I too am sorry that it got so out of hand. And know the feelings of frustration run both ways. After many attempts to contact Campbell, when I finally did speak to him, I felt our conversation only made things worse, which of course was not my intent. For some reason he thinks failed to show up for scheduled meetings and failed to inform him/his office of what I was/wanted to do etc. Both of which is just simply not the case and i tried to explain that to him but was not successful. We could go on and on about the when?s and why?s and the he said/she said etc. but I really want you Lance to know/understand my side. Although it is probably not apparent I am really not some unreasonable belligerent crazy woman out on some rampage. So in a very short version, and in my defense, the methods I took were this: i asked a couple of questions of the Sheriff?s Department as to: was Jane Doe listed with any national organizations?, after weeks no one seemed to know and then finally the answer was ?No? so i suggested a few Orgs that have web sites and suggested she be listed with them. Understanding the Sheriff?s Of?ce was very busy I waited several more weeks. Nothing, I asked again. No response. It appeared they didn?t have time. (Listing the case only takes a few minutes) So i offered to do it. No response. 80 I went ahead and attempted to do as i found out more about the case, I talked to people, Bolster etc, I noticed there was conflicting/missing information and various other things just sort of hanging undone and that a composite drawing had never been done. When i questioned it no one seemed interested, said it would cost too much etc. So I offered to pay for it, still nothing. So I found a forensic artist, still no response. So i said i would have it done, and Bolster ?nally did send the records and thus it was done. Then I found numerous missing person cases that had never been checked on in regards to the case and again attempted to make contact with the Sheriff?s Office (Still knowing everyone was busy). No response. 80 I asked ifl could do anything to help check them out. No response. So I started trying to check myself. But please know i have always noti?ed your office of what i was doing; although, I almost never got a response. etc.etc.etc. basically this is how the whole thing started and how the whole process has the situation as it stands to day. Well enough about that, i hope possibly we can make a deal tojust put it behind us. Maybe? Because none of this has to do with the matter at hand, Jane Doe. So the information from the NY is regarding the Jaqueline Lerman case, it is my understanding she was a possible match years ago and a couple of dentists made comparisons and thought it was a match but the medical examiner at the time said no and so the records were returned to NY and it was not questioned. (The NY case is still of?cially open) I met with Bolster and asked if this could be looked into .so after a year of calling NY every week they have finally found and sent what they have. ltjust needs to be compared to Jane Doe?s records again to see if it warrants looking into. it doesn?t matter who does it! Just so it gets done! i will gladly give you everything I have or whatever you .But I just ask that it does get looked should be at least a dental diagram in that we have the dental diagram X-rays for Jane Doe. I am sure you have resources much better than mine but i do have contact with several specialists that can look at this too if it would it is what ever is easiest for you! Oh and I hate to even bring this up but you are aware that the Center for Missing Exploited Children did offer to do a facial reconstruction for FREE which is like $3,000 to $5,000+ procedure? We just have to get them the skull. Can we look into doing this? Inquiries Additional Concerns Third, I sent Mr. Bolster several possible matches based on her data and loosely on the age range, but I would like to know if there has been any inquiry to the possibility of the Theresa Raines match? I am aware that according to the information listed in the attached sheet, there are some differences, but based solely on this she should not be excluded as a potential match. As Itold Richard Bolster, if staffing and workloads are the issue, I will be more than happy to do these things buthe insisted I go through your department. Also I have found that frequently the contact agency wants confirmation form an official authority such as someone from you department. If you could grant me authority to say that I am working ?with? your agency or something to that affect, again I would happily pursue these potential matches myself. (Be assured I would do so with professionalism and courtesy) Fourth, and lastly (for now), in reviewing the single sheet of information Mr. Bolster sent me in comparison with a local newspaper article dated the week after she was found, there seems to be a discrepancy in the age range. Bolster?s sheet says between 20 and 35 years old and the news paper article stated between 25 and 35 years old. Which range did the Medical Examiner actually report or was it something else all together? Also I have shown copies of the skull x-rays to several experts (including dentists and anthropologists specializing in forensics) and based on what they could see in the skull x?rays they all placed her age range at much younger. Please note, I gave them no information to slant their opinions. Because of this I would like to see the Medical Examiner?s rationale for his estimation of her age. If this means x?rays, copies of the autopsy report, or whatever, I will be happy to pay for any copies etc. Along with that information, I would like to request copies of her dental x-rays and again I will pay for whatever the costs. The reason I am concerned about her age range is two fold. One reason is there are many organizations that will not list her case because she is not considered a child, thus excluding her from an entire network of possible searches/matches. There is a huge difference when searching for a child/teenager versus a thirty year old. The second reason for concern is regarding the NCIC database. I acknowledge I do not know anything about this database or exactly how it works but if it is anything like databases in general (which I I design and build everyday at work) it is only as good as the data entered. I assume CIC ?hits?? are created by matching case data, meaning that if a case matches certain criteria with another case it sends up a red ?ag or rather a ?hit?. Is this correct? If so, then if she has been entered in the database as a 25 to 35 year old potential matches have been falling by the wayside all these years. Right? If it is legitimately determined that she is younger than originally estimated then I would like to get her age range ?officially? changed, in the NCIC database and anywhere else that is applicable. The?body is viewed for the first time lying supine on an autopsy table in the Ramsey County Medical Examiner's office completely nude. No clothing accompanies the body or is present on the body for examination. The body is that of a normally developed, mildly obese, Caucasian female who is 5 feet 3 inches in heel?crown length and weighs 128 pounds. Temperature of the body is warm to touch with rigor being absent and no discernable livor pattern being noted due to the state of severe postmortem decomposition being present. L'lLOU??fjl Examination of the head finds the scalp to be completely denuded or hair with the exception of focal tufts of brown hair located in the occipital regions. This hair measures 0.1 to 1.5 cm in length and has a cut or clipped edge present. No comment can be made on the iride color or the pupillary size due to the absence of the eyes bilaterally. The deceased has her own teeth present in the maxillary and mandibular regions. Examination of the cervical region of the collum, ventral thorax, ventral abdominal wall and lateral flanks on the right and left side are consistent with that of an adult CaucaSian female of the above stated age. Examination of the externaligenitalia are within normal limits as are the soft tissues overlying the upper and lower extremities, nuchal region A of the collum, dorsal thorax, lower back and buttockS'regions. RECENT INJURIES External . The body has undergone a severe degree of postmortem decomposition that is evenly distributed in the soft tissues overlying the ventral and dorsal aspects of the body. Focal areas of soft tissue maceration with tissue loss can be appreciated at focal areas on the ventral and dorsal a aspects of the body. In the facial region this tissue loss can be appreciated over the anterior as well as the left lateral facies. ?Portions of the right ear are absent. The lobule of the left ear remains showing evidence of being pierced. Those areas involved by maceration are noted in the upper extremities 'bilaterally as well as in focal areas on the torso and lower extremities. Areas of soft tissue uninvolved by this maceration show evidence of soft tissue discoloration and.interva3cular'hemolysis. Some bloating of the soft tissues _can be appreciated. . Examination of the.collum region reveals a ligature composed of a single drawestring type lanyard with plastic tips at both.ends. This ligature has been tied about the collum in a single knot that is located in the approximate midline overlying the ventral surface 0f the collum. Removal of this ligature reveals a deep furrow into the soft tissues of the collum that approximate the dimensions of this ligature.' Viewed laterally this ligature-can be seen running from a point higher on the dorsal Surface of the collum to a point that is lower on the ventral surface of the collum. No evidence of hemorrhage into the adjacent Soft tissue or epidermal desiccation can be appreciated when examining the collum area. . Examination of the soft tiSSues overlying the dorsal aspect of the thorax as well as the left labium majora and the lateral aspects of the left lower extremity in the thigh and knee region reveal areas of purplish discoloration that become confluent with one another. Cutting into theSe areas reveal some 'hemorrhage to be present in the subcutaneous as well as the dermal portions of the tissue. . I 1 Examination of the scalp reveals multiple linear striations to be present that have a white appearance. INTERNAL EXAMINATION The body is opened in a routine Y-fashion with fat of the umbilicus measuring' 1 inch in thickness. The abdominal cavity is found to be free of exudates, adhesions, or hemorrhages. At initial inspection the organs are in their normal anatomic location with no evidence of traumatic displacement to be noted. The appendix is present in its normal position. The gallbladder is also present in its normal position. 1 Examination of the ventral and thoracic wall finds it to be free of fractures with.no hemorrhages into the adjacent soft tissue. The pleural cavities are note . worthy in that hemothoraces are noted bilaterally measuring each 100 co in amount. .1 7.L The mediastinum is within normal limits with no evidence of hemorrhage into the anterior mediastinum being noted. The pericardial sac is intact and upon opening is found to contain 5?6 cc of serous?like fluid negative for pathology. PANCREAS: The pancreas weighs 80 grams. The organ is of normal size and symmetry for this age female with peripancreatic fat being minimal. Serial sectioning of the organ reveals pancreatic tissue that has undergone some degree of postmortem autolysis and is a yellowish?brown in color. No evidence of trauma can be appreciated on examination of the pancreas. GI TRACT: . The esophagus is of normal uniform diameter with an intact mucosa showing no evidence of ulcerations,-perf0rations, diverticula, or obstructing masses. The killer's identity is long known. He was an unlikely suspect an on-duty Minnesota State Patrol trooper who lured the apparent hitchhiker one late spring day in 1980 and confessed to the crime nine years later. Yet, two decades later, the murder victim buried in Blue Earth's Riverside Cemetery still remains a "Jane Doe" one of roughly 13 unidentified people who have died in Minnesota in recent decades. But an online community of mostly civilian sleuths, including an unlikely partnership between a Minnesota mom?to?be and a retired police chief are trying to help authorities and relatives find a name and a sense of finality for this legion of the anonymous dead. The Doe Network, launched five years ago by a handful of Internet surfers interested in unsolved mysteries, has grown into what some say is a valuable clearinghouse of information on thousands of unidenti?ed bodies and missing persons reports. There are now hundreds of members, from housewives and case investigators to retirees, sifting through the two massive data files in search of potential matches. They are aided by thousands of other Web site visitors stretching coast to coast, and from Europe to Australia. "Our motto and our mission is that everybody deserves a name," says Todd Matthews, a Tennessee- based company quality-control manager who helped found the site. The network is credited with cracking more than a dozen "cold" cases that had stymied law enforcement and relatives of the deceased or missing for years. One of the more recent successes involved a middle-aged paralegal from who, in her spare time, was able to match details of a Wayne, N.J., man missing since 1996 to a skull and jaw found by Vermont police authorities two years later in a wooded area. The common thread was the detail in both reports that the victim was handicapped. "This is the best site of its kind around," says Don Mickelson, a former police chief who retired in 1996 after 33 years with the St. James, Minn., police department. Anderson, who has obtained copies of Jane Doe's skull and dental records, and Mickelson have poured through more than 2,000 ?les maintained by the online site. They have the narrowed the list of potential matches to five. The strongest link appears to be a missing-person case that actually was investigated shortly after the murder. Kabe says he was convinced Jane Doe was actually a missing New York City woman, after dentists compared dental records of the two women and thought they matched. But the lead was all but dropped when a pathologist from Ramsey County examined the records and concluded that they probably were not the same person. EXHUMATION PROPOSED The National Center for Missing and Exploited Children in Washington, DC, which deals exclusively with minors, has taken an interest in the Minnesota case. The organization has told Anderson it is willing to foot the estimated $3,000 to $5,000 fee to create a clay facial reconstruction of Jane Doe's face if the body is exhumed. The only image of the dead woman is a sketch recently drawn by a volunteer police artist with the online site's Project EDAN (Everyone Deserves a Name). Mickelson and Anderson are willing to pay for the exhumation and DNA tests, but they say they are waiting for local authorities to approve the request and obtain a court order. Sec. 634.051 and M.S. Sec. 634.03. Under Section 634.051, the prosecution must establish beyond a reasonable doubt: I. The death of the victim 2. The fact of killing by the defendant. Under Section 634.03, a confession shall not be sufficient to Warrant a defendant's conviction "without evidence that the offense charged has been committed." CONCLUSIONS I understand our evidence under 634.051 to be as follows: 1. we can clearly prove the death of the victim and, 2. PrOve the fact of killing by the defendant we must rely upon the confession. In other words, if the confession is barred by Section 634.03, we don't have a case. 3. I believe we can satisfy the requirement of Section 634.03 as to the confession. To satisfy this statute, we only need to prove that the death here was a homicide. we do not need proof that the defendant committed the homicide. ARGUMENT I think if there was confusion on the subject of corroboration, it occurs because of the corroboration requirement in Section 634.04 which deals with the necessity to corroborate the testimony of an accomplice. Through that statute, it is clear that the corroboration must link the defendant to the crime. At page 140, the court said: "Evidence that the offence [sic] charged has been committed by some persgg is all that is required." More recent cases make it clear that Section 634.03 only requires proof of the corpus delicti. in State. 338 NW 2d 419 (Minn. 1983), the.Supreme Court said that Section 634.03 codifies the requirement that the corpus delicti be established by evidence independent of the confession. This conclusion is justified by two earlier arson cases, State 3; Plagman, 121 NW 2d 621 (Minn. 1963), and State 3; Hansen, 174 NW 2d 697 (Minn. 1970). Both cases held that the defendant's confession was admissible because there was proof that the fire was willfully set by someone. In Plagmgn the court said at page 623: "That there was a fire willfully set by someone is the corpus delicti of the crime charged." The most recent cases characterize the duty of the prosecutor as the duty to establish that the confession is trustworthy. However, it remains clear that this requirement to satisfy by proof of the corpus delicti and not by proof which identifies the defendant as the perpetrator. State 3; vaughn, 361 NW 2d 54 (Minn. 1985) deals with the charge of selling stolen property. Defendant sold the property to undercover police officers, so there was no question about the fact that the property was sold. The issue was whether the property was stolen. The court held that the prosecutor was required to produce "sufficient, independent evidence from which the jury could infer that the statements were trustworthy and that, therefore, the property in question was stolen." In other words, the key question was only whether the property was stolen. .ln matter 9f welfare 345 NW 2d 723 (Minn. 1984) the defense argued that each element of the offense must be independentally corroborated to meet the requirement of Section 634.03. This argument was specifically rejected by the Supreme Cburt which said the prosecution's "task is to bolster the confession by independent evidence of trustworthiness." The court said if there is no tangible injury which can.be isolated as the corpus delicti, the accused has to be identified to show a crime has been committed. In this case, they went on to hold that Corroboration cf this aiding and abetting a felony murder crime was sufficient. We obviously have a tangible injury (a homicide) which can be isolated as the corpus delicti. It follows that we do not have to identify the defendant as the perpetrator to demonstrate sufficient corroboration. Her head had also been shaved. I presently have an ex P?rmesota State Trooper incarcerated who is confessing to killing her. He states that he picked her up on 1-90 and that she was dropped off in the west-"bound lane by a blue van. He also states that she was heading out west to live and that she had stopped and stayed around Milwaukee for sometime, like several nonths. Fe claim that he remenbers her name to have been Carolyn Marie and he thinks Jacobson for the last name, but not l'y sure. He alsorecalls poSsible birthdate in April or May of 1950 something. He also recalled her as fairly fr rendly and Open. At the tine he picked her up he said she was wearing a T?shirt type top, jeans and an army colored type jacket. It's from the. jacket that he' calims to have gotten the stragulation cord. He also claims that she was carrying a small, floppy, leather purse. . Detective McKay also spoke with the victim, who told her that . father had forced - to perform oral sex, to submit to anal sex, and to submit to other repeated acts of sexual contact, under threat of a loaded and cooked gun. At times, the Defendant threatened to cut off his - penis or to kill him. The child also reported the abuse to Tyrell State Hospital personnel, including Helen Isham, to Reverend Ronald Bernier, a friend of the family and pastor of Defendant's church, to Mary Ann Davis, to Jody Whitting, Robert Bernier's niece. While in custody in Faribault County and in the State of Texas, Defendant has openly and freely admitted that he is the person who killed a young woman, as yet unidentified, in Faribault County, on or about May 26, 1980. Defendant states that he was on duty as a Minnesota State Trooper at the time, that he found the victim hitchhiking or walking on Interstate Highway 90 just West of the Bricelyn exit at about 9:30 He asked the woman to get into his squad car. She did. They proceeded westbound toward Blue Earth. At the ity limits, Defendant decided to take the victim back out into the rural areas. He proceeded eastbound from the Blue Earth city limits on gravel roads to a remote location in Section Ten (10) of Emerald Township. Defendant states that he was interested in sexual activity with the victim and that she appeared to be a willing participant. He has described orally a location where he states that he took his victim's life. He described the scene as a grassy area at the end of a long field drive about 100 or 150 yards North of the interstate highway and alongside a drainage ditch where there was a pole - telephone pole or light pole with an electrical box of some kind on it. He states that at the scene he exited his squad car and removed his victim from the squad car. At this point in time, the victim appeared to Ibecome unwilling to? engage in sexual activity. Defendant proceeded to force her to engage in fellatio having first handcuffed her. Defendant states that his victim was extremely agitated, threatening to report the incident to his superiors. He states that he then removed a drawstring from her outer clothing, wrapped it around her neck while she was still handcuffed and strangled her with it. He then removed all of the body's clothing and placed the body in the nearby drainage ditch. Defendant states that he carefully gathered In) all of the victim's clothing and' personal possessions and took them with him for later disposal. Defendant 3 has shown complainant the location where he claims to have killed his victim. 's His previous description of the location was extremely accurate even though 1' he could not have been there for six or seven years before that. A human body was found on May 30, 1980 floating in County Ditch No. 5 FOWMCJ CCT SECTION Subdivision U.O.C. GOC PAGE, 2 of 4 . COMPLAINT at its crossing with Highway 109 in Section Nine (9) of Emerald Township in a severely decomposed condition. A small knotted rope or drawstring was in place around the corpse's neck. The body was otherwise totally nude. The 7_location where the body was found is about a mile from the scene of the killing as described by Defendant. Water in the drainage ditch at the 3'time was unusually high due to recent,heavy rains - high enough and rapid -f enough to float a body, in the observation of complainant. The body was taken to the Ramsey County Medical Examiner for an autopsy. The autopsy report issued by Dr. M. B. concluded that the victim was an adult caucasian female measuring 5'3" in.heel?crown length and weighing 128 pounds. 'The medical examiner estimated the victim's age, at the time of death, at 25 to 35 years. He concluded that death was caused by ligature strangulation. I believe the body found is that of Defendant's victim. Defendant.has recently been examinedlnra clinical one Dr. Kenneth A. Perkins, of Minneapolis. Dr. Perkins concluded that Defendant does not now exhibit any significant pathology nor any neurotic or organic disfunction. He observed no evidence of any thinking disorder nor of any memory deficit or defect. In complainant's frequent contacts with Defendant while incarcerated in the Faribault County Jail, complainant has observed no conduct which would lead complainant to believe that Defendant is mentally ill or delusional.
