Roberto?s parents were the typical immigrant parents who worked themselves to no end so that their children could experience the success they dreamed about when they immigrated to this country. Education was the most important goal of Mr. and Mrs. Michienzi. They struggled to ensure that all of their children received educations. Roberta?s brother is a surgeon and his sister is a pharmacist. I was there to witness the pride and excitement at Roberto?s graduation party from dental school. His pride paled in comparison to that of his parents. Roberto is a very mild mannered and soft spoken individual. The criminal investigation over the last several years has not only devastated Roberto, but also his family. This family?s incredible pride has been virtually shattered by the investigation and the indictment. Roberto has done the right thing and accepted responsibility. He and I have spoken many times over the last several years regarding this situation. He more than anyone knows that he must take responsibility for violating the law, shattering his dreams and his parents pride. He did that by pleading guilty and accepting responsibility. Roberto understands that he is going to be punished by the court. I truly believe that a prison sentence is not the answer. The harshest punishment Roberto is. enduring is looking at his parents everyday and seeing how he destroyed their pride. 1 am asking that you consider a possible sentence of supervision as the appropriate punishment for Roberto. Unforttmately the family?s dreams were shattered as a result of the legal problems with Roberto. They are completely devastated over the progression of events and indeed have been suffering from the moment the criminal charges came into being. The parents? lives are consumed with guilt in that they are blaming themselves for what happened. He is a religious person with traditional moral beliefs. Anyone who knows Roberto would never envision him to commit insurance fraud. He has up until this point in his life worked for and earned everything that he possesses. They miraculously paved a way to a professional education for all of us, even though they had very little. They were able to accomplish the American dream a?cr coming to this country with nothing. They raised three doctors through their hard work alone. I am a craniofacial pediatric surgeon with degrees in medicine and dentistry, my brother Roberto with a dental degree and extensive study in implantology, and my sister has a doctorate in Pharmacy with board certi?cation in the USA and Canada. We are very proud and thankful for having been blessed with such wonderful parents. Roberto was always a cheer-?r] loving child. He loved to help my grandmother when we visited her in Italy. He w0uld spent countless hours with her, choosingto stay by her side to help her with chores since she had severe arthritis while all of the other children played outside. He is always willing to help others, a Special attribute oftentimes noticed by all around him even early on. He has a pleasing am about him with a very big heart. He is loved by his family, peers, coaches and teachers, throughOut grade school, high school, college and professional school. He has always been the one to help his friends and class mates with projects and home work, even when it meant sacri?cing time for his own studies. His compassion and gentleness are only a few of the special attributes noticed by his patients. During his last year of Dental School, he began to observe at a dental practice as I and my pawns had suggested since our family and the dentist?s families were friends. I also observed at the same dental of?ce during dental school but in retrospect, I realized that] never felt very comfortable in this of?ce. There was often an unsettling feeling but being a ?end of the family and a Successful dentist, [thought it was ok. As I look back, 1 see this is the point when I started seeing changes in my brother and he was not his true happy self full of joy and always laughing and wish we have never made the suggestion of going to this practice. Yes I believe whole heartedly and as God as my witness that my brother was led astray and was demoralized and tmunatized while under poor leadership and direction. I believe from the moment we are born until the day we die, we draw from the outside world, from God and from people. Trust good people, open your heart to them and you will thrive and ?nd proper direction. Trust the mung kind of people, and you will ?nd improper direction. I wish there was a class in dental school for the young naive graduating dental student to look out for so they are not led astray in the wrong direction by others, but there was not for my brother or I. Roberto came to trust a mentor who he believed was his friend, but had ulterior motives and not his best interest at heart that in the end would dishonor my brother and the sysrern. i believe my brother has learned tr'emendously from this sad and unfortunate experience and he is truly sorry for what has happened and for any hurt be has brought to himself and others. Roberto has accomplished tremendous ?good? since he has been in his own practice as of 2001. He was happy train to do the thing he loved most; bringing joy to others and making his patients smile with beanti?rl dentistry. He has volunteered his time to help victims of Hurricane at Kelly Air Fome base in Texas, helped raider-privileged children with ?reial and dental deformities in Vietnam, repaired severe dental injuries of children involved in motor vehicle accidents of Mothers Against Drunk Driver?s or M.A.D.D. This is a true representation of my brother and de?nes his character since he was a child, his desire to bring mike to the world around him. These are but a few instances where Roberto has shown his true character. I say all of this ever mind?rl of the unfortunate predicament Roberto now ?nds himselfentangled. Given all that he has accomplished in his professional career and his personal life, it is di?'icult to reconcile Roberto the man as I know him and others know him to be, and the terrible circumstances which have brought him before your Court Frankly, something does not add up. There were comments in the circle of dentistry regarding his partner and his business practices and I?m sure Rob was gu?ty by association and may have fell to the temptaticn of monetary gain to offset ?nancial pressures accumulated from School loans, ect. [believe his charges for fraudulent activity date from 1996-2001. I ?rst heard of this situation from Rob in early November of last year and he con?ded in me the dates of his charges at a later conversation in the middle of January. I heard about this a few years ago, but never asked Rob about it because it was not my place and he was practicing across the street. It was hard for me to believe until he told me. As I stated above, Rob practicing on his own after taking over for his former partner in a nice practice across the street from me in around 2000-2001. I?m not totally sure of the dates. We had started up a cordial ?iendship again, even though we were competitors. I would see him occasionally arotmd town and at various dental courses and always enjoyed his company and conversation. He had developed into the implant expert in our town and I really respected how he was developing and marketing his practice. I had a few patients who had sought his services for treatment and all spoke highly of him and his team.
