Savage #0026/07 Conduct Unbecoming Violation of Official Procedures or Directives (ll0t 0i' property). Report of Investigation lA# 02--06--033 On 06/24/02 while conducting an interview with Cpl. Michael Casarella in reference to 02?05-025, he indicated that he had been present in the Vice and Organized Crime Component ofthe Charlotte County Sheriff Office when Cpl. Wyatt Henderson discharged a firearm inside the office resulting in damage. It should be noted that this interview of Casarella was as a result of an allegation that he (along with others in VOCC) participated in activities such as discharging paintball guns, throwing firecrackers, footballs and baseballs in the office and other unprofessional conduct. It was during this interview as an accused member that he brought this incident to light. I advised Major Sapp of this allegation, and it was determined that I should investigate it as an administrative matter, rather than a criminal case, so this Internal Affairs case was opened. On 07/16/02, Lt. Lucas and I interviewed Casarella in reference to this matter. He indicated that he believed the event occurred in December of 2001. Casarella indicated that he believed Det. Bennett, Lt. Goff and Det. Desguin were present at the time. Casarella stated that he and Desguin were throwing what he believed was a "Nerf' football at the time, and that Henderson told them not to hit him with the ball. According to Casarella, Henderson took out what he recognized as a .38 caliber handgun, and unloaded it. Henderson then loaded one round of what Casarella described as simunition, or plastic training bullets Henderson had Hom another agency. Casarella stated that Henderson then discharged the weapon at the wall opposite his desk. Nobody was seated at the desk he fred over at the time, but Casarella and others occupied the room at the time of the incident. According to Casarella, the gun was never pointed at anyone, although the actual discharge was apparently an intentional act. The damage that resulted, according to Casarella, was a hole in the wall and a corresponding hole in a large black flag that covered the section of wall that had been fired into. Casarella stated he told Henderson that this behavior was not acceptable, and also that he briefed Lt. Golf about it. No effort was made to repair the damage, and to Casarella's knowledge, no official report had been made. I made arrangements with Dr. Ivan Kiselev to accompany Lt. Lucas and me to the VOCC to investigate the scene. Henderson's desk is still in the same location as when this incident allegedly occurred and a hole was located in the wall opposite it, consistent with what had been reported. I located a large black skull and cross bones flag on another wall in the office. It also had a hole in the fabric consistent with this incident. Dr. Kiselev photographed the wall, and samples were taken for analysis. Kiselev determined that the gun was fired from more than 6-8 feet from the wall, and the round was most likely a very low penetration plastic round. Copies of Dr. Kiselev's report and photographs are included in this tile. I then interviewed Lt. Rick Goff. He was the supervisor in the unit at the time of this event. Goff believed the gun incident occurred in January or February of 2002. He stated he was present when the gun was fired, and that Henderson tired it. He thought it was a paint or simunition round that had been fired. Goff indicated that he saw the hole left by the round inthe wall ofthe office, and stated he thought he told Henderson not to do that again, No report was written about the incident. I interviewed Det. Shane Desguin next. He stated that he and Casarella were throwing some type of ball in the office. He stated that Henderson told them he would shoot them with a rubber bullet if either of them threw the ball too close to him. He stated that was not a threat, just banter back and forth. He stated that Henderson loaded a .38 caliber handgun with what he believed was a rubber bullet, and tired once into the opposite wall. Desguin indicated that there was never a serious threat to anyone in the office, nor was this a malicious act designed to injure anyone. He also described incidents of horseplay in the office; such as shooting paintball guns, throwing balls, etc that were . cornrnonplace in that unit, participated in by most of its members. I then met with and interviewed Cpl. Wyatt Henderson. His attorney, Debra Rowe, accompanied him. Henderson was advised of the Garrity warning, and was placed under oath. I advised him that as a result ofthe previous investigation 02-05-025) an allegation that he discharged a firearm in the office was raised. I asked him directly to explain the situation. Henderson stated that footballs, baseballs, golf balls etc had been thrown around the office for over a year. He stated that he had seen property damaged in the otiice. On the day in question, he stated that Casarella and Desguin were throwing a ball inside the office once again. Henderson stated that a game often played was to see how close they could get the ball to somebody's head or desk, he stated that he has been hit before, but not on this particular occasion. Henderson stated that he had, on his desk, a Tupperware container that had a training round of ammunition, along with other items inside. The training round had no powder; it works off a primer and has a plastic projectile. He stated that he pulled his .38 caliber handgun out of his ankle holster, emptied the gun onto his desk, and loaded it with one of these training rounds. Henderson stated that he shot the gun one time, discharging the training round across the room into the wall opposite his desk. Henderson stated that the weapon was never pointed at anybody, and he denied threatening anyone with it. He stated this incident took place in December of 2001, in the VOCC office. Henderson stated that the desired effect was to get the other officers to stop throwing balls in his direction, and it worked. When I asked him if he reported the discharge of the weapon, he stated that he did not feel that he had to, because both his Sergeant (Casarella) and his Lieutenant (Goff) were present when the incident took place. When asked about damage to the office from the gun incident, Henderson advised there was a hole in the waH where the projectile struck it. He provided a sample of the training round he fired, and it is consistent with the physical fmding at the office, and the lab report as well. It is apparent from both this investigation, and the previous incident, 02-05- 025) that a considerable amount of unacceptable behavior was occurring in VOCC, participated in by mo st members, and joined in and condoned by the Sergeant and Lieutenant. In an effort to get all the information on the table as to this behavior, Henderson spent time describing events he has witnessed or heard of that fall into this 2 realm of behavior. He described Casarella shooting from a moving vehicle with a paintball gun at Det. Gerry Tollini's issued vehicle; he stated he (Henderson) was driving while Casarella f'u?ed. He handed over a picture of Osama Bin Laden, and written over the top was Osama Bin Henderson, and there is evidence it had been shot with a paintball. He stated that after shooting the training round, Lt. Goff handed him paintball rounds and told him to shoot the other officers with those next time. He handed over several paintball rounds he stated were those given to him by Goff. He discussed the use of OC spray in the office, in a manner consistent with what had been documented in 02-05-025. Henderson presented me with a copy of a certificate for training he states covered the use ofthe type of simunition he discharged inthe office. Henderson admits that this use of those rounds in inconsistent with his training. He then handed me thirty-nine photographs of various forms of damage, from broken blinds to paintball stains and burn marks from inside VOCC office. These are consistent with the now well-documented horseplay in that office. He described a possible theft of ofiice equipment, which is currently under investigation i.n a separate case. When I asked him why he felt compelled to fire a gun, rather than seek help from the administration, he indicated that Goff and Casarella were powerfiil, and he, as a probationary employee felt he had no recourse. He described Casarella shooting a paintball gun into the Ford parking lot hitting new cars on display alongside of U.S. 41. He also described Casarella and Goff hitting golf balls over the Wal-Mart in Englewood damaging customer's vehicle. He then described what he alleged was missing money from a safe. Copies of all the photographs are included in this file. I attempted to verify the most serious of Henderson's accusations, but was not able to. spoke with Lee Doyle ofthe Ford dealership, and he advised that no vehicles had ever been hit with paintballs. I verified through Lt. Pete Sbarbori, that no reports of vandalism were taken at Ford for that type of activity. I contacted Lt. Caro from Englewood, and he advised that they had no reports of golf ball damage to any vehicles at the Wal-Mart in their area. The allegations about missing money had been answered in an audit during a recent staff inspection of VOCC conducted by Lt. Lucas. Conclusion: Two investigations have clearly shown that the continual horseplay occurring in the VOCC unit resulted in property damage, at least one injury, (Keith Bennett, 02-05-025). However this in no way justifies using a firearm inside the office, regardless of the type of projectile discharged. The assertion that this was the only recourse available is not acceptable in this writer's opinion. The supervisors of that unit, namely Sgt. Casarella and Lt. Goff have already been transferred out of that command, however their lack of supervision, and involvement in the actual events is equally inexcusable. I recommend that the charge of Conduct Unbecoming against Wyatt Henderson for discharging a firearm in the office be Sustained. Based upon the fact that Henderson did not complete a written report about the discharge of a weapon, the allegation of Violation of Official Procedures or Directives (not endangering persons or property) should be Sustained as well. 3 -- way 4 Sgt. Savage #0026/15 Excessive Force Resulting in Injury Report of Investigation lA# 02-08-054 On 05/23/03 in the afternoon hours Det. Cpl. Wyatt Henderson of the CCSO Vice and Organized Crime Component, along with other detectives from that unit participated in the arrest of juvenile 02013338. Cpl. Henderson submitted a written report detailing the arrest. He stated that a brief pursuit began after the suspect fled from the officers who initially approached him at the Port Charlotte Beach Complex. He stated that he maintained close proximity to the suspect vehicle in his own vehicle. Henderson reported observing the suspect discard narcotics out ofthe window of his vehicle. He stated that after the suspect discarded the drugs he stopped his vehicle on Harbor Blvd. Henderson described his actions during* takedown and to- reluctantly complying with his instructions. He stated thatfthen refused to lay prone so that he could be handcuffed. Henderson stated that he forced the -t'onto the roadway, and that when mace came in contact with the roadway, his chin was lacerated. He stated that- did not complaint about his injuries, and refused medical treatment. Det. Keith Bennett submitted a written report about the arrest. He described the preliminary details as follows. Bennett stated that the operation was a buy-bust type where the suspect was to deliver marijuana to undercover detectives, He stated that the suspect had sold narcotics to undercover detectives in the past, and video was shown to the detectives for identification purposes. He stated that he was assigned to his own . vehicle, and was to approach the rear of the suspect's vehicle for the takedown, He also indicated that Det. Sal Durant was in the vehicle with him. According to Bennett, the suspect arrived at approx. 1640 hours, and began to circle the beach complex. He described pulling in behind the suspect once he had stopped and to exiting his vehicle, displaying a badge on a cord around his neck. Bennett described the suspect looking in the rearview mirror of his vehicle, seeing Bennett and fleeing immediately. According to Bennett's statement, the suspect fled the beach complex with Cpl. Wyatt Henderson in pursuit. He described the events of the pursuit, and stated that he observed the suspect pull over, and Henderson stop beside him. He stated that he proceeded to the rear ofthe suspect's vehicle, and observed as Henderson ordered the suspect to the ground. He stated that Henderson ordered him down several times, but the suspect did not comply. He then reported the following: "Cpl. Henderson took the suspect to the ground, and placed the suspects hands behind his back, right arm first then lett. Det. Durant approached from the rear with handcuffs. The suspect was then secured with handcuffs by Det. Durant". Bennett went on to report that he observed blood on the ground, and asked the suspect if he was mjmedgis reported to have said, "You pistol- whipped rne". Bennett stated in his report that isaid "why did you guys have to hit me with that gun'?" According to Bennett's report, he told*that he had not hit him, and it appeared that he injured himself while on the pavement. He stated that the suspect continued to question why he had been hit with a gun, He described other evidence he located in the suspect's vehicle, included a concealed weapon (brass knuckles). He concluded his report with these written remarks; "At no time did I remove my weapon (.38 caliber model 36 snub nosed revolver) from its holster during this incident. I used minimal force in securing the suspect's arms behind his back for handcuffing. At no time did I strike this suspect, or utilize excessive force". Det. Grant Davis prepared and submitted a written report that is attached to the case package concerning the criminal case against In that report Davis stated that CCSO Vice and Organized Crime began a narcotics operation to take to custody for having sold marijuana to undercover detectives He described arrangements being made to meet gat the Pt. Charlotte Beach Complex. According to Davis, case agent Jack Collins had probable cause to arrest "for various felony otfenses. He stated that he attended"a pre--operational briefing during which the roles of each detective were assigned. He reported that he was assigned to Sgt. Jerry White's vehicle; Cpl. Wyatt Henderson would be alone in a vehicle, as would Det. Jack Collins and Det. Shane Desguin. Det. Keith Bennett and Det. Sal Durant were in the other car from VOCC present for the arrest. Davis' report goes on to state that at about 1640 on 05/2l/O2 all units of CCSO Vice and Organized Crime arrived at the beach complex as scheduled. He stated that he and Sgt. White observed the suspect enter the beach complex in his vehicle and circle around before parking. He stated that once the suspect stopped, the takedown signal was given, and Det. Bennett engaged his emergency equipment, pulling up behind the suspect vehicle. He stated that he and Sgt. White also drove up, and he observed (R) Det.'s Bennett and Durant identify themselves as police. Davis stated that the suspect then fled in his vehicle, and the Detectives advised communications that they were in pursuit. He stated that Sgt. White and he proceeded down Harbor Blvd. following the pursuit, and he observed the suspects vehicle stopped on the side of the road. He reported that Henderson's vehicle was in the right hand lane of Harbor Blvd. next to the suspect vehicle. He reported seeing Henderson exit his vehicle with his gun drawn, and he observed Det. Bennett place his vehicle behind the suspect's in a felony takedown position. Davis reported that he and White drove to the front ofthe suspect's vehicle and stopped. He stated that as he walked along the driver's side of the suspect vehicle he observed that Henderson had the suspect in a prone position on the grotuid. His written report stated that he saw Henderson handcuff the suspect and bring him to a standing position. He stated that he observed the defendant was bleeding from an injury he initially thought was his mouth, but determined it to be his chin. He stated that the suspect was placed in a seated position next to one ofthe police vehicles. Davis then wrote "At this time the suspect did not make any statements or complaint about being injured and did not appear to be injured other than on his chin area. While waiting for a fully marked patrol unit I spoke with the suspect briefly and did not observe any further injury to the suspect or anything unusual while the suspect was speaking? According to his report, that concluded his involvement in this arrest. Sgt. White also submitted a written report of these events, consistent with that of (R) Det. Davis. White went on to say that following the arrest, Henderson told him that the 2 suspect did not comply with instructions and was taken down resulting in the suspects chin hitting the roadway causing the visible injury to his chin. Det. Jack Collins prepared a case report for the OCA number listed above, and it was submitted per policy through channels and included all the aforementioned police reports. . . On May 2002 Major Glen Sapp requested Lt. David Lucas of CCSO Internal Affairs look into the facts and circumstances surrounding this arrest. He advised Lucas that there had been an allegation of pistol-whipping, and in fact the suspect had been injured sustaining a broken jaw. There was no formal complaint by anyone, not the defendant in this case, nor any ofthe officers involved. Lt. Lucas opened 02-05-024. He first reviewed the case report, and each statement written by the oliicers involved. He also examined the arrest paperwork from the jail. In his interview with jail medical personnel the suspect indicated he injured his jaw on the ground during the arrest. Based upon the statements in the report, and the jail medical information combined with the lack of a formal complaint, Lucas concluded that all appeared to be in compliance with policy. The Internal Affairs case was closed UNFOUNDED. Over several months during the summer of 2002 there were numerous allegations leveled at several narcotics detectives and supervisors by members ofthe unit. Several Internal Affairs cases were opened, transfers took place, and disciplinary actions of various types were taken in narcotics. Detectives Bennett and Davis were interviewed several times on various issues, as were Henderson, Collins, and Desguin. At no time during the months of these investigations, did the officers involved in this arrest indicate there was a problem with the arrest or the reports of that arrest until August 2002. It should be noted that I interviewed Det. Bennett on May 315*, 2002 as the complainant in an unrelated matter, and Bennett never mentioned a problem with the arrest hat had taken place just I0 days before. On August l2th, 2002 Bennett and Davis met with Major Raymond Komar and informed him that they had been to the FBI to report a case of police brutality. They told Komar that Henderson had in fact pistol-wmppedg and both claimed to have knowledge of the event. Komar met with me, and I was instructed to look into this allegation. I opened 02-08-054, into excessive force and began the investigation. I obtained copies ofthe original case report submitted through narcotics on the arrest. All of the statements and reports submitted in that matter are included in this report. I also obtained a copy of the Internal Affairs case written by Lt. Lucas, it also is included in this report. I then began to conduct interviews based on this new case. I interviewed and obtained a sworn statement &om Det. Grant Davis on August 19m, 2002. In this interview he provided background information on the operation that led to the arrest of se details were consistent with those previously established. He described-- fleeing once undercover officers confronted him, and 3 described the brief pursuit. In this statement, Det. Davis stated that when he exited his he heafdg Scream as if he were in pain. Davis had not previously made any such statement, nor had any other member on the scene. He then stated that when he approached the suspect and Cpl. Henderson, he stated that Henderson had his knee ingback, and there was a "large pool of blood" on the ground where the suspect had been bleeding from his chin. In his original report he stated that the suspect was bleeding, and there was a "small amount of blood on the roadway surface". He then stated that he spoke with the suspect who told him that he had been hit in the head with a pistol, which caused his chin to hit the ground. The report he submitted in May following the arrest stated that the suspect made no statement to him about how he had been injured. He also stated that he overheard Det. Cpl. Henderson state that he had struck the suspect with his firearm, a fact not mentioned in Davis's original report. He also reported that Henderson described and demonstrated the motion he used to strike the suspect in front of him. He indicated that Det. Bennett, Det. Collins and Sgt. White were aware of these statements. I asked him if he informed anyone in the agency at the time of these events about what he was now reporting and he stated that he did not. When asked why, he stated that he did not want to be a rat. He stated that his conscience got the best of him, and he reported these events to Director Platt in August. He also stated that Det. Bennett told him that Cpl. Henderson had struck for no apparent reason. I interviewed and obtained a sworn statement from Det. Keith Bennett. He stated he was present for the operation involvingw He stated that he and Det. Sal Durant approachedw at the beach complex, and observed him flee in his vehicle. He stated that by the time he and Durant caught up with the pursuit, Henderson had the suspect stopped. Bennett stated that when he observed them, Henderson was holding wt gunpoint. He stated that in accordance with his training, he felt he should handcuff the suspect while Henderson had his gun pointed at the suspect. He stated that he and Durant moved in to take down, and as they approached, Henderson slammediinto the pavement. He stated that {mad not resisted, but may not have been complying with Henderson's instructions. He stated that as he attempted to handeuff the suspect now in the prone position, he saw Henderson strike the suspect. Bennett described seeing the event out ofthe corner of his eye. He described Henderson using a downward strike with a firearm in his hand to hit the suspect. He stated that $yelled, and Durant came up and handcuffed him. He stated that the suspect initially thought it was he (Bennett) who had hit him. He stated that after they moved a sitting position near a vehicle, Henderson began moving through the crowd of officers and boasted about pistol- whipping the suspect. He stated that after awas removed from the scene Henderson told him that he was glad Bennett and Durant were the witnesses to the event, implying that they would cover for him. He stated that he and Durant talked about the incident being wrong, and said he expected to be contacted by Internal Affairs about it. According to Bennett, once back at the office Henderson got a phone call dom District Four Lieutenant Pete Sbarbori informing him that the suspect claimed to be injured, and reported being hit with a gun. He then stated that several days later Henderson told him (R) that he needed statements written on the arrest. According to Bennett, Henderson told 4 him that the suspect thought Bennett hit him with the gun, and told him to write a statement explaining that he (Bennett) did not hit the suspect. Bennett stated that he felt the incident was an example of excessive force on the part of Henderson. He stated that he learned later that the suspect might have sustained a broken jaw. He indicated that Henderson told him he needed to clean his gun to remove any traces ow DNA from his gun. Bennett stated that he did not see any ofthe reports written on this event. This statement by Det. Bennett is factually different from the written re ort he submitted in May of 2002. During the May statement he described? being taken down to the ground, but never mentions seeing Henderson strike him. Bennett also stated that several days aiter the event Henderson ordered him to write a statement, but the date of the report is May 22"d, the day following the event. Additionally, Bennett claimed to have been instructed as to what to write in his report by Henderson, yet the supervisor, Sgt. Jerry White, signs oi? the report on May 22"d 2002. I interviewed Det. Jack Collins was well. He described the nature of the operation dealing with this arrest in a manner consistent with what has been previously established. He stated that he did not participate in the pursuit, nor was he there for the actual take down and arrest ofj He stated that he recovered marijuana thrown from the vehicle by ile was fleeing the deputies. He stated that when he arrived Bennett, Henderson Durant and Sgt. White were there, and he believed that Det. Davis there as well. According to Collins, already handcuffed when he saw him. He stated that?indicated the "big giant guy", implying Henderson, struck him with a pistol. He stated that Henderson reported taking him down with an arm bar, and as a result the suspect hit his face on the ground. He denied hearing any comments made about pistol-whipping by Henderson. I interviewed and obtahied a sworn statement dom Det. Sal Durant. He stated that he was in a vehicle with Det. Bennett for the arrest He stated that they caught up to where Cpl. Henderson had stopped the suspect, and they stopped behind n. He stated that it took him a couple of seconds to get out ofthe vehicle, and when he approached he observed his knees, and Bennett and Henderson there also. He stated that he could not recall if anyone had a gun in their hand. He stated that he handcuffed the suspect, who made a reference to being pistol-whipped. According to Durant, he did not see any event that could be described as pistol whipping. He stated that he did not hear Henderson make any comments about pistol--whipping the suspect, but did recall hearing something about that topic later. He could not relate the context in which he heard the comment, He maintained that his initial report was an accurate accounting of what he could testify to in this matter. His initial report does in fact mentiong reporting being struck by a pistol. I briefed Major Raymond Kornar as to the information developed in this investigation. Initially, Major Komar requested an outside agency follow up on the allegation of excessive force, and Collier County sent investigators to CCSO. I was advised to cooperate, but to cease my investigation. Subsequently, Federal authorities 5 began to conduct an investigation and I was again told to suspend any investigation in the excessive force compliant. In November of 2002, Major Komar advised me that the discrepancies in the statements given by Det.'s Davis and Bennett involving their May 2002 official report, and August 2002 sworn statements must be resolved. I opened 02-I I-077, involving Davis, and O2-l 1-078 into Bennett. Both detectives were placed on paid administrative leave based upon what appeared to be factually inconsistent statements, but once again due to ongoing investigations by Federal authorities I was denied access to the officers. That restriction remained in place until February of 2003. I was then advised by Major Komar to complete the investigations into the allegations of Falsification of Otiicial Documents, and Failure to Report Criminal or Civil Violations of the Law involving Davis and Bennett. I also interviewed and obtained a sworn statement from Detective Michael Casarella. A former narcotics detective, Casarella was working a road patrol corporal in May of 2002. He was the supervisor on when the arrest ofmook place. Casarella was not at the scene of that arrest. The contribution he makes to this matter is that an officer assigned to him, DFC Ruben Gonzales was assigned to transporvgl *?but the jail would not accept him due to his injuries. He stated that he did not interact with ghimself but observed him at the hospital. He stated that he reported the condition of%to his supervisors, including District Four Commander Lt. Sbarbori. Det. Cpl. Wyatt Henderson submitted a resignation letter ending his tenure with -- CCSO as of Thursday, February 2003. A copy of that letter is included in this tile. I was never granted permission to speak with Henderson in reference to these matters, so this report is being completed with no statement from Henderson. Via correspondence with the attorney representing Keith Bennett an interview was arranged. The interview took place at my office on 03/27/03; present for the interview was Capt. David Lucas, Det. Bennett, his attorney David Goldberg and I. Bemiett was given the Garrity advisory and placed under oath. The interview was to be restricted to the discrepancies in Bennett's May report, and his August statement. Bennett provided background information describing a twenty--year career in law enforcement in various capacities from patrol to assistant chief of police. He indicated that he is an experienced investigator as well. He described the events leading up the pursuit of gm a manner consistent with what had been previously established. I asked him if he testified in an August l5?' statement that he personally observed Cpl. Henderson strike --Ie stated that he had. I asked him of he felt that Henderson's actions constituted a crime, and he indicated that they did. The event was described as pistol-whipping, using a gun to strike an individual. I asked him about the details of his written report dated May 22"d. I asked him if he wrote that after Durant secured the suspect he saw blood and asked if the suspect was injured. He stated that was correct. I asked him if he wrote that when he spoke with the suspect and the suspect asked why he was hit with a gun, Bemiett told him he didn't hit him, he appeared to have injured himself on the pavement. He stated that he wrote that in his report. Based on his August statement reporting being an eyewitness to the alleged pistol whipping, I asked 6 him complete description ofthe events as they transpired in arrest of&Bennett replied that it was a complete description of his activity inthe arrest, and stated that was what he was instructed to write. I asked who instructed him, and he replied "By Cpl. Henderson? I asked him again why he did not report Henderson striking the suspect in his initial report. He stated that Henderson told him that he (Henderson) would cover that in his own report. He also stated that Henderson told him that &thought he (Bennett) had struck him, and Henderso_n told him to write that he had not. He maintained that Henderson told him what to put in his report, and he followed those instructions. It should be noted that Henderson did not approve the report in question. Bennett took this report that Henderson allegedly instructed him to write to Sgt. Jerry White to be approved. I asked Bennett if he reported seeing the pistol-whipping to anybody. He stated that he spoke to Director Dan Platt on several occasions about the incident. Bennett stated that he first reported it to Platt the Thursday or Friday following the arrest, a day, or a couple of days later. He also stated that the conversation took place with Platt in the narcotics The arrest took place on Tuesday May 21st, 2002, according to Bennett that would put his reporting to Platt on Thursday the 23'd, or Friday the 24th. This is not possible as Platt was with Sheriff Clement in Jacksonville that entire week attending the FBI's 6th annual Florida Executive Development Seminar. I obtained copies of the paper associated with that event, and they are included in this report. He also stated that Henderson bragged on numerous occasions in Platt's office inthe months following the event about hitting-- Once again, Bennett claimed that he expected to be interviewed by Internal Attairs, and when he was, he would tell the truth. Yet on May ten days after witnessing what he described as an aggravated battery committed by Henderson against ajuvenile victim, Bemrett was interviewed in Internal Affairs, but said nothing of this alleged event, I asked Bennett who his chain of command was at the time of this arrest, and he indicated that it was Cpl. Wyatt Henderson, Sgt. Jerry White, and then Platt. I asked him if he ever informed White of his observations. White was the supervisor of the unit, and was on scene for this arrest. Bennett stated that he did not. When I asked him why not, he stated that he assumed he knew. I asked about why he did not report the incident to anyone until August, and he stated that he felt Henderson was protected, and that the director of Narcotics knew, so he had no recourse. He described Platt's role as a supervisor in Narcotics, and once again stated that within a day or two he reported this pistol-whipping to Platt, bypassing White. As has been previously reported, Platt was not in town during that time israme for the conversation to have taken place. There is also no record of this conversation having taken place. White was his supervisor, was in town, approved Benr1ett's report, yet he was not informed. Via correspondence with the attorney representing Grant Davis an interview was arranged. The interview took place at my on 03/27/03; present for the interview was Det. Davis, his attorney David Goldberg, Capt. David Lucas and me. Davis was given the Garrity advisory and placed under oath The interview was to be restricted to (R) the discrepancies in Davis' May report, and his August statement. Davis once again 7 advised that he was a participant in the arrest He stated that he had (R) been assigned to a vehicle with Sgt. White, the immediate supervisor for the narcotics unit. He describedrg fleeing the beach complex, and the brief chase that resulted from that action. He stated that he observed the trafiic stop effected by Cpl. Henderson and stated that as he and White went by, Henderson had his gun drawn and inside the van he had been driving. He stated that Sgt. White pulled his vehicle in front of lost sight 0f* and Henderson. He stated that he then heard I et out a scream. He stated that as he pushed open the car door of Sgt. White's vehicle he heard it. He stated that as he approached where Henderson was, he observed Henderson beginning to stand up, and wbeirrg stood up as well. He was unable to recall if Henderson had his gun in his hand. He stated that he did not observe Henderson strike we stated that he then overheard a conversation in which Henderson told Keith Bennett that he (Henderson) had in fact hit He stated that Bennett was telling Henderson to "shut the fuck up" or the kid would end up living in Henderson's new house. He stated that after hearing that dialog, he went over tow He stated that jstold him that he had been thrown to the ground, his head bounced off the pavement, and he reported being hit in the head with a gun. He stated that he if he wanted an ambulance, but he declined. I quoted from Det. Davis' report May 23, 2003 and pointed out that in that report he stated the suspect did not make any statements about how he had been injured. I asked him directly which version was factual, and he replied that the version alleging the pistol whipping was accurate. I asked him why that was not in his original report, and he stated that he thought the suspect was contirsed, that maybe his head did hit the ground. I coniionted him with his testimony that he had not spoken to-until after he heard Henderson and Bennett talking, and Henderson supposedly spoke of hitting and he said that he did not hear Henderson say he hit He then said that Henderson said something about I showed him, or something to that effect. That is in conilict with the statement Davis gave in August during which he stated that Henderson said he hit him with a pistol. It is also in conflict with Davis statement just moments before this comment when he stated that Henderson told Bennett he hid; He then stated that when he wrote his report Wyatt Henderson told him he would handle the pistol-whipping in his report. I asked him if at the time he wrote his report was he aware that the defendant was injured. He stated he was, and he was trying to keep himself away from liability for an act (pistol-whipping) that he did not observe. I asked him of he believed that law enforcement officers have an obligation to report crimes, he stated that they do. I asked him if he reported his knowledge of criminal behavior on the part of Henderson against<* and he stated he had. I asked to whom, and when, and he replied Director Platt in August. I asked him why he delayed reporting this criminal activity for months, and he indicated that Henderson told him that the kid resisted and fought him. He also stated that Henderson reported being cleared by Intemal Affairs in this matter. He stated that it wasn't until months later that he learned from Det. Bennett did not resist and Henderson simply struck him. I established that the chain of command at the time ofthe Qarfest was Cpl. Henderson, Sgt. White, and then Director Platt. I asked if he ever reported the (R) excessive force issue to White, the next in the chain of command over Henderson, and he 8 stated no, because White left on medical leave alter the arrest. I asked if it was (R) immediately after, and he said that it was within a week or two. In fact it was about two weeks, giving him ample time to report to his supervisor. I-le then stated that the next day after the arrest Henderson, White and Director Platt went behind closed doors and he assumed they discussed the arrest. It should be noted that is not possible as Platt was out of town that week with the Sheriff Clement for a conference. I returned to the allegation about Henderson dictating to Davis how to write his report. He indicated that it was not normal for another officer to tell someone what to put in a report. He then stated he didn't bring his concern about that to anyone because he thought Henderson would take responsibility for his actions. He reiterated that he pieced it together over time during the summer of 2002 that Henderson had in. fact abused and once he figured it out he reported it. That is not in anyway consistent with the statements in August and November where in both he states that from the outset~ said he was pistol-whipped, and Henderson allegedly stated he hit him. On 04/ 10/03 I conducted an extensive interview with Director Dan Platt. Due to Bennett's allegation that he informed Platt of the pistol--whipping, amidst other aLlegation? I advised Platt of the Garrity advisory and obtained a sworn statement fiom him. I established that he was in command of Narcotics during the period of time in question. I asked about his certification since he supervised several law enforcement officers up to and including a Lieutenant, and he told me he was corrections certified. He stated that he did not carry a firearm until he had updated his certification in February of 2002. He established that in May of 2002, Sgt. White was in the Narcotics chain of command. He described a relationship with Henderson in which Henderson did come to him, outside of the chain of command to discuss matters with him, but he stated those conversations were not about operational matters. He denied ever interfering on Henderson's behalf to prevent an investigation or protect him in any way. He stated that he was not aware of the pistol--whipping allegation Bennett and Davis until August of 2002. I asked him if following the arrest of Bennett came to him and told him about the pistol-whipping. He stated that no such conversation took place. He also reiterated that he not in town in the days following the arrest for such a conversation to take place; he was with the Sheriff in Jacksonville. He stated that up to the day I was speakin to him, Bennett has never told him that he personally saw Henderson pistol whip bile also denied ever hearing Henderson boast about striking Other matters relevant to narcotics operations were discussed during this interview as well, but this concluded the questions about this incident. Lastly I interviewed and obtained a sworn statement from Sgt. Jerry White. He was the ranking supervisor on the scene ofthe arrest of He also provided background information on the case in a manner consistent with what has been established. He stated that Det. Grant Davis was in his (White's) vehicle, and described the events leading up to the pursuit in a manner consistent with the established stated that the pursuit was brief? and he pulled in front ofthe suspect vehicle after Henderson had stopped it. He stated that as he passed - vehicle, the suspect had (R) one foot out ofthe door. He stated that he could not recall if Henderson had a gun in his 9 hand. He stated that he and Det. Davis got out of his vehicle and he had to go around the no nt of his vehicle to see what was happening during the takedown. He stated that his first observation upon running up was face down on the roadway being handcuffed by Det. Sal Durant. He reported that Henderson came over to him immediately and told him he took the suspect down hard. He stated that after they got oved he learned of the injury. White stated that due to phone calls he did not speak to ?himself at that point. He stated he did observe a small amount of blood on the roadway wherealhad been taken down. He stated that he briefed Director Platt via phone as to the operation, He stated that after the phone calls he was involved with, the marked unit had arrived to transport White reported that he spoke to iat that time, and asked if he wanted medical treatment, which- declined. He stated that he was unsure about when he learned ofthe allegation of pistol-- whipping, but did not believe it to be at the scene. When I asked if him how he had been injured, White indicated that he had not. I asked him if Keith Bennett told him that he had seen Henderson strike or pistol-whip the suspect; he stated that he did not. He indicated that he had a good working relationship with both Bennett and Davis, and he had been in charge of the VOCC unit since March of 2002. He indicated that he signed off on both Davis and Bennett's reports on this matter. I asked if either officer indicated that he had been pressured into writing the reports a certain way, he indicated that neither stated that to him. He indicated that Bennett and Davis never told him that Henderson told them what to write in their reports. In describing the office that VOCC inhabited at the time, it would have been possible for Bennett or Davis to have a private conversation with him about any concerns, yet neither one did. He denied ever hearing Henderson boast, or make statements in the otiice about pistol-whipping asked about the scream that Davis allegedly heard while exiting White's vehicle, and White stated he did not hear any scream He stated that he and Grant Davis exited his vehicle very close together, and refuted the observations reported by Davis. He stated that following the arrest, neither the officers in the unit, nor**complained about any aspect ofthe arrest. He described being "shocked" bythe Bennett and Davis' allegations in this matter. At the conclusion of the cases involving Det. Keith Bennett, and Det. Grant Davis both were terminated from CCSO. Each was found to have committed the following violations, Falsitication of Official Documents, Failure to Report _Civil or Criminal Violations of Law, and Untruthfulness. These charges were based upon their conflicting reports and sworn statements. On May 30th, 2003 following the investigation conducted by the Federal Bureau of Investigation, the case against Henderson was presented to a Federal Grand Jury, and Henderson was indicted for Violation of ?fivil Rights by Using Excessive Force, Misleading Superiors with the Intent to Keep a Federal Offense from being Reported, and Making False and Fictitious Statements to the FBI. This case subsequently went to a jury trial and Henderson was found guilty on all charges. He was convicted on 12/ l0/03 and is currently awaiting sentencing. I have included various media stories relating to these events for information purposes in this l0 file. Based upon all the facts contained herein, I recommend the charge of Excessive Force Resulting in Injury be closed SUSATINED. I I 7 Lt. Michael F. Human Resource Director Ms. Emma Dennison, Charlotte County Sheriff's Office, gained documentation from Florida State University that the diploma presented by Cpl. Henderson was in fact a forgery. Further investigation reveals that Cpl. Henderson was being paid through funds, educational incentive, from the Charlotte County 0 Sheriffs Office for this degree. A check with other records involving pertaining to Cpl. Henderson reveals that he made application for the Chief of Police in Cape Coral, Florida. This application shows that Cpl. Henderson attended Florida State University during the period 03/90 through 12/94. The above records were forwarded to Florida State University in the attention of Mr. Timothy Martin, FSU Registrar, who in statement form reveals that Cpl. Henderson was never a student at FSU and they do not have a method of attaining a degree on-line through the Internet. See attached documentation of the investigation by Cpl. Paul Tierney of the Charlotte County Major Crimes Unit concerning the criminal investigation that is currently on going. CONCLUSION: Cpl. Wyatt Henderson presented, to the Charlotte County Sheriff's a Office, a diploma from Florida State University as a true document when in fact the document is a forgery as stated by the Registrar of Florida State University, Mr. Timothy Martin. Cpl. Henderson received education incentive monies as a result of this published document, which he was not entitled in the sum of $4,048.00. Capt. David A. As I have informed you, I have ordered transcripts from the colleges that I have attended and these documents take from five to ten business days to be fonivarded via United States Postal Service, As for the in-questioned degree, I am still attempting to locate the application which was completed and forwarded to the institution which awarded the degree. I am having difficulty locate these documents for several reasons ranging from nearly six years ago, five residential moves and one divorce within the time frame. I would prefer to present all of my proof and documentation at one time so equal and impartial review can be granted. Next, I met with agents ofthe Federal Bureau of Investigation on Friday, October 4th, 2002 at my attorney's office in Fort Myers. The agents did disclose that the parties of the complaint were Detectives Grant Davis, Keith Bennett and Jack Collins. was asked to advise if there would be any reasons why these individuals would fabricate such a story to discredit my career as a law enforcement officer. The agents advised that this was a fact finding mission on the allegation of a civil rights violation. I find it interesting that these individuals have given false statements, reports or testimonies to either the Charlotte County Sheriffs Office or the Federal Bureau of Investigation to the point that I may now be challenged civilly and personally by their fictitious remarks. Since it is apparent that the Internal Affairs investigators do not conduct proper and impartial investigations, it will do no good to attempt to file a formal complaint with these parties or their supervisor, Major Komar who retains a personal dislike for me. However, since my reputation has been tried within the agency and the local press, I would hope that the Sheriff would take some actions against the individuals who perjure themselves or who sign and attest falsely to official documents ofthe Charlotte County Sheriffs Office. With regard to the Federal Bureau of Investigation continuing investigation into the allegation of "pistoI-whipping" Christopher Grant in May of2002, I requested and was granted the opportunity to take a polygraph test to assist the agents with their investigation. Also, I requested, if not demanded that the agents take my duty weapon, the weapon in question to have it checked for physical evidence of use inthe alleged incident. I am tentatively scheduled for a polygraph test on Monday, October 7th with a secondary interview on Thursday, October 10th, 2002. I had contacted the personnel within the unit for a possible operation between 1800 hours and 2100 hours. The suspect called and advised that the weight would be at his residence at 2130 hours. I contacted Director Platt in you absence for the operation and the other members of the unit for response to our office at 2130 hours. I had allowed for the hour drive time( cover story) and this would allow for the prep and transaction time for the operation. At 2200 hours I received a call from the suspects saying that the deal would go at his residence at 2230 hours. There was no further conversation until approximately 2230 hours when the suspect called and advised that his delivery would want possession ofthe money prior to the actual deal, that the product was herein county. I declined to continue the operation. I advised the unit personnel that we would attempt to "comp" the time out this week, which was acceptable with all members involved (Hopkins, Diaz, Davis, Durant, Bennett). Detective Bennett eventually responded to an alert from Detective Durant at approximately 2030 hours. Director Platt ascertained it I had contacted you and I did inform him that I had tried as well as having other members of the unit try via the Nextel. I advised the director that I assumed that you were still in Jacksonville or in transit back to Charlotte county. Whatever problem with the Nextels effected both you and Detective Bennett. No personnel was contacted from District 3 of from dispatch about any such arrests. I check with all personnel and their were no contacts made. I have not contacted the dispatch supervisor to enquire, perhaps you should take care of that matter. l'm not sure how we can contact this subject we haven't been advised ofthe arrest prior to Miranda if he invoked. I cannot advise why we were not contacted. We have a second attempt of a controlled delivery ofthe one pound of cannabis for the prison. Briefing is at 0800 hours tomorrow at the admin office.
