Said location is more particularly described as a two story tan brick and Siding veneer smgle family reSidence wrthin the Copper?eld Northmead Village With an attached garage on the corner of Lake Drive and Pine Falls Drive in Harris County, Texas With the front door facmg North and a concrete driveway. There are painted numbers "8454" on the concrete curb directly in front of the reSIdence on Lake Drive. There are currently two vehicles in the driveway of the residence One of the vehicles 15 a late model two door red Ford Ranger pickup truck license plate number CBR0479 The numbers 8454 also appear in white wood lettering above the garage door MY BELIEF IS BASED UPON THE FOLLOWING FACTS: Your Af?ant has been a peace officer for 13 years and is currently aSSIgned to the Homicrde DiVision of the Harris County Sheriffs Department On August 28, 2015 at approxrmately 8 37 your Af?ant responded to a Harris County Sheriff?s Department of?cer-involved shooting that had Just occurred at a gas station/convenience store located at 16050 West Road, Harris County, Texas 77095 Your Af?ant knew from the dispatch report that the of?cer was deceased at the scene and that based on the unit number, that the deceased Deputy was Deputy Darren Goforth Your Af?ant arrived at the scene along with multiple other law enforcement units and con?rmed that the deceased of?cer, whose body was still at 16050 West Road, was in fact uniformed patrol of?cer Deputy Darren Goforth. Your Affiant observed Deputy Goforth?s deceased uniformed body on the ground next to his patrol vehicle With what appeared to your A?'iant based on his training and experience, to be multiple gunshot wounds. Deputy Goforth?s patrol vehicle was parked next to the gas pumps. Your A?iant spoke with Crime Scene Unit Deputy Sean Simpson who told your Af?ant that all of the shell casmgs recovered at the scene of the fatal shooting were 40 caliber AgUila shell casmgs Your Af?ant met with Harris County Sheriff?s Department Detective Mark Reynolds at the scene who told your Affiant that a Witness to the shooting named ChristOpher Lee Crummey stated that he was exiting his vehicle at the gas station/convenience store when he heard a gunshot Crummy told Reynolds that he turned in the direction of the sound and saw the Deputy on the ground and a dark skinned black male With a ?fade? or bald head shooting a gun in the Deputy?s back Crummey told Reynolds that he got his children into his vehicle and then saw the black male shooter enter the driver?s side of a Red Ford Ranger and drive away from the scene on West Road. Your Affiant discovered that there were multiple surveillance cameras located on and around the convenience store that were positioned in a way to potentially capture the shooting of Deputy Goforth Your Af?ant, along with other officers, met With the store operator/owner named Tou?q Gilani Gilani told officers that he was in the store when the shooting occurred and that his cameras had captured the shooting Your Af?ant watched the video of the shooting in a back of?ce of the convenience store The cameras show a red Ford Ranger parked at the front of the store and occupied by a driver The Video shows the person known to your Af?ant as Deputy Darren Goforth eXit the convenience store and walk towards his patrol vehicle which was located at the gas pumps After Goforth passes the red Ford Ranger and is near the patrol vehicle, the video captures the dark skinned male driver of the Red Ford Ranger exrting his truck and ambushing Goforth by approaching him from the back and shooting him in the head with a handgun Goforth is next seen falling to the ground and the dark skinned male ?1 stands over Goforth repeatedly discharging his gun into the deputy?s back The Video then shows the dark skinned male re-enter the red Ford Ranger and drive westbound from the location. Your A??iant was able to see that the shooter was a dark skinned large muscular framed male with a bald or short haircut Your Af?ant was able to see a distinctive aftermarket trailer hitch on the rear of the shooter?s Red Ford two door extended cab Ranger. Your Af?ant spoke with Deputy Chris Mullins who was assisting With a database rev1ew of all known Red Ford Rangers Within Harris County, Texas ZIP code 77095 By narrowing the search based on known vehicle details, Mullins told your Affiant that he determined that a Red Ford two door extended cab Ranger LP CBRO479 was registered at 8454 Lake Drive, Houston, Harris County, Texas 77095 and that occupants of that residence included a black male. Based on this discovery, Mullins told your Af?ant that he had of?cers go to the location to attempt to make contact with the reSIdents Harris County Sheriff?s Department Gary Smidt told your Af?ant that on August 29, 2015 at apprommately 12 38 am he observed a Red Ford Ranger extended cab pickup truck license plate number CBRO479 in the driveway of 8454 Lake Drive, Harris County, Texas. Smidt told your Af?ant that he knocked on the front door and made contact with a black male identifying himself as Justin Woods Smidt said that he asked Woods if the Red Ford Ranger was his truck and he said ?No, it?s my brother?s truck?, and identi?ed his brother as Shannon Miles, o.b 9/15/1984 . Smidt said that he then asked for and received verbal consent from Woods to search the home for Shannon Miles Smidt told of?cers that Shannon had recently left the location with their mother While Deputies were looking lI'lSlde the home for Miles, your Af?ant arrived at 8454 Lake Drive as did Miles and his mother. Your Af?ant made contact With Miles who admitted that the Red Ford Ranger pickup truck LP CBRO479 was his truck Miles pr0Vided of?cers written consent to search the truck Your Af?ant immediately observed Similar characteristics between Miles and the shooter on the Video particularly Miles? 3126, hair style and skin tone. Your lAf?ant asked Miles if he owned any ?rearms and he said, ?Yes, two? When asked what kind of ?rearms, Miles responded that he had preViously disposed of a Smith and Wesson 9 mm and now only had a 40 caliber unknown make/model handgun. When asked about the ?rearm?s location, Miles told your Af?ant that the gun was in a blue baseball bag in the garage at 8454 Lake Drive. It is your Af?ant?s belief that Shannon Miles is the person in the Videotape shooting Deputy Darren Goforth multiple times on August 28, 2015 It is also your Af?ant?s belief that the Red Ford Ranger LP CBRO479 is the vehicle used by Miles to travel to and from the shooting of Deputy Goforth It is further your Af?ant?s belief that based on statements made by Shannon Miles, that the ?rearm used to shoot and kill Deputy Goforth is located Within the residence and attached garage at 8454 Lake Drive, Harris County, Texas Your A?iant obtained a search warrant on August 29, 2015 at 6 30 am signed by Harris County Criminal Magistrate Joe Licata to search for implements and instruments of the crime of Capital Murder of a Peace Of?cer including all ?rearms and ammunition located at 8454 Lake Drive, Harris County, Texas Your Af?ant advised Deputy Jason Brown of the signing of the search warrant at 6 30 a m. by Magistrate Licata and a copy of the Signed warrant was forwarded to Deputy Brown. Deputy Brown told your Af?ant that a loaded Smith and Wesson SD40 40 caliber ?rearm serial number FWK5523 was located in the reSidence in a blue bag as described previously to your Af?ant by Shannon Miles In addition to the ?rearm located in the blue bag there was also a box made for 50 cartridges of Agu11a .40 caliber bullets Your A?iant knows from his presence at the shooting scene that there were 15 Aguila 40 caliber casmgs left at the location of the shooting Brown told your Af?ant that he transported the recovered Smith and Wesson SD40 .40 caliber ?rearm serial number FWK5523 to the Harris County Institute of ForenSic Science Firearms Laboratory for comparison to ballistic eVidence located and recovered by crime scene of?cers at the Darren Goforth homicide scene of 16050 West Road, Harris County, Texas Brown advised that Harris County Firearms Examiner Jill Dupree conducted the comparison of multiple ?red casmgs from the homicide scene Your Af?ant has rev1ewed a report prepared by Dupree and con?rmed by Harris County Firearms examiner Robert Baldwm in which Dupree determmed that the SD40 40 caliber Smith and Wesson serial number FWK5523 which Shannon Miles identi?ed as his 'own is the same weapon that ?red the casmgs recovered from the Deputy Goforth shooting scene at 16050 West Road, Harris County, Texas. During the execution of the search warrant on August 29, 2015, your A??iant observed a white in color cooler located in the kitchen of 8454 Lake Drive. Your Af?ant immediately noted that it appeared consistent With the white container your Af?ant observed in the Video of the bed of the Red Ford Ranger pickup truck during the shooting of Deputy Goforth On August 29, 2015, your Af?ant also observed a square dust outline in the bed of the red Ford Ranger pickup truck parked in the driveway at the 8454 Lake Drive location Your A?iant observed that the dust outline was in the same or Similar posmon as the positioning of the white container seen in the muse Video in the bed of the Red Ford Ranger pickup truck. Deputy Brown told your Af?ant that on August 29, 2015, he observed a damp load of laundry inSide a washing machine in the garage area of 8454 Lake Drive which included a white t?shirt conSIStent With the t-shirt observed to be worn by the shooter during the homicide of Deputy Darren Goforth Brown also noted to your A?iant that there were other Items of clothing in the same washing machine. Your Af?ant observed splattered blood and other Signi?cant biological ev1dence at the 16050 West Road crime scene which could have transferred or landed on the clothing of the shooter Your A?iant believes that based on the recent washing of these items at 8454 Lake Drive there could be biological eVidence remaining from the Capital Murder crime scene and/or be indicative of an attempt to conceal ev1dence of the Capital Murder Brown also stated that he observed multiple white t-shirts in a pile in the garage laundry area consistent with the white t-shirt that the shooter wore at the time of the August 28, 2015 crime. Brown stated that on August 29, 2015 while also in the process of executing the search warrant, he observed an empty Ruger gun case in the master bedroom of 8454 Lake Drive, Harris County, Texas Deputy Brown told your Af?ant that during the execution of the search warrant at 8454 Lake Drive, he observed 7 cellular telephones including Samsung and Kyocera ?smart? cell phones in a bedroom containing mail and a Texas Driver?s license for Shannon Miles which showed 8454 Lake Drive as Miles? address Brown additionally reported locating Within the residence a Dell Latitude Laptop Computer D520, a MacBook Pro Laptop Computer, a ZTE cellular smart telephone, a Cannon Digital Camera, and 4 Flip Type Telephones Af?ant was contacted by Deputy C. Helstrom of the Harris County Sheriff? 3 Of?ce, who advised that during the prior search of the inside of the residence located at 8454 Lake Drive, he observed a wireless router/wireless access point, which af?ant knows to be a device capable of providing Wireless internet service to devices within a certain phy51cal proximity of the router/wireless access point. Deputy Helstrom sent your af?ant a photograph of the router/wireless access pomt which was located at the aforementioned residence. Said router/wireless access point is further described as a black in color at&t router/wireless access point, on the side of which is printed the following identi?ers: SSIDATT218, Wireless Network Keyz2212969405, PN: 4201-001142-001, and MAC: (pictured below). Af?ant also spoke with Gary Spurger, who af?ant found to be credible and reliable. Spurger advised af?ant that he has specialized training and knowledge in regard to electronic wireless devices, including routers and wireless access points. Spurger advised your af?ant that routers and wireless access points have device and activity logging capabilities. Speci?cally, Spurger advised your af?ant that the device could contain records of speci?c dates and times during which ind1v1dual electronic devices connected to the intemet through said router/Wireless access point. Based on Brown?s observations, af?ant knows that at least two of the cellular ?smart? phones (Kyocera and Samsung cellular phones) capable of internet wi-? connections were located Within a 8454 Lake Drive bedroom along with identifying information of Shannon Miles Af?ant knows that these deVices appear to be ?smart phones?, devices which af?ant knows to be commonly capable of creating a wireless connection to the internet through a router/wireless access point. As such, af?ant believes that the router/wireless access point described herein contains records that could establish the presence or absence of Shannon Miles or other persons? phone(s) at the 8454 Lake Drive residence where the ?rearm identi?ed as having ?red casings at the shooting scene of 16050 West Road, Harris County, Texas was located by law enforcement. 3"?qu Your A?iant further knovvs from experience that vvireless internet routers contain data that can indicate time. date and device connections to the particular router and cellular device. ZOIS that appeared to Deputy Brovvn to be consistent vvith the shoes worn by the shooter in the video ofthe killing of Deputy Darren Goforth.
