COMMONWEALTH OF MASSACHUSETTS PLYMOUTH, SS NO: 81865 COMMONWEALTH V. DARRELL JONES AFFIDAVIT OF LISA MARIE FINA Lisa Marie Pina, being first duly sworn, states as follows: I. My name is Lisa Marie Pina and I live in the Commonwealth of Massachusetts. 2. I was questioned by the Brockton Police in 1985, about the shooting death of Guillermo Rodriguez, who was known by the nick name I was then called to testify as a witness in a criminal case concerning the death of Mr. Rodriguez. 3. On the night of the shooting I was in a car with Walter Watson {who was known by the name ?BoBo?) and others, including Terri Starks and Edna Levine, and an older man named Al Marrow. The car was parked in the D'Angelds parking lot on Montello Street in Brockton, Massachusetts. We had been in Pete and Mary?s bar earlier and we had been drinking. 4. I was in the back seat of BoBo's car when there was some commotion and as the car was backing up I looked over my shoulder and saw someone lying on the ground. I did not see the person get shot and I did not personally see anyone running away. I later learned that the person who fell to the ground was AFF. 222 Guillermo Rodriguez. I did not know Guillermo Rodriguez personally, but I knew who he was. 5. At that time I did not know Darrell Jones, but I learned that he is known by the nick name ?Diamond.? Based on conversations that I heard his name was mentioned in connection with the incident in the D?Angeloe parking lot, but I didn?t know the name ?Diamond? at all and I did not know Darrell Jones. 6. After I saw the body in the parking lot, people in the car started talking and someone decided that we should get out of the parking lot and make sure that someone called for help. BoBo Watson drove the car out of the parking lot to the back door of Pete and Mary% bar by Franklin Street and I went inside. I did not make the call, but I think that I called to the bartender to make the call for an ambulance. We later left the area in BoBo?s car and went back to BoEo?s. 7. The Brockton police came to my house at least two times to question me about what happened in the'UAngeloe parking lot. I remember that the last time they came one of the police detectives was Detective Smith. I knew him and recognized him because at the time I worked for McDonald?s and Detective Smith would be there working on details while I was there. Detective Smith showed me pictures and asked if I could identify the person who was in the parking lot, and I told him that I could not because I didn't see much of the incident, and I didn?t really AFF. 223 have a chance to see the people who were involved. Any knowledge I had was based on what other people were saying not on what I saw. 8. I kept telling Detective Smith that I didn't know who did this, and he kept telling me that I ?did? know. Detective Smith kept saying something like ?pick a picture Lisa . . . pick a picture . . . you know who did it, you know who did At the time of these events I was young and I felt a lot of pressure to do what the police wanted me to do. Eventually as the police insisted that I pick a picture, I randomly made an indication toward one of the pictures, and the police seemed to be satisfied with that. Detective Smith told me that I picked out the right one and I said that if I did it was purely by luck. I still remember how stressful it was to have the police telling me to pick a picture after I told them that I didn?t see the person well enough to pick. 9. I never told either Detective Smith or Detective Washak that any particular person did the shooting and if they said that I did, then they would not be accurate in describing the conversation with me. I did not see much that night, but I felt like the police had their own idea of what happened and they wanted me to come to the same conclusion that they did. 10. The Brockton Police came to my house and spoke to me a couple of times and then I was called as a witness at the trial AFF. 224 by the prosecution. I was not contacted by the lawyer for Diamond, or by any private investigator for Diamond before he went on trial for the murder of POW.
