In 2009 I lost my job of 8 years and was forced to go on unemployment, for a year, with an annual income of $22000. During that time I contacted my servicer, Chase Home Finance, and was told they would not accept partial payments, that I should stop making payments and would be placed in a 3 month forbearance. That was the start of my nightmare with Chase. was forced to ?le bankruptcy in 2011, and Chase did not ?le for Relief from the Stay, because they hadn't fabricated the Assignment of Mortgage in time. I later received a small check from the Independent Foreclosure Review, for their inexcusable fraud. 1 applied for approximately a dozen modifications with Chase from the period of 2009 to as recently as December 2013, all of which were mishandled by Chase. have lived in this home since 1986 and prior to Chase servicing this loan, had NEVER, in all that time, had a 30 day late payment on my mortgage. I have attached the current tax assessments for the property of $119500, which is still an overstatement, however, if the principal were to be reduced, the property taxes have been lowered, the homeowners flood could also be lowered, I see no reason why a modi?cation would not be in everyone's best interest. Sincerely, Complaint Review Page ".l'ii Lil - 1 Hun-n.? Welcome Sandra Case number: 141119?001222 Back STATUS Response disputed BSI Financial Services said: Response Hello, regarding your concern about the timeliness in which your loan modification application was processed, we would like to apologize for the inconvenience the time lapse may have caused you. However, we must advise you that BSI Financial Services and your loan's owner cannot review an incomplete modi?cation packet. Although the ?nancial packet was sent to us on March 21, 2014, we did not receive all required documents until July 10. 2014. Please be advised that a trial payment plan was sent to you September 22, 2014. On November 18, 2014, the same trial payment plan terms were offered at the mediation hearing and rejected by Ms. Lopaz. A borrower may decide not to make the trial payments, which will re5ult in a rejection of the modification offered. When the trial payments are not completed, BSI Financial Services considers the modi?cation to have been rejected. Please be advised that your agent is Scott Hanson and if you wish to inquire about other loss mitigation options you may contact him at Ext. 6761. If you should have any further questions please contact us at 1-800-327-7861. Thank You, BSI Financial Services WHAT HAPPENED Describe what happened so we can understand the Mortgage servicer has violated RESPA Reg 5 times. Servicer received a completed loan mod request on March 21, 2014. Servicer did not acknowledge loan mod request until July 11, 2014. Servicer did not start to evaluate loan mod request until July 11, 2014. Servicer filed for foreclosure on June 5, 2014. Servicer offered a TPP on September 23, 2014, with a ?rst payment due date of October 1, 2014. Servicer was unwilling to disclose the terms of the loan modification it offered, prior to the first payment due date 8: did not disclose this infom'iation until after it withdrew its offer. My loan was FHA insured, however, the Sec of HUD sold it through its Distressed Asset Sale Program, so the loan is now conventional. Which part of the mortgage process is your issue related to? Problems when you are unable to pay This is about Conventional fixed mortgage DESIRED RESOLUTION What do you think would be a fair resolution to your issue? An opportunity to negotiate a principal reduction, to fair market value. The loan was sold by HUD for 60 cents on the dollar of fair market value. The fair market value of the home is $1 19500, the servicer mishandled the loan mod request 8: started foreclosure and now states they are entitled to $229000.
