AFFIDAVIT OR DETERMINATION OF PROBABLE CAUSE

good reason to believe and does believe that ARREOLAMICOLE ELAINE did

Said reason and belief is based upon the following facts and circumstances (provide narrative, using back of
this affidavit or attaching additional pages and/or case report, as needed):
On 10/2/15 I, Of?cer A.Lotspeich #965, responded to a major accident WIB SH 114 at O'Connor Rd, Irving,
Dallas County, Texas involving a marked Irving PD vehicle. The defendant, Nicole Arreola, was the driver of a
silver Jaguar traveling WIB on SH 114 just west of O'Connor Rd when she struck a marked Irving Police
vehicle from behind that had its emergency lights ac?vated while blocking traf?c for road construction. The
of?cer inside that vehicle, R.Silva #799, was transported to Parkland Hospital with a concussion, broken ribs,
and other injuries to his shoulder. The force of the impact to the back of Of?cer Silva's vehicle sent it off the
roadway and into a light pole in the center grass median. Arreola ?rst denied driving but later admitted she was
and admitted she was intoxicated while doing so. She had the strong odor of alcohol coming from her breath,
bloodshot eyes, slurred speech, had defecated on herself, and admitted to consuming "?ve shots and a sip of
beer? earlier. She was asked to perform several SFST's and was unable to do so correctly due to being
intoxicated. Arreola was intoxicated and had lost the normal use of her mental and physical faculties due to the
introduction/amount of alcohol in her system. She was placed under arrest for Intoxication Assault SBI of of
Peace Of?cer and read her DWI StatutOry Warning. She was asked to provide a blood specimen and consented.
She was taken to Baylor of Irving where she signed the consent form prior to her specimen being taken. Her
results are pending. At the jail she consented to a PET and provided a result of 0.144.

ORDER

The foregoing affidavit! attached arrest report having been presented to me and upon consi deration of the
facts and circumstances contained therein, itis hereby determined that probable cause exists to believe the accused
