D. #2380, a police officer with the Arlington, Texas, Police Department, who after being duly sworn on oath deposes and says that SHE HAS GOOD REASON TO BELIEVE AND DOES BELIEVE THAT: On or about November 25, 2015, in the City of Arlington, Tarrant County, Texas, Kenny Cox Pham 10/25/1968 did then and there commit the offense of FAILURE TO STOP AND RENDER AID a FELONY, in that HE did then and there intentionally or knowingly then and there 31953999113?! anWin 1 . vehicles/hit; became? volyed,' .accid . . .. gn1 t-toang Pham 06/16/1944, and the said defendant did thereafter, knowing said accident had occurred, intentionally or knowingly leave the scene of said accident, without giving his name and address to any person, and without rendering reasonable assistance to Nghi Hoang Pham which it was apparent that Nghi Hoang Pham was in need of medical treatment, MY BELIEF AS AFORESAID IS BASED UPON THE FOLLOWING FACTS AND CIRCUMSTANCES: On November 25, 2015 at approximately 2131 hours, a crash occurred in the 3300 block Of S. Collins Street in Arlington, TX. This crash was reported as an auto-pedestrian crash. The vehicle in this crash was traveling southbound in the inside lane at 3300 S. Collins St. The pedestrian in the crash, identified as Nghi Hoang Pham 06/16/1944, attempted to cross 3300 S. Collins St. from West to east. Nghi Hoang Pham was crossing the street outside of any crosswalk. While Nghi Hoang Pham was in the roadway, Nghi Hoang Pham was Struck by the vehicle traveling southbound. Nghi Hoang Pham received serious injuries in the crash. The vehicle stopped brie?y at the location; however, it continued southbound without Stopping and providing the Statutorily required information or rendering any medical aid at all. Nghi Hoang Pham was transported to the Medical Center Of Arlington at 3301 Matlock Road. ghi Hoang Pham died from his injuries received in this crash at 2213 hours. Your affiant responded to the scene of the crash and is the primary investigator for the crash as a member of the Arlington Police Department Accident Investigations Unit. On November 26, 2015 Your Affiant was notified by phone at approximately at 1554hrs that an individual, who was later identified by his Texas Driver?s License #14960075 as Kennedy Cox Pham, had arrived at the Arlington Police Department north Station located at 620 W. Division St and wanted to turn himself in reference to a hit and run fatality crash that occurred on November 25, 2015 on S. Collins St. I made contact with Sgt. Pina #1983 at the north Station and he stated that he arrived at the north station and observed the front desk officer, Officer Green #2220, Speaking with an Asian male who was later identified at Kennedy Cox Pham. Upon approaching them, Kennedy COX Pham stated to Sgt. Pina that he felt guilty and wanted to turn himself in. Sgt. Pina stated prior to his arrival he had .61 4? previously heard Officer Green talking on the radio stating that someone wanted to turn themselves in reference a fatality hit and run crash and believed that this person, Kennedy Cox Pham, was referring to the crash that Your Affiant had investigated on 11/25/2015 at 3300 S. Collins St. Your Affiant made contact with Kennedy Cox Pham and asked him if he would be willing to speak with investigators regarding why he had come to the Arlington Police Department north station. Kennedy Cox Pham stated that he would be willing to speak with Your Affiant therefore he was taken to an interview room where he was interviewed by Your Affiant and Sgt. Brown #1547. Prior to interviewing Kennedy Cox Pham, he was informed that at any point prior to or during the interview he was free to leave and that he was not required to speak with Your Affiant. Kennedy Cox Pham stated that he understood but that he would be willing to speak with and answer questions from Your Affiant. Kennedy Cox Pham stated that he had heard about the fatality crash while at church today. He was told that the crash had occurred on Collins St near the church that he was attending. Kennedy Cox Pham stated that he was traveling southbound on Collins St in the same area and at the same time that the fatality crash was supposed to have occurred. Kennedy Cox Pham said that while he was traveling south on Collins St prior to May?eld Rd he struck something in the roadway. He stated that he did not know what he had hit. After striking the unknown object, Kennedy Cox Pham stated to Your Affiant thath stoppedts 11.6. 093419.898 what h9th hits. Your Affiant was told by Kennedy Cox Pham that he had parked his vehicle, a black Toyota Tundra, in front of his home located at 925 Colbi Hill Ct, in Arlington TX, 76014. Kennedy Cox Pham stated that upon exiting his vehicle he had a dif?cult time opening his driver?s door. When he stepped out of his vehicle he noticed damage to the front driver?s side light and driver?s side area. The next morning Kennedy Cox Pham stated that he felt guilty and moved Toyota Tundra into his garage located at 925 Colbi Hill Ct. so it couldn?t be seen. An Accurint search of Kennedy Cox Pham showed that he owns a vehicle with the Texas license plate of CLL2617. This vehicle is registered as a black 2006 Toyota pickup truck and shows the registered owner as Kennedy Cox Pham and lists the same address that is currently on his driver?s license. Your Affiant obtained a search warrant for Kennedy Cox Pham?s home to search for his black 2006 Toyota Tundra pickup truck with the Texas license plate of CLL2617 and VIN 5TBET341X6SS49964. A second search warrant was obtained to download or image data from any restraint, power train or other module found in the Toyota pickup. Both search warrants were signed by Judge Jackson and executed on the same day, November 26, 2015, at approximately 2255 by Your Affiant. Upon executing the search warrants Your Affiant located Kennedy Cox Pham?s Toyota Tundra in the garage of his home at 925 Colbi Hill Ct. The damage observed on the Toyota Tundra was consistent with the damage you would find when a vehicle strikes a pedestrian. An inspection of the vehicle showed that the vehicle had damage to the front left headlight/tum light assembly as well as dents and scrapes along the front left quarter panel. The headlight/turn light assembly was broken and missing several pieces. Using the pieces of evidence recovered from the crash scene, Your Affiant was able to match them to the missing pieces from the headlight/turn light assembly of the Toyota Tundra:e Based on the statements of the witnesses, evidence left at the scene, statements made by Kennedy Cox Pham, and damage observed on Pham?s Toyota Tundra, it is Your Affiant?s belief that the vehicle that struck and killed Nghi Hoang Pham was Kennedy Cox Pham?s Toyota Tundra. Furthermore, it is Your Affiant?s belief that the Toyota Tundra was driven by Kennedy Cox Pham at the time of the crash. SUSPECT is further identified as KENNEDY COX PHAM. His TX DL number is 14960075. His reported address is 925 COLBI HILL CT. ARLINGTON, TX 76014. Said offense was reported to the Arlington Police Department under report 150062898, on 11/25/2015.
