Re: Moeller lawsuit, Request for comment re: allegations from lawsuit 1 of 1 Subject: Re: Moeller lawsuit, Request for comment re: allegations from lawsuit From: "Watson, Tim" Date: Sat, 25 Jul 2015 00:43:54 +0000 To: "Bradracino@gmail.com" , "'loriehearnsd@gmail.com'" Dear  Ms.  Hearn  and  Mr.  Racino:   As  you  are  aware,  our  office  represents  North  County  Transit  District  (NCTD)  in  the  li@ga@on  ini@ated  by  Virginia Moeller.     NCTD  is  deeply  concerned  and  troubled  by  the  July  23,  2015  e-­‐mail  sent  to  its  Board  Members  by  Mr.  Racino.    As  an ini@al    maMer,  Mr.  Racino’s  e-­‐mail  indicates  an  incomplete  inves@ga@on  into  the  facts  of  the  Virginia  Moeller  case.   Mr.  Racino  admits  that  he  has  only  obtained  the  Plain@ff’s  documents  related  to  NCTD’s  Mo@on  for  Summary Judgment/Adjudica@on.    It  appears  he  has  chosen  not  to  obtain  NCTD’s  publically  available  mo@on,  the  declara@ons and  evidence  suppor@ng  NCTD’s  Mo@on,  or  a  complete  copy  of  Mr.  Tucker’s  deposi@on  transcript  before  wri@ng  his story.    Mr.  Racino  has  apparently  made  a  conscious  decision  to  not  obtain  the  complete  record  in  order  to  once again  publish  a  one-­‐sided  piece  against  NCTD.    NCTD’s  posi@on  is  made  very  clear  by  its  Mo@on  and  suppor@ng evidence,  all  of  which  Mr.  Racino  could  have  very  easily  obtained.   It  also  appears  clear  that  Mr.  Racino  will  not  men@on  the  fact  that,  in  ruling  on  NCTD’s  Mo@on  for  Summary Judgment/Adjudica@on,  aXer  considering  the  No@ce  of  Lodgment  upon  which  his  ar@cle  will  apparently  rely,  the court  dismissed  three  of  Ms.  Moeller’s  four  causes  of  ac@on.     As  you  know,  the  No@ce  of  Lodgment  was  filed  months  ago,  on  April  3,  2015.    The  mo@ve  behind  publishing  a one-­‐sided  ar@cle  based  on  incomplete  research,  months  aXer  the  fact  and  essen@ally  on  the  eve  of  trial,  is  highly suspicious  and  appears  to  have  the  clear  purpose  of  tain@ng  and/or  causing  bias  against  NCTD.                                 NCTD  categorically  denies  Ms.  Moeller’s  claims,  but  feels  it  would  be  inappropriate  to  provide  more  specific comments  in  light  of  the  upcoming  trial.       Tim  J.  Watson Partner Tim.Watson@lewisbrisbois.com 701  B  Street,  Suite  1900 San  Diego,  CA  92101 T:  619.699.4991    F:  619.233.8627   RepresenEng  clients  from  coast  to  coast.  View  our  naEonwide  locaEons.
