The Independent Monitor candidate, Walter Mack, aided by the Doar Law Team advisers identified in this proposal will carefully follow the Consent Decree's provisions to assess and report whether the requirements of the Decree have been achieved along with the goals of constitutional and effective policing, professional treatment of individuals, and increased community trust of the Cleveland Division of Police ("CDP"). While we recognize that substantial progress may have already been made, the Doar Law Team will bring extensive expertise in gauging community engagement, evaluation and measurement of use of force, crisis intervention, and search and seizure issues, as well as police accountability, leadership, training and investigative excellence. Key to an effective and successful monitorship will be the monitor's ability to earn the trust and confidence of the CDP and other stakeholders dedicated to the successful implementation and achievement of the goals of the Consent Decree. PERSONNEL AND QUALIFICATIONS The proposed monitor will be Walter Mack, Esq., the Managing Partner ofDoar Rieck Kaley & Mack. Mr. Mack has been a federal court appointed monitor, independent investigator and Independent Private Sector Inspector General ("IPSIG") for the New York City Department oflnvestigation, the New York City School Construction Authority, the Port Authority of New York and New Jersey, the New York City Business Integrity Commission, City College ofNew York, New York State Dormitory Authority, the Westchester County Solid Waste Commission, the New York County District Attorney, the New York State Attorney General and the New York Metropolitan Transit Authority. He has designed compliance programs, monitored companies, labor unions, and organizations to insure that they comply with relevant laws and court orders and conducted investigations for corporate, government, and not-for-profit clients. Perhaps of greater importance, he was appointed by the City of New York as the Deputy Commissioner ofthe Internal Affairs Bureau ofthe New York City Police Department when that Department faced many of the issues analogous to those facing CDP at this time and is professionally aware of policies including transparency and oversight issues that can hinder substantial and effective compliance with lofty constitutional policy goals. Mr. Mack is an experienced District Court monitor who has served four District Judges in the Southern and Eastern Districts ofNew York. He recognizes the importance ofthe District Court's input and guidance but also the need for efficient, vigorous interaction to obtain, analyze and report unvarnished facts and data cogently and accurately to the District Court Judge. Depending on the scope of the monitoring assignment, Mr. Mack has drawn upon and partnered with professionals from varying disciplines to provide the additional experience and expertise that were needed. Mr. Mack has selected the following candidates who will comprise his professional team for monitoring the Cleveland Division of Police. Mr. Mack, as Monitor, will assign Supervisors, reporting to him, who will be responsible for various components of the project. Dr. Guy McCombs will be responsible for community/civilian input collection and measurement. George Georgiades will be responsible for overall data collection and reporting. Bryant Hoar will head the police assessment team. Donald Sobocienski will be the project administrator. Mr. Mack will devote fifty percent of his time to the monitorship. He brings special expertise regarding Internal Affairs Reporting and Data Compilation. He will be committed to whatever additional time is necessary to fulfill his obligation to the Court, the United States Department of Justice and the City of Cleveland. The team supervisors are committed to expending whatever time is necessary to conduct the demands of their assignments. A description of Walter Mack's qualifications and the professionals comprising the proposed team are as follows: -2- MONITOR Walter Mack possesses extensive civil and criminal litigation, investigative and regulatory experience in and outside of the government. In 1993 he was appointed as Deputy Police Commissioner ofNew York City for Internal Affairs by then Police Commissioner Raymond Kelly. The first civilian to be appointed to that position, Mr. Mack was in charge of all investigations of police corruption and matters pertaining to the use of excessive force. During his tenure, Mr. Mack instituted a number of new and progressive programs and policies to combat the problems of corruption and police brutality. He worked closely with civil rights organizations, such as the New York City Civilian Complaint Review Board. Prior to his Police Department appointment, Mr. Mack served as an Assistant United States Attorney for the Southern District of New York. During his years of service as an AUSA, Mr. Mack held the positions of Deputy Chief of the Criminal Division, Chief of the Organized Crime Unit, and Senior Litigation Counsel. He has personally investigated and prosecuted at trial complex and significant cases brought by that office during his appointment. A former United States Marine Corps Captain, Mr. Mack served in Vietnam as a military police supervisor and rifle company commander. Mr. Mack created the Compliance Practice Group within Doar Rieck Kaley & Mack which is responsible for this submission. A resume for Mr. Mack is attached in Appendix A. SUPERVISORS Police Assessment Bryant Hoar is a consultant on proper police practice, procedure and investigations. He gained extensive experience in law enforcement with the New Jersey State Police (NJSP), retiring as a Captain after 25 years. During his tenure with the NJSP, the organization underwent dramatic change as a result of a federal Consent Decree in 1999. Mr. Hoar participated in all phases of this change in a variety of roles as the Decree was successfully implemented over a 10year period. Mr. Hoar assisted in fulfilling the requirements of the Decree in a reasonable, functional manner that would not negatively impact public service and safety. As a front-line supervisor, he made recommendations and assisted in the development of reports and policies to both record and correct critical elements addressed by the Decree. These elements included reviewing and approving reports pertaining to motor vehicle stops, frisks, searches and use of force. Mr. Hoar worked with road duty Troopers and detectives in the preparation of the reports and their adherence to New Jersey state law, case law, standard operating procedures and constitutional issues. He conducted management reviews of critical incidents assessing them for further action and made recommendations to the New Jersey Attorney General's Office for disposition whether through training, counseling, discipline or no action. In his last position, as a Region Commander with the NJSP, he supervised several hundred sworn and civilian personnel. He has experience with Internal Affairs investigations and procedures. Among other responsibilities, he supervised personnel who were tasked with ensuring that policies instituted under the Consent -3- Decree received on-going, effective adherence. Mr. Hoar is acknowledged for his extensive understanding of criminal investigations and police practice including murder and death investigations and has provided expert testimony in the Superior Court ofNew Jersey on many occasions. He also conducted official corruption investigations into state and law enforcement officials. He served on the Newark FBI Joint Terrorism Task Force as a supervisor and liaison. Since leaving the NJSP, Mr. Hoar has been engaged on an assignment for the Port Authority ofNY & NJ Inspector General's Office. A resume for Mr. Hoar is attached in Appendix A. He will have overall responsibility for assessing the success of the CDP in achieving the police performance presaged in the Consent Decree and advising the Monitor on those subjects. Community Enaagement Dr. Guy McCombs, III, is president of Third Power which specializes in public policy research and evaluation work. For over 35 years, Dr. McCombs has been a social scientist providing in-depth social and public policy research and evaluation analysis. His work includes the design and implementation of ground-breaking, high quality survey and critical impact market research. Dr. McCombs is considered one the foremost social policy researchers on minority issues in the state ofNew Jersey and he has done highly acclaimed work related to the preservation and promotion of civil rights and equality in the provision of public services. In 1997, he was selected by New Jersey Governor Whitman to be one of the three principal investigators charged with designing, administering and analyzing the study entitled: "Racism in New Jersey." Recently, he completed a statewide evaluation study on Disparity in Procurement for New Jersey Transit. He has also conducted multi-faceted and complex public opinion/evaluation studies for the Port Authority regarding the public's satisfaction with Port Authority facilities. An inquiry into whether Newark Airport car rental agencies were using discriminatory practices against young Mrican-American and Hispanic-American customers resulted in a bias finding and legal sanctions against one of the car rental companies operating at Newark Airport. Much of Dr. McCombs' research and evaluation work is geared to the improvement of urban relations and community inclusion for all ethnic, racial and diverse groups. Prior to the opening of the New Jersey Performing Arts Center, (NJPAC), he conducted research to ascertain the potential cultural event participation by African-Americans and Hispanics in the NJP AC service area. He is currently Board Chairman ofiFS (Independence: A Family of Services, Newark, Irvington and East Orange, NJ). Dr. McCombs, through his company Third Power, has developed and participated in program start-up needs assessments, process evaluation, outcome evaluation, program impact analysis, employee and customer satisfaction, employee appraisal processes, public transportation fare and service issues and investigations of disparate treatment. Some of the clients for this work include: The Port Authority of NY&NJ; City of Camden, NJ; Asbury Park Waterfront Redevelopment Project; Plainfield Municipal Utilities Authority,NJ; NJ Department of Transportation; New Jersey Transit; SEPTA, the transit authority for Philadelphia, PA; and City of Richmond, VA. -4- A resume for Dr. McCombs is attached in Appendix A. He will be responsible, inter alia for conducting the Biennial Community Survey. Data Collection and Analysis George Georgiades is a principal in Gemean Consulting. A recognized technologist, data analyst and computer forensic expert with over a decade of experience carrying out data analysis, digital forensics and electronic discovery, Mr. Georgiades has consulted on and implemented technology solutions for the New Jersey Division of Law, New Jersey Department of Transportation, New Jersey Department of Environmental Protection, the New York Stock Exchange, large multinational banks and corporations as well as other government entities, public and private clients. He has testified as an expert in data analysis and computer forensics before the Securities and Exchange Commission and has served as an electronic discovery expert for many clients involved in or anticipating litigation. Mr. Georgiades has extensive experience with systems including proprietary, database, archival and back-up, financial and enterprise resource planning. Mr. Georgiades has authored hundreds of assessments and reports, certifications and affidavits on topics including data analysis, electronic discovery, computer forensics and enterprise systems. This work has enabled his clients to successfully address a wide variety of challenges such as multimillion dollar litigation actions over racial profiling, intellectual property infringement and financial misstatements , as well as advance court cases and other disputes. He has developed forensic methodology for handling, processing, and analyzing electronic data in numerous organizations. For a state agency that needed to meet discovery obligations, Mr. Georgiades developed a system that collected and analyzed information from an archive system. He also analyzed a case and document management system with a web-based front-end. Creating customized extracts from the system greatly enhanced transparency. A resume for Mr. Georgiades is attached in Appendix A. He will have a leadership role in assisting the Monitor to perform Subsections E, F and G of Section XIV and advising the Monitor on the success of achieving the Decree's goals in Subsection B of Section X, Data Collection and Analysis. Project Administrator Donald Sobocienski is the Chief oflnvestigative Services in the Compliance Practice Group ofDoar Rieck Kaley & Mack. For the past 19 years, Mr. Sobocienski has functioned as either the Project Manager or Principal Investigator for Walter Mack's appointed Monitorships and compliance engagements. As such, Mr. Sobocienski was responsible for developing relationships and maintaining communications with the stakeholders, performing data review and analysis, report writing, and insuring the subject entity's compliance with the specific mandates of that project. Prior to joining Doar Rieck Kaley & Mack, Mr. Sobocienski was the Strategic Analyst for the New York State Organized Crime Task Force. Among Mr. Sobocienski's achievements while with the Task Force was the design and implementation of the agency's storage and -5- retrieval recordkeeping system. Mr. Sobocienski also was tasked with preparing several assessments and studies pertaining to organized crime and racketeering in specific industries including waste disposal and construction, most notably, Corruption and Racketeering in the New York City Construction Industry which were published by the Task Force as an interim and final report in 1987 and 1989 respectively. Mr. Sobocienski's assessment of organized crime in the Long Island waste disposal industry contributed to a study by the Rand Corporation entitled Racketeering in Legitimate Industries: A Study in the Economics of Intimidation. Mr. Sobocienski was the Project Coordinator for a multi-state project to address the growing problem of Soviet emigre organized crime. He was one ofthe principal authors of the project's concluding report entitled An Analysis of Russian-Emigre Crime in the Tri-State Region. On a briefleave of absence from the Task Force in 1987-1988, Mr. Sobocienski worked as a consultant for the Pennsylvania Crime Commission in their effort to develop a state of the art intelligence capability. A resume for Mr. Sobocienski is attached in Appendix A. Mr. Sobocienski would assist in monitor coordination, stakeholder interaction and responding as described in Subsections I through N of Section XIV of the Decree. TEAM MEMBERS Lindsay Eason brings over four decades of law enforcement and public safety experience covering both government and the private sector. During his 23-year career with the New York City Police Department (NYPD), he was an instructor in the Police Academy where he oversaw the training of thousands of police recruits through established performance metrics designed to ensure the safety of police personnel, the public, and those suspected of crimes during police-citizen encounters. He also supervised patrol personnel, verifying arrests and responding to serious crimes and dangerous conditions. As Executive Officer to the Police Commissioner's Security Detail assigned to the Intelligence Division, Mr. Eason was responsible for overseeing a team of elite detectives. He was charged with swift evaluation of potential threats to the Police Commissioner and responding to critical incidents and intelligence regarding issues that might affect the stability of police relations with the public or threaten the safety and welfare of the public. Appointed by Mayor Michael Bloomberg for two terms, Mr. Eason served as Sheriff, the chief civil law enforcement officer for the City of New York. In that capacity, he oversaw the management ofthe Sheriffs Office with approximately 200 staff and a $13.5 million budget. He successfully instituted a performance management system and promoted professionalism in the rank and file concurrent with the focus on expanding the use of police resources to the fight against terrorism. Currently in the private sector, Mr. Eason serves as an appointed member of the New York City Civilian Complaint Review Board, an agency responsible for receiving and investigating complaints of excessive force, abuse of authority, discourtesy or offensive language by uniformed members of the NYPD. He also is the public safety director for the Grand Central Partnership, one of the largest business improvement districts nationally. Previously, as a -6- consultant and training manager for The Emergence Group, he designed and implemented training for police departments in Dushanbe, the capital city of Tajikistan, and surrounding provinces of this central Asian republic. Initially upon his retirement from the NYPD, Mr. Eason served as Director of Security for Michael Bloomberg at Bloomberg Financial LP. A resume for Mr. Eason is attached in Appendix A. A special focus for Mr. Eason will be Subsection C of Section IX, Accountability of the Decree. Willie Freeman has a background that combines law enforcement and public safety experience. He completed a 23-year career as a Lieutenant ofthe New York City Police Department in the Patrol Services Bureau and the Police Academy with responsibilities for supervision, confidential investigations and community interactions. He also served as a supervisor of the internal affairs unit. Earlier as a Sergeant with the NYPD, his assignments included Patrol Services, Police Academy and Organized Crime Control. Among his responsibilities were narcotics enforcement and recruitment supervision. Upon leaving the NYPD, Mr. Freeman spent over a decade in the Newark, New Jersey public schools serving as Director of Security Services. The system includes 82 schools, 8,000 employees and 44,000 students. In addition to managing security personnel, coordinating investigations, and monitoring safety and security plans, Mr. Freeman's responsibilities included acting as liaison between the schools and the community and police. He currently serves as a security consultant to urban school districts nationally. Mr. Freeman's expertise will be especially valuable to the monitor in evaluating training in Sections VI, VII and XI of the Decree. A resume for Mr. Freeman is attached in Appendix A. Gregory Mazzone spent 20 years with the New York City Police Department in a variety of positions including several years as an instructor in the New York City Police Academy. Mr. Mazzone developed the curriculum in the physical education unit and assisted in the development of new physical fitness standards for entry level Police Officers. He trained recruits and new instructors in physical training, self defense, frisking, handcuffing, baton, crowd control and car stops. Promoted to Sergeant in a precinct assignment as a Patrol Supervisor, he also served as Integrity Control Officer and implemented cost effective measures that increased efficiency while reduced expenses. In the Chief of Departments Office, Operations Unit during 2001, Mr. Mazzone had coordination responsibilities for the rescue and recovery efforts at the Command and Control Center after September 11. Within the Intelligence Division, he supervised the team that ensured security of the Mayor and leading administration officials for four years. Mr. Mazzone joined MacAndrews & Forbes Group after retiring from the NYPD. As Director of Security for East Hampton on Long Island, he is responsible for the personal security of the firm's clients and their estate properties. In addition, he founded Island Security Service which oversees training for companies on Long Island for their security offices and offers peace officer training in accordance with New York State Department of Justice. A resume for Mr. Mazzone is attached in Appendix A. He will be assigned specific tasks -7- as part of the Monitoring Plan described in Subsection F of Section XIV of the Decree. Charles Meade is the President of Firrin Associates which provides consulting services for fraud investigations, security operations, training and litigation support. Before forming Firrin Associates, he was a leading member of the audit/fraud special investigations unit for Altria, a Fortune 500 company with operations in 90 countries. His experience in criminal justice and law enforcement is founded on a 21-year career as a member of the Nassau County Police Department on Long Island. Mr. Meade has business/investigative experience on five continents. He has had responsibility for internal investigations of employee or vendor malfeasance and coordinating and implementing successful fraud prevention operations. He also has conducted organizational reviews and audits to ensure compliance with business and regulatory requirements. Frequently, he has dealt with entities operating under collective bargaining agreements. In addition, Mr. Meade served as a union delegate for four years for the Nassau County Detectives Association, as such he is attuned to the concerns and constraints of various professional situations. Training has been a significant part of Mr. Meade's responsibilities. As a NY State Police Certified Trainer, he created and taught classes at the Nassau County Police Academy on a wide variety of police-related topics to recruits, in-service, and supervisory personnel. He also was a member of the Speakers Bureau of the Nassau County Police Department charged with speaking to community and religious groups as well as high school and college classes. Recently, Mr. Meade has been engaged on an assignment for the Port Authority of NY & NJ Inspector General's Office. A resume for Mr. Meade is attached in Appendix A. Mr. Meade will be assigned to specific tasks as part of the Monitoring Plan described in Subsection F of Section XIV of the Decree. Mark Muse has over 27 years of broad law enforcement experience gained with the New Jersey State Police (NJSP). Starting as a Road Trooper at numerous stations in Northern New Jersey for more than a decade, Mr. Muse became an instructor at the New Jersey State Police Academy and over the course of 12 years rose to Commandant. A critical portion of the federal consent decree, under which the NJSP operated from 1999 to 2009, focused on the training of new troopers. During that time, Mr. Muse was responsible for recruiting and handling all aspects of recruit training. As Assistant Bureau Chief for the Academy, he supervised academy and civilian personnel and provided oversight for all academy-generated programs. As Academy Commandant, Mr. Muse was involved in the creation and revision of policies and procedures to ensure sustained consent decree compliance. Throughout, Mr. Muse was engaged in creating training, for recruits and incumbents, that fulfilled the requirements of the decree. During his tenure, Mr. Muse was involved in all aspects of law enforcement training and participated in the training of over a thousand troopers and local police officers. He also was a key contact for the NJSP monitoring team and the Attorney General's Office, creating and providing training documentation Named Division Operations Officer, Mr. Muse served as liaison between the Field -8- Operations Section and other branches within the division, along with outside law enforcement agencies, to provide support for troopers and regional operations officers to accomplish their missions and initiatives throughout the state. During this time, he was part of the operating team that handled security for Governor Chris Christie's 2010 inauguration. Mr. Muse's most recent position with the NJSP was as Bureau Chief for Communications in the Emergency Management Section where he supervised several units and 250 enlisted and civilian members maintaining a multi-million dollar communications infrastructure and coordinating operational communications requests from the entire organization as well as external agencies. Upon retiring from the NJSP, Mr. Muse was engaged by the Polytech Career Academy in Flemington, NJ to overhaul the curriculum and coordinate the instruction of a basic law enforcement program for high school students interested in pursuing a career in the criminal justice system. Presently, he is serving as the Associate Director of Safety and Security at the Liberty Science Center in Jersey City, NJ, where he has successfully turned around the effectiveness of the security office through careful assessment of the issues, the creation of policies and procedures and the alignment of personnel to meet the Science Center's standards and goals. A resume for Mr. Muse is attached in Appendix A. Mr. Muse will be assigned specific tasks as part of the Monitoring Plan described in Subsection F of Section XIV of the Decree. Patrick Oliver is a recognized law enforcement executive. Since 2005, he has been a member of the faculty at Cedarville University where he is an associate professor and serves as Director of the Criminal Justice Program. Previously, he compiled a record of 27 years in Ohio law enforcement in a broad range of positions, serving as the Chief of Police of the cities of Fairborn, Grandview Heights, Cleveland and as interim Chief of Police of the village of Lincoln Heights. He also was Ranger Chief of the Cleveland Metropolitan Park District and spent 11 years as a trooper with the Ohio State Highway Patrol. In the last decade on a national basis, he has consulted with police forces on performance and management audits, conducted workshops on topics such as ethics, recruitment and retention, and standards of excellence for groups of law enforcement officers and associations of police chiefs. In addition to several Ohio, Illinois and Minnesota organizations, some of the law enforcement groups he has worked with include the Bay Area Rapid Transit Police, Oakland, CA; Public Safety employees, LaGrange, GA; Alaska State Troopers and Anchorage Police Dept., AK; and Fort Lauderdale Police Dept., FL On an international basis, Professor Oliver has participated in exchange programs in Brazil, Turkey and Israel with national police forces and for field study in counterterrorism strategies. He has also taught seminars in leadership and in criminal investigations to security forces from Lebanon and several African countries. Since the 1990s, Professor Oliver has published numerous articles and studies in law enforcement magazines and journals. In 2013, he authored Recruitment, Selection & Retention of Law Enforcement Officers and he was the recipient of research grants, in 1999 and 2002, through the Ohio Office of Criminal Justice Services for projects on aspects of the hiring process for law enforcement officers. -9- Professor Oliver will be instrumental in all phases of the monitorship but will help us particularly in understanding local issues and factors. His resume is attached in Appendix A. Michael Schaller is Of Counsel at King, Kitrick, Jackson & McWeeney, a law firm in Brick, New Jersey. He spent 26 years with the New Jersey State Police (NJSP) serving ultimately as Chief of Staff of this law enforcement organization of 4,000 personnel. As such, he handled the daily coordination of operations, homeland security, investigations and administrative branches, the Offices of Professional Standards and Community Outreach, as well as the New Jersey Regional Operations and Intelligence Center. He ensured business and operational continuity, aggressive fiscal oversight and public accountability and effective response to a multitude of complex, critical incidents. Mr. Schaller participated in all areas regarding patrol practices, supervision, training and internal affairs in the 10-year effort to fully satisfy compliance with the federal consent decree concerning the NJSP. During the period the Consent Decree was in force, his assignments included unit head ofM.A.P.P.S., a computerized data base that captured patrol data, and Strategic Initiatives Officer, tasked with development and oversight of risk management processes. Assigned as enlisted director in the Office of State Police Affairs, he had daily interactions with the federal monitors and the Office of the Attorney General relating to all areas of the consent decree. As Commander of the Office of Professional Standards, Mr. Schaller oversaw all aspects of internal affairs, including intake, investigation and adjudication. He testified before the New Jersey Legislative Black & Latino Caucus and Governor Corzine's Advisory Committee on Police Standards regarding police accountability and risk management. With extensive public speaking and instructional expertise, Mr. Schaller has made presentations on police accountability, supervisory issues and early warning systems to numerous state, county and local police departments nationally as well as the International Association of Chiefs of Police. He is certified by the Police Training Commission as an instructor and has provided instruction at pre-service, in-service and advanced levels on arrest, search & seizure, criminal law, discipline, civil liability and supervisory issues to thousands of local, county and state officers. While he was assigned to the Criminal Investigations Section, Mr. Schaller conducted a broad spectrum of investigations targeting conspiracy, narcotics trafficking and assaults. A resume for Mr. Schaller is attached in Appendix A. Mr. Schaller will be assigned specific tasks as necessary and as part of the Monitoring Plan described in Subsection F of Section XIV of the Decree. Jan Walden has extensive experience administering and supervising diversity programs including Small Business, DBE Development, Affirmative Action and Equal Employment Opportunity and monitoring the hiring and policies of the New Jersey Transit Police and the New Jersey State Police. She is a tireless advocate for small, minority and women business enterprises as well as for non-discrimination in minority and women workforce participation. Over the course of her 27-year career at New Jersey Transit Corp., she was director of the -10- office ofbusiness diversity from 1987 through 2003. From 2000-2001, she also served as Director ofthe New Jersey Department of Transportation Office of Civil Rights. During her career, Ms. Walden gained expertise in state and federal contract compliance, regulatory compliance and DBE certification. As Assistant Executive Director Diversity Programs, Ms. Walden was Director of Business Programs and EEO/Affirmative Action. Under her leadership, New Jersey Transit consistently won local, regional and national awards for contracting to small, minority and female-owned firms. In 2009, Ms. Walden became Vice President for Small Business and Workforce Initiatives at McKissack & McKissack, the nation's oldest minority-owned construction and engineering firm. Each played an instrumental role in ensuring the NJSP transition to a modem, professional police force that carries out their functions with efficency -16- and equitable treatment for New Jersey citizens and other members of the public, consistent with the goals of the Consent Decree. Bryant Hoar was involved with the implementation and review/approval process for the NJSP Motor Vehicle Stop Report. This report captured Consent Decree related information on motor vehicle stops, frisk, searches, consent search requests, canine deployments and the race and gender of operators and passengers. He reviewed and approved the narratives of reasonable articulated suspicion and probable cause as defined by current case law and constitutional law in New Jersey. He also conducted review and approval ofthe NJSP Use of Force Report. This report captured information on instances involving all aspects of police force (physical, mechanical, chemical or deadly), including the narratives for legal justification of the level of force utilized. He conducted Management Reviews of designated critical incidents to identify conduct and actions by Troopers which required further supervisory action. These actions included verbal and written counseling, training or referral to the Office of Professional Standards (lAB) for investigation and possible discipline. He supervised a Mobile Video Recorder Review Team which reviewed the audio and video documentation of a variety of incidents. After retraining in adult-based learning techniques and attending a weeklong course given by the Royal Canadian Mounted Police, he was part of a team that was responsible for revising the recruit curriculum. The new curriculum included scenario-based training, critical thinking and problem solving techniques, both individually and in small groups, which Mr. Muse delivered to numerous recruit classes. He also participated in the development of a recruit orientation program that is delivered to each recruit class several weeks prior to their academy assignment. As a member of the Executive Development Unit, he was responsible for training mid-level managers. The training was subject to research, development, revisions, updates and implementation with all mid-level managers. A follow-up questionnaire to all participants provided information that was used to evaluate the effectiveness of the training and to make changes as deemed necessary. Meeting frequently with the independent monitoring team in his capacity as Executive Officer and Commandant ofthe Academy, Mr. Muse insured compliance of all training requirements stipulated in the Consent Decree. The requirements covered development -17- and evaluation of all training including for academy instructors, newly promoted troopers and supervisors and protocols for trooper coaches. He oversaw the inclusion of training in the Data MAPPS program and the establishment of a central repository for training records, as well as the creation of reports and other documentation as recommended by the monitoring team. MAPPS is a computerized data base that provides front line supervisors, managers and executive level commanders the ability to see concise and centralized performance information regarding the personnel under their command. The system includes motor vehicle stop, search and arrest data, internal affairs history, performance review of motor vehicle recordings, training records, and assignment history among other data. During the period of the Consent Decree, Mr. Schaller also supervised the creation of risk management processes from development to roll out. Ultimately, the risk management effort was designed to provide a global view of the aggregate performance ofNJSP members. The steps included the formation of a risk management core group that was tasked with developing processes to manage risk from data collection to analysis and the presentation of findings, outcomes, and recommendations to the Risk Management Panel. The panel, which met quarterly, was comprised of executive level NJSP commanders and members of the Attorney General's Office. The tasks that were undertaken post-Panel meetings were commonly associated with changes to policies or procedures, the development of new or abandonment of past training initiatives, and, occasionally, the re-assignment of personnel. Analyzing a case and document management system within the DOT that included data stored within Oracle, Mr. Georgiades led the team in creating customized extracts directly from the Oracle system. The administrative departments of the targeted municipalities serve as a fulcrum in a variety of ways, stimulating interest in writing the agenda for community needs, encouraging collaborative efforts and balancing relationships. Although we do not expect that our entire Team will be present on site at any one time, we recognize the importance of the Monitor's presence, not only for purposes of conducting reviews and audits, but to facilitate communications and forge effective relationships between parties. I am the President of Third Power Market Development, Inc., a marketing research and evaluations communications firm specializing in public policy issues and community impact studies. I received an Ed.D. from The George Washington University, a Master's Degree in Fine Arts from Eastern Michigan University and a Bachelor of Science from Bowling Green State University. While earning my doctorate, I served as an adjunct professor of Graduate Statistics. For thirty-five years, I have been a social scientist providing in-depth social and public policy research and evaluation analysis. My work includes the design and implementation of ground-breaking high quality survey and critical impact market research. I am considered one of the foremost social policy researchers on minority issues in the state of New Jersey. My most highly acclaimed work has been related to the preservation and promotion of civil rights and equality in the provision of public services. I was selected by New Jersey Governor Whitman to be one of three principal investigators charged with designing, administering and analyzing the study entitled: Racism in New Jersey. Not long ago, I completed a statewide evaluation study on Disparity in Procurement for New Jersey Transit. I have also conducted multi-faceted and complex public opinion/evaluation studies for the Port Authority regarding the public's satisfaction with Port Authority Facilities and an inquiry into whether or not Newark Airport car rental agencies were using discriminatory practices against young African-American and Hispanic American customers. This inquiry resulted in a bias finding and legal sanctions against one of the Newark Airport car rental companies. 3. In the national arena, I conducted a Congressional Evaluation Study for the effectiveness of the Follow Through Supplementary Program, which was the initial step for the minority-focused Head Start Program. I contributed my expertise and writing to the creation of Public Law 94-142 which provided for the Mainstreaming of Children with Disabilities into public schools across America. I developed the Compliance Guidelines for all Universities and Colleges subject to the U.S. Rehabilitation Act (Califano/Sections 501, 502, 503 and 504, 1977). Prior to establishing my own firm, I served as the Vice President for Market Development for the national organization now know as "A Thousand Points of Light" where my work focused on developing and evaluating programs which offered viable volunteerism opportunities to promote economic and social equity to more than 380 communities in the United States and Puerto Rico. As a National Project Service Manager of the American Association of University Professors, I developed the national implementation plan for Section 504 of the Rehabilitation Act of 1977 -for all 3000 U.S. colleges and universities. Some of the work I am proudest of is the development and delivery of these compliance tools that served as protection for Students with Disabilities. I developed the "Quarter Care System" plan with the Bureau of Vocational Rehabilitation, Commonwealth of Pennsylvania which redirected traditional benefits payments to coverage of educational and care cost for those who wished to attend college. 4. My research and evaluation efforts have focused on developing surveys to capture quantitative data that is not readily available. For example, I designed and conducted a National Forum on the role of volunteerism as a unique tool for social justice in the African-American, Hispanic-American, Asian American, Native American and the GLBT (Gay Lesbian Bisexual Transsexual) communities. It was my responsibility to help SEPTA- Philadelphia's Transit Authority to determine how to bring back 40% of the African-American ridership when they did not return after a long term strike. The University of Rhode Island asked me to develop and implement a five year diversity plan for all of its campuses 5. Much of my research and evaluation work is geared to the improvement of urban relations and community inclusion for all ethnic, racial and diverse groups. I am currently the Board Chairman of IFS (Independence: A Family of Services, Newark, Irvington and East Orange, NJ), an organization that I have been associated with for seventeen years. IFS, following the "traditional African premise that every human being has the innate ability to change his or her life for the better", serves as a last resort for the most troubled and disenfranchised children, youth and families referred from the child welfare and juvenile justice systems. On behalf of the New Jersey Performing Arts Center and, prior to its opening, I conducted focus groups and surveys to provide valuable information on the potential of cultural event participation by African Americans and Hispanics in the NJPAC service catchment area. I have assisted in minority recruiting and advertising campaigns for large public and private entities. In conjunction with Asbury Partners, LLC, I created specific community awareness and outreach activities to assist the $2.5 Billion project, Asbury Park Waterfront Redevelopment project.
