1 COMMONWEALTH VS DARRELL (DIAMOND) JONES 34
2 approximately 15 or 20 seconds, that the videotape
3 is a fair and accurate representation of what

4 occurred on that day. It is my ruling that so

5 much of it as relates to the identification of the
6 defendant is admissible, and I will hear counsel

7 on what parts are inadmissible.

8 MR. ELIAS: Judge, 1 would think all that

9 portion that would have anything beyond the
10 showing to her of photographs and asking her if

11 she can pick from that the party that m" I think
12 the question was "the shorter of the two parties"
13 that she saw should be stricken. I don't think

14 there can be included in there, however, her
15 previous opportunities to observe this defendant.
16 She said I think she saw him swinging a gun in
17 there a week before or something of that nature.
18 I think everything that followed the

19 identification is not germane to the queetion of
20 whether or not she could recognize the party and
21 pick out his photograph. I think everything after
22 that did not go towarde her opportunity and her
23 ability pick him onto The rest of it I suggest to
24 you is, one, highly prejudicial, and two, complete
