Ruprecht November 2, 2015 Senator Roger Katz, Senate Chair Government Oversight Committee 82 State House Station Augusta, ME 04333-0082 RE: Committee Hearing November 12?1 Appearances of Montgomery and Aaron Chadbourne Dear Senator Katz, Further to our discussion on October 28th, this will con?rm that Montgomery and Aaron Chadboume will appear voluntarily to testify on November Neither they nor the Of?ce of the Governor concedes the validity of the Committee?s subpoenas, but since they have chosen to appear, they will not be moving to quash the subpoenas. My clients and the Of?ce of the Governor speci?cally reserve the right to challenge the subpoenas in the face of any attempt to enforce them. Moreover, the Of?ce of the Governor intends to set no precedent by these appearances. Neither this nor any other administration is bound to act similarly in the future. We expect personal appearances will yield little new information relevant to work. The Governor?s Of?ce provided documents to OPEGA during its investigation and further offered to answer in writing any questions the Committee had prior to the last hearing, but the Committee refused that assistance. Unfortunately, certain members are now suggesting that the Of?ce of the Governor was hiding something when it offered to cooperate that way. That is simply untrue. My clients hope that by appearing they will put a stop to such irresponsible Speculation. The Chairs have requested that each witness provide documents on designated topics that are in his or her possession but have speci?cally excepted any documents previously furnished to OPEGA.
