AFFIDAVIT FOR WARRANT OF ARREST AND DETENTION

The undersigned Af?ant, who after being duly sworn by me, on oath, makes the following statement:
I have good reason to believe and do believe that:

Shia LaBeouf WIM 6/1 1/86

On or about the 9th day of October, 2015, in the incorporated limits of the City of Austin,
County of Travis, Texas, did then and there commit the offense of:

Public Intoxication Class Misdemeanor

On October 9, 2015 at approximately 19:31:07 hours Sergeant Jelesijevic 3462 advised me, Of?cer Muchnikoff 7299, that he was on
his regular assigned patrol in the Downtown Austin area wearing the uniform of his profession to include shoulder patches and a
badge. Sgt. Jelesijevic was driving a clearly marked Austin Police Department patrol unit equipped with emergency lights and the
word ?Police? on the vehicle. Sgt. Jelesijevic was driving West bound on 6th St. after dark and was stopped in the middle of three
lanes at the red light at the intersection of 6th St and San Jacinto Blvd, a public place. The 6th St West bound light turned green at

19:31:07 hours and at 19:31:12 hours a group of one male and two females began crossing the intersection from the South West comer
to the North West corner against the clearly lit crossing signal. The subjects entry into the roadway obstructed the ?ow of traf?c,
including Sgt. Jelesijevic, and was acknowledged by the subjects when the male subject lifted his hand in the internationally

recognized Sign for stop when directing traf?c as they crossed. Sgt. Jelesijevic conducted a probable cause subject stop on the three

crossing against signal by activating his emergency lights and repositioning his vehicle to be pointed directly at them. Sgt. Jelesijevic
later identi?ed the subjects as: Shia LaBeouf 6/ 1 1/ 86; Grace Alayna 11/9/94; and Daytona Stanga 6/2/97.

 

After Sgt. Jelesijevic activated his overhead lights LaBeouf visually acknowledged him, looking straight at him, and raised his hands

waist high while taking six backward steps followed by three more while turning away from Sgt. Jelesijevic as he exited his patrol
vehicle and ordered LaBeouf to stop. LaBeouf returned next to Stanga and Alayna and a strong odor of an alcoholic beverage was

immediately apparent to Sgt, Jelesijevic as emanating from LaBeouf. Sgt. elesij evic stated that LaBeouf?s speech was slurred and
thick tongued and his eyes were glassy and dilated.

While Speaking With Sgt. Jelesijevic, LaBeouf stated that if stopped by Los Angeles Police Department he typically walks away

because Police had killed a friend of his and he became increasingly confrontational, aggravated, profane, and verbally aggressive

three times. While interacting with Sgt. elesijevic, an unidenti?ed

third party began ?lming the encounter which is common on 6th St. LaBeouf reacted very hostile to this stranger by puf?ng his chest

and Walking in an aggressive and threatening manner at the male, prompting Sgt. elesijevic to intervene and stop LaBeouf from I

pmemlan-y assaulting me Stranger. LaBeouf then continued his verbal tirade towards Sgt. elesijevic and began to bow up or puff his
