Dr. Costa was my dentist until his retirement from his practice. I always found him very professional and very concerned in regards to a patient?s dental issue. He was always on call for any issues you may have had in an emergency and responded in a timely manor. He always had time for a patient in an emergency and you never was told to wait two or three weeks before you could come in for an appointment all who work in the of?ce had exemplarily work habits down to the receptionist at the of?ce they were always kind and caring. As a patient that is all-that you can ask for and I am one of those people who have a true fear of dentists and at Dr. Costa office I found a comfort level that help me to be able to continue to return. District Court U.S. Post Office 85 Courthouse 7th Avenue and Grant Street Pittsburgh, PA 15219 November 13, 2007 Dear Judge Lancaster: I am writing to you on behalf of one of my closest and best friends, Dr. Alfonso Costa. I met A1 when I first arrived in Pittsburgh about ten years ago. We histantly became very, very close friends. As you can imagine, being in a high pro?le profession I meet thousands upon thousands of people in all walks of life. I have met civic leaders, heads of state, legislators, philanthropic leaders, business leaders, community activists and countless professionals. I can comfortably say that I can count those whom I consider to be my closest friends on one hand and included in that count is Al. If there is anyone I know I can always depend on it is Al. One of the things I admire most about Al is what I consider to be his real success, his family. He has four children that are each kind, bright, smart, and respectful. I have been in the company of A1 with his family an untold number of times and I have witnessed how attentive, caring, and loving he is as a husband and father. Every action he takes is for the betterment of his family. Some say that a real test of a man is the success in which his children experience. Besides the dynamic qualities I named above, Al?s two sons are students at Yale University. This is a true success worthy of this great man. Al is always there to help in anyway he can. He is an active participant with my foundation, the Bus Stops Here, whose mission is to improve the overall quality of life for troubled and underprivileged children by offering the opportunities to help them succeed in life. Al?s life is a great example to these kids that you can come from a disadvantage background and have a wonderful, successful life. He is role model for the children my fund aims to assist and I am proud to have his help. Not only does he ?i Case Document 16-7 Filed 12/20/07 Page 5 of 53 help these inner city kids by providing ?nancial donations, but he gives of his time as well. He is always there ready and willing to help in anyway even by taking time from his day to drive me to Wilkinsburg to help deliver computers to young kids. Anything to help, he is there to do. Al is always there for his friends and for the community. There is not anything that I can ever remember asking of him, big or small that he has not graciously done. He is this way with the community as well. Besides my foundation, he gives of his time in many other ways to the youth of Pittsburgh, notably through the Carson Scholars Fund. I am very much aware of the extensive time and effort that Al puts into this organization because my wife, Trarneka, is on the Advisory Board. This organization, which helps provide scholarships for mainly inner city kids that would otherwise not have an opportunity to receive funds for higher education, I believe is vitally important. I myself am a product of the inner city and can appreciate how important scholarship funds are for higher education. Al was the sole factor in bringing this scholarship fund to Pittsburgh and I can honestly say for both my wife and I that this important program for inner city youth will cease to continue if Al is incarcerated and not able to oversee all of the integral parts that are vital to its success. As his good friend I am cognizant to many things. he does to help people that nobody ever knows about nor does he seek any recognition. I have witnessed his kindness and generoSity on many, many occasions. The same way he goes out of his way to respect me is the same way he respects everyone no matter from what walk of life they come from. I can honestly say that it would be very detrimental to innocent children of our community if A1 were incarcerated. Not only will he suffer from incarceration but also the people in the community that depend and benefit from his good works will suffer. I know nobody will be able to step in and take his place in the Pittsburgh community and certainly not as my friend. If yo . .- any questions or if you would like to discuss this furth a e, my ersonal cell phone number is 412?215-6600. I ?rst met Al Costa in 1992 when he enlisted me as a CPA to assist him in the preparation of his tax returns. Since that time, I have also come to know him and his family on a personal level. I believe you can learn much about a person by observing his relationship with his family and others. Dr. Costa is a dedicated husband and father. Through the efforts of he and his wife, Mary, they have raised four outstanding children. Dr. Costa has always stressed the importance of education and nothing can match the pride he exhibited when his ?rst son was accepted to Yale. have also had the opportunity to observe Dr. Costa?s dealing with people outside his family. He goes out of his way to demonstrate his appreciation and respect to all those with whom he deals. Also, as his CPA, I am privy to his charitable giving. Over the years, Dr. Costa has given significantly to many charities such as the Pittsburgh Opera. But even more signi?cant than his monetary donations to charities, is the time he spends pursuing various charitable activities. I am especially knowledgeable of his efforts over the past years in relation to the Carson Scholarship Fund, which provides scholarships to disadvantaged youths. He serves on the Board of Directors and organizes and hosts various fundraisers for this charity. Finally, I can tell you that Dr. Costa's 2002 tax return was audited by the IRS. This audit resulted in no adjustments which is rare in any audit. I know that Dr. Costa has accepted responsibility for his actions and will accept the consequences resulting therefrom. i believe he is an asset to this community and I hope that you will see fit to be as lenient as possible as the incarceration of this man would serve no seeable purpose. I have known Al since he was in high school at Central Catholic. He was always a hardworking student in both high school and college. During the day he attended school, and at night he would always help his parents at their family run pizza shop, often working until late in the evenings and on weekends. He Was an excellent student at the University of Pittsburgh Dental School. I remember when he ?rst started his dental practice how hard he worked putting in long hours. I was one of his first patients and was impressed by the tremendous ability he demonstrated. He was always very thorough, and unlike other dentists was quick and painless. I have been in the medical ?eld in Pittsburgh since 1974. I completed my medical school and residency programs at the University of Pittsburgh. I began my urologic practice in Pittsburgh in 1984. I have always known Dr. Alfonso Costa to be compassionate and caring with all of his patients. He has helped many people in the Pittsburgh area with his skilled dental care. In fact, in 1991 Dr. Alfonso Costa became ill and required surgery, but he delayed his surgery so he could complete the care of his patients ?rst. Dr. Alfonso Costa has always given back to the community. I remember one of the ?rst things he did after starting in practice was to sponsor many young underprivileged children attending their ?rst Pittsburgh Pirates baseball game. And most recently he was the founder of the Pittsburgh Chapter of The Carson Scholars. He has truly enjoyed sponsoring these scholarships for young people from many Pittsburgh neighborhoods. He has also spent a lot of his time enlisting as many people as possible to help these young students excel in school. . - I have always respected Dr. Alfonso Costa because he has not let his success interfere with his family life. He is an excellent husband and father because he is always around for his family. He has helped his four children understand the importance of education, sports, and community service. And his four children have worked hard to make their father proud. Dr. Alfonso Costa is also a great son, brother and brother?in?law. Several years ago Dr. Costa?s father was afflicted with Parkinson?s disease. He required a great deal of care and Dr. Costa was always available for his father. He often brought his father to doctors and therapists despite his busy schedule. When his father could not walk, he built a bedroom on the ?rst ?oor for him so he would not have to go to a nursing home. One year after his father died another tragedy struck the family. The youngest sister Rosalia, thirty-six weeks pregnant, suddenly collapsed and died. The baby was miraculously delivered and revived. The baby boy required a great deal of care including a feeding i Case Document 16-7 Filed 12/20/07 Page 16 of 53 tube for over two years. Dr. Alfonso Costa rallied the family together during this tragedy. He helped his mother provide twenty? four hour a day attention to this miracle baby. With his help this little boy can now eat without a tube and he can also walk with the aid of braces. I am very privileged to know such a dedicated, hard working and giving individual as Dr. Costa. I sincerely recommend that Dr. Alfonso Costa not be incarcerated because he is too valuable a person to his wife and children, his family, his friends, and to the Pittsburgh community. Despite his battle with cancer in 1991, he always maintained a positive attitude and never let his diagnosis or treatment interfere with the care of his patients or his duties to his family or community. Al?s compassion towards people has been shown through his giving back to our community in many ways. He has promoted the arts and music through his work with the Pittsburgh Opera and has promoted education for the young less fortunate of Pittsburgh through the work he has done with The Carson Scholars Fund. District Courts Dear Judge Lancaster: I am writing to you on behalf of Dr. Alfonso A. Costa. As property manager for Costa Land Company, I assist in employing contractors, subcontractors, and maintenance workers for Costa Land Company and its subsidiary companies. These subsidiary companies include ASpen Maintenance, Barbuto Maintenance, Costa 36, Costa NYC, Emfaze Associates, HOpewell Security, Lilly 14, Long Meadow Associates, Maria Associates, MGAC Associates, Pittsburgh Hilton Head Associates, Loyco Associates, TT New York, and Villa Lilly. From contractors to trash collectors and everyone in between, Costa Land Company and its subsidiary companies, through their undertakings in construction, employ over one hundred people per year. Because Dr. Costa is such an integral part of Costa Land Company and its daily operations, incarcerating him will potentially lead to the breakdown of these aforementioned companies. Consequently, this will jeopardize the job security of the hundreds of people who rely on Costa Land Company and its subsidiary companies for employment. These people include, but are not limited to plumbers, electricians, landscapers, parking lot sweepers, asphalt and concrete workers, snow removers, painters, trash collectors, HVAC technicians, security guards, architects, contractors and subcontractors. With complete direction and guidance ii'orn Dr. Costa, my speci?c role in these companies includes a variety of tasks, most notably to negotiate maintenance and repair contracts and also to oversee any work that is executed at our properties. While it is ultimately my responsibility to perform this work, Dr. Costa is actively involved with every aspect of this process; he coaches me through any given project from start to ?nish. Dr. Costa demands that all possibilities and potential problems are examined before proceeding with work, no matter how small or large the task. In this regard, I depend on Dr. Costa for his management and leadership on a daily basis in order to successfully maintain our companies? properties. Dr. Costa takes an equally active role with directing the other employees in his office, Laura Vash, Monica ortuna, and Sarah Piccione. I feel con?dent in speaking for this group when I state that we simply could not function as a company Without Dr. Costa?s expertise and guidance. For example, even when Dr. Costa is not in the of?ce, I can expect him to call approximately 10 to 15 times in just one day. This is not to say that Dr. Costa lacks confidence in his employees. Quite conversely, Dr. Costa expects us to perform our respective jobs to the best of our ability at all times. Sometimes Dr. Costa calls to offer words of encouragement or motivation, something that most bosses would not typically do. It is Dr. Costa?s constant communication with us that keeps this company alive. Case Document 16-7 Filed 12/20/07 Page 19 of 53 On a more personal note, although Dr. Alfonso A. Costa has employed me for the past year, it would be limiting to label him only as my boss or employer. I cannot reduce to terms the ways that Dr. Costa has acted as a mentor and role model to me outside of the of?ce. Most recently, Dr. Costa helped me to secure a real estate investment of my own, something that will provide for my family for years to come. And I am only one person, one story. You can only imagine how many other people Dr. Costa has personally helped outside of his own companies without asking for anything in return. Incarcerating Dr. Alfonso Costa will adversely affect not only me, not only the people in this of?ce, but the hundreds people who rely on Costa Land Company and its subsidiary companies for employment. Dr. Costa?s incarceration would serve no purpose, would bene?t no one, but it would certainly be responsible for hurting many. I have knownDr. Costa for 'twentwaive years and he has always been a dedicated father and husband, a major contributor to his community, and an extremely loyal and committed friend. As a family man, Dr. Costa and his wife Mary have raised their four children: Joey, Christina, Alfonso, and Maria to be respectful and exemplary young people. He has always treated my family as his own. Dr. Costa has acted as a mentor to me when I wanted to get involved in the real estate business. He advised and assisted me in every aspect of my first major real estate acquisition. Dr. Costa is a man of his word and is always there if you need him. Dr. Costa has given a signi?cant amount of his time and money to many charitable organizations where he has been intimately involved in their success. He is responsible for starting the Pittsburgh Chapter of the Carson Scholars Foundation. A foundation which I am on the advisory board. Dr. Costa is directly responsible for raising hundreds of thousands of dollars to recognize and reward students for their humanitarian and academic achievements. FE Holliday Fenoglio Fowler, November 9, 2007 VIA REGULAR MAIL The Honorable Gary Lancaster US. District Court RE: Dr. Alfonso Costa Dear Honorable Lancaster: 1 am writing this letter on behalf of Dr. Alfonso Costa. I am a commercial mortgage banker based in Pittsburgh and approximately seven years ago, I was introduced to Dr. Costa through a mutual business associate. Since that time, I have completed more than $85,000,000 in commercial mortgage ?nancings on his behalf. The lenders, including Citigroup, Morgan Stanley and Merrill performed detailed underwriting examinations of both the properties and Dr. Costa as a borrower. These examinations revealed no adverse issues. I have witnessed Dr. Costa?s charitable endeavors. Although it could be argued that successful individuals should perform charitable work, Dr. Costa?s efforts have greatly exceeded simply writing checks to support causes and making appearances at events. One of his endeavors is The Carson Scholars Fund, a fund that recognizes and rewards students in grades 4 11 for academic and humanitarian aChievements. The annual fundraiser consists of a public autograph session with at least 15 Steeler players, all of whom are persuaded by Dr. Costa to join him in donating their time for a good cause. I have also witnessed Dr. Costa interact with both his children and mine. This is a good man who knows that a strong family unit is the foundation for all facets of life. When I called Dr. Costa to offer my support following his plea, Dr. Costa did not offer excuses or attempt to blame others. He took full responsibility for this isolated incident. I would respectfully ask the court to show mercy in this case and spare Dr. Costa from incarceration. I believe Dr. Costa will use such opportunity to expand his charitable work in an effort to restore his good name. Please do not hesitate to contact me at 412?281?8714 should you have any questions. I have known Al and his family for a number of years. Al and his..:w wife Mary, have been active in many civic organizations, such as.. the Pittsburgh Opera. But.hot all of their activities-are cultural. Most importantly, Al and.Mary personally participated.in developing large fund raising programs for the Carson Scholars Fund I focus on-the Carson Scholars Fund because it was not just money that Al gave. Rather, he gave of himself. He invested the time to make these programs succeed? And, it is not the only personal involvement he and his family have in charitable or civic works. Al used his friendShip with a number of Pittsburgh Steelers, mot for his own benefit, but to create an affair that raised hundreds of thousands of dollars for Dr. Carson and his scholarship fund? Al did not just give nwney, but created EH1 exciting affair? that brought hundreds of people together with" all of the proceeds behefiting time Carson. Scholars Fund. Zhi fact, for? the silent auction, he gave his own personal items, to raise even more money. Al is an officer of the Scholars Fund and his wife Mary is oh the Board. Al brought along Jerome Bettis to become a member of the Board, helping to give the organization a high profile. Al spent hundreds of hours of his own time in developing the affair for the Carson Scholars Fund. 1The Fund is the creation of Benjamin S. Carson, Sr., M.D., a pediatric surgeon, and its mission is to provide scholarships to kids who have achieved academic success. Almost all of the1?ihds it raises are used for its programs. Case Document 16-7 Filed 12/20/07 Page 28 of 53 The Honorable Gary L. Lancaster Page October 31, 2007 Al has done many other good works over the years. In addition to his involvement-in culthral activities, in which he has also given money and time, he has done small things that are just as important but are not publicized. When his father could not retire from operating a small pizza.business because no one would_pay the price he needed to retire, Al secretly financed a buyer, so his father could retire. And, then, after a few years of partnership with the Buyer, Al just gave him the store. Those things are not generally _known and they garner no publicity. Al-has remained true to his roots. He maintains friendships with those whom he has known for years and is always there for them. His business employs a large number of people, local and elsewhere. Again, he is always-there for his employees. I am sorry that i need to write this letter on Al?s'behalf. I am sure it was very difficult for him to ask for such a letter or to be in the pmedicament he finds himself in. Justice has in) be tempered. by? mercy. REGULAR MAIL November 12, 2007 The Honorable Gary Lancaster US. District Court RE: Dr. Alfonso Costa Dear Honorable Lancaster: 1 am writing this letter on behalf of Dr. Alfonso Costa. While I have not personally done business with Dr. Costa, our Pittsburgh office has consummated a number of transactions with Dr. Costa as the principal borrower. To the best of my knowledge, Dr. Costa performed up to expectations in each of these transactions, and the properties and his personal background had to be examined and underwritten in each case, which is no small undertaking. My main knowledge of Dr. Costa was through our children and their respective athletic endeavors. Dr. Costa was very involved with the lives of his children, and attended all of. their games. His children were always respectful, hard working and very helpful to their teammates. There is a saying that ?the apples do not fall far from the trees?, and I believe that these traits come from the home and are learned from watching. 1 cannot think of a higher compliment to a parent than to have someone comment on the actions and attitude of their children. On many occasions, I had the opportunity to watch Dr. Costa interact with his children as well as those of others on the team. I had the opportunity to watch him interact with other parents, coaches and opposing players and parents. in every case, Dr. Costa always treated everyone with reSpect. it is my understanding that Dr. Costa has accepted full responsibility for his actions in the matter before the court, and has not attempted to place the blame anywhere other than on his shoulders, which is also telling about his character. I would reSpectfully ask the court to show mercy in this case to the fullest extent permissible under the courts powers. Piccione Chief Operating Officer spiccione@costalandco.corn The Honorable Gary Lancaster U.S. DISTRICT COURT Dear Judge Lancaster: I am the Chief Operating Of?cer of Costa Land Company, a real estate development and management company, founded by Dr. Alfonso Costa Costa Land Company and its subsidiary companies have real estate holdings throughout the United States with many assets in the Pittsburgh area. At Costa Land Company we pride ourselves for having a reputation of being true to our word, honorable, respectful, courteous and honest to every person we do business with. These are the ethics embedded into us and shown to us everyday by personal example from our Chairman, Dr. Alfonso Costa. Besides running Costa Land Company, Dr. Costa is also the President and leading force behind each of its subsidiary companies which includes: Maria Associates, Long Meadow Associates, Pittsburgh Hilton Head Associates, MGAC Associates, Emfaze Associates, LoyCo Associates, Costa NYC, Lillyl4, Inc, TT New York, Costa 36, Villa Lilly, Greco Associates, Aspen Maintenance Company, Barbuto Maintenance Company and Hopewell Security Company. Dr. Costa is the driving force behind this company and its subsidiaries named above. He actively participates in each and every detail of the organization from the property management to the negotiation of leases to the hiring of contractors. Dr. Costa is responsible for the day-to-day operations of the companies, as well. He directs me along with my fellow co?workers all who rely heavily on his leadership. Without his guidance these companies would suffer detrimental setbacks and possible demise. In addition to our of?ce staff, our companies? employee a multitude of local businesses including: accountants, lawyers, ?nancers, architects and engineers. We also subcontract work to scores of local maintenance workers, construction workers and contractors. The loss of Dr. Costa?s daily leadership would mean the disintegration of our company and in turn, the loss of jobs for all of these individuals from the Pittsburgh area. It is very necessaiy for the survivability of Costa Land Company and its subsidiaries that Dr. Costa have the ability to travel and visit the properties. Costa Land Company is currently in a joint venture with Swig Equities on two projects in New York City. These projects entail extensive renovations on two buildings in the financial district, which has created jobs for hundreds of peOple. All of these people depend on the success of these projects for continued employment. Dr. Costa visits New York regularly to oversee the projects, meet with his partners and ensure the overall success of the joint venture. Dr. Costa is committed to the Pittsburgh comrmmity. He is the founder of the Pittsburgh chapter of the Carson Scholars Fund. Bringing the fund to Pittsburgh and securing 2Q: Case Document 16-7 Filed 12/20/07 Page 33 of 53 supporters was no easy task. To spark interest, Dr. Costa personally reached out to his friends, colleagues, local leaders and members of Pittsburgh?s public and parochial schools, conveying to them how strongly he believed in the positive impact the fund would have on the youth of Pittsburgh. Each year Dr. Costa hosts the fund?s two annual events, the Auction Event and the Awards Banquet. I have witnessed Dr. Costa giving hundreds of his personal hours to this cause. One highlight of the auction is an hour-dong autograph session with members of the Pittsburgh Steelers. The players donate their time because Dr. Costa personally reaches out to his friends on the team and asks for their donation of time. He spends countless hours gathering items for the auction as well as donating many of his own personal items, all in an effort to raise money, which will be awarded through scholarship to local Pittsburgh students. As well as his time, Dr. Costa donates his office, supplies, and assumes many other expenses related to coordinating the fundraiser. He gives so much because he wants to ensure that the maximtun amount of money raised in Pittsburgh goes directly towards scholarships given to Pittsburgh scholars. For example, last year out of the $200,000 raised at the fundraiser, $193,000 was given directly to the fund with only a 3.5% cost due to Dr. Costa picking up the majority of the expenses. Dr. Costa?s involvement is strictly out of the good of his heart. He does not seek recognition or admiration for his good deeds. Through Dr. Costa?s leadership, the Pittsburgh chapter of the Carson Scholars Fund has awarded over 150 students from Pittsburgh public and parochial schools $1,000 scholarships that can be used towards their higher education. Each year at the awards banquet, families gather together to celebrate the achievements of their children; it is truly a moving day. Last year a mother of a fifth grade award recipients came to me and as she wiped tears from her eyes she asked me to please thank Dr. Costa and tell him that for their family, ?this was the best day of our lives.? Dr. Costa is the reason why we have the fund in Pittsburgh and because of his cormnitment and dedication we have been able to positively impact the future of Pittsburgh area students. This scholarship cannot and will not continue without Dr. Costa. Due to my position at Costa Land Company I am privy to the knowledge that Dr. Costa is involved with many philanthropic causes. He gives of his time, contributes items and monetary donations to over fifty different charitable causes. This is not common knowledge because he never seeks to be acknowledged for his donations. It is in giving, not in recognition, which he is most comfortable and feels most satis?ed. It is dif?cult to sum up the significance and admirable qualities of a man like Dr. Costa in a short letter. As I have outlined, he has a positive effect in the business world and to the many charitable organization for which he is involved. Even more so I feel it is important to touch on the true nature of the type of man Dr. Costa is. He cares about people. I personally witness on a daily basis his sincerity, generosity and kindness towards everyone he encounters. I can?t begin to tell you how many calls he receives from people looking for assistance, needing help or guidance. He is always there for everyone giving sel?essly in any way that he can. I respectfme ask that you take these admirable qualities and important contributions to our community into consideration and not incarcerate Dr. Costa and allow him to continue to contribute to our community. sincere ah J. iccione Case Document 16-7 Filed 12/20/07 Page 34 of 53 international Association of Lions Clubs (Lions Clubs International a) CAROL A. Case Document 16-7 Filed 12/20/07 Page 38 of 53 November 19, 2007 Judge Gary Lancaster US. District Court Dear Judge Lancaster: I am writing on behalf of Alfonso A. Costa. I have known Alfonso as a client and on a personal basis for over fifteen (15) years. in the early 1990?s, Alfonso was beginning to invest in commercial real estate and a mutual friend referred him to rne. When we met, I found Alfonso to be an intelligent young man with a plan and a keen insight into the real estate industry. In our first meeting, I was surprised to learn that Alfonso?s wife, Mary, grew up in the same city neighborhood as and lived next door to my Aunt Mary. Since that first meeting, we have represented Alfonso in his real estate business. . have had the opportunity and the pleasure of observing as Alfonso developed his real estate portfolio. As a buyer or seller of property, Alfonso has always acted in a forthright and ethical manner. Alfonso truly is a man of his word. ln helping to negotiate the purchase of valuable properties on Alfonso?s behalf, I have remarked, on many occasions, to attorneys representing the sellers, that Alfonso?s word is better than any written agreement. In the world of high stakes commercial real estate, have found Alfonso?s integrity as refreshing as it is rare. Alfonso has developed a significant commercial real estate portfolio which requires the special management skills that he possesses. He makes decisions every day that are essential to the continued success of the business. His efforts have created jobs for the people who work for his company directly and for the many people and companies that provide ancillary support services such as maintenance workers and landscapers. Without Alfonso?s leadership and daily involvement for any period of time, the viability of the real estate portfolio and the jobs which it requires would be in serious jeopardy. have often marveled at Alfonso?s success as a real estate businessman and I am proud to have been a small part of the team that helped to make it happen. am proud because I believe that Alfonso did it the right way by keeping his word regardless of the consequences. On a personal level, have known Alfonso to be a dedicated and loving family man. He is a loving son and is very supportive of his entire extended family and is relied on heavily. I have gone to sporting events and other activities in which Alfonso?s children have been involved. To say that he is a caring and proud father is a gross understatement. 2? Post Of?ce Courthouse 7th Aveoue 82: Grant Street Pittsburgh, PA 15219 To the Honorable Judge Gary Lancaster: I am writing this letter in support of Dr. Alfonso Costa, for whom I worked from August 2005 to September 2006. During my time working with Dr. Costa as a staff member at his real estate company, I witnessed him giving away much of his company?s pro?ts to support charitable organizations in the Pittsburgh area. Dr. Costa comes from a humble background, and having achieved success in business, he has truly taken advantage of his ability later in life to give back to the community where he grew up. During my employment at Dr. Costa?s real estate company, much of my work was conoected to the Pittsburgh chapter of the Carson Scholars Fund. Dr. Costa founded and serves as President of the Pittsburgh chapter, and he also serves as an Of?cer of the overall national organization. The Carson Scholars Fund is a scholarship program for young people of all backgrounds and fmancial standings that rewards academic achievement in elementary through high school. The overall purpose of the organization is to elevate academic achievement to the level of prestige that is often held by young people only for those who excel in sports or who are seen as ?pop in the conventional seose. In this way, the Fund aims to eventually make an overall change in the way that young people feel about the merits and rewards of academic success. I began working with the Carson Scholars Fund in its second year. While involved with the Pittsburgh chapter, I came to know ?rst~hand how close the Fund?s work is to Dr. Costa? 5 heart. In addition to making exceptionally generous monetary donations to the Pittsburgh chapter of the Fund, Dr. Costa was also involved in a very hands?on way with the chapter?s yearmrouod activities, from raising funds for the scholarships, to cultivating new donor bases, to putting together the awards reception for the school~age scholarship recipients. Having had personal interaction with the Pittsburgherea recipients, I know what a positive impact the scholarship fund has had on them and on their schoolmates who begin to look up to the scholarship awardees as academic role models. This unique organization would not have been founded?wand would not continue to existwin the Pittsburgh area without Dr. Costa, and through itl believe that Dr. Costa has truly succeeded in initiating a positive change in the state of education and youth development in the Pittsburgh community. As I have, I hope you will zecogniZe that: Dr. Costa is actively involved in making positive cootributions to the Pittsburgh community. Thank you for your time, and please do not hesitate to contact me to further discuss my support of Dr. Costa and/or his work with the Carson Scholars Fund. November 20, 2007 VIA REGULAR MAIL The Honorable Gary Lancaster U.S. District Court RE: Dr. Alfonso Costa Dear Honorable Lancaster: I am writing this letter on behalf of Dr. Alfonso Costa. I have loiown Dr. Costa since 1979 when we played football against each other in high school. The Central Catholic Vikings and Dr. Costa were great competitors that day and prevailed over my Fox Chapel Foxes. Since that time, Dr. Costa and I crossed paths numerous times at functions that were attended by our families and/or mutual friends. I have known Dr. Costa for many years on a personal basis and more recently through a business relationship. Our firm, HFF, is the largest commercial real estate ?nancial intermediary in the United States. We are involved in 2,000 transactions per year accounting for over $40 billion of capitalization. We do business with the top owners and ?nancial institutions in the commercial real estate industry throughout the country. I have been in this business since 1984. have been doing business with Dr. Costa for over 10 yearslist of clients that have done business with over the past 23+ years. Dr. Costa is a very creative, intelligent and passionate person. He is extremely hard working with comes directly from his family background. He has been able to move from a business background in dentistry and into the real estate business with no disruptions. The financial institutions that we have done business with including Morgan Stanley and Citigroup think very highly of Dr. Costa and value his relationship at the highest levels. in addition to our business relationship, I have had the pleasure to Spend time with Dr. Costa and his family as well. He and his wife have a wonderful relationship and have raised four (4) beautiful children. My wife and I have five (5) children of our own and we would be proud to have our children to grow up to be like the children that Mary and Dr. Costa are raising. I have also found Dr. Costa to be a very generous man. In addition to all of the charities that he supports directly or through his friendships and business relationships, he has found the time to support charities that my family has been involved with over the years. He is as caring of an individual as I have met in my life. It is my understanding that Dr. Costa has accepted full responsibility for his actions in the matter before the court, and has not attempted to place the blame anywhere other than on his shoulders, which is also telling about his character. 1 would respectfully ask the court to show mercy in this case to the fullest extent permissible under the courts powers. 301 Grant Street, Suite 600 0 One Oxford Centre 0 Pittsburgh, PA 15219 ~tel 432-281-8714 0 Fax 412~28l?2792 .31 Case Document 16-7 Filed 12/20/07 Page 42 of 53 November 20, 2007 Page 2 Shouid you wish to speak to me directly about Dr. Costa, please do not hesitate to contact me at 41 2481? 871 4. Sessorns, MD 2777 Shamrock Drive Allison Park, PA 15101 Honorable Judge Gary Lancaster US District Court Grant Street Pittsburgh, PA Dear Judge Lancaster: 1 am writing this letter on behalf of Dr. Alphonso Costa who is well known to me. Dr. Costa is a good man! He is'a family man, a father, husband, dentist, businessman, scholar and a dedicated humanitarian. Dr. Costa is one of several children. to an Italian immigrant who came to this country looking for a better life for themselves and their family. His father and family were from Larirnor Avenue and worked severaljobs and ran a shoe repair shop and a pizza shop. Dr. Costa worked in the pizza Shep as a kid. His father was an immigrant who so loved America that he joined the US Army and served in World War ll. His mother and father instilled in the children to get an education. In so many ways, he was the epitome of the American dream. Dr. Costa went on to become a dentist, his older brother a physician and his sisters, a radiologist and pharmacist. Al became a dentist and was driven to success. I met him While he was in college and impressed upon him the value of hard work. I encouraged him and his brothers to apply to Mehany Medical College but the University of Pittsburgh gave them scholarships. Al went on to become a dentist with a good practice. He became interested in the real estate business and less attentive to dentistry, eventually becoming a run time real estate developer. He is active in many charitable causes. Al is a member of the Sons and Daughters of Italy. He donates to many causes and has been a dynamic leader of the Benjamin Carson, MD scholarship program. He is chairman of the Pittsburgh Chapter and a member of the board at the national level. He has coordinated the annual fundraiser for this organization and personally donated many thousands of dollars to this group. They award scholarships to deserving students solely based on scholarship. This program is coordinated with the support of the Pittsburgh Steelers, Jerome Bettis and Hines Ward. I serve on the Board as well. The Sons and Daughters of Italy named Al ?businessman of the year?. At the affair, Tony Lasorda praised his leadership. He has helped other students in Pittsburgh as well. As a father, he has raised brilliant, beautiful children. Two of his boys are students at Yale. Your Honor, 1 have the highest personal regard for Dr. Costa and implore you to be lenient with him and give him probation. I am sure he is willing and able to refund Medicare. The public interest would not be served if he were incarcerated. I know he has profound regret and embarrassment for any misdeeds. Your Honor, I appreciate your attention you to my letter and appeal for this great man. Lancaster United States District Court, Western Seventh and Grant Streets, Room 6370 PO. Box 1805 Pittsburgh, PA 15230?1805 Dear Judge Lancaster: As President of Shady Side Academy, Pittsburgh, PA, I am writing on behalf of Dr. Alfonso Costa, Sn, a parent of three Academy alumni (all in top tier or Ivy League schools) and one currentstudent, Maria, a sophomore. During my seven years at the Academy, I feel compelled to share that no parent has shown more support of his children, his family, and a willingness to reach out to the school and the broader community of Pittsburgh than Dr. A1 Costa. Although an extremely busy professional, Dr. Costa seldom if ever failed to be present for his children for parent conference days, school performances, athletic competitions and/ or academic awards ceremonies. This required scores upon scores of hours given the immense involvement of his four children in activities both within and outside their school environment. He has been an advocate for his children as well as one who has consoled or celebrated them whichever was apprOpriate. I celebrate him as a model and upstanding parent who is always there for his family; seeing so many busy parents who fail in this regard moves me to note this about Dr, Costa. A ?ne father and family man Dr. Costa is one who stands tall in exercising this special responsibility. Dr. Costa is also has a unique, caring and philanthropic heart and is one who reaches out to others in need in the Pittsburgh community and across the country. One (and there are many) shining example of this is his support of the Dr. Benjamin (Ben) Carson Scholars program, an outreach to underprivileged children here in Pittsburgh to enabling them further educational opportunity. A supporter of the efforts of Dr. Ben Carson, a pediatric neurosurgeon, World renown for saving the lives of children by performing miraculous life saving surgery to children (Example: performing surgery of separating those children connected at birth and who would not otherwise survive), Dr. Costa has also been a major catalyst for the raising of funds here in western for the Carson Scholars Program enabling at~risk youth new hepe through educational Opportunity. All this to say, that the heart of Dr. Al Costa even extends beyond the love of his own family to that of western and the greater world; a humanitarian. 5% Case Document 16-7 Filed 12/20/07 Page 46 of 53 The Honorable Gary L. My wife, my son and I have known Al and his family for close to 10 years now. It is my hope that I can provide you with my personal observations and experiences over the past decade such that you will be able to receive a full picture of the man. We met through a mutual friend who recommended that we meet due to Al?s love of music. As General Director of Pittsburgh Opera, I asked for his help. agreed to help and true to everything I know about him, threw himself into the task. He became a generous donor, but even more importantly, he joined The Board of Trustees and gave countless hours to us. We worked closely together raising funds from his contacts in the conununity and giving me sound advice about the opera company operationally and strategically. We became close friends and our families bonded as well. Al and Mary are the best parents I know and have always put family and friends ?rst. When his sister died, we cried together in church. We spoke together about his father running a pizza shop and how he was among the ?rst in his family to get an education. He has told are often how he worships and loves Mary, his childhood sweetheart. He has always set a perfect model for his children and has taught them the virtues of honesty, integrity and loyalty. In all dealings with me and with those others that I am aware, such as his volunteering for the Carson Fund for underprivileged youth etc, A1 has always been personally generous, kind, and a man of his word. I cannot speak to things I am unaware of that happened before I met him. But I can assure you that 100% of my extensive knowledge of A1 Costa is that he is an absolutely wonderful member of our Pittsburgh Community. To remove him from the community through incarceration would, at this time, only hurt the community (as well as his family). I will be in court on January 11 to give whatever support I can to Al and Mary and his wonderful family. I implore you to find some other way than incarceration for Al to make up for his mistakes. This is a good person before you. Please show him as much rnercy as you are allowed. nest regardsMark J. I have had the privilege of observing Dr. Costa, more than ten years ago, start an organization dedicated. to raising money to provide toys for needy children at Christmas. Each year, Dr. Costa lends his time and money to this effort and as a result, it has continued be a source of joy to children during the holidays. Whenever there were not enough gifts to go around, Dr. Costa, without any hesitation, reached into his own pockets and bought hundreds of gifts for children he did not know, nor ever met. I also was personally aWare or Dr. Costa's establishment of the Pittsburgh Chapter of the Carson Scholarship Foundation. This organization awards academic scholarships to public schools students for academic performance and demonstration of humanitarian qualities to students ranging from grade school to high school. In addition to donating substantial sums each year to this Foundation, Dr. Costa has donated hundreds of hours of his time. Each year he travels between Baltimore and Pittsburgh, at his own expense, on a weekly basis to ensure that the Pittsburgh chapter carries out the mission of the Foundation. He has been instrumental in not only raising money for the Foundation, but in ensuring that the fund-raising activities become a regular part of the organization. Over time, Dr. Costa has become a close personal friend-?someone that I consider to be an adviser, mentor, teacher?and role model. I have watched. him and his wife raise four children and imbue in each of them a strong work ethic, good morals and an avid interest in giving back to the community. As individuals, and as a family, they have contributed countless hours to those who are less fortunate and have done so from the time his children were in elementary school through high school and even now while at college. Dr. Costa?s concern for others was particularly evident to me when I had serious medical. issues and there was a strong possibility that I would lose my foot. He reached out to friends and colleagues to ensure that I saw the right specialists while I was in the hospital. Not a day went by without a visit from Dr. Costa. His un?agging support, during such a difficult time for me, meant so much to me and my family-wand I still have my foot. jg Case Document 16-7 Filed 12/20/07 Page 51 of 53 B.
