FIRST COUNT The Grand Jurors of the County of Hamilton, in the name and by authority of the State of Ohio, upon their oaths do ?nd and present that RAYMOND TENSING, on or about the 19th day of July in the year Two Thousand Fifteen at the County of Hamilton and State-of Ohio aforesaid, purposely caused the death of SAMUEL DUBOSE, in violation of Section of the Ohio Revised Code and against the peace and dignity of the State of Ohio. SECOND COUNT The Grand Jurors of the County of Hamilton, in the name and by authority of the State of Ohio, upon their oaths do find and present that RAYMOND TENSING, on or about the 19th day of July in the year Two Thousand Fifteen at the County of Hamilton and State of Ohio aforesaid, knowingly caused the death of SAMUEL DUBOSE, while the said defendant was under the in?uence of sudden passion or in a sudden ?t of rage, either of which was brought on by serious provocation occasioned by the victim that was reasonably suf?cient to incite the defendant into using deadly force, in Violation of Section 2903.03 (A) of the Ohio Revised Code and against the peace and dignity of the State of Ohio.
