INVOLVED SUBJECT: “Subject 1”; Male/Black; 54 years XX W. 83rd St. INVOLVED SUBJECT’S INJURIES: Multiple gunshot wounds/ non-fatal INITIAL INCIDENT: The involved officer responded to a call for assistance from the Illinois State Police regarding a man barricaded inside a home with a knife. DATE/TIME: 30 JAN 11, 0523 hours LOCATION: XX W. 83rd St. – inside Beat 0622 Independent Police Review Authority Log#1043057/ U#11-06 SUMMARY OF INCIDENT: On 30 January 2011, at approximately 0520 hours, Chicago Police Department (CPD) Officer A, Officer B, Officer C, Officer D, as well as, Officer E and several other officers responded to a call for assistance from the Illinois State Police (ISP) at XX W. 83rd St. Upon arrival at the scene, ISP members related to CPD members that Subject 1 was involved in a domestic battery altercation on the expressway earlier that morning and that he was currently barricaded inside his upstairs bedroom with a knife. Upon entry of the residence, Officers A, C, D, and E observed blood on the walls and floor. Officers A, C, and D, along with two ISP members went upstairs. Officer E stayed downstairs in the kitchen and spoke with Subject 1’s roommate, Witness 2. Officers A, C, and D lined up respectively in the hallway outside Subject 1 bedroom door and ordered Subject 1 several times to come out of his bedroom without the knife. Subject 1 refused to comply with the officers’ verbal commands. Officer D kicked open the door and the three officers observed Subject 1 holding a knife. The officers ordered Subject 1 to drop the knife and come out of the bedroom. Subject 1 screamed and charged out of the bedroom toward the officers while wielding the knife above his head. Officer D moved into a hallway bathroom and Officer A then fired two shots striking Subject 1 in his flank area. Subject 1 fell to the floor where he continued to struggle with officers until he was tasered by Officer C. Subject 1 was placed into custody and transported by a Chicago Fire Department (CFD) ambulance to Stroger Hospital, where he again resisted officers by running away, kicking and flailing his arms, until tasered again by Officer C. Subject 1 was admitted into Stroger Hospital with multiple gunshot wounds. He was discharged into police custody on 01 February 2011. Page 2 of 15 Independent Police Review Authority Log#1043057/ U#11-06 INVESTIGATION: In a statement to the Independent Police Review Authority (IPRA) on 30 January 2011, Witness 1 stated that earlier that morning she and her boyfriend/Subject 1 left a friends’ party and were driving on I-94 when the couple began to argue. During their argument, Subject 1 struck Witness 1 several times on the face. Witness 1 observed blood coming from her nose. Subject 1 told Witness 1 that she was not getting out of the car. Thereafter, Witness 1 jumped to the rear seats of the vehicle to avoid being struck by Subject 1. Subject 1 stated to Witness 1, “I guess we’re going to die tonight,” and began driving excessively fast. Moments later, Witness 1 opened the rear driver side door and jumped from the vehicle. Witness 1 struck the ground and lost consciousness momentarily. When Witness 1 regained consciousness, there were people on the scene requesting medical assistance for her. An ambulance arrived at the scene and transported Witness 1 to Christ Hospital. Witness 1 related that at the party she and Subject 1 both consumed three drinks of cranberry juice and vodka. Witness 1 did not believe Subject 1 was drunk, due to the fact that he was able to drive. Witness 1 stated that Subject 1 had been insecure for the past few weeks and that he lost his job in October 2010. She also stated that Subject 1 began accusing her of being unfaithful since December 2010. Witness 1 and Subject 1 have been in a relationship for thirteen years. After jumping from the vehicle, Witness 1 did not have any further contact with Subject 1. Witness 1 sustained a fractured nose, a fractured right knee, a fractured right cheekbone, and abrasions about the head, shoulders, feet, face and hands. In a statement to the Independent Police Review Authority (IPRA) on 30 January 2011, Officer B stated that she and her partner, Officer A responded to a call to assist Illinois State Police Troopers with a man barricading himself in the house with a knife. They arrived at XX West 83rd St. and observed several state trooper squad cars parked outside the residence. At that time, Officer B ran towards the residence and approached the front door. She attempted to open the gate but it was locked. However, Officer B observed that the front door to the residence was open wide. She witnessed several troopers standing inside the residence looking up towards a staircase with their weapons drawn. At that time, one of the troopers yelled from the residence telling Officer B and other CPD officers that the gate was locked. Officer A along with several other CPD officers ran through a gangway along the side of the residence. Officer B stayed outside the residence and secured the perimeter. After a few minutes, Officer B heard muffled yelling and then heard two gunshots. She then heard an officer announce over the radio that shots were fired by police. Officer B also heard an officer request an ambulance over the radio. Shortly afterwards, Officer A came back outside and stated “I shot him. He came at us with a knife so I shot him.” 1 1 Interview of Officer B, Page 12, lines 11-12 Page 3 of 15 Independent Police Review Authority Log#1043057/ U#11-06 Officer B stated that she never entered the residence. She also stated that Officer A sustained a bruise to his leg during the incident. In a statement to the Independent Police Review Authority (IPRA) on 30 January 2011, Officer C stated that he and his partner, Officer D responded to a call to assist Illinois State Police Troopers at XX W. 83rd St. When the officers arrived at the scene, Officer C followed Officer D through a gangway on the side of the residence and then entered and went upstairs to the second floor of the residence. Officer C observed drops of blood on the stairs. At that time, Officer D, Officer A, Officer E and two troopers were present upstairs, along with Officer C. The troopers told the officers that Subject 1 was involved in a domestic battery altercation on the expressway earlier that morning and that he was currently locked inside his bedroom with a knife. The two troopers, one Black male and one White male went into the front bedroom on the second floor. The officers stood in the hallway and Officer C could hear muffled talking coming from the rear upstairs bedroom. Officer E told Subject 1 to “Come out.” 2 Officer A told Subject 1 to “Slide the knife up under the door.” 3 Officer E went downstairs to speak with Subject 1’s roommate. At this point, Officer D stood in front of Subject 1’s bedroom door while Officer A and Officer C respectively stood behind him. Officer D talked to Subject 1 but Officer C could not hear Subject 1 responding. Officer D kicked in the door to Subject 1’s bedroom and Officer C observed Subject 1 in the left corner of the room with his hands on a table. Officer C stated that it was pitch black in the bedroom but the hallway light illuminated the bedroom. Subject 1 immediately raised his right arm and yelled “Awww!” Subject 1 lunged toward the officers while holding a knife in his right hand. Officer D dove into the bathroom on the right side of the hallway and shut the door. As Subject 1 crossed the threshold of the doorway, Officer A shot his gun twice. At that time, Subject 1 was approximately 5 or 6 feet away from Officer A. Officer C went downstairs and seconds later returned upstairs and observed Subject 1 lying on his stomach in the hallway. Officer D handcuffed Subject 1 left arm but was unable to handcuff his right arm due to Subject 1 flailing his arm around. The officers directed Subject 1 to give them his hand and stop resisting. Officer D stated “Taser, Taser” 4 In response, Officer C lifted up Subject 1’s shirt and tasered him once. Both taser probes attached to Subject 1’s back. When Subject 1 still did not comply with the verbal commands, Officer C tasered him again. At that point, Subject 1 put his right hand behind his back and Officer C observed cuts on Subject 1’s wrists. A trooper helped Officer D finish handcuffing Subject 1. Officer C heard an officer call for an ambulance over the radio. When the ambulance arrived, Subject 1 was placed inside and transported to Stroger Hospital. Officers C and D followed the ambulance in their squad car. When he arrived at the hospital, Officer C observed Subject 1’s gurney being taken out of the ambulance. As the gurney was being taken out of the ambulance, Subject 1 jumped off the gurney and he ran towards the entrance of the parking lot. Officer C chased Subject 1 and performed an emergency takedown. 2 Interview of Officer C, Page 7, line 5 Id. Page 7, line 6 4 Id, Page 3 Page 4 of 15 Independent Police Review Authority Log#1043057/ U#11-06 Subject 1 swung his arms and kicked his legs, as Officers C, D, and F tried to gain control. Officer C performed a drive taser stun on Subject 1 and the officers were able to handcuff him and transport him inside the emergency room. In a statement to the Independent Police Review Authority (IPRA) on 30 January 2011, Officer D stated that he and his partner, Officer C responded to a call to assist Illinois State Police Troopers at XX W. 83rd St. When the officers arrived at the scene, they went inside the residence through a side door. The troopers informed the officers that the Subject 1 was barricading himself in his bedroom with a knife. Officer D walked upstairs to the second floor and he and Officer A cleared the first bedroom and bathroom. At that point, two troopers were in the first bedroom and Officers A, C, and D were lined up respectively in the hallway outside the rear bedroom. The officers asked Subject 1 to come out the bedroom. Subject 1 responded that he had hurt himself. Officer D stated that he heard some commotion in Subject 1’s bedroom and kicked in the door. He observed Subject 1 standing towards the back of the bedroom with his hands on a shelving unit. Subject 1 raised his hands, holding a knife in his right hand and screamed while charging towards the officers. Officer D jumped sideways into the bathroom and closed the door. He then heard two gunshots. After Officer D opened the bathroom door, he observed Subject 1 lying face down in the hallway with a trooper attempting to get him handcuffed. The knife was lying near his head and his right hand was outstretched toward his head. Officer D observed that both of Subject 1’s wrists were cut but did not see any gunshot injury. The officers and troopers directed Subject 1 to give them his right hand. Subject 1 failed to comply with the verbal commands, so Officer C tasered him in the lower back. Subject 1 continued to disregard the officers' commands, so Officer C tasered Subject 1 again. At that time, Subject 1 was handcuffed and an officer called for an ambulance over the radio. When the ambulance arrived, Subject 1 was placed inside and transported to Stroger Hospital. Officers C and D followed the ambulance in their squad car. When he arrived at the hospital, Officer D observed Subject 1’s gurney being taken out of the ambulance. As the gurney was being taken out of the ambulance, Subject 1 jumped off the gurney and ran towards the entrance of the parking lot. Officers C, D, and F chased Subject 1 and Officer C performed an emergency takedown. Subject 1 flailed his arms and resisted arrest, so Officer D struck him with an aspiton. Officer C performed a drive taser stun on Subject 1 and the officers were able to handcuff him and transport him inside the emergency room. (Att. 23) In a statement to the Independent Police Review Authority (IPRA) on 31 January 2011, Officer A, stated that he and his partner, Officer B responded to a call to assist Illinois State Police Troopers with a man inside a house with a knife. They arrived at XX West 83rd St. and Officer A observed CPD and ISP squad cars parked outside the residence. At that time, Officers A and B ran towards the residence. Officer A spoke with a Black male trooper who stated that a woman was stabbed and thrown out of a vehicle on the expressway. The trooper further stated that the offender was inside the residence with a knife. Page 5 of 15 Independent Police Review Authority Log#1043057/ U#11-06 Officer A went to the side door of the residence. The side door was open and Officer A observed a few troopers inside the residence giving directions to the offender. He heard the troopers say “Drop the knife. Come on down the stairs. Put your hands up.” 5 At that point, Officer A entered through the side door and he and Officer D went upstairs into a hallway. Officer A observed a bedroom and Officer D went inside to make sure it was clear. Officer A continued down the hallway and on the right side he observed a bathroom. He looked inside and did not see anyone. Officer A noticed that facing him at the end of the hallway was a closed door. Subject 1 was in that rear bedroom. At that time, there was an overhead light on in the hallway and Officer A noticed blood on the floor and walls. Two troopers came upstairs and went into the first bedroom. For approximately five minutes, Officers A and D directed Subject 1 to drop the knife and come out with his hands up. They also directed Subject 1 to slide the knife under the door and open the door with his hands up. After Subject 1 failed to comply with verbal commands, Officer D kicked the door open to the rear bedroom. At that point, Officer A was standing four feet behind Officer D. After the door was kicked open, Officer A looked inside the dark bedroom and observed furniture but did not see Subject 1. He heard Officer D direct Subject 1 to come out with his hands up. At that point, Officer A heard screaming and observed Subject 1 running towards him with a knife over his head. At that point, Officer D jumped back into the bathroom and Subject 1 was now coming directly at Officer A holding the knife above his head moving it in a stabbing manner. When Subject 1 was about four feet away, Officer A fired one round toward Subject 1 but Subject 1 kept coming towards him while screaming and holding a knife. Therefore, Officer A fired another shot. At that time, Subject 1 fell to the floor of the hallway and the knife fell out of his hand. Officer A observed that the knife was a four or five inch serrated knife. Two troopers and Officer D immediately attempted to handcuff Subject 1. Subject 1 was resisting being handcuffed and continued to move his right hand towards the knife. At that point, Officer C deployed a taser against Subject 1 striking him on his back. The troopers and Officer D were then able to cuff Subject 1. Officer E then instructed Officer A to go outside and sit in his vehicle. Officer A stated that his right knee was injured when he banged it on something during the course of the incident. He sought medical treatment at Christ Hospital for the bruised knee. In a statement to the Independent Police Review Authority (IPRA) on 31 January 2011, Witness 2 stated on 30 January 2011 at approximately 0515 hours, he was asleep at his residence located at XX W. 83rd St. when he was awakened by the sound of someone pounding on his neighbor’s door. He heard Illinois State Police Troopers identify themselves to his neighbors and ask for Witness 2’s roommate, Subject 1. He then heard his neighbors direct the troopers to his residence. 5 Interview of Officer A, Page 9, lines 16-17 Page 6 of 15 Independent Police Review Authority Log#1043057/ U#11-06 The troopers knocked on Witness 2’s front door. Witness 2 told the troopers that the security gate on the front door does not open but they could enter through the side door in the gangway. After Witness 2 opened the side door and began walking away from the door, he heard Subject 1’s voice. Witness 2 had not known that Subject 1 was home. After Witness 2 opened the side door, the troopers told him to hold up his hands, lean against the wall and spread his feet. The troopers asked him if he was Subject 1. Witness 2 told the troopers his name and yelled to Subject 1 asking him to come downstairs because there were some people who wanted to talk to him. Subject 1 did not respond. Approximately five or six troopers entered the residence and asked Witness 2 to wait outside. Witness 2 heard the troopers explain to Subject 1 why they were there. Witness 2 became cold outside and went back inside the residence, staying in the kitchen on the first floor. He heard the troopers ask Subject 1 if he had any weapons and could he come to the top of the stairs. He also heard the troopers tell Subject 1 to put his weapon down and put his hands up. The troopers continued to talk calmly to Subject 1. Witness 2 heard Subject 1 tell the troopers that he had a knife. Shortly afterwards, Chicago Police Officers arrived and entered the home. Witness 2 observed about four officers discuss the situation with the troopers. The officers then walked to the top of the stairs and began asking Subject 1 to throw the knife out and come out with his hands up. Witness 2 heard Subject 1 bedroom door open and then he heard officers say “He’s got a knife in his hands.” 6 Witness 2 heard commotion and he heard the officers warning Subject 1 to put the knife down and put his hands up. He did not hear a response from Subject 1 but then he heard a gunshot. After the gunshot, Witness 2 observed officers and troopers retreating downstairs. The officers told Witness 2 that he must go outside because the residence is now a crime scene. He sat inside an officer’s squad car. He did not see Subject 1 taken from the house to an ambulance. In a statement to the Independent Police Review Authority (IPRA) on 7 April 2011, Paramedic 2 stated that he is a paramedic with the Chicago Fire Department. On 30 January 2011, at approximately 0527 hours, he and his partner, Paramedic 1 responded to a call for a gunshot victim at XX W. 83rd St. When the paramedics arrived on the scene, Paramedic 2 noticed several Chicago Police Department and Illinois State Police vehicles parked outside. Paramedics 1 and 2 entered the residence and officers directed them upstairs. The paramedics walked upstairs and observed a man, later identified as Subject 1 lying in the hallway handcuffed with officers standing around him. Paramedic 2 noticed that Subject 1 had two gunshot wounds on the right side of his body without any exit wounds. Paramedic 2 also observed taser prongs on Subject 1’s upper back. At that time, Subject 1 was alert but he did not say anything. Paramedic 2 recalled seeing an unknown officer holding a bloody knife on the scene. The unknown officer stated that Subject 1’s lunged at officers while holding the knife and an officer fired two shots at Subject 1. Paramedic 2 and his partner immediately transported Subject 1 to the ambulance. 6 Interview with Witness 2, Page 20, line 19 Page 7 of 15 Independent Police Review Authority Log#1043057/ U#11-06 Once inside the ambulance, Subject 1 was placed on a stretcher. Paramedic 1 drove the ambulance to Stroger Hospital, while Paramedic 2 and a Black Male Chicago Police Officer were in the back of the ambulance with Subject 1. The officer released Subject 1 from the handcuffs so Paramedic 2 could reposition him and provide medical treatment. During the 20 minute ride to Stroger Hospital, Subject 1 was cooperative with receiving medical aid. Paramedic 2 stated that Subject 1 admitted to harming himself. Upon arrival at Stroger Hospital, Paramedic 1 parked the ambulance in the driveway of the emergency room. A CPD squad car who trailed the ambulance parked also. The officer exited the back of the ambulance and stood at the door, along with the two officers from the squad car. Paramedic 1, who stood outside the door of the ambulance, held the foot of the stretcher while Paramedic 2, who was still inside the ambulance, held the head of the stretcher. The paramedics pulled the stretcher out of the ambulance and locked it into position. At that time, Subject 1 jumped off the stretcher and ran west through the parking lot toward Ogden. The three officers chased Subject 1 through the emergency room parking lot. The officers eventually caught him at the end of the parking lot and Subject 1 swung his arms and kicked towards the officers. The officers regained control of Subject 1 and handcuffed him. At that time, the paramedics placed Subject 1 back on the stretcher, transported him inside the emergency room and transferred care to hospital personnel. In a statement to the Independent Police Review Authority (IPRA) on 24 February 2012, Officer F stated that on the morning of 30 January 2011, he and his partner Officer G responded to a call to assist Illinois State Police Troopers with a man barricaded inside a house with a knife. The officers arrived at XX West 83rd St. and stood outside the residence. Officer F did not witness the officer-involved shooting. However, Officer F rode in the back of the ambulance with Subject 1 during the transport to Stroger Hospital. He observed that Subject 1 had several self-inflicted cuts on his wrists and elbows, as well as, two gun shot wounds on his stomach. During the transport, Officer F stated that Subject 1 was conscious but did not speak. In a statement to the Independent Police Review Authority (IPRA) on 4 April 2012, Officer E stated that on the morning of 30 January 2011, he responded to a call to assist Illinois State Police Troopers at XX W. 83rd St. When Officer E arrived at the location, he observed several Chicago Police and Illinois State Police vehicles. He was informed by a trooper that the Subject 1 barricaded himself inside the residence with a knife after being involved in a domestic battery incident while traveling on Interstate 90/94. At that time, Officer E entered the residence and observed blood on the floor and walls of the family room/dining room of the house. He observed Subject 1’s housemate, Witness 2 in the kitchen and began talking with him. At that point, other officers were upstairs attempting to establish dialog with Subject 1 who was locked inside the rear upstairs bedroom. The officers were attempting to make a peaceful resolution. Page 8 of 15 Independent Police Review Authority Log#1043057/ U#11-06 While Officer E was in the kitchen, he heard someone scream and then heard someone yell “Drop the knife…drop the knife.” 7 Then he heard two gunshots. Officer E walked to the stairs and found out that an officer had fired the shots. He heard an officer announce over the radio that shots were fired by police and request for an ambulance. He observed Subject 1 lying on the ground in the hallway struggling with officers. Officer E stated that officers were attempting to handcuff the subject, but Subject 1 was refusing to show his hands. He then witnessed Officers C taser Subject 1. At that point, the officers were able to gain control of Subject 1 and handcuff him. Shortly afterwards, the paramedics arrived and rendered medical aid to Subject 1. The paramedics immediately transported Subject 1 to an ambulance. The Crime Scene Processing Report indicates that Officer A’s weapon, a 9mm semiautomatic Sig Sauer, serial# AM66140 was inventoried; a “Win” 9mm Luger +P cartridge and a magazine containing 11 “Win” 9mm Luger +P cartridges were recovered from the weapon and inventoried; a “WIN” 9mm Luger +P fired cartridge case was recovered on the interior floor behind west entrance door and inventoried; a “WIN” 9mm Luger +P fired cartridge case was recovered on the floor at the south doorjamb of the east bedroom marker #2 and inventoried; cotton swabs with blood were recovered from the driver’s side rear quarter panel of a Buick License #XXXXXXX parked in the rear of XXXX S. Lafayette and inventoried; handwritten notes with blood were recovered from the 2nd Floor bedroom and inventoried; a 8.5 inch “Pakistan” wooden handle knife with a 4.5 inch blade was recovered and inventoried. The Arrest and Case Incident Reports document that Subject 1 was arrested for Aggravated Domestic Battery, Aggravated Assault against a Peace Officer with a Knife and Resisting Arrest. The reports indicate that Subject 1 was driving with his girlfriend, Witness 1 when he punched her multiple times, and locked her in the vehicle. Witness 1 escaped the battery by jumping out of the moving vehicle and suffered a broken leg, knee and facial fractures. Subject 1 fled into his residence with Illinois State Police in pursuit. Chicago Police Officers A, B, C, and D, as well as, several other officers responded to a call for assistance from the ISP at XX W. 83rd St. Upon arrival, ISP related to CPD officers that Subject 1 was barricaded in the upstairs bedroom of the residence with a knife. Upon entry of the residence, the officers observed blood on the walls and floor with a trail of blood leading to an upstairs bedroom. Officers ordered Subject 1 several times to come out of his bedroom without the knife and Subject 1 refused to do so. Fearing additional victims, Officer D pushed the door open and again Subject 1 was ordered to come out of the bedroom. Subject 1 charged out of the bedroom toward the officers while holding the knife. Officer A then fired two shots striking Subject 1. Subject 1 fell to the floor where he continued to struggle with officers until he was tasered by Officer C. Subject 1 was then transported to Stroger Hospital, where he again resisted officers by running away, kicking and flailing his arms. The Tactical Response Report and Officer’s Battery Report of Officer A document that Subject 1 lunged at Officers A and D while wielding a knife. In fear of both his and Officer D’s lives, Officer A discharged his firearm at Subject 1. 7 Interview of Officer E, Page 14, line 18. Page 9 of 15 Independent Police Review Authority Log#1043057/ U#11-06 The Case Supplementary Report indicates that Illinois State Police Trooper A told the detectives that he responded to a personal injury accident at 103rd and Bishop Ford Expressway. Upon arrival, Illinois State Police Trooper A encountered Witness 1, who stated that she was in a vehicle with her boyfriend, Subject 1 when the couple began to argue. Witness 1 stated that during the argument Subject 1 began beating her about the face. She told Illinois State Police Trooper A that Subject 1 was driving dangerously and she jumped out of the vehicle. Illinois State Police Trooper A obtained Subject 1’s information and sent out an ISPERN alert regarding his whereabouts. The Chicago Fire Department transported Witness 1 to Christ Hospital. Illinois State Police Trooper A also went to Christ Hospital to re-interview Witness 1. After leaving the hospital, Illinois State Police Trooper A met up with other Troopers at XX W. 83rd St. A resident at XX W. 83rd St. allowed the Troopers to enter the residence and told them that Subject 1 is upstairs. Illinois State Police Trooper A and the other troopers called out to Subject 1. Subject 1 yelled from the second rear bedroom but refuses to come out of the room. When Chicago Police Officers arrived, Illinois State Police Trooper A was downstairs in the kitchen. The CPD officers went upstairs. Shortly afterwards, Illinois State Police Trooper A heard a loud noise and then heard two gunshots. Illinois State Police Trooper A remained downstairs. Illinois State Police Trooper B told detectives that he responded to a crash with an ejection at 103rd and Bishop Ford Expressway. Upon arrival, Illinois State Police Trooper B encountered Witness 1, who stated she was involved in a domestic battery incident with Subject 1 who lived at XX W. 83rd St. Witness 1 also provided the vehicle description and plate number of Subject 1’s vehicle. Illinois State Police Trooper B proceeded to XX W. 83rd St. and located Subject 1’s vehicle behind the residence. Illinois State Police Trooper B notified his supervisor and waited for back-up to arrive. After additional troopers arrived, Illinois State Police Trooper B knocked on the door of the residence and Witness 2 answered and allowed entry into the home. Witness 2 directed the troopers to Subject 1, who was in an upstairs rear bedroom. The Troopers tried talking to Subject 1. Subject 1 was mumbling inaudible comments. Illinois State Police Trooper B heard fellow troopers yell “knife.” Illinois State Police Trooper B contacted CPD for back-up. When CPD arrived, Illinois State Police Trooper B was downstairs talking with Witness 2. Illinois State Police Trooper B heard CPD officers trying to deescalate the situation. Then he heard Subject 1 scream and heard two gunshots. Illinois State Police Sergeant A told detectives that he was notified by Illinois State Police Trooper A to respond to XX W. 83rd St. Illinois State Police Sergeant A along with several ISP units responded to the scene. Illinois State Police Sergeant A heard Subject 1 state that he knew he was in trouble and he did not want to go to jail. Subject 1 refused to cooperate with the troopers verbal commands and CPD was called. CPD went upstairs where Subject 1 was located inside a bedroom. Illinois State Police Sergeant A heard Subject 1 scream loudly and then he heard two gunshots. At that time, Illinois State Police Sergeant A went upstairs and observed Subject 1 lying on his stomach and handcuffed behind his back. Illinois State Police Trooper C told detectives that he responded to a call from Illinois State Police Trooper B for backup at XX W. 83rd St. Illinois State Police Trooper B stated that he had located the vehicle of Subject 1 who was wanted for a domestic battery incident. Illinois State Police Trooper C arrived at the residence with several other troopers. The troopers Page 10 of 15 Independent Police Review Authority Log#1043057/ U#11-06 knocked on the door of the residence and met with Witness 2, who informed the troopers that Subject 1 was in an upstairs bedroom. Illinois State Police Trooper C went upstairs attempting to talk with Subject 1 and observed Subject 1 holding a knife. Illinois State Police Trooper C asked his partner to call for CPD canine. CPD arrived and attempted to talk to Subject 1. Subject 1 failed to adhere to the officers’ directions. A CPD officer kicked in Subject 1’s bedroom door and Subject 1 screamed and came running out with a knife. A CPD officer fired two shots. Subject 1 remained uncooperative by resisting and was subsequently tasered by a CPD officer and handcuffed. Illinois State Police Trooper D told detectives that he responded to XX W. 83rd St. looking for a domestic battery offender. The troopers knocked on the door of the residence and met with Witness 2, who informed the troopers that Subject 1 was in an upstairs bedroom. Illinois State Police Trooper D called out to Subject 1 and Subject 1 stated that he did not want to go to jail. Illinois State Police Trooper D went upstairs and observed Subject 1 holding a knife. The troopers retreated and called CPD for a taser or canine. CPD officers arrived on scene and announced their office. CPD officers talked to Subject 1 and kicked the bedroom door open. Subject 1 screamed and came running out the bedroom holding a knife. A CPD officer shot Subject 1. Illinois State Police Trooper D observed Subject 1 fall down but he continued to wave the knife around. Illinois State Police Trooper D grabbed the knife from Subject 1 and secured it. Subject 1 remained uncooperative by resisting and was subsequently tasered by a CPD officer and handcuffed. Officer A told detectives essentially the same information as provided in his statement to IPRA. Officer B told detectives essentially the same information as provided in her statement to IPRA. Officer D told detectives essentially the same information as provided in his statement to IPRA. Officer C told detectives essentially the same information as provided in his statement to IPRA. Officer F told detectives essentially the same information as provided in his statement to IPRA. Officer H told detectives that he was present at XX W. 83rd Street. He stated that he was on the bottom stairs when he heard a loud noise followed by Subject 1 screaming. He then heard two gunshots. At that time, he went up the stairs and observed officers struggling with Subject 1. Officer H stated that the stairwell and hallway was too small for any further officers to help. Officer I told detectives that he was present at XX W. 83rd St. He stated that he was on the bottom stairs when he heard a loud noise followed by Subject 1 screaming. He then heard two gunshots. Officer I stated that he did not witness anything further. Page 11 of 15 Independent Police Review Authority Log#1043057/ U#11-06 Officer J told detectives that he was present at XX W. 83rd St. He stated that he remained downstairs on the first floor during the incident. He heard someone say “drop the knife” and then heard two gunshots. Officer J did not witness anything further. Officer K told detectives that he was present at XX W. 83rd St. He stated that he remained on the first floor during the incident. He heard officers ask Subject 1 to slide the knife under the door. He stated that he heard a door being kicked in. He then heard officers yelling “drop the knife” followed by Subject 1 screaming. He then heard two gunshots. Officer K stated that he heard officers continue to give Subject 1 verbal commands. He then heard a taser deployed. Paramedics 1 and 2 told detectives essentially the same information as provided in Paramedic 2’s statement to IPRA. Witness 2 told detectives essentially the same information as provided in his statement to IPRA. Witness 1 told detectives essentially the same information as provided in her statement to IPRA. Witness 3 told detectives that he was driving onto the Bishop Ford Expressway around 103rd St. at approximately 0250 hours on 30 January 2011. At that time, he was driving behind a beige Buick that was swerving in and out of its lane. He observed a struggle ensuing between the occupants of the Buick. He then observed a woman fall out of the car and land on the pavement. At that time, the Buick was traveling about 60-65 mph. The Buick then came to a complete stop and then sped off. Witness 3 stopped and exited his vehicle and ran to help the woman on the expressway. He observed that the woman was bloody and in severe pain. He waited with the woman until an ambulance arrived. Subject 1 told detectives that he has dated Witness 1 for 13 years. On the morning of 30 Jan 2011, he and Witness 1 left a nightclub downtown and as he drove the couple began arguing. Subject 1 stated that he accused her of being unfaithful. Witness 1 asked to go home but Subject 1 instead entered onto the Dan Ryan Expressway southbound to prevent Witness 1 from exiting the car. During the argument, Subject 1 admitted that he punched Witness 1 twice in the face. He stated that Witness 1 kicked him and jumped into the back seat of the vehicle. Witness 1 then jumped out of the rear driver’s side door. Subject 1 stated that he did not know the exact location where Witness 1 jumped. He stated he exited the expressway at 147th St and returned northbound on the expressway. Subject 1 stated that he did not see Witness 1 on the expressway, so he exited on 87th St. He then drove behind a building which was located on 83rd and Cottage Grove. While parked behind the building, Subject 1 stated that he cut both of his wrists with a razor because he was upset about the incident. He remained parked behind the building for Page 12 of 15 Independent Police Review Authority Log#1043057/ U#11-06 approximately 45 minutes. Subject 1 stated that when he realized his attempted suicide was unsuccessful he drove home. During the interview with detectives, Subject 1 stated that he did not want to live. When Subject 1 arrived at his residence, his housemate, Witness 2 was asleep and did not witness him enter the home. Subject 1 stated that he went into his bedroom and used a knife to cut the right side of his neck and his wrists. He stated that he was home for about 45 minutes when he heard the Illinois State Police enter his home. When the Illinois State Police arrived, Subject 1 stated that he was in possession of a knife but he did not come out of his room. He then closed the door to his bedroom and took some Benadryl, a water pill and a pill for hypertension. Subject 1 stated that he wanted to “fallout.” When the Chicago Police arrived, Subject 1 stated that he did not want to live. After an officer kicked in the door to his bedroom, Subject 1 stated that he charged the officer. Subject 1 stated “I wanted to put myself out of my misery; I wanted the police to shoot me. I wanted to be taken out before they could arrest me. I wanted the police to kill me.” The Illinois State Police denied IPRA’s request to interview Illinois State Police involved members Illinois State Police Troopers A, B, C, D, and Illinois State Police Sergeant A. The Event Queries and the Office of Emergency Management and Communications (OEMC) transmissions indicate that Illinois State Police members called for assistance with a man with a knife at XX W. 83rd St. The transmissions also indicate that OEMC was immediately notified of the officer’s weapon discharge, and that an ambulance was requested. In addition, the transmissions indicate that officers called for assistance at Stroger Hospital when Subject 1 attempted to escape. The Evidence Technician photographs depict the scene of the shooting from various angles, the knife used by Subject 1, Subject 1’s vehicle and photographs of Witness 1’s, Subject 1’s and Officer A’s injuries. The Subject 1 refused to discuss any matters related to police conduct with the Independent Police Review Authority. A CFD Ambulance Report indicates that Subject 1 had two entry wounds on his right flank area with no exits. Subject 1 had two taser prongs in the thoracic part of his back. The report indicates that Subject 1 stated that he tried to commit suicide just prior to police interventions. Subject 1’s medical records indicate that he was brought by ambulance to Stroger Hospital for multiple gunshot wounds. Subject 1 had two bullet wounds on his right flank and right thoracoabdomen, and one further wound on his right buttock. Subject 1 also had selfinflicted lacerations to bilateral arms and was tasered twice by police. The medical records indicate that during a psychiatric evaluation, Subject 1 admitted to cutting himself multiple times Page 13 of 15 Independent Police Review Authority Log#1043057/ U#11-06 with a knife and he stated that he was shot twice by police when he came out of his room with the knife. Subject 1 was discharged into police custody on 1 February 2011. Alcohol and Drug Testing was conducted on Officer A on 30 January 2011. The Alcohol/Breath Test was conducted at 1017 hours and the Blood Alcohol Content was .000. The Drug Test was completed at 1030 hours and the results were negative. A Report from the Illinois State Police Forensic Science Center (ISPFSC) dated 25 February 2011 indicates that Officer A’s 9mm Sig Sauer semiautomatic pistol was test fired and found to be in firing condition. Two fired casings recovered were fired from Officer A’s weapon. Reports from the ISPFSC dated 21 July 2011 indicate that an examination of the knife recovered from the scene did not reveal any latent impressions suitable for comparison. The reports also indicate that blood was found on the swab sample from the knife. Page 14 of 15 Independent Police Review Authority Log#1043057/ U#11-06 CONCLUSION AND FINDING: This investigation found that Officer A’s use of deadly force was in compliance with Chicago Police Department policy. According to the Chicago Police Department’s General order 03-02-03, II: A. “a sworn member is justified in using force likely to cause death or great bodily harm only when he or she reasonably believes that such force is necessary: 1. 2. to prevent death or great bodily harm to the sworn member or to another person, or: to prevent an arrest from being defeated by resistance or escape and the sworn member reasonably believes that the person to be arrested: a. has committed or has attempted to commit a forcible felony which involves the infliction, threatened infliction, or threatened use of physical force likely to cause death or great bodily harm or; b. is attempting to escape by use of a deadly weapon or; c. otherwise indicates that he or she will endanger human life or inflict great bodily harm unless arrested without delay.” Officer A’s actions were in accordance with the conditions of CPD’s deadly force policy. Officer A shot Subject 1 after he disregarded the officer’s verbal commands to drop the knife, and instead ran toward the officers wielding the knife in the air placing the officer in imminent fear of great bodily harm or death.
