The remainder of this month was fast and focused as both the House and Senate prepared for the longer August recess. Both chambers focused on shoring up the Federal Highway Trust Fund (FHTF). The fund was slated to run out of money in late August. Transportation infrastructure projects throughout the states, including highway and bridge repair, are covered by this fund. The House passed legislation to appropriate $11 billion to keep the fund solvent until May 2015. Additionally in both bodies there were separate and various measures considered and voted on to deal with the crisis along the Texas-Mexico border which has resulted in thousands of undocumented unaccompanied minors crossing into the United States primarily from Central America. Also this month the House considered a bill to provide greater transparency to the listing of endangered species by requiring that data used by federal agencies to make listing determinations be posted online. The Senate tried to do away with a tax provision allowing companies who are moving overseas to deduct their moving expenses. The Senate Defense Appropriations Subcommittee marked up the Department of Defense FY 2015 appropriations bill, proposing $549.3 billion in base and overseas funding. This bill is one of the vehicles we are pursuing for the New Horizon tech transfer pilot project funding. Of particular note, a bipartisan, bicameral deal aimed at reforming the Department of Veterans Affairs was announced at the end of this month. The legislation would: give the VA secretary more authority to clean house at the agency; allow veterans to seek private care if VA doctors are unable to treat them within a 2?week window; hire more medical personnel; and expand medical facilities. The most controversial move before adjournment was the passage of a Republican effort to initiate legal action against President Obama. Citing executive overreach and violation of the Constitution, House Republicans pointed to sweeping changes to climate change rules, immigration enforcement, the healthcare law, and an increase in minimum wage for federal contractors all without Congressional approval as evidence of their claim. The Farm Bill contains many of the rural Ag programs that are grant/loan opportunities for small municipalities and rural counties. For the first time in six years the Water Resources Development Act (WRDA) passed both chambers of Congress. The WRDA bill authorizes local U.S. Army Corps of Engineers (Corps) projects that deal with water resources, environmental, structural and navigation issues. Much of the water and waste water funding available to municipalities and counties is included in this bill. The Senate version of this bill gives the Corps of Engineers authority over which projects will move forward where the House bill establishes a process for project review with Congressional review. The conference committee for this bill held their first meeting this month. Also this month the Senate with a vote of 52 -48 ended the minority party?s right to filibuster executive and judicial branch nominees. Under the new rules, a simple majority vote and not a 60 plus majority is all that is required to end debate and move forward with a vote on nominees. Republicans were vocal in their claims that the move ends the 200-year?old tradition of filibusters, considered an essential right of the minority party. While this does not directly affect any of the issues we are working on, it reflects the continued partisan tone of this congress and creates concern that needed legislation may not move forward. The Speaker of the House stated that the House would not participate in any conference of the current Senate immigration bill meaning immigration legislation be unlikely to pass in this Congress. The Association is concerned about the tax-free status of municipal bonds. These bonds fund a ma jerity of critical infrastructure that the county is responsible for by state constitution or statute. If tax free status is stripped from municipal bonds, it could cause a funding crisis. The proposal put forth by the ?budget committee,? titled the Bipartisan Budget Act of 2013, provides $63 billion in sequester relief over two years ($45 billion in FY2014 and $18 billion in FY2015), which is Split evenly between defense and non?defense discretionary Spending. Despite some opposition from individuals in both parties, the agreement passed the House on December 12 by a vote of 332-94. The budget deal went to the Senate, where it is was approved the following week and signed into law. One of the biggest factors which drove support for this bill was the restoration of regular order to the budget process. According to numerous analysis of this agreement counties and municipalities could be affected as follows: 0 The agreement prevents a second round of cuts to the Payment in Lieu of Taxes the Community Development Block Grant (CDBG) and some justice and public safety programs. The bill also features a provision that establishes a de?cit-neutral reserve fund for PILT and Secure Rural Schools. 0 The agreement does not include cuts to entitlement programs such as Medicaid or the Social Services Block Grant. It allows states to recoup costs from bene?ciary-liability settlements, collect medical child support when health insurance is available from a non-custodial parent and allows states to delay payment of prenatal and preventive pediatric payments when a third party is responsible. For now, the tax exemption for municipal bond interest and the federal deduction for state and local taxes remain intact. 0 Earlier this year, the Transportation Security Administration (TSA) announced that, beginning in July 2014, all airport operators would be responsible for monitoring all passengers as they leave secured boarding areas known as ?sterile areas? imposing a new cost on affected airports. The budget proposal addresses this issue by requiring TSA to continue monitoring airport exit lanes at airports currently receiving this service. a This budget deal also changes the de?nition of long-term care hospitals, whereby at least 50 percent of their patients would have to come from Medicare. This definition could affect some county hospitals. Also in the month of December; the Senate Finance Committee approved the Supporting At?Risk. Children Act by voice vote, this measure strengthens adoptions and guardianship, child support and child welfare; the House Transportation and Infrastructure Subcommittee on Highways and Transit held a hearing on the Federal Transit Administration?s (F TA) Capital Investment Grants program which provides competitive grants to fund new and extended fixed guide way transit systems; and Congress as a whole passed an extension of Transitional Medicaid Assistance until December 31, 2018. The conference committee on the water resources bill will push its work into 2014. One of the biggest differences being considered by conferees is the process for authorizing US. Army Corps of Engineers (Corps) navigation, flood control and wetland restoration projects the Senate bill would authorize about $5.7 billion in projects through 2018, while the House bill would authorize 23 projects at about $3.1 billion over five years. Until now, Congress has used earmarks to designate Corps projects in the legislation a practice that con?icts with the current earmark moratorium. A 5-year farm bill which included one year of PILT funding was passed by both bodies this month and sent to the President for signature. The State Department released their Environmental impact Statement (EIS) on the Keystone XL Pipeline project. The Senate confirmed President Obama?s nomination of Senator Max Baucus (D-Montana) to become the next US. ambassador to China making Senator Ron Wyden (D- Oregon) the new chairman of the Senate Finance Committee and Senator Mary Landrieu (D-Louisiana) the new chair of the Energy Committee. Both the House and the Senate passed a measure increasing the debt ceiling until March 2015. Activities Summary 1 . Participated in the Eddy Lea Alliance conference calls and meetings. Discussion and action topics this month included Texas lawmakers considering the disposal/storage of spent fuel in Texas, potential deployment of in the US market, the DOE federal loan guarantees for nuclear plants, the impact of recent US reactor closures, Senator Landrieu?s chairmanship of the Energy Committee, DOE Sec. Moniz visit to Texas and his comment that the administration?s stance on Yucca mountain, the fire at the WIPP site and subsequent release of airborne radiation and the repercussions of these events for the ELEA. This month withdrew from the ELEA industry team leaving AREVA and URS as the industry team partners. Explained the provisions in Senator Heinrich?s WIPP bill and the need to get the delegations of NY, SC and ID to support. The bill has conditions which must be met before non- defense waste will be allowed at WIPP for disposal: a. Preserve to submit report on GTCC b. Institute a ROD that WIPP is the preferred option c. Maintain caps in the LWA Definition of Waste is maintained: i. Any non-defense waste must meet same definition as defense as stated in the LWA. a. State and Federal legislation and regulations maintained?separate authorization for funds f. Reauthorizes the now?expired payments to New Mexico Agreed to meet with Tim Frasier who is currently with the Bi?Partisan Study Group and working on a grant to promote the Blue Ribbon Committee?s recommendations. Agreed to meet with Senator Heinrich or his staff and try to determine his level support for the Feinstein Bill. Conference calls, email correspondence with Eunice Mayor and city manager, re: Eunice capital outlay priorities, discussion of funding for Eunice lake restoration. Continued research for grant opportunities for Eunice. Researched, discussed, drafted Eunice Daniels Grant Foundation application. Calls with NM state officials (State Engineer, State Forester) re: funding opportunities for Tatum?s Lake Project and the communities desire to create lake. Spoke to acting city manager Bob Gallagher on the needs/desires of the City of Jal. Researched Grant funds for Jal. Calls and emails with NM DOT on federal funding for walking trails?found program, created write up, status update on administration of the program (from EMNRD to DOT). Worked with Tim Wittig (New Horizons) to set up meetings with the New Mexico delegation to follow up on New Horizon board member meetings and to put forward technology transfer language. Reviewed the Partnership intermediary Statute and the 2014 Defense Authorization act section 1603. Worked with Tim on language for the partnership intermediary section. Continued to work with Corey N. on the training wing opportunity for the airport. Reviewed and discussed training wing returning to Las Cruces. 0 Reviewed and discussed notice of the FAA agreement to fund at 80% the contract tower at Lea County airport. Discussed options for continuing the funding beyond 2014. 0 Continued working with DLA regarding fuel contract for Navy training wing.
