TEXAS ORDER ON MOTION TO QUASH SUBPOENAS On October 15. 2015, a telephone conference was held regarding the State?s Motion to Quash Subpoenas DuceS Tecum and Motion for Protective Order, Paxton?s Response to Motions for Protective Orders, Paxton?s Response to Motions to Quash Production of Records of Public Proceedings and Open Courts. Court Reporters Sue Maienschein and Jan Dugger?s Motion for Protective Order and Alternatively Request for In Camera Inspection, and Jacobsen?s Motion for Protective Order and Alternatively Request for In Camera Inspection. Counsel for the State of Texas were present during the telephone conference. Counsel for the Defendant were present during the telephone conference. Counsel for the Defendant af?rmatively waived the presence of the Defendant during the telephone conference. Counsel for the Defendant withdrew the previous objection of the Defendant for any actions to be held in Tarrant County, Texas for purposes of this telephone conference. The Court allows the Defense to reserve its right to object to further hearings being held in Tarrant County. Pursuant to Texas Government Code, Section this conference occurred with the Court presiding in Tarrant County, Texas. Counsel for Sue Maienschein, Jan Dugger, and Jacobson was present during the telephone conference. Upon conclusion of the telephone conference, the counsel for the parties agreed to the entry of the following: The Court notes that Jacobsen, Sue Maienschein, Jan Dugger, Kathy Bounds, and Sherri Vecerra complied with the requests for Subpoena Duces Tecum served upon them by timely forwarding the requested records to the Court for an in camera inspection. The Court has reviewed the requested records and enters the following ORDER: The transcripts of the Grand Jury impaneling conducted on December 10, 2014 by Judge Angela Tucker of the 199th Judicial District Court and transcribed by Sheri Vecerra shall be designated by the Court as Court?s Exhibit No. 1 and shall be maintained by Lisa Morton, court reporter for the Court in these cases. The transcripts of the Grand Jury impaneling conducted on December 16, 2014 by Judge Wheless of the 417th Judicial District Court and transcribed by Kathy Bounds shall be designated by the Court as Court's Exhibit No. 2 and shall be maintained by Lisa Morton, court reporter for the Court in these cases. The transcripts of the Grand Jury impaneling conducted on June 12, 2015 by Judge Chris Oldner of the 416th Judicial District Court and transcribed by Sue Maienschein shall be designated by the Court as Court's Exhibit No. 3 and shall be maintained by Lisa Morton, court reporter for the Court in these cases. The transcripts of the Grand Jury impaneling conducted on June 26, 2015 by Judge John Roach of the 296th Judicial District Court and transcribed by Jan Dugger shall be designated by the Court as Court?s Exhibit No. 4 and shall be maintained by Lisa Morton. court reporter for the Court in these cases. The records forwarded to the Court by Jacobson shall be designated by the Court as Court?s Exhibit No. 5 and shall be maintained by Lisa Morton, court reporter for the Court in these cases. Copies of these exhibits shall be furnished to Counsel for the State and the Defense. The Court ?nds, by furnishing these transcripts to the Court for in camera inspection, that the witnesses Sheri Vecerra, Kathy Bounds, Sue Maienschein, and Jan Dugger did not violate any order previously issued regarding sealing of the information of the Grand Jury of Collin County, Texas. Counsel for the State and the Defense shall maintain the copies of the transcripts for their records and shall use the information therein only for the purposes of litigating and defending these cases. Otherwise, the parties may not disseminate any information contained within these exhibits without further order of the Court. Costs of $318 to Sue Maienschein and costs of $288 to Jan Dugger shall be paid by the Defense.
