Homer, LB. #3499, FORT WORTH POLICE DEPARTMENT, and I have good reason to believe and do believe that on or about the 4th day of September, 2015, in Tarrant County, Texas, MICHAEL TUAUA, White male, Date of Birth 07/12/1993, did then and there commit the offense of BODILY INJURY in that he did then and there intentionally and knowingly, while in the course of committing theft of property and with intent to obtain or maintain control of said the face and body and stole a case. of thirty, Keystone Light beer. My belief is based upon the following facts and information: 1. That on September 4, 2015, at 2331- hours, Of?cer Chambers a police of?cer, with the TCU Police Departrnent was on routine patrol. Of?cer Chambers was traveling north bound in the 3000 block of Merida. He observed a group of individuals in the road and heard loud voices coming from the group. Of?cer Chambers turned west onto Lowden and approached the disturbance. 2. Of?cer Chambers observed one victim,_ lying on the ground and a second victim,? standing next to him. who was walking with the two victims, ran up to Of?cer Chambers? patrol vehicle and advised his friend was assaulted only moments prior to Of?cer Chambers arrival. advised the suspects ran away when Of?cer Chambers turned the corner. Of?cer Chambers provided a written statement. 3. Fort Worth Police Of?cer R. Rockwell #4232 and Of?cer T. Shelton #3218 were dispatched to 2700 W. Lowden to work the call. The of?cers arrived on scene and began to investigate. Of?cers leamed tha_ were walking west in the 2700 block of W. Lowden. - was carrying a case of Keystone Light beer. A can of beer was thrown at the three of them as they walked, hitting All three turned around and looked in the direction the can of beer came from to see who threw the beer and observed three individuals standing in the yard of_ No one else was present. 4. 6. 3 (j FWPD15-83325 I, Detective S.L. Homer #3499, assigned to the Robbery Unit, was noti?ed by FWPD communications of a robbery at the intersection of W. Lowden and Merida. I responded to the scene. I received the details of the call from of?cers at the scene. I arranged for - and ?to be transported to 350 W. Belknap to be interviewed. wereimmediately tranSported from the crimelscene to 350 W. Belknap, to the Robbery Of?ce to give independent statements. Detective S. McCarthy LD. #298 8 interviewed - and_ separately. In his statement to police, ?stated he yelled at the three suspects in the yard, asking why someone threw the beer. The suspects ran toward A black male suspect, wearing a TCU backpack (the type of which is issued to TCU athletes), hit-with a closed ?st to his left temple. ?felt pain and backed away quickly and bent over. _ran, in fear he was going to be assaulted. When 7 7 _looked up, he observed the three suspects kicking and punching- a 10. ?ae?sanbe asi?fla?ying on the'p?aa?n inthe ?tetal?prfsitlon? while the suSpects where hitting and kicking him. - stated the suspects stopped assaulting -and one suspect said, ?Get the beer.? stated the, ?Asian-paci?c male with big hair? picked up the case of beer which belonged to -and all three suspects ran south through an alley. _also provided a statement to police. statement is consistent with- statement. said he was walking to his apartment with his ?and their friend,?. -said- was carrying a case of Keystone Light beer. said he was suddenly hit in the back of the leg with a full can of beer that had been thrown at him. When he turned around to ?nd out what happened the suspects began to yell at him. ?stated he could not understand what the suspects were saying but understood quickly the suspects wanted to ?ght. The suspects ran up to them and one of the suspects hit- in the head with a closed ?st. _stated he ran away in fear of being assaulted. When he was out of reach, all three suspects turned and started to punch When the suspects stOpped hitting- they ran away. ?said as the suspects ran away a TCU police vehicle arrived on scene. _said he went to check on - -told-he felt pain in his shoulder and face. immediately said, ?And they took my beer.? . - . . Medstar was dispatchedto treat? for his injuries. was transported to Harris Methodist Hospital emergency room. Detective F. Solano ID. #3265 went to the Harris Methodist hospital to interview -. ?statement was consistent with and statement. -stated friend?s house, carrying a case of Keystone Light beer and walking with 11FWPD 15?83325 was hit with a beer can that was thrown at them. When -turned around to see where the beer can came from, he said a black male suspect ran at him and hit him with a closed fist in the face. - fell to the ground and tried to protect himself by pulling his knees close to his chest and covering his head and ribs. -stated the I incident happened very quickly and lasted thirty to forty?five seconds. -speculated there were three suspects but could not be sure. When the suspects ?ed, they took-the beer that bel'Onged to,- 3 ?a provided his medical records from his emergency room treatment which document his injuries as follows: Facial contusion, Forearm contusion, Left shoulder pain, Arthralgia (joint inflammation). :4 At the scene of the offense, FWPD of?cers observed several items that are believed to have be left behind by the suspects, to include; one bottle. of Bombay Sapphire gin, one bottle of Heineken beg, and apair of red and blackisunglasses. CSSUiof?cer?s processed the scene. Also?fdund was a black Apple Ether?161311 image? fang-While? of?cers?were at the scene. The name that appeared on the caller ID was ?Mike Tuaua?. Officer Rockwell and Officer Shelton spoke with one of the residents 0? ?stated he was having a small party when four TCU football players arrived at his house uninvited. ?stated he did not know their names but was told by another guest they were football players. With'the information provided to of?cers about the TCU athletic back pack, the name on the caller ID of the abandoned cell phone and third party information that the suspects were football players, officers checked the TCU football roster. The TCU football roster lists the name ?Mike Tuaua? who was later identi?ed as Michael Rea Tuaua w/m - Tuaua was contacted through university of?cials and asked to call me, Detective S.L. Homer. Police learned that Tuaua had hired an attorney. Through his attorney, Tuaua agreed to be interviewed by me. On September 6, 2015, Tuaua arrived at 350 W. Belknap with his attorney to speak with me. I asked Tuaua'to provide a written statement about what occurred on Friday, September 4, 2015 at approx. 2330 hours at 2700 W. Lowden. This interview was video and audio recorded. In his statement Tuaua identified the three people who came to the party with him. Tuaua said he was with Nam (later identified as? -(later identi?ed as and .(later identified as r- drove Im?s car and the four of them went to a party. Tuaua told me. Vehicle is a silver Kia. Tuaua stated they stayed twenty to thirty minutes. He stated they had no problems with the people at the party, but were asked to leave. i7. 18, 19. 20. 21. 22. 23. 24. Tuaua stated he walked outside, he heard yelling, and saw surrounded by three males, and they were pushing and? shoving. Tuaua stated he ran over to stop the ?ght. Im also came over to where the ?ght was happening. Tuaua stated he saw- ?in a scuf?e? with a male. According to Tuaua, *and the male fell to the ground and Tuaua punched the guy to get him off Tuaua stated the entire incident lasted a few seconds. Tuaua stated he saw the pack of beer but does not know what happened to it. I asked Tuaua some follow up questions in addition to his written statement. I asked Tuaua why he and the others left the party. Tuaua stated there were no problems at the may, there were 116? girls present. I asked Tuaua why he got involved in an altercation between _and the victims. Tuaua said it was to protect Hecause he was outnumbered. Tuaua explained hand got involved to help Tuaua. I pointed out the distinct physical difference between and the victims, who are substantially physically smaller and asked him to explain why he felt -was in danger. Tuaua did not answer that question. I asked Tuaua several times if he or anyone he was with took the case of Keystone Light beer that belonged to Tuaua said he did not take the beer and does not know who did. I asked Tuaua if there is Keystone Light beer at his house. Tuaua stated, ?No? and said he does not drink that beer. Tuaua stated he, . and ?an away from the scene of the crime and went to his house at Tuaua said they did not talk about the incident at all. He said he went to bed and fell asleep. Tuaua said he did not hear police of?cers knocking on his door approximately one hour after the offense occurred. I concluded the interview. I was noti?ed through attorney that he refused want to make a statement to police. I was noti?ed through .3 attorney he refused to make a statement to police. contacted police through his attorney and agreed to an interview. During the interview admitted he was at the party with Tuaua,. and ?explained he was still in the house when the incident started. As _walked out of the house to go to the car, he observed Tuaua and 25. 3 (j Dabout twenty yards from the car. at noticed the victims but could not distinguish what was happening. ?saw-'un up to the group and realized they were involved in a ?ght. -approached the group as the ?ght ended. ?tated he was scared and confused when he saw police approaching. ~lerted Tuaua. and that police had arriVed and they ?ed the scene on foot. ?t was in front of the others and became separated from them. _stated he received a phone call from Tuaua instructing him to meet back at Tuaua?s heuse It is not believed at this time that participated in the robbery. On September 6, 2015, I wrote a search warrant for the home of Tuaua located at- Fort Worth, Texas. The search warrant was signed into existence by Judge Catalano and was executed on September 6, 2015. I found three cans of Keystone Light beer in the back yard of the residence. The cans of Keystone Light beer were collected by CSSU. Tuaua?s bedroom has an exterior door which leads to the backyardcreated a photo lineup containing Tuaua?s photograph and the photographs of ?ve other males of similar age and features. I created a lineup containing Petties?Wilson?s photograph and the photographs of ?ve other males of similar age and features. Both lineups consisted of six photographs, featuring only the face and neck, each placed in a separate folder. On September 6, 2015, I met with at 350 W. Belknap. I showed -the photo lineup of Tuaua. ?picked Tuaua?s photograph and stated he was the individual who ?ran at us, joined in on kicking, and stepping on_ while he was on the ground and was the last to stop. He also is the one who took the beers.? On September 8, 2015, I met with the residents 0? _311d They advised that on September 4, 2015 four individuals who they believed 1 to be TCU football players arrived at their house uninvited. ?stated that Tuaua punched and broke a window on the exterior of the house. -was told by another guests that the football players were being rude and made the guest uncomfortable. decided to ask them to leave. and-all stated they did not see the robbery occur. advised he would be able to identify the person who punched and broke the window of their house. I showed - the photo lineup containing Tuaua?s photograph. _identi?ed Tuana?s photograph as the individual who broke two windows at his house at On September 10, 2015, I wrote search warrants for the collection of epithelial cell samples for Tuaua and?
