from behind, in a chokehold, and he placed the knife to her neck. The officers ordered Subject 1 to drop the knife and to let Witness 1 go, but he refused. Officer A heard another taser popping sound and saw that Officer B had deployed his taser a second time. Subject 1 pushed Witness 1 to the floor and charged at Officer B and Officer A, with the knife still in his hand. Officer A stated that he was in fear of his life and that of Officer B so he fired four times at Subject 1 and Subject 1 collapsed to the ground (Att. # 57). In a statement to the IPRA on 30 April 2012, Officer C provided the following account of the incident which is consistent with the summary above and the account given before the Round Table Panel. Officer C stated that on 24 December 2009, he, Officer A and Officer B responded to Subject 1’s residence. Officer C saw Subject 1 standing on his front porch, but when he saw the officers, Subject 1 entered his apartment. Officer C, Officer A and Officer B followed Subject 1 inside, where Officer C saw Subject 1 seated on a couch. Witness 1 was irate when she told the officers that Subject 1 had turned over their Christmas tree. Officer C asked Subject 1 to leave the residence, but he refused and stated, “I’m not going anywhere.” Suddenly Subject 1 stood up from the couch and produced a knife and he held it in his right hand. Subject 1 placed the knife to his throat and repeated that he was not going anywhere. Officer C and Officer A withdrew their weapons while Officer B removed his taser. Officer C asked Subject 1 again to drop the knife, but he refused. Officer B deployed his taser, but the taser probes had no effect on Subject 1 Subject 1 appeared more irate than before and he began yelling loudly. Officer B re-loaded his taser and deployed it a second time, but it had no effect on Subject 1 Subject 1 removed the prongs while still holding the knife in his hand. Officer A removed his ASP and attempted to strike Subject 1 on his back side, but he missed. Officer A removed his weapon again. Subject 1 took Witness 1 into the kitchen. Officer C followed Subject 1 and stood near a kitchen table to try to get a clear line of fire. Approximately 15 to 20 seconds passed as the officers continued to order Subject 1 to drop the knife and let Witness 1 go, but he refused. Subject 1 pushed Witness 1 toward Officer C and then, with the knife still in his hand, Subject 1 lunged toward Officer A, who was standing next to Officer B. Officer A fired his handgun, striking Subject 1 and causing him to collapse to the floor (Att. # 56). Page 10 of 11 INDEPENDENT POLICE REVIEW AUTHORITY Log # 1032749 /U# 09-53 FINDINGS: The investigation found that the use of deadly force by Officer A was in compliance with Chicago Police Department policy. According to the Chicago Police Department’s General Order No. 02-08-3, III: A. A sworn member is justified in using force likely to cause death or great bodily harm only when he or she reasonably believes that such force is necessary: 1. to prevent death or great bodily harm to the sworn member or to another person, or: 2. to prevent an arrest from being defeated by resistance or escape and the sworn member reasonably believes that the person to be arrested: a. has committed or has attempted to commit a forcible felony which involved the infliction, threatened infliction, or threatened use of force likely to cause death or great bodily harm or; b. is attempting to escape by use of a deadly weapon or; c. otherwise indicates that he or she will endanger human life or inflict great bodily harm unless arrested without delay. The officer’s actions were in accordance with the requirements spelled out above by A (1). By all accounts Subject 1 had posed an imminent threat when he lunged towards Officer A and Officer B. As such, Officer A was acting under the reasonable belief that Officer A’s and Officer B’s lives were in imminent danger and thus was justified in using deadly force to “prevent death or great bodily harm to the sworn member or to another person.” Page 11 of 11
