NO. 45047?177 FILED: 08?19-2015 REMEDY NO. 823433-F1 PART RESPONSE This is in response to your Request for Administrative Remedy dated April 28, 2015, wherein you request to use the Trust Fund Limited Inmate Computer System (TRULIN CS) Electronic Messaging to communicate with family and friends. Speci?cally, you state you were denied messaging access without explanation by staff, for contacting a journalist about wrongdoing on the behalf of Bureau of Prisons staff. Program Statement 4500.] 1, Trust Fund/Deposit Fund Manual, dated April 9, 2015, state; ?it is important that staff ensure inmates are only restricted from using TRULINCS, or individual TRULINCS services, when absolutely necessary to protect the safety, security, or orderly operation of the correctional facility, or the protection of the public or staff.? Due to the ?self?service? format TRULINCS provides, all inmates who are physically capable of accessing a TRULINCS terminal should be provided access in all but limited cases. Public Messaging is the only exception to this approach, as it involves communication with persons in the community and the possibility of continuing criminal or other prohibited activity that may jeopardize the safety and security of the institution. This policy also states Pending Investigation or Disciplinary Actions for TRULINCS Abuse or Misuse. If an inmate is pending either investigation or disciplinary action for possible. abuse or misuse, a partial or total restriction is authorized by the Warden. A restriction in this situation is discretionary to ensure the institution?s safety, security, and orderly operation, or the protection of the public and staff. When deemed necessary, ordinarily the SIS of?ce recommends this type of restriction. Any TRULINCS restriction recommended by the SIS of?ce may only be imposed with the Warden?s approval, in accordance with the procedures outlined in this section and documented on form Request for Inmate Telephone Restriction or TRULINCS Restriction. If prohibited from possessing a copy of the written explanation, inmates remain entitled under the Freedom of Information Act (FOIA) to access this information from their case ?les and must be provided reasonable opportunities to access and review such documents. Clari?cation to staff regarding this process was addressed in a memorandum from D. Scott Dodrill, Assistant Director Correctional Programs Division, dated September 13, 2010, which provide supplemental guidance and New TRULINCS Feature Inmate Public Messaging Service Restrictions. The section titled History of Illegal Activities Using Computers states, as with computer knowledge and skills, a TRULINCS messaging restriction based on this threat should be very rare, and only when the illegal activity involved use of e?mail as stated in your March 31, 2015, e?mail addressed to Anna Smith subject Anonymous vs in which you stated ?You cannot prevent us." On April 1, 2015, a memo from Warden Rodney Chandler was placed in your investigative ?le which states, a review of your ?le and history indicates you used computers and messaging to solicit threats. Therefore, you will not be granted access to electronic messaging. Due to safety concerns and other legitimate security interest, you will not be provided a copy ofthis notice. However, it will be retained in the investigative case ?le for reviewing upon your FOIA request. Staff reviewed your file and denied you access based on your conviction for Internet Threats.
