TO: LIEUTENANT ROBERT M. MORRILL DETECTIVE BUREAU BROCKTON POLICE DEPARTMENT FROM: SERGEANT FOTIS COLOCOUSIS BROCKTON POLICE DEPARTMENT - A to 12 SHIFT SUBJECT: INTERVIEW WITH-BRIGITE STRUTHERS 165 Carl Avenue - Apt. C-hl Brockton, MA. 02402 D.O.B. - 07/17/63 RE: GUILLERMO RODRIGUEZ (Homicide) Case #8501-5545. Date of Offense: Monday, November 18, 1985 At approximately 5:00 P.M., I received information that the women we were seeking to interview regarding the homicide of GUILLERMO RODRIGUEZ was identified as a BRIGITE STRUTHERS. As a result of this information, I checked our records and located a photograph of her and an address. I went to the address of 165 Carl Avenue, Apartment C-41, and spoke to a Mrs. ELVA STRUTHERS who stated to me that BRIGITE was her daughter. She further stated she did live there at that address with her. She said she was not at home but provided a description of her for me and stated that she was probably at 'Pete and Mary's',a local bar. A short time later, I met with Detective John Luciano in the vicinity of 'Pete and Mary's'. I provided him with a des- cription of BRIGITE STRUTHERS and furnished him with a photograph. I felt it would be best for him to go in with 'plainclothes' and attempt to locate the witness. He contacted me by radio, stating that he did locate her and she was willing to talk to us and would meet us at her mother's apartment as she preferred to talk there. At approxi- mately 7:15 P.M., I met Detective Luciano and BRIGITE at that location and we sat at the kitchen table and she related the following to us. She stated that last Monday evening she went into 'Pete and Mary's' at approximately 4:00 P.M. She also stated she was in there for some time and at 7:40 P.M., she observed a party get off the Ashmont Bus right in front of 'Pete and Mary's' and she identified him as being the party that was in the photograph which appeared in today's being the subject, DARRELL JONES, aka Interview with: BRIGITE STRUTHERS Page 2 of 4 pages. She stated he got off the bus with another party, a party de- scribed as 5' 5" tall, wearing a light jogging suit and a white cotton hat. The hat was described as being similar to a sailor's cap. She showed us a cap that she had which was identical in style, and stated that she did not know this party's name. She further stated that she said, "How ya doing, When questioned further about that, I asked the party?s name and she said, call him They call him She stated she went into the ladies room. A short time later, a woman named VANELLE came in and there was a three-we conversation. She said that at some said 10:00 she went over to D'Angelos Sub Shop and ordered a sub for herself. She stated she walked back to 'Pete and Mary's' and had some con- versation at the doorway with this party, and asked him if he was hungry. He stated, "What are you gonna buy me?" She replied, "I'll get you a sub." Her story is that the two of them then walked across the street to D'Angelo's Sub Shop. They went out the front door of 'Pete and Mary's', across Montello Street, and up through the center aisle between the two parking lots to the door of D'Angelos Sub Sh0p. They walked into D'Angelos. There was one (1) party in front of them in the little alleyway where the take-out counter is located. She does nto remember at this time whether it was a male or a female. She states she then, when it was her turn, walked up to the counter and got the two subs and stated she had conversation with him while they were waiting for the subs. She then gave him his sub, she kept her sub and as they left there was nobody else in the foyer. She states she originally had ordered a ham and cheese sub for herself the first time she was in there and the second time she went in with she ordered a steak and cheese sub for him. She went on to say that she gave him his steak and cheese sub and kept her ham and cheese sub, and they walked out. She then walked to the right, which would have been north, to the parking lot on the north side of D'Angelos Sub ShOp and got into a black Oldsmobile belonging to SKIP BAKER. She further stated that she observed walking back into 'Pete and Mary's' and once she got into SKIP's car, the two of them left. They drove out of the parking lot to Montello Street and took a left on Montello Street, heading in a southerly direction. She stated that was all she knew about the incident until the next day wehn she heard got shot. She stated she Interview with: BRIGITE STRUTHERS Page 3 ofi? pages. knew and that she likel'POW'. She also stated that SKIP BAKER was in the car the entire time? We then went over the story with her again and she stated, upon questioning as to who was in 'Pete and Mary's?at the time, she states that who is the victim, GUILLERMO RODRIGUEZ, was sitting in the same booth he always sits second booth in on the left. He was sitting alone. She further states VANELLE was there, EVELYN was there, CLYDE COWARD and one TERRY STARKS. When questioned about other people who may have been in the bar, she states that STEPHEN BETTS was not, KEITH BETTS was not, and when questions about a she said, a didn't know?? nd she did not recall seeing anyone with a cast on their arm. a I asked her to describe this party she called and she said, "The guy that's in the paper.? At this time, she got up and went over to the newspaper that was in the living room. She handed it to me and said, "That's the guy there," and pointed to the picture of DARRELL JONES on the front page of the Enterprise. When asked for a physical description, she said he was approxi- mately 5' 9" tall, good build, with big teeth, and young about eighteen (18). She said, "He was younger than me and he had a 'tail' where the hair and the neck meet." She said it was tinted a reddish-brown color. I asked her how long she had known the party and she stated, "Either May or June.? When asked why she did not come forward, she stated she 'doesn't work that way' but she knew that eventu- ally we would be coming to see her. I asked her if she was positive of the party whose picture was in the Enterprise and she stated, "Yes," she was sure. She put her finger on the picture a couple of times. When I showed it to her and I asked her again, I said, "Are you absolutely, positively, sure,"she said, "Yes, that's I know and that's him.? While there, I did a sketch of the layout of the relation- ship between ?Pete and Mary's' and D'Angelos Sub Shop and drew the intersections to simplify things for her. At that time, I asked her where SKIPthe diagram. She also marked the spot where he was standing outside of 'Pete Interview with: BRIGITE STRUTHERS Page 4 of 4 pages. and Mary's' when he said, "Yes," he wanted a sub. She wrote in the word 'yes' which would appear to be in the middle of Montello Street. and she showed where car was located in the parking lot and I put that on there. I mentioned to her that I would like her to look at some photographs. She stated that she would. I told her that a detective would be up to see her within the next couple of days and she said that she would talk to them and there is absolutely no problem. She was very cooperative. This concludes the interview, and a sketch is attached. Respectfully submitted, Fotis C616cousis, Sergea?f 4 to 12 Relief Shift Attachments: 1 FC/gj I 1 P?m \?n?dzh '3 G. 4-. F. r. . I went to Churchill Linen Company and I showed Paul Jones a photo lineup which included a, photo of our prime suspect a Darrel Jones, known as "Diamond." Upon viewing the photOjlineup Paul Jones narrowed the photos down to approximately three (3), one of which was Darrel Jones. However, he was unable to make a positive identification. He told me at this time that he and his girlfriend, Denise Perkins, had gone to D'Angelos on Montello Street, to get subs. He said Denise waited in the car and he went in to buy the subs and when he went inside there was a . black female who had just made a purchase. I On Tuesday, November 12, 1985, I contacted Denise Perkins of 19 Otis Street, Brockton,MA. Denise is twentyrone years of age and she is also listed as an witness to the assault. I located Denise at her place of employment, Custom Model Products, in West Bridgewater. I went to see Denise and showed her a photo lineup. She went through the entire lineup and picked out the photo of Darrel Jones, known as "Diamond," and said that that was the photo of the assailant, but she could not be one hundred percent sure. I asked her for her' version of what had taken place and she reiterated what her boyfriend had said. Their stories are exactly the same. Denise described the _assailant as being a black male, with short hair, and skinny. She said he wasjwearing a dark colored jacket that was just a little past his waist in length, and dark pants. _She said he appeared to be around twenty-one or twenty-two years old. Denise said that just prior to the shooting a group of blacks, four or five in number, came out of Pete and Marys and got into a car that was parked in D'Angelos parking lot. He said he found the pistol on Tuesday, November 12%, 1985 when he opened his place of business, but had not mentioned it at that time. The weapon is a .32 caliber automatic with a clip.: The ownerrof the Colonial Spa asked if he could have it back if the owner of the gun was not found. we believe that his original intention_was to keep the gun, until he read the article in the paper and realized that it migh; be a murder weapon,so he decided that he had better turn it in. He f. also informed us at that time that there was a black male in his barroom the'night of the shooting and that it was unusual for blacks to be in his establishment. He also stated that he would not be able to identify the party that he had seen. The gun was biought to the station and dusted for.prints by Detective Welter Mehl, and then was transported to the State Police Lab in Boston, by Detective Gerald Rideout to be test fired, and to do a factory trace on'the serial number in an attempt to locate the owner of the gun. a On Sunday, November 17, 1985, I was called into the station to interview Darrel "Diamond" Jones, who had just been brought into the station under arrest and charged with "Murder." Jones was . ?.21 331?(my - 'lgues: age .. .. I brought to the Detective Bureau where he was advised of his per Miranda. He said.he understood his rights and was willing to discuss the'case with us.' Sergeant Fotis Colocousis was present at this time, and assisted with the questioning. Jones told us that he *du had been in Pete and Marys on the evening of the shooting, but that .- he had never left Pete and Marys. He said a friend of his, whom he did not know by name, had offered to get him a sub from the sub shop 'across the street. He said she left Pete and Marys and went across the street and he stoodlby the front door inside and awaited her return. He said she came back with the sub and gave it to him. He said he never left fete and Marys during that time when the shooting occurred, and he was there, he said, when the police came in after the shooting and interrogated the people who were present. He said he first became aware of the incident that had taken place long after the actual incident occurred. He said he didn't know anything about; it, nor who was involved. It was learned at a later date, through witnesses, that he had, in fact, gone over to D'Angelos Sub Shop with the girl, picked ups?a sub and returned to Pete and Marys. . After being questioned for some time by Sergeant Colocousis'and myself Jones was returned to his cell. we were unable to obtain any information from him.concerning the investigation.that would help us at this time. On Tuesday, November i6, 1?85, at 9:?0 I participated in a video tape interview of Terry Starks, along with Detective'doseph Smith. The interview was conducted at 145 North Warren Avenue. Present during the interview were Detective Joseph Smith and myself, Detective Washak. .Lisa told us that she was at Pete and Mary's for approximately?one hour to an hour and a half. She left Pete and Mary's at 10:30 p.m. on the llth-accompanied by Walter Bobo Watson, Edna Levine, Terri Starks and Alfred Marrow. They were all leaving together as Bobo Watson was giving them a ride home. They crossed the street to where Bobo Watson's car was parked. It was parked in D'Angelo's parking lot on Montello Street. As they left the premises, they observed Guillermo Rodriguez leaving the premises at this time with an unidentified black male. They crossed the street, entered Watson's car. Bobo Watson was driving. Seated next to him was Edna Levine, seated next to Edna Levine was Terri Starks. Alfred Marrow sat behind the driver in the rear, and Lisa Pina sat on the right?hand side, rear. They observed Rodriguez crossing the street with the unknown black male. At this time Mr. Watson began to back his motor vehicle up and Terri Starks exclaimed, "It's Diamond and he has a gun." Lisa then observed that the victim and Diamond were approximately 10 feet away from the side of the motor vehicle. She observed Rodriguez fall to the ground and Diamond run in the direction towards Pete and Mary's, running west on Ward Street. She then - Mr. Watson took the vehicle across the street to Pete and Mary's, while Lisa left the vehicle to call an ambulance. She stated she was too hysterical to call. She had her girlfriend call the Police Department, who sent an ambulance and a cruiser to the scene. From Pete and Mary's, the group went to Bobo Watson's home at 45 Fuller Street, where they discussed what had happened - basically concluding that Diamond was dangerous and someone to be very much afraid of. After spending some time at Bobo Watson's house, Lisa was taken by Bobo back to Pete and Mary's and dropped off. Detective Smith and myself showed Lisa a photo array of six photos, including one of Darrell a/k/a Diamond Jones - his photo. Lisa eliminated three photos right off, picked up Diamond's photo and handed it to Detective Smith. Detective Smith inquired as to whether she was making identification Lisa Pina . . -2- 11-17-35 or not, and she said, picked it up, didn't I picked this one." When questioned further, she_indicated that was the person she had seen at the scene of the crime. This concludes the interview with Lisa Pina. . The next interview - again on 11-17-85: was at 45 Fuller Street. Interviewed were Walter Bobo Watson and Edna Levine. Present during the interview were Detective Smith and myself. Edna was asked or they both were asked - what they had observed at the scene. Edna indicated that they had left Pete and Mary's at approximately 10:30 crossed the street to Bobo's car, which was parked at D'Angelo's sub shop on Montello Street. Once in the vehicle they observed Guillermo Rodriguez, known as Pow (not clear), crossing the street with an unidentified black male. As this Pow and the person with him came across the street and entered the parking lot - according to Edna - Terri Starks exclaimed, ?It's Diamond and he has a gun. Let's get out of here."I Mr. Watson backed up his motor vehicle. At this time Edna saw Guillermo Rodriguez fall to the ground and Diamond run towards Pete and Mary's. Bobo Watson observed the same thing. They both were shown the photo lineup and Edna Levine positively identified Diamond - Diamond being Darrell Jones. Mr. Watson was unable to pick out his photo at this time. This concludes these interviews. Stenographer: Claire Cassidy Police Department Brockton Massachusetts 02402 On Thursday, the fourteenth of November, I was assigned to assist Officer Donald LaGarde, an investigation of a Homicide. The victim being Guilleimo Rodriguez. Mr. Rodriguez was known by me, I've had dealings with him in the past. He's a known drug dealer in the Brockton area. I went with Detective LaGarde to the apartment of Denise Bradshaw located at, I believe, 102 North warren Avenue on the third floor. We had information that Denise Bradshaw was a girlfriend of, susPect at the time, a party by the nickname of 'Diamond', whose real name is Darren Jones, Upon arrival at the apartment we learned from tenants downstairs that 'Diamond' is a frequent visitor to the apartment. He had been there the night before, which would have been the night of the shooting. Sometime prior to the shooting had tried to sell the first floor tenant some speakers. The first floor tenant advised us that there are usually four to five black individuals, an assortment of males and females, residing in the third floor apartment. The traffic is heavy all day and all night. Believing that 'Diamond' was still armed and possibly in the apartment, we requested backup and when the uniform officers arrived we knocked on the door and after several minutes wait the door was answered by Denise Bradshaw, who stated that nobody was in the apartment except her and a girlfriend. A search of the apartment revealed a black male hiding in a bedroom closet. His name was Donald Houston. Later learned Donald's nickname is 'Deke'. Also learned that 'Deke' is a very close friend of 'Diamond'. At this time nobody in the apartment would tell us where 'Diamond' was, other than he was not in the apartment at this time. We asked Donald Houston and Denise Bradshaw to accompany us back to the station for questioning. Donald Houston at this time refused to accompany us back to the station. He also could give no explanation as to why he was hiding in the closet. A warrant check was made and it was determined that there were no warrants out? standing on this party at this time. We left him at the apartment. We then came to the station with Denise Bradshaw. Denise Bradshaw was advised of her rights, and she told us that on MDnday night, which was the holiday, and the night of the shooting that she was home all night. She could not remember who she was home with. She stated that she watched that she watched T.V. that evening and did not leave the house. When asked what she watched on T.V. she could not remember what she watched on T.V. She stated also that the night before, which would have been Wednesday evening, and two nights after the shooting, that 'Diamond', who she admitted she had 2. had a lonstanding relationship with, came to her apartment with his brother who is known as 'Junior'. (real name is David Jones.) Junior and Ruby Phillips and 'Diamond' came to her apartment and she stated that 'Diamond' was agitated over something and upset and acting crazy, and proceeded to knock all the items off of her bureau drawer in her bedroom and started to tear the place up. And at this point she called the Police. When she did this the three individuals left her apartment and when the police arrived the three were long gone. She also stated that she did not know where 'Diamond' was, but she assumed that if he was anywhere, he was probably with his brother Junior.and Ruby Phillips of 15 Hunt Street. She appeared to be very calm and collected during the questioning. I don't believe a word she said, however. From there we went to 15 Hunt Street. Detective LaGarde and myself and Detective Enos. Again, we went through the business of knocking on the door and nobody answering, and scurrying around within the apartment. Several minutes before the door was answered, it was finally answered by a black female, who identified herself as Ruby Phillips. Upon entering the apart- ment we were given permission to search it. She told us that 'Diamond' was not there and she had not seen 'Diamond'. Also in the apartment, in the living room, was David Jones, also known as Junior, 'Diamond's brother, and a third party with a cast on his arm, who identified himself initially as Jerome Love. During our stay in the apartment a Prisoners Property Sheet from the Brockton Police Department was found with the name Porter. At this time he told us his name was Porter and he also uses the Love. As far as I can determine his name is Jerome Porter. He's seventeen years old and he's from Boston. At this time he had a cast on his arm, which I later learned that got in a robbery attempt at Pete and Mary's a week before, when he and Junior and 'Diamond' robbed a security guard in Pete and Mary's. Although I cannot verify this as how he got his arm broken, I believe it is. A search of the apartment was made and no trace of the suspect 'Diamond' was found. Very little co-Operation from anyone in the apartment, they all think it's a big joke. That terminated my involvement for that particular day. The next morning when I returned to work, I was informed by Detective LaGarde that a gun had been found in the rubbish of the Colonial Spa by the owner of the Colonial Spa. This weapon is a thirty-two automatic with a clip. The owner allegedly informs Detective LaGarde that he had the gun for two days and wanted the gun back if we couldn't find an owner for it. No explanation apparently given as to why he held the gun for two days. We can assume that he planned to keep it and not tell anybody until he read in the paper that a murder had been committed and that this was probably the gun. He also admitted that a black male fitting the general description of the assailant was in his barroom that night at approximately the same time or shortly after the shooting, however conveniently or unconveniently, he could not identify this particular person, even though he says it's very, very unusual for a black to be in his establishment. Again, not much co- operation. The gun was returned to the station where it was dusted for prints by Detective Walter Mehl, and it was taken to Boston by Detective Gerald Rideout and delivered to the State Police Lab, there. On November 15th, I Spoke with a Shelton Lewis. Shelton Lewis was under arrest in the station, charging him with Armed Robbery. Shelton is a close friend of 'Diamond's and it is believed that Shelton is involved in several Armed Robberies with 'Diamond'. He stated that Donald Houston, the party hiding in closet of Denise Bradshaw's apartment, has the nickname 'Deke'. Prior to that we had not known who 'Deke' other than that 'Deke' was a close friend of 'Diamond's'. Now we know that Donald Houston and 'Diamond' are close friends. Lewis also stated that 'Deke' and 'Diamond' had showed him airline tickets. He could not recall what State the tickets were for. This would be a couple of days prior to the shooting and that they had told him that they wanted to kill a couple of peeple before they left the area. Shelton told us that his brother, Spencer, had been threatened a couple days prior to the shooting by 'Diamond' and 'Deke', and that 'Diamond' and 'Deke' had guns and that they had put them to his brother's head. He told us he didn't know exactly what the argument was over, but that if we talked to his brother, his brother would tell us. we went to the Lewis residence on Stillman Avenue, I believe the number is 91. We had a talk with, if you could call it that, Spencer Lewis. Talk- ing to Spencer is like talking to a chair. You get more reaction from the chair. All Spencer would say was he knew 'Diamond' and he knew 'Deke' and they had had an argument, but there was no gun involved. He didn't what his brother was about. I showed him a picture of the gun that had been found at the Colonial Spa, he said he had never seen a gun like that. He also stated that he had not seen 'Diamond' or 'Deke' since the alleged argument with them. His attitude was, again, very poor, unto-operative. While we were there talking with Spencer Lewis, State Police Detective Peter Downey and I decided to go to the apartment of Joy Boone. Joy Boone comes into the picture because she was or is the girlfriend or ex?girlfriend of a party by the name of Steven Betts. Steven Betts' name has been mentioned several times as possibly being the one that did the shooting. In fact the only two names that have been mentioned up to this point are 'Diamond' and Betts. Anyway, when we went to her apartment on 142 Stillman Avenue and we were admitted to the apartment and also present in the apartment at this time was Ruby Phillips and 'Diamond's' younger brother Junior. As we were driving up to Joy Boone's apartment at 142 Stillman, I observed the younger Jones, known as Junior, knocking on the door of 132 Stillman Avenue. 132 Stillman Avenue is an apartment of Louise Allen and I had received information that day that "Diamond' was hold up in Louise Allen's apartment at 132. So, it must have been more than mere coincidence that the younger brother was knocking on the door of 132 when we came around the corner. Upon seeing us he went to 142, which as I stated is the apartment of Joy Boone and Ruby Phillips was also inside. These are the same two individuals we had visited the day before who thought this was all a big joke. And again, they stated that they had not seen 'Diamond' and generally unco?operative and wise-cracking. At this time I spoke with Joy Boone. Joy Boone does not fit the description of anybody given to us, who might have seen anything. Other than the fact that she is Stven Betts' girlfriend/ex?girlfriend, I can't see as she is involved in this matter at all. She told us that she had heard Steven might have been involved in the shooting and she gave us a third floor apartment at 199 North warren Avenue, which is directly across the street from 202 North warren Avenue, which is the apartment, once again, of Denise Bradshaw. She told us Steven Betts was living in this apartment with a Gail Monterio. And if we wanted Steven, that's where we could find Steven. She told us that if Steven did it, she hopes he's put away forever and ever, because basically she can't stand the sight of him any longer. Also on this particular day, a photo line-up was shown of black females, included in this were Ruby Phillips, Denise Bradshaw and Joy Boone. The manager of D'Angelos looked at the array and could not identify anybody. Also these photos were shown to Paul Jones, Kingman Avenue, Brockton, at his place of employment which is Churchill Linen. Jones and his girlfriend Denise Perkins were in the parking lot at D'Angelos and observed the actual shooting. He could not identify anybody from the photo line?up.either. We then received information to meet an informant in Randolph at the Dunkin Donuts, that there was a young eighteen year old balck girl, by the name of Lisa Middleton who apparently witnessed the shooting. And that Lisa Middleton was with another black girl by the name of Terry Starks from Brockton, who also witnessed the shooting, knew more about it than she cared to know. we were able to determine that Lisa Middleton was at home with her mother, a fact that her mother confirmed, on the night of the shooting. Even though she had been in Brockton, her mother had picked her up at the bus stop at eight P.M. and that she was home with her mother. She could not possibly have been involved. So we scratched the name Lisa Middleton. Also we were able to obtain the name Walter Watson and the information that Walter watson was at Pete and Hary's on the night in question and had witnessed the shooting. 0r knew more about the shooting than he cared to tell. Halter drives a Cadillac, a two-tone Cadillac, I believe with a Continental Kit. A vehicle of this description was described by the two witnesses at D'Angelos as coming out of Pete and Mary's, several people coming out and getting into this particular vehicle at the time of the shooting. And so we learned that Walter Watson worked for the Brockton Housing Authority and lives at 45 Fuller Street. We were unable to locate him on this particular night, however, I understand that he was located and stated that Terry Starks, a name that had been given to us before as being with Lisa Middleton, was with him at Pete and Mary's and upon exiting Terry Starks was alleged to have said something to the effect, 'Here comes Diamond, he's got a gun." We have not been able to locate her at the time of this report. And will attempt to do so today. pj/z?WLW. i?u? -- -. amass/way Division of State Police 1010 Commonwealth Avenue Boston, Massachusetts 02215 November 26, 1985 Det.
