Timeliness: This Supplement is timely filed. 2. Relief Sought: Mr. Bin al Shibh continues to seek assistance from this Military Commission in ceasing the use of sounds and vibrations in Mr. Bin al Shibh's confinement facility, and to allow the Defense to inspect Mr. Bin al Shibh's cell, cell walls, substructure/foundation , area surrounding his cell, and the control room for the cells within the confinement facility. Mr. Bin al Shibh continues to request expetts, such as qualified engineers, audio experts, and other technical specialists, to assist his Defense team in investigating Mr. Bin al Shibh' s confinement conditions. To date, Mr. Bin al Shibh continues to experience the same types of sleep depriving environmental manipulation, including noises and vibrations, that he notified this Commission of in filing AE152(RBS) on 3 April 2013. Mr. Bin al Shibh asks the Commission to consider the following supplemental facts including, but not limited to, those outlined below because they have probative value in relation to the facts in AE152(RBS) thus increasing the probability that the Government may be systematically disrupting Mr. Bin al Shibh's concentration, sleep, and ability to work on his defense case. Between 1 January 2014 - 31 December 2014: 1. On 8 February 2014, Mr. Bin al Shibh was subjected to noises and disturbances. 2. On 9 February 2014, Mr. Bin al Shibh was subjected to noises and disturbances. 3. On 27 Februruy 2014, Mr. Bin al Shibh was subjected to disturbances dming the daysh ift. 4. On 2 Mru·ch 2014, Mr. Bin al Shibh was not able to sleep due to disturbances. 5. On 4 Mru·ch 2014, Mr. Bin al Shibh was subjected to distmbances. 6. On 6 Mru·ch 2014, Mr. Bin al Sh ibh was subjected to distmbances by the night guru·ds. 7. On 7 March 2014, Mr. Bin al Shibh was subjected to disturbances by the night guards. 8. On 8 - 12 Mru·ch 2014, Mr. Bin al Shibh was not able to sleep due to vibrations and noises outside of his cell. He notified the guru·ds that the vibrations and noises interfering with his ability to sleep. 9. On 20 March 2014, Mr. Bin al Shibh asked the guards to stop the disturbances. 14. On 21 March 2014, Mr. Bin al Shibh was subjected to vibrations in the media room, and experienced disrupting sounds coming from the shower during prayer. 15. On 22 March 2014, Mr. Bin al Shibh was subjected to distmbances after morning prayer. 16. On 24 March 2014, Mr. Bin al Shibh was subjected to disturbances. 17. On 29 April 2014, Mr. Bin al Shibh was subjected to disturbances for over 40 minutes during the night. 26. On 10 May 2014, Mr. Bin al Shibh was subjected to loud banging noises coming from the shower at 1030. 27. On 11 May 2014, Mr. Bin al Shibh was subjected to loud banging noises coming from the shower during noon prayer time. 28. On 11 May 2014, Mr. Bin al Shibh sent a letter to the guards asking for relief. 29. On 11 May 2014, Mr. Bin al Shibh was subjected to loud banging noises coming from the shower dw-ing the night. 30. On 13 May 2014, Mr. Bin al Shibh was subjected during the night to loud cricket noises, and banging noises coming from the shower. 31. On 14 May 2014, Mr. Bin al Shibh was subjected to vibrations in the morning, and loud banging noises coming from his shower all night. 32. On 15 May 20 14, Mr. Bin al Shibh was subjected to noises at night, and experienced headaches and ear pain. 33. On 16 May 2014, Mr. Bin al Shibh was subjected to vibrations and noises in the shower. Mr. Bin al Shibh talked to the SJA trying to get relief. 34. On 20 May 2014, after being subjected to vibrations and sleep deprivation for three days in a row, Mr. Bin al Shibh talked with the Camp Commander asking for relief. 38. On 23 May 2014, Mr. Bin al Shibh was subjected to vibrations and loud banging noises coming from the shower that kept him from being able to sleep. 39. On 24 May 2014, Mr. Bin al Shibh was subjected to noises that kept him from sleeping. 40. On 26 May 2014, Mr. Bin al Shibh was subjected to vibrations. He ca11ed for the guard to come but the guard did not come. 41. On 27 May 2014, Mr. Bin al Shibh had to cancel his legal appointments because he was not able to get any sleep. 42. On 28 May 2014, Mr. Bin al Shibh cance11ed his legal appointment because he was not able to get any sleep. 43. On 30 May 2014, Mr. Bin al Shibh was not able to get any sleep. 44. On 2 July 2014, Mr. Bin al Shibh was subjected to a clinking noise. 62. On 3 July 2014, Mr. Bin al Shibh was subjected to a clinking noise in the drain. 63. On 7 July 2014, Mr. Bin al Shibh was subjected to banging noises coming from his drain while he was trying to sleep. 64. On 8 July 2014, Mr. Bin al Shibh was subjected to banging noises coming from his drain. 65. On 9 July 2014, Mr. Bin al Shibh was subjected to constant banging noises coming from his drain . 66. On 14 July 2014, the drain banging stopped. 67. On 15 July 2014, Mr. Bin al Shibh talked to the SJA and Assistant Watch Commander requesting relief. 68. On 23 July 2014, Mr. Bin al Shibh was subjected to vibrations and disturbances. 69. On 24 July 2014, Mr. Bin al Shibh was subjected to vibrations. 70. On 24 July 2014, Mr. Bin al Shibh spoke with the SJA requesting relief from the disturbances. 71. On 3 August 2014, Mr. Bin a! On 5 August 2014, Mr. Bin al Shibh was subjected to vibrations, door noise, 74. On 7 August 2014, Mr. Bin al Shibh was subjected to vibrations. 75. On 7 August 2014, Mr. Bin al Shibh was subjected to worse vibrations, and the drain banging began again. He could not sleep and had to cancel his morn ing meeting so he could get some sleep. 76. On 9 August 2014, Mr. Bin al Shibh was subjected to vibrations. The vibrations stopped when he went to sleep. 77. On 10 August 2014, Mr. Bin al Shibh was subjected to non-stop vibrations all night long. 78. On 13 August 2014, Mr. Bin al Shibh was subjected to non-stop vibrations all night. 79. On 15 August 2014, Mr. Bin al Shibh was subjected to disturbances from the night shift guards. 80. On 16 August 2014, Mr. Bin al Shibh was subjected to vibrations, banging in the toilet, and more noise. 81. On 18 August 2014, Mr. Bin al Shibh wrote a letter to the Camp Commander asking for relief. 82. On 29 August 2014, Mr. Bin al Shibh wrote a letter to the Camp Commander asking for the disturbances to stop and for the guards to stop harassing him. 84. On 1 September 2014, Mr. Bin al Shibh wrote to the Camp Commander and the guards asking for relief because the guards disturbed his sleep three nights in a row. 85. On 3 September 2014, Mr. Bin a1 Shibh wrote the Camp Commander about the noises. 86. On 8 and 9 September 2014, Mr. Bin al Shibh was subjected to a cold cell. 87. On 15 September 2014, Mr. Bin al Shibh was subjected to disturbances by the guards in the control room the entire day and could not get any sleep. 88. On 16 September 2014, Mr. Bin al Shibh wrote a letter to the Camp Commander about the guards harassing him. The vibrations and noises increased and his cell became very cold. 89. On 20 September 2014, Mr. Bin al Shibh wrote a letter to the Camp Commander asking for relief from the harassment and disturbances. That night Mr. Bin al Shibh was subjected to vibrations and noises. He asked the guards to stop the harassment, but it did not stop until after midnight 90. On 21 September 2014, Mr. Bin al Shibh wrote a letter about the harassment of the guard from the previous night. The vibrations and disturbances went on for the entire guard shift. Mr. Bin al Shibh asked the guard to stop all the disturbances for that night. 91. On 26 September 2014, Mr. Bin al Shibh wrote a letter in Arabic about the non-stop harassment by the guards. 93. On 27 September 2014, Mr. Bin al Shibh talked with the Camp Commander about harassment by the guards. Mr. Bin al Shibh also gave a letter to the guards about the vibrations. 94. On 29 September 2014, Mr. Bin al Shibh gave a letter to the guards about the distmbances. Mr. Bin al Shibh subsequently experienced retaliation by more disturbances and the guards making his cell very cold. 95. On 30 September 2014, Mr. Bin al Shibh sent a letter to the guards telling them about continuous sharp sounds that hurt Mr. Bin al Shibh's ear. The guards did not let Mr. Bin al Shibh say anything, and one of the guards slammed his door. Mr. Bin al Shibh's cell got very cold, and he was subjected to constant vibrations and sharp noise. 96. On 3 October 2014, Mr. Bin al Shibh was subjected to very cold temperatures in his cell. 97. On 8 October 2014, Mr. Bin al Shibh sent a letter to the guards asking them to stop the guard in the control room from purposely creating disturbances for Mr. Bin al Shibh. 98. On 9, 12, 13, and 15 October 2014, Mr. Bin al Shibh sent letters to the guards asking them to stop the disturbances. The distmbances increased at night. 99. On 18 October 2014, Mr. Bin al Shibh talked with the guard about how cold the temperatme was in his cell. On 19 October 2014, Mr. Bin al Shibh sent a letter to the guards telling them it was very cold and the disturbances were really bad. He requested to speak with the Assistant Watch Commander (AWC), but the AWC did not come. 101 . On 3 November 2014, Mr. Bin al Shibh asked the guards to stop the noise 102. On 6 November 2014, Mr. Bin a! Shibh sent a letter to the guards about the disturbances. 103. On 13 November 2014, Mr. Bin al Shibh sent a letter to the Camp Commander about the non-stop disturbances. 104. On 20, 22, 23, 24, 25, 26, and 28 November 2014, Mr. Bin a! Shibh sent letters to the guards asking them to stop the disturbances and vibrations. 105. On 28 November 2014, Mr. Bin a! Shibh was awakened from sleep because his cell was so cold. Mr. Bin al Shibh was subjected to a lot of disturbances from the guards in the control room. 106. On 29 November 2014, Mr. Bin al Shibh sent a letter to the guards about the disturbances and how cold his cell was. He also talked with the Camp Commander. 107. On 6 and 7 December 2014, Mr. Bin al Shibh sent letters to the guards about the disturbances. 108. On 12 December 2014, Mr. Bin a! Shibh talked with the Camp Commander about how cold his cell was. 109. On 13 December 2014, Mr. Bin a1 Shibh was subjected to new noises coming from the recreational area. On 17, 19, and 22 December 2014, Mr. Bin al Shibh wrote letters to the Camp Commander to stop making his cell so cold. 111. On 23 December 2014, Mr. Bin al Sh ibh wrote a letter to the Camp Commander about the vibrations he was subjected to the whole night that kept him from being able to sleep. 112. On 24, 25, 26, and 29 December 2014, Mr. Bin al Shibh wrote the Camp Commander about cruelly exposing him to cold temperatures and the disturbances. b. Between 1 January 2015 - 3 August 2015: 1. On 3 and 4 January 2015, Mr. Bin al Shibh was subjected to disturbances that kept him from sleeping. 2. On 7 and 8 January 2015, Mr. Bin al Shibh wrote letters to the Camp Commander about causing the vibrations throughout the entire night and being awakened. 3. On 9 January 2015, Mr. Bin al Shibh sent another letter to the Camp Commander about the disturbances that he was subjected to. 4. On 10 January 2015, Mr. Bin al Shibh was subjected to vibrations and disturbances that kept him from sleeping. He wrote a letter to the Camp Commander on 16 January 2015 about the disturbances. 5. On 18 January 2015, Mr. Bin al Shibh talked to the Camp Commander about the cold and the disturbances by the guards in the control room. 6. On 22 January 2015, Mr. Bin al Shibh was subjected to vibrations and banging noises which kept him from getting sleep. On 4 February 2015, Mr. Bin al Shibh sent a letter to the Camp Commander about the disturbances. 11. On 4 and 8 February 2015, Mr. Bin al Shibh sent letters to the guards asking them to stop the disturbances. 12. On 8 February 2015, Mr. Bin al Shibh cancelled his legal appointments because of guards that harass him. 13. On 22 February 2015, Mr. Bin al Shibh sent a letter to the Camp Commander about the disturbances day and night. 14. On 28 February 2015, Mr. Bin al Shibh wrote a letter about being subjected to vibrations and disturbances by the guards. 15. On 2 March 2015, Mr. Bin al Shibh cancelled his legal meeting because of guard harassment. 16. On 2 and 3 March 2015, Mr. Bin al Shibh wrote letters because the disturbances woke him up and harassed him. 17. He was not able to sleep because a guard distmbed him and made vibrations. 20. On 26 March 2015, Mr. Bin al Shibh was subjected to disturbances that kept him from sleeping. 21. On 27 March 2015, Mr. Bin al Shibh cancelled his legal appointments because of guard harassment. 22. On 29 March 2015, Mr. Bin al Shibh was subjected to loud banging after morning prayer and after sleeping. 23. On 31 March 2015, Mr. Bin al Shibh was subjected to loud banging coming from behind the wall and the drain. He could not sleep because of the disturbances. 24. On 8 April 2015, Mr. Bin al Shibh cancelled his legal appointments due to guard harassment. 25. On 10, 11, 12, and 13 April 2015, Mr. Bin al Shibh was subjected to disturbances by the guards that interfered with his ability to sleep and he wrote letters asking for relief. 26. On 14 Apri12015, Mr. Bin al Shibh was subjected to vibrations and disturbances by the guards. He sent a letter to the guards asking for relief. 27. He spoke with the SJA about in on 28 April 2015 and he sent letters to the guards. 29. On 1 May 2015 Mr. Bin al Shibh spoke with the Camp Commander about the extreme cold in his cell. 30. On 5 May 2015, M r. Bin al Shibh was subjected to continuing disturbances and loud banging noises coming from the drain. 31 . On 9 May 2015, Mr. Bin al Shibh asked the AWC to stop the vibrations and the distmbances. 32. On 10 May 2015, Mr. Bin al Shibh was subjected to vibrations and banging noises. He sent a letter to the OIC. 33. On 22 May 2015, M r. Bin al Shibh was subjected to noises. 34. On 31 May 2015, Mr. Bin al Shibh asked the guards to stop the disturbances. 35. On 31 May 2015, M r. Bin al Shibh asked the OIC to stop the vibration and let the client sleep. 36. On 21 and 22 July 2015, Mr. Bin al Sh ibh refused to meet with his legal team because of the vibrations and noises that he continues to be subjected to. 4.
